Petition for amparo (recurso de amparo) processed under expediente number 07-005809-0007-CO, filed by CARLOS ADRIAN VARGAS MURILLO, of legal age, identity card number 0501180589, resident of Tilarán, on behalf of Ganadera La Gitana, against the MAYOR OF THE MUNICIPALITY OF TILARAN, the DIRECTOR OF THE TILARAN HEALTH AREA, the MINISTER OF HEALTH, and the MINISTER OF THE ENVIRONMENT AND ENERGY.-
Findings:
18- By a brief filed with this Chamber, a group of residents seeks to join these proceedings as supporting intervenors (coayuvancia) (folio 483)
Justice González Quiroga writes the opinion; and,
Considering:
The petitioner alleges that the Municipalidad de Tilarán keeps open a garbage dump that does not meet the required conditions and is causing serious harm to the environment and to the health of animals and people living nearby. They state that they have made numerous applications to different authorities, but no satisfactory response to the problem has been provided and the pollution continues to affect the area; they therefore request the intervention of this Court.
The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as required by the initial order:
Regarding the standing of Carlos Adrián Vargas Murillo to bring an action before this jurisdiction to protect the right to a healthy environment, which he alleges was violated by the inaction of the respondent authorities, the Chamber has repeatedly held that, because diffuse interests (intereses difusos) are involved, any member of the affected community has standing to seek constitutional relief (amparo) in pursuit of environmental protection. In this regard, the statement made by this Constitutional Court in judgment number 3705-93 at fifteen hours on July thirtieth, nineteen ninety-six, is particularly relevant and provides, insofar as pertinent:
“When the legal protection of the environment is at issue, the standing of private persons to bring judicial proceedings and secure the enforcement of rules intended for that purpose, or to request judicial protection (tutela jurisdiccional) of their violated rights, is of great importance. It must, however, be analyzed from several perspectives—that is, in relation to the nature of the proceeding, the claims, and the parties involved—and also taking into account that environmental rules may be breached through the acts or omissions of either a private-law or public-law entity. The latter may do so simply by failing to exercise the required oversight over the conduct of private parties when they violate environmental rules, thereby disregarding its statutory authority, which requires it to exercise such oversight; or by directly violating, through its own conduct, legal provisions intended to protect and preserve the environment.
In Judgment Number 2233- 93, this Chamber held that preservation and protection of the environment is a fundamental right, thereby recognizing standing to seek constitutional relief. In environmental law, the procedural prerequisite of standing tends to extend and expand to such a degree that the traditional concept must necessarily be abandoned; it must be understood that, in general terms, any person may be a party and that such person’s right does not arise from property titles, rights, or specific causes of action that might be exercised under the rules of conventional law. Instead, that person’s participation in the proceedings is based on what modern commentators call a diffuse interest, through which the original standing of a person with a legitimate interest, or even of a merely interested person, is diffused among all members of a given category of persons who are thus equally affected by the unlawful acts that infringe their rights.
In matters involving environmental protection, the typically diffuse interest that gives a person standing to bring an action is transformed, by virtue of its inclusion among human rights, into a true ‘right of response’ (derecho reaccional), which, as its name indicates, empowers its holder to ‘respond’ to a violation arising from unlawful acts or omissions. The infringement of that fundamental right therefore constitutes a constitutional illegality—that is, a specific ground for constitutional relief against specific acts or self-executing rules (normas autoaplicativas), or, as applicable, for an action of unconstitutionality (acción de inconstitucionalidad) against any rules or acts not subject to constitutional relief, and even against omissions. This latter category becomes especially important in the case of the right to the environment because, when the aim is to preserve the environment that nature has given us, the most frequent violation results from the failure of public authorities to take the measures necessary to protect it.”
As stated in the preceding whereas clause (considerando), in environmental law, the procedural prerequisite of standing tends to extend and expand to such a degree that, in general terms, any person may be a party. Accordingly, Josefina Gómez Gómez, María Eduvina Alvarez Carranza, José Alcidez Ruiz, Luz Marina Alfaro, and other residents have standing to appear as parties in this constitutional relief proceeding pursuant to the final paragraph of article 34 of the Ley de la Jurisdicción Constitucional.
