Whereas:

  1. 1In a written submission received by the Chamber’s Secretariat at 12:44 hours on November 2, 2010, the petitioners filed an amparo proceeding against the Municipality of San Rafael de Heredia, stating that they disagreed with holding the farmers’ market on the main street of Residencial de la Rosa. They state that the market held on October 24, 2010, prevented them from sleeping peacefully or resting in their homes because activities began at 03:00 hrs. and did not end until 15:00 hrs. They allege that, during that time, the noise pollution generated by the bustle of vendors and customers was overwhelming. They assert that free passage along the main road was obstructed because the street was closed at its southern end; consequently, access was permitted only through the entrance located one hundred meters east of the service station—the main access route to San Rafael—with the resulting traffic jams caused by the concentration of vehicles.They add that responding to any emergency under these circumstances would be very difficult because they are confined. They emphasize that when the market ended and the stalls began to be dismantled, indescribable chaos ensued, to the point that it was impossible to walk through the area. They note that although the organizers made efforts to clean the site, garbage accumulated in the gutters and was carried away by the rain; furthermore, the odor produced by the sale of fish, cheese, and chicken over several hours was unbearable. They stress that security has diminished considerably. They explain that they brought their objection before the Municipal Council of San Rafael de Heredia; however, they were told that the municipal corporation had adopted the resolution and that prior authorization from the residents was unnecessary. Based on the foregoing, they consider their fundamental rights to have been violated.
  2. 2Verny Valerio Hernández, in his capacity as President of the Municipal Council, reports under oath that the municipality is the authority chiefly competent to determine the location of the farmers’ market in each canton, taking into account the particular conditions of the proposed location and accessibility for all residents of the canton, while always safeguarding local budgetary interests and services. He states that this is a discretionary act of the Municipal Council and that, in this case, it was temporary and subject to the condition that space be kept clear in the street for the free passage of vehicles. He states that, in any event, the Cantonal Agricultural Center is responsible for overseeing the operation of the farmers’ market and therefore considers that entity to be the proper party to the proceeding. He requests that the amparo proceeding be dismissed.
  3. 3In a written submission received on November 22, 2010, Julieta Ramírez Montero, in her capacity as Mayor of the Municipality of San Rafael de Heredia (folio 21), states that, at ordinary session No. 38-2010 of October 11, 2010, the Municipal Council resolved to relocate the farmers’ market, from that date through the end of the year, to a site adjacent to the Municipal Stadium. She notes that the Market’s original location was on the southern side of San Rafael Central Park; however, in view of the upcoming municipal mayoral election, it would inconveniently and inopportunely coincide with the location of the year-end and New Year festivities to be held the following December. She states that the resolution was issued on grounds of expediency and convenience and was appropriate to the public purpose.
  4. 4By written submission filed on November 26, 2010, the Secretariat of the Municipal Council of the respondent Municipality provided this Court with resolution No. 17 from ordinary session No. 46/2010, held on November 22, 2010.
  5. 5By order issued at thirteen hours and six minutes on January twenty-fourth, two thousand eleven, the Chamber directed the Minister of Health to inspect the farmers’ market in question (folio 95).
  6. 6By written submission dated February 4, 2011, María Luisa Ávila Agüero, in her capacity as Minister of Health, provided a certified copy of the report by the Director of the San Rafael-Barva Health Governing Area (folio 97).
  7. 7The legal requirements have been observed in the proceedings followed.

Justice Araya Garcia drafts the opinion; and,

Considering:

I.Subject matter of the proceeding. The petitioners consider their fundamental rights to have been violated because they requested that the respondent Municipality relocate the farmers’ market, since its proximity to their homes not only creates a road obstruction to traffic but also affects the surrounding environment through noise pollution and the garbage left in the area.

II. Proven facts. The following facts are deemed duly established and relevant to the determination of this matter

a. At ordinary session No. 38-2010 of October 11, 2010, the respondent Municipal Council resolved to relocate the farmers’ market, from that date through the end of the year, to a site adjacent to the Municipal Stadium. (folio 39) b. On October 25, 2010, the petitioners filed a complaint with the respondent Municipality concerning the pollution and problems caused by the new location of the Farmers’ Market. (folio 36) c. At ordinary session No. 46/2010, held on November 22, 2010, the respondent Municipal Council resolved to ratify the resolution authorizing the use of the cantonal road located on the eastern side of the Municipal Stadium, from the area in front of the Francisca Valerio Senior Day Center to the intersection of that cantonal road with the Heredia-San Rafael National Route, specifying that authorization was granted solely for the use of half of the roadway and subject to compliance with the applicable regulations.