This Chamber has repeatedly held that both the right to health—derived from the right to life—and the right to a healthy and ecologically balanced environment are fundamental rights. The State is obligated to take the measures necessary to protect the environment and prevent levels of pollution that endanger the health of the governed, a responsibility that the law unquestionably assigns to the Ministerio de Salud and the Ministerio de Ambiente y Energía, among other institutions. In relation to the present case, however, the Código Municipal likewise requires Municipalities to ensure that the governed are guaranteed the real and effective enjoyment of the right to health and to a healthy environment.
V.There can be no doubt that an open dump, rather than a technical sanitary landfill, is a serious source of various forms of environmental pollution, posing an imminent danger to the health of residents, neighbors, passersby, and persons who remain there for several hours searching through the garbage for waste that may be useful to them. The Chamber considers that the respondent authorities, as well as all persons with any involvement in this matter, have a duty to safeguard a better quality of life for the people of the canton and for all inhabitants generally, without waiting until the environmental, construction, and planning conditions of the garbage dump cause further deterioration beyond that already occurring and thereby aggravate harm to health or the environment.
VI.With regard to solid waste (desechos sólidos), several provisions establish the State’s obligation to ensure its proper treatment in order to guarantee environmental protection. In that regard, for the purpose of implementing and guaranteeing the provisions of Article 50 of the Constitución Política, and in connection with the case before us, Article 262 of the Ley General de Salud stipulates: “Every natural or legal person is required to contribute to promoting and maintaining conditions in the natural environment and in artificial environments that make it possible to meet the population’s vital and health needs.” Article 263 of the same body of law, in turn, provides: “Any action, practice, or operation that damages the natural environment or that, by altering the composition or intrinsic characteristics of its basic elements, particularly air, water, and soil, causes a reduction in their quality and aesthetic value, renders such resources unusable for any of their intended purposes, or makes them harmful to human health or to fauna or flora harmless to humans, is prohibited.
Every person is required to diligently carry out the actions, practices, or works established by law and regulations for the purpose of eliminating or controlling elements and factors of the natural, physical, or biological environment and of the artificial environment that are harmful to human health.” Article 17 of the Ley Orgánica del Ambiente likewise establishes: “Human activities that alter or destroy environmental elements or generate waste or toxic or hazardous materials shall require an environmental impact assessment (evaluación de impacto ambiental) by the Secretaría Nacional Ambiental created under this law. Prior approval by that body shall be an indispensable requirement for commencing the activities, works, or projects.” In relation to these provisions, it must be borne in mind that authorization to operate any solid-waste disposal site (depósito de desechos sólidos) requires compliance with the corresponding requirements.
Once the statutory requirements have been met and the technical studies required for that purpose have been reviewed, the Ministerio de Ambiente y Energía, the Ministerio de Salud, and the local Municipalidad—by reason of the specialized nature of the matter and the authority of local government—are responsible for deciding whether to authorize the operation of the relevant project, taking into account national and local interests in environmental protection, and, once it has been authorized, for conducting the appropriate follow-up to ensure that it operates within the legally established framework.
VII.In the specific case, it is evident that many of the requirements necessary for the proper operation of the Tilarán garbage dump (vertedero de basura) were disregarded or have been entirely unmet during the more than twenty-seven years that the dump has been operating. This has resulted in the serious problem now reported by the petitioner, whose property is adjacent to the dump. The problem has been corroborated by the authorities of the Secretaría Técnica Ambiental, Ministerio de Ambiente y Energía, Ministerio de Agricultura y Ganadería, Instituto Costarricense de Acueductos y Alcantarillado, Fuerza Pública, and Ministerio de Salud. In the latter case, although residents filed a complaint concerning this problem in 2004, it was not until 2006 that the health authorities issued two health orders (órdenes sanitarias) requiring the Municipalidad to fumigate the site, and not until 2007—after this amparo proceeding (recurso de amparo) had been filed—that officials of the Area de Salud de Tilarán issued another order requiring the respondent Municipalidad to collect the garbage deposits located at the entrance to and along the edges of the dump, among other measures.
Furthermore, on April 17, 2007, a group of residents filed a complaint with the Area de Conservación Arenal – Tempisque del Minae concerning environmental pollution caused by the Tilarán dump. As of the date this amparo proceeding was filed, that authority had likewise taken no action to verify the allegations, even though the matter involved the contamination of a stream and a spring (naciente).
VIII.The Chamber now observes that, in the present case, the authorities responsible for safeguarding the environment and the health of residents have not properly performed their duties, because they have taken no timely action to halt the general environmental pollution caused by the garbage dump in question, particularly the pollution affecting the La Cabra stream and the property of the petitioner company, which borders the site and is used for livestock activities. Moreover, the most recent inspections conducted by officials of the Dirección Ambiental de Recurso Hídrico del Instituto de Acueductos y Alcantarillados and the Area de Conservación de Arenal Tempisque confirm that pests have proliferated at the site and that the La Cabra stream is contaminated by all manner of waste originating from the dump, including tires, garbage bags, and other items. All of this was confirmed by officials of the Departamento Auditoría y Seguimiento Ambietal de la Setena, who concluded that the management practices employed at the dump have adversely affected the surrounding environment and that the contamination of the Cabra stream affects water users—people, domestic animals, and wildlife—both with respect to that stream and the water outcrop (afloramiento de agua) located on the property.
In view of the foregoing, the Chamber considers that, although in May 2007 the Ministerio de Salud, through health order No. 015-07, instructed the Alcalde Municipal to implement a series of health-related measures concerning the solid-waste dump, and although the Municipalidad claims to have complied, the inspection reports prepared by various public officials and included in the record demonstrate that neither the actions of the Municipalidad nor the orders of the Ministerio de Salud have been sufficiently effective or timely to prevent continued environmental pollution and the continuing endangerment of the health of the population and animals. It must be recalled that this Chamber has previously held that environmental protection requires not only a corrective approach but also a preventive one, because errors are irreversible and carry a high environmental cost. In that regard, in judgment No. 05906-99, this Chamber held that “the action required of the State by the Constitución Política in response to sources of environmental pollution must be multidirectional and decidedly active, and absolutely intolerant of situations that threaten or impair the optimal environmental conditions that the Constitution itself guarantees to residents.” Accordingly, any action aimed at protecting the environment is valid, but it is also necessary that the adopted measures not remain merely on paper and that they actually be implemented.
For that reason, in the specific case, the Chamber considers that the Ministerio de Ambiente y Energía, the Ministerio de Salud, and the respondent Municipalidad have failed to fulfill their basic, primary, and unavoidable obligation to monitor compliance with the requirements applicable to dumps of this kind when they are located within their jurisdiction and to take the measures necessary to ensure that such activities are conducted and developed in accordance with law, thereby guaranteeing citizens’ right to enjoy a healthy and ecologically balanced environment. Thus, the aforementioned bodies must not be satisfied merely with issuing recommendations or verifying improvements. Although solid-waste disposal is inherently an objectionable activity, it is also true that, for that very reason, the rules governing it and specific directives such as health orders must be interpreted broadly, with an effort to apply them continuously and as rigorously as technically possible.
Consequently, a complacent attitude on the part of the Administration, reassured merely by knowing that something is being done, is unacceptable, because the harm to the environment and health continues to recur in the meantime. In that context, the justification offered by the respondent Alcalde—that resources are lacking—is likewise invalid, because accepting such an explanation would amount to accepting and legitimizing the proposition that harm to the environment may be measured according to the financial resources available, which is entirely erroneous. Consequently, it is evident that the neglect shown by the Municipalidad and the Ministerio de Salud for more than twenty-seven years with respect to the pollution problem raised here is the principal basis for granting this proceeding. In a similar case, the Chamber held in judgment No. 20006-08983 of eleven sixteen a.m. on June 23, 2006: “This Constitutional Court considers that the Ministerio de Salud has failed to fulfill its obligations to protect the right to health of the protected party and the other residents of the housing development in question, by failing to exercise its statutory powers to resolve definitively the health problem affecting them and formally reported by them.