By official letter CN-ARS-SRB-0276-2011 dated February 1, 2011, the Director of the San Rafael-Barva Health Area informed the Director of Legal Affairs that the Farmers’ Market causes noise pollution and fails to comply with other regulations (drinking water, adequate infrastructure for wastewater disposal, sanitary facilities in inadequate condition, etc.); accordingly, a copy was being forwarded to the respondent Mayor so that he would arrange for the market to be relocated within no more than five days to an area where it would not disturb residents. (folio 98)

III.The right of petition, prompt determination, and prompt and effective justice. The right established in Article 27 of the Political Constitution refers to the authority of every citizen to address, in writing, any public official or governmental entity in order to present a matter of interest. As an integral part of its content, and as an important factor in its enforceability, this guarantee is complemented by the right to obtain a prompt response within a specified period. Thus, if every person has the authority to address public bodies in writing so that they may provide information or resolve matters of interest, the Public Administration is necessarily obligated to respond within a specific period, which in no way implies that the response will be favorable—see, to this effect, judgments numbers 1995-653 and 2000-10447. In this regard, Article 32 of the Constitutional Jurisdiction Act provides:

“When the amparo proceeding concerns the right of petition and the right to obtain a prompt determination, established in Article 27 of the Political Constitution, and no period for responding has been specified, the violation shall be deemed to occur once ten business days have elapsed from the date on which the request was filed with the administrative office, without prejudice to the fact that, when deciding the proceeding, consideration may be given to reasons asserted for deeming that period insufficient, in light of the circumstances and the nature of the matter.” In any event, notwithstanding this general rule of ten business days, there are also circumstances in which it must necessarily be assessed whether the period taken by the administration is excessive for purposes of the right to obtain a response—see, to this effect, judgments numbers 2000-37 and 2002-6858. Indeed, the Chamber has previously ruled on the reasonableness of time periods in administrative proceedings, holding in judgment number 2007-15580, among others, that:

“In this regard, the ‘reasonableness’ of the duration of administrative activity is determined on a case-by-case basis according to various factors, such as the technical complexity of the administrative matter, the extent of the evidence to be received, or the degree to which the challenged act affects the person or the environment. It follows that there is no strict right to the constitutionalization of time limits, but rather a right to constitutional review of those actions of the Administration for which there are insufficient grounds to justify the time taken to resolve any type of administrative request.” However, when claims or administrative appeals are involved—where Article 41 of the Constitución Política applies—and a procedure is required to verify the facts that are to serve as grounds for the final act, as well as to adopt the relevant evidentiary measures, it has been established that the legal period granted to the Administration to resolve such matters is that provided in Article 261 of the Ley General de la Administración Pública—two months—unless an express provision establishes otherwise.

IV.The State’s duty to protect the environment. Following the amendment of Article 50 of the Constitution, which expressly enshrined the right to the environment as a fundamental right, the State’s obligation to guarantee, defend, and protect that right was also established in unequivocal terms, thereby making the State the guarantor of the protection and preservation of the environment and natural resources. It is pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Constitución Política, that the State’s responsibility to exercise a protective and governing role in this area was derived, as provided by the constitutional provision under discussion, a role developed by environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right. In this connection, it must be borne in mind that the applicable legislation designates the Ministerio del Ambiente y Energía as the governing body for the natural resources, energy, and mining sector, as provided in Article 2 of the Ley Orgánica of that Ministry, number seven thousand one hundred fifty-two, dated June fourth, nineteen ninety.

In the Chamber’s view, this environmental governance function encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided in Article 56 of the Ley Orgánica del Ambiente, but also confers upon it the important function of exercising leadership in environmental matters, which consists of maintaining a predominant role in this field. In this regard, the oversight and supervision of environmental matters and activities constitute an essential function of the State under Article 50 of the Constitución, insofar as its third paragraph provides, in relevant part: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the Branches of Government from delegating the exercise of their own functions, particularly when those functions are essential.

Accordingly, with respect to environmental protection, the functions of governance, oversight, and supervision in environmental matters belong to the State and are entrusted to its various administrative agencies.

V.The role of municipalities in environmental matters. In accordance with the foregoing, municipalities, as an integral part of the State as a whole, bear significant responsibility for environmental matters within the scope of their powers and obligations, whether through the direct approval of permits or licenses requiring prior compliance with requirements demonstrating to other public authorities that appropriate environmental management measures are in place, or through regular inspections and the referral of hazardous situations to the authorities having broader powers to intervene. It has already been established that local governments are subject to an obligation to coordinate and prevent environmental harm within their territorial jurisdiction; consequently, municipalities are indeed important participants in the task of protecting the environment. Local governments unquestionably have the authority to establish their own land-use planning (ordenación territorial) through regulatory plans (planes reguladores); however, the existence of such plans—which, for the most part, lack planning components addressing a healthy and ecologically balanced environment—does not render environmental protection legislation inapplicable.

On the contrary, the Chamber considers it a fundamental requirement, one that does not infringe the constitutional principle of municipal autonomy, that every regulatory plan, before being approved and implemented, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective established by Article 50 of the Constitution, so that land-use planning and its various regulatory regimes are compatible with the scope of the higher-ranking provision, particularly in view of the fact that this provision establishes the right of all inhabitants to obtain an environmental response from all public authorities. This undoubtedly includes municipalities, which are not exempt from the application of the constitutional provision and its implementing legislation. It is evident that, in this case, the national and local interests fully coincide; local governments may and must therefore require compliance with environmental requirements within their territory and, in the event of a conflict with the authorities responsible for environmental matters, may submit the disputes to the appropriate judicial authority, depending on the nature of the violation.

For the foregoing reasons, environmental protection provisions are not constitutionally incompatible with the powers and responsibilities of municipalities, which are required, by virtue of Article 50 of the Constitución Política, to devote themselves to protecting the environment—see, to this effect, judgment number 2006-7994, issued at eight fifty-seven a.m. on June second, two thousand six.

VI.The specific case. In the case under consideration, the evidence contained in the record duly establishes that the farmers’ market (feria del agricultor) in the city of San Rafael de Heredia must not continue operating at its current location, since doing so does in fact endanger the lives and health of local residents. The respondent stated that this location was temporary; however, the respondent later extended its use, even though the corresponding health operating permit for that specific location had not been obtained (see folio 102). The findings of the inspection conducted by the Ministerio de Salud on January 31, 2011, unequivocally indicated that the Farmer’s Market in question causes noise pollution (contaminación sónica) and fails to comply with other regulations concerning potable water, adequate infrastructure for wastewater disposal, sanitary facilities in proper condition, and other matters, all of which endangers not only people’s health but also the right to a healthy and balanced environment.

In light of the inspection findings, the health authorities sent a copy to the respondent Mayor so that the Mayor would arrange, within no more than five days, for the market to be relocated to an area that does not disturb local residents and that complies with the legal system. In view of the foregoing, it is clear that the respondent Municipalidad violated the petitioners’ constitutional rights, not only with respect to the rights identified above, but also because it did not even proceed to resolve the complaint filed on October 25, 2010, thereby additionally violating the protected parties’ right to prompt and effective administrative justice. Consequently, the appeal must be granted.