Its actions have been insufficient, untimely, and ineffective, as demonstrated by the fact that the problem persists because it has taken no concrete action in exercise of the police power (poder de policía) conferred upon it by law to enforce its orders. The members of this Constitutional Court are therefore left with the impression that this has been the conduct of a ‘paper Administration,’ whose activity is exhausted in mere bureaucratic procedures, simply limiting itself to conducting inspections and issuing recommendations or health orders, without taking any measure to verify compliance and, worse still, without demonstrating any effective action genuinely aimed at resolving the reported health problem definitively, as required to fulfill the public purpose entrusted to it. This is detrimental to health and the environment and therefore constitutes a violation of Article 50 of the Constitution, a situation that this Chamber finds intolerable
VIII.The Chamber concludes that, in the present case, we are faced with a serious public-health problem affecting the environment and the health of the residents of the community of Tilarán; and in its consistent case law, the Chamber has held that it is unacceptable for human beings to be denied the right to a healthy environment and the right to health because the corresponding public authorities are unable to exercise effectively the oversight powers and problem-solving authority granted to them by law. The documents and sworn reports contained in this case file show that the respondent authorities, although they have been aware of the problem described herein for years, have not taken the actions necessary to safeguard the health of the residents and protect the environment. Thus, the respondent authorities are responsible for the harm to the fundamental rights of the protected persons because of their failure to safeguard promptly and effectively the health of that population and the environment.
The persistence of the problem demonstrates that the measures taken by the Ministerio de Salud, the Municipalidad de Tilarán, the Ministerio de Ambiente y Energía, and SETENA, within the scope of their respective powers and in the exercise of their supervisory or oversight authority to protect health and the environment, have clearly been insufficient; they have therefore incurred liability for failing to exercise those powers, which in turn violates the unnamed or atypical constitutional right of persons subject to government administration (administrados) to receive efficient and effective public services. In view of the foregoing, and because the reported facts and the few effective actions taken by the respondents have seriously harmed the environment and the right to health of the residents of the canton of Tilarán, the appeal is hereby granted. This declaration requires the Ministerio de Salud and the Municipalidad de Tilarán to implement immediately the corresponding technical measures to resolve this problem.
For its part, the Ministerio de Ambiente y Energía, as the governing body for environmental matters, acting through the Secretaría Técnica Ambiental, shall actively oversee compliance with the orders issued herein and adopt such measures as may be appropriate within the scope of its powers to ensure effective compliance with any public-health orders issued. Likewise, the respondent authorities shall issue and carry out the legally appropriate actions necessary to provide a definitive and comprehensive solution to the solid-waste problem in the canton of Tilarán.
Por tanto:
The appeal is granted on the grounds of environmental damage. Jovel Arias Ortega, in his capacity as Mayor of the Municipalidad de Tilarán, and Hilda María Barrantes Guerrero, in her capacity as Director of the Area Rectora de Salud de Tilarán, or whoever may hold those offices, are ordered, each within the scope of their respective powers, to adopt the measures necessary to provide a comprehensive solution to the environmental-pollution problem at the Tilarán garbage dump, beginning upon service of notice of this judgment. Tatiana Cruz Ramírez, in her capacity as Secretary General of the Secretaria Técnica Nacional Ambiental, or whoever may hold that office; María Elena Madrigal, in her capacity as Director of the Area de Conservación Arenal- Tempisque of the Ministerio de Ambiente y Energía; and María Luisa Avila Agüero, in her capacity as Ministra de Salud, or whoever may hold that office, are ordered to verify compliance with the foregoing and, if appropriate, to proceed as required by law.
The aforementioned respondents are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who fails to comply with or enforce this order may be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines. The Municipalidad del Cantón de Tilarán is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration due to the environmental damage caused; the amount thereof shall be determined during enforcement of the judgment in the administrative-litigation proceedings (ejecución de sentencia de lo contencioso administrativo). This decision shall be served personally on Jovel Arias Ortega, Hilda María Barrantes Guerrero, Tatiana Cruz Ramírez, María Elena Madrigal, and María Luisa Avila Agüero.

Recurso de amparo que se tramita en expediente número 07-005809-0007-CO, interpuesto por CARLOS ADRIAN VARGAS MURILLO, mayor, cédula de identidad número 0501180589, vecino de Tilarán, a favor de Ganadera La Gitana contra el ALCALDE MUNICIPAL DE TILARAN, la DIRECTORA DEL AREA DE SALUD DE TILARAN, la MINISTRA DE SALUD y el MINISTRO DEL AMBIENTE Y ENERGIA.-
Resultando:
18- Por memorial interpuesto a esta Sala, un grupo de vecinos presenta su coayuvancia a este proceso (folio 483)
Redacta el Magistrado González Quiroga; y,
Considerando:
Alega el recurrente que la Municipalidad de Tilarán mantiene abierto un botadero de basura que no reúne las condiciones exigidas y que está produciendo un grave daño al ambiente y a la salud de los animales y de las personas que habitan cerca. Indican que han realizado múltiples gestiones ante diferentes instancias, pero no se le ha dado respuesta positiva al problema y la contaminación sigue afectando la zona, por lo que solicitan la intervención de este Tribunal.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En cuanto a la legitimación de Carlos Adrián Vargas Murillo para accionar ante esta jurisdicción en tutela del derecho a un ambiente sano que aduce violentado por la inercia de las autoridades recurridas, es reiterada la jurisprudencia de la Sala en el sentido de que, como se trata de intereses difusos, cualquier miembro de la comunidad afectada está legitimado para acudir a la vía de amparo, en procura de la protección al ambiente. Al respecto, es de particular relevancia lo dicho por este Tribunal Constitucional en sentencia número 3705-93 de las quince horas del treinta de julio de mil novecientos noventa y seis, que en lo conducente dispone:
"Tratándose de la protección jurídica del ambiente, la legitimación de los particulares para actuar judicialmente y lograr la aplicación de las normas que tienen esa finalidad o bien, solicitar la tutela jurisdiccional para amparar sus derechos violados, es de gran importancia. Pero debe analizarse desde varios puntos de vista, es decir, en relación con la naturaleza del proceso, las pretensiones y las partes intervinientes y, también tomando en cuenta que el quebranto de las normas ambientales puede provocarlo con su actuación u omisión tanto un sujeto de derecho privado como de derecho público. Este último, simplemente omitiendo ejercer el control debido sobre la actuación de los sujetos privados, cuando infringen las normas ambientales, ignorando su competencia funcional, que le exige ejercer ese control; o bien, infringiendo directamente con su actuación disposiciones jurídicas destinadas a proteger y conservar el ambiente.
Esta Sala en Sentencia Número 2233- 93 al señalar que la preservación y protección del ambiente es un derecho fundamental, da cabida a la legitimación para acudir a la vía de amparo. En el derecho ambiental, el presupuesto procesal de la legitimación tiende a extenderse y ampliarse en una dimensión tal, que lleva necesariamente al abandono del concepto tradicional, debiendo entender que en términos generales, toda persona puede ser parte y que su derecho no emana de títulos de propiedad, derechos o acciones concretas que pudiera ejercer según las reglas del derecho convencional, sino que su actuación procesal responde a lo que los modernos tratadistas denominan el interés difuso, mediante el cual la legitimación original del interesado legítimo o aún del simple interesado, se difunde entre todos los miembros de una determinada categoría de personas que resultan así igualmente afectadas por los actos ilegales que los vulneran.
Tratándose de la protección del ambiente, el interés típicamente difuso que legitima al sujeto para accionar, se transforma, en virtud de su incorporación al elenco de los derechos de la persona humana, convirtiéndose en un verdadero "derecho reaccional", que, como su nombre lo indica, lo que hace es apoderar a su titular para "reaccionar" frente a la violación originada en actos u omisiones ilegítimos. Es por ello que la vulneración de ese derecho fundamental, constituye una ilegalidad constitucional, es decir, una causal específica de amparo contra los actos concretos o normas autoaplicativas o, en su caso, en la acción de inconstitucionalidad contra todas las normas o contra los actos no susceptibles de amparo, e incluso, contra las omisiones, categoría ésta que en el caso del derecho al ambiente se vuelve especialmente importante, porque al tratarse de conservar el medio que la naturaleza nos ha dado, la violación más frecuente se produce por la inercia de las autoridades públicas en realizar los actos necesarios para protegerlos.”
Tal y como se indicó en el considerando anterior, en el derecho ambiental, el presupuesto procesal de la legitimación tiende a extenderse y ampliarse en una dimensión tal que lleva a entender que en términos generales toda persona puede ser parte. En tal virtud, la solicitud de coadyuvancia presentada por Josefina Gómez Gómez, y María Eduvina Alvarez Carranza, José Alcidez Ruiz y Luz Marina Alfaro y otros vecinos tienen legitimación para figurar como parte en este amparo de conformidad con el último párrafo del artículo 34 de la Ley de la Jurisdicción Constitucional.