Accordingly, Verny Valerio Hernández, in his capacity as President of the Concejo Municipal, and Julieta Ramírez Montero, in her capacity as Alcaldesa, both of the Municipalidad de San Rafael de Heredia, or whoever may hold their respective offices, are ordered, immediately upon notification of this judgment, to relocate the farmers’ market to a location meeting the sanitary conditions previously approved by the Ministerio de Salud. They must also, within no more than three days, resolve the complaint submitted by the petitioners and notify them of the decision. They are hereby warned of the consequences, including criminal penalties, arising from failure to comply with the orders issued by this Constitutional Court, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. The Municipalidad de San Rafael de Heredia is ordered to pay costs and damages, which shall be determined during enforcement of the judgment before the administrative litigation court. This judgment shall be personally served upon Verny Valerio Hernández, in his capacity as President of the Concejo Municipal, and Julieta Ramírez Montero, in her capacity as Alcaldesa, both of the Municipalidad de San Rafael de Heredia, or whoever may hold their respective offices. Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 12:44 horas del 2 de noviembre del 2010, los recurrentes presentan recurso de amparo contra la Municipalidad de San Rafael de Heredia, y manifiestan que no están de acuerdo con que la feria del agricultor se lleve a cabo en la calle principal del Residencial de la Rosa. Indican que la celebración de la feria el 24 de octubre de 2010, no les permitió dormir con tranquilidad, ni descansar en sus hogares, dado que desde las 03:00 hrs. se iniciaron las actividades, las cuales finalizaron hasta las 15:00 hrs. Alegan que durante ese tiempo la contaminación sónica que generó el ajetreo de los comerciantes y clientes fue impresionante. Aseguran que el libre tránsito por la vía principal fue obstaculizado, ya que la calle fue cerrada en el extremo sur, en función de lo cual, únicamente se habilitó el ingreso por la entrada que se ubica cien metros al este de la estación de servicio - la ruta principal de acceso a San Rafael - con los consecuentes embotellamientos que la aglomeración de vehículos ocasionó.Acotan que la atención de cualquier emergencia en estas circunstancias, sería muy difícil, pues se encuentran confinados. Destacan que cuando finalizó la feria e inició el desarme de los puestos de venta, se generó un caos indescriptible, hasta el punto que no era posible caminar por la zona. Resaltan que si bien los organizadores hicieron esfuerzos para limpiar del lugar, la basura se acumuló en los caños y fue arrastrada por la lluvia, además el olor que produjeron las ventas de pescado, queso y pollo, durante varias horas, era insoportable. Subrayan que la seguridad ha disminuido considerablemente. Explican que plantearon ante el Concejo Municipal de San Rafael de Heredia su inconformidad, sin embargo, se les precisó que la corporación había tomado el acuerdo y no era necesario, de previo, pedir autorización a los vecinos. Por lo descrito, estiman lesionados sus derechos fundamentales.
  2. 2Informa bajo juramento Verny Valerio Hernández, en su condición de Presidente del Concejo Municipal, que el municipio es el competente por excelencia para fijar el lugar en el cual debe estar ubicada la feria del agricultor en cada cantón, tomando en cuenta para ello las condiciones especiales del lugar en el cual se vaya a ubicar, las condiciones de accesibilidad para todos los vecinos del cantón, velando siempre por los intereses y servicios locales presupuestarios. Indica que se trata de un acto discrecional del Concejo Municipal y que en este caso fue temporal y con la condición de liberar espacio en la calle para el libre tránsito de vehículos. Refiere que en todo caso es responsabilidad del Centro Agrícola Cantonal velar por la realización de la Feria del agricultor, por lo que estima es a éste a quien debe tenerse como parte en el proceso. Solicita que se rechace el recurso de amparo.
  3. 3Mediante escrito recibido el 22 de noviembre de 2010, Julieta Ramírez Montero, en su condición de Alcaldesa de la Municipalidad de San Rafael de Heredia (folio 21), que el Concejo Municipal en sesión ordinaria No. 38-2010 del 11 de octubre de 2010 acordó trasladar la feria del agricultor a partir de esa fecha hasta fin de año contiguo al Estadio Municipal. Señala que la ubicación originaria de la Feria era al costado sur del Parque Central de San Rafael, sin embargo en virtud de las próximas elecciones para alcalde municipal, concurriría de manera inconveniente e inoportuna con la ubicación de las fiestas de celebración de fin y principio de año, que se celebrarían en diciembre próximo. Refiere que se trata de un acuerdo emitido por razones de oportunidad y conveniencia, adecuado al fin público.
  4. 4Por escrito presentado el 26 de noviembre de 2010, la Secretaría del Concejo Municipal de la Municipalidad recurrida, aporta a este Tribunal el acuerdo No. 17 de la sesión ordinaria No. 46/2010, celebrada el 22 de noviembre de 2010.
  5. 5Por resolución de las trece horas y seis minutos del veinticuatro de enero de dos mil once, la Sala ordenó a la Ministra de Salud que procediera a realizar una inspección a la feria del agricultor en cuestión (folio 95).
  6. 6Por escrito del 4 de febrero de 2011, María Luisa Ávila Agüero en su condición de Ministra de Salud, aporta copia certificada del informe de la Directora del Área Rectora de Salud San Rafael-Barva (folio 97).
  7. 7En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Araya Garcia; y,

Considerando:

I.Objeto del recurso. Los recurrentes consideran lesionados sus derechos fundamentales, toda vez que han gestionado ante la Municipalidad recurrida la reubicación de la feria del agricultor, debido a que su proximidad con sus casas de habitación genera no solamente obstáculo vial para el tránsito, sino que se ve afectado el entorno en materia ambiental, por contaminación sónica y la basura que dejan alrededor.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

a. El Concejo Municipal recurrido en sesión ordinaria No. 38-2010 del 11 de octubre de 2010 acordó trasladar la feria del agricultor a partir de esa fecha hasta fin de año contiguo al Estadio Municipal. (folio 39) b. El 25 de octubre de 2010 los recurrentes presentaron ante la Municipalidad recurrida una denuncia por la contaminación y los problemas que estaba presentando la nueva ubicación de la Feria del Agricultor. (folio 36) c. El Concejo Municipal recurrido en sesión ordinaria No. 46/2010, celebrada el 22 de noviembre de 2010 acordó ratificar el acuerdo que autorizó la utilización de la carretera cantonal ubicada costado Este del Estadio Municipal, desde el frente del Centro Diurno de Ancianos Francisca Valerio y hasta la intersección de dicha calle cantonal con la ruta Nacional Heredia-San Rafael, advirtiendo que la autorización es únicamente para la utilización de la mitad de la vía y del cumplimiento de la normativa correspondiente.

(folio 89) d. Por oficio CN-ARS-SRB-0276-2011 del 1 de febrero de 2011, la Directora del Área de Salud de San Rafael- Barva le comunicó al Director de Asuntos Jurídicos, que la Feria del Agricultor produce contaminación sónica y no cumple otras regulaciones (agua potable, adecuada infraestructura para la disposición de aguas servidas, servicios sanitarios en condiciones inadecuadas, etc.), por lo se remitía copia al Alcalde recurrido para que procediera a gestionar la reubicación de la feria en un plazo no mayor a cinco días, a una zona que no cause molestia a los vecinos. (folio 98)

III.El derecho de petición, pronta resolución y justicia pronta y cumplida. El derecho establecido en el artículo 27 de la Constitución Política hace referencia a la facultad que posee todo ciudadano para dirigirse, por escrito, a cualquier funcionario público o entidad oficial con el fin de factor importante para su justiciabilidad, esta garantía se complementa con el derecho a obtener pronta respuesta dentro de un plazo determinado. De manera que si toda persona tiene la facultad de dirigirse por escrito a los órganos públicos a fin de que éstos le informen o resuelvan asuntos de su interés, la Administración Pública necesariamente estará en la obligación de contestarle dentro de un plazo concreto, lo cual no supone en modo alguno que la contestación será favorable –ver, en este sentido, sentencias números 1995-653 y 2000-10447. Al respecto, el artículo 32 de la Ley de Jurisdicción Constitucional señala:

“Cuando el amparo se refiera al derecho de petición y de obtener pronta resolución, establecido en el artículo 27 de la Constitución Política, y no hubiere plazo señalado para contestar, se entenderá que la violación se produce una vez transcurridos diez días hábiles desde la fecha en que fue presentada la solicitud en la oficina administrativa, sin perjuicio de que, en la decisión del recurso, se aprecien razones que se aduzcan para considerar insuficiente ese plazo, entendidas las circunstancias y la índole del asunto”.

En todo caso, y a pesar de esta regla general de los diez días hábiles, también existen supuestos donde se debe valorar, necesariamente, si el plazo tomado por la administración resulta excesivo o no a los efectos del derecho de obtener una respuesta –ver, en este sentido, sentencias números 2000-37 y 2002-6858-. En efecto, la Sala se ha pronunciado ya sobre la razonabilidad de los plazos en sede administrativa, definiendo mediante sentencia número 2007-15580, entre otras, que:

“En este sentido, el carácter “razonable” de la duración de la actividad administrativa se determina casuísticamente con base en diversos elementos, tales como la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino más bien un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.” Sin embargo, cuando se trata de reclamos o recursos administrativos -donde lo procedente es aplicar el artículo 41 de la Constitución Política- que requieren un procedimiento para verificar los hechos que han de servir de motivo al acto final, así como adoptar las medidas probatorias pertinentes, se ha definido que el plazo legal otorgado a la Administración para resolver éstas gestiones es el dispuesto en el artículo 261 de la Ley General de la Administración Pública –dos meses-, salvo norma expresa en contrario.

IV.El deber del Estado en la tutela del ambiente. A partir de la reforma del artículo cincuenta constitucional, en la cual se consagró también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos veinte, sesenta y nueve y ochenta y nueve de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo dos de la Ley Orgánica de este ministerio, número siete mil cientos cincuenta y dos, de cuatro de junio de mil novecientos noventa.

Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no solo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo cincuenta seis de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo cincuenta de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo nueve de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.

De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

V.El papel de las municipalidades en materia ambiental. De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente. Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de éstos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental.

Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo cincuenta constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo. Es evidente que en este caso, es totalmente coincidente el interés nacional y el local, y por ello los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción.

Es por lo anterior que las normas tutelares del ambiente no son incompatibles, desde el punto de vista constitucional, con las facultades y competencias de las municipalidades, las que están obligadas, por imperativo del artículo cincuenta de la Constitución Política, a prodigarse en la protección del ambiente –ver, en este sentido, sentencia número 2006-7994, de las ocho horas cincuenta y siete minutos del dos de junio de dos mil seis-.

VI.Sobre el caso concreto. En el caso bajo estudio, de las pruebas que constan en el la ciudad de San Rafael de Heredia no debe continuar llevándose a cabo en su actual ubicación, toda vez que efectivamente ello pone en riesgo la vida y salud de los vecinos del lugar. El recurrido indicó que dicha ubicación resultaba temporal, sin embargo posteriormente la prorrogó, incluso sin contar con el permiso sanitario de funcionamiento respectivo para ese lugar en específico (ver folio 102). El resultado de la inspección realizada el 31 de enero de 2011 por el Ministerio de Salud fue contundente en señalar que la Feria del Agricultor en cuestión produce contaminación sónica y no cumple otras regulaciones (agua potable, adecuada infraestructura para la disposición de aguas servidas, servicios sanitarios en condiciones inadecuadas, etc.), todo lo cual pone en riesgo no solo la salud de las personas, sino también el derecho a contar con un ambiente sano y equilibrado.

En virtud de los resultados de la inspección, las autoridades de salud emitieron copia al Alcalde recurrido para que procediera a gestionar la reubicación de la feria en un plazo no mayor a cinco días, a una zona que no cause molestia a los vecinos y que se ajuste al ordenamiento jurídico. En razón de lo expuesto, es claro que la Municipalidad recurrida lesionó los derechos constitucionales de los recurrentes, no solo por los derechos señalados, sino también por cuanto ni siquiera procedió a resolver el reclamo interpuesto desde el día 25 de octubre de 2010, lo que violenta además el derecho de los amparados a obtener una justicia administrativa pronta y cumplida. Por consiguiente, procede declarar con lugar el recurso.

Por tanto:

Se declara con lugar el recurso. En consecuencia, se ordena a Verny Valerio Hernández en su condición de Presidente del Concejo Municipal y a Julieta Ramírez Montero en su condición de Alcaldesa, ambos de la Municipalidad de San Rafael de Heredia, o a quienes en su lugar ejerzan el cargo, que de inmediato a la comunicación de esta sentencia, trasladen la feria del agricultor a un lugar que reúna las condiciones sanitarias que de previo sean aprobadas por el Ministerio de Salud. Asimismo, en un plazo no mayor a tres días deberán resolver el reclamo planteado por los recurrentes y notificarles lo resuelto. Lo anterior bajo apercibimiento de las consecuencias, incluso penales, que se desprenden por la desobediencia a las órdenes dictadas por este Tribunal Constitucional, artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena a la Municipalidad de San Rafael de Heredia al pago de las costas, daños y perjuicios, que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta sentencia a Verny Valerio Hernández en su condición de Presidente del Concejo Municipal y a Julieta Ramírez Montero en su condición de Alcaldesa, ambos de la Municipalidad de San Rafael de Heredia, o a quienes en su lugar ejerzan el cargo, en forma personal.