En reiteradas ocasiones esta Sala ha manifestado que tanto el derecho a la salud -derivado del derecho a la vida- como el derecho a un ambiente sano y ecológicamente equilibrado, constituyen derechos fundamentales. El Estado está obligado a tomar las medidas necesarias para proteger el medio ambiente y evitar grados de contaminación que pongan en peligro la salud de los administrados, lo que sin duda alguna es competencia legalmente otorgada al Ministerio de Salud y el Ministerio de Ambiente y Energía, entre otras instituciones, pero también, en relación con el caso que nos ocupa, el Código Municipal en igual sentido obliga a las Municipalidades a velar porque al administrado se le garantice el disfrute real y efectivo del derecho a la salud y a un ambiente sano.
V.Ahora bien, no cabe duda de que un botadero y no un relleno técnico sanitario de basura es un grave foco de contaminación ambiental de diversa índole, con el inminente peligro para la salud de los pobladores, de los vecinos, de los que transitan o de las personas que permanecen en él por varias horas buscando entre la basura desechos que puedan ser de su utilidad. La Sala considera que es deber de las autoridades recurridas, así como de todas las personas que tengan alguna injerencia sobre este tema, salvaguardar una mejor calidad de vida de las personas del cantón y de todos los habitantes en general, sin que haya que esperar que por las condiciones ambientales, de construcción y planificación del botadero de basura, se sufra un deterioro mayor del que se esté dando que agrave la salud o el ambiente.
VI.En materia de desechos sólidos, existen varias normas que establecen la obligación del Estado de darle un adecuado tratamiento a los mismos en aras de garantizar la protección del ambiente y en ese sentido, a fin de desarrollar y garantizar lo dispuesto en el artículo 50 de la Constitución Política, y en relación con el caso que nos ocupa, la Ley General de Salud en su artículo 262 estipula: "Toda persona, natural o jurídica está obligada a contribuir a la promoción y mantenimiento de las condiciones del medio ambiente natural y de los ambientes artificiales que permitan llenar las necesidades vitales y de salud de la población.". Por su parte, el artículo 263 del mismo cuerpo normativo dispone: "Queda prohibida toda acción, práctica u operación que deteriore el medio ambiente natural o que alterando la composición o características intrínsecas de sus elementos básicos, especialmente el aire, el agua y el suelo, produzcan una disminución de su calidad y estética, haga tales bienes inservibles para algunos de los usos a que están destinados o cree éstos para la salud humana o para la fauna o la flora inofensiva al hombre.
Toda persona queda obligada a cumplir diligentemente las acciones, prácticas u obras establecidas en la ley y reglamentos destinadas a eliminar o a controlar los elementos y factores del ambiente natural, físico o biológico y del ambiente artificial, perjudiciales para la salud humana". A su vez, el artículo 17 de la Ley Orgánica del Ambiente establece: "las actividades humanas que alteren o destruyan elementos del ambiente o generen residuos, materiales tóxicos o peligrosos, requerirán una evaluación de impacto ambiental por parte de la Secretaría Nacional Ambiental creada en esta ley. Su aprobación previa, de parte de este organismo, será requisito indispensable para iniciar las actividades, obras o proyectos". En relación con tales normas, debe tenerse presente que para autorizar el funcionamiento de cualquier depósito de desechos sólidos, es imprescindible que se cumplan los requisitos correspondientes y una vez cumplidos los requerimientos exigidos por la ley y revisados los estudios técnicos que deban presentarse al efecto, le corresponde tanto al Ministerio de Ambiente y Energía como al Ministerio de Salud y a la Municipalidad del lugar -en razón de la especialidad de la materia y de la autoridad del gobierno local- autorizar o no el funcionamiento del proyecto que interese, tomando en consideración los intereses nacionales y locales en la protección del ambiente y una vez autorizado, darle el seguimiento correspondiente a efecto de que el funcionamiento se realice dentro del marco legalmente establecido.
VII.En el caso concreto, resulta evidente que muchos de estos requisitos que son necesarios para el correcto funcionamiento del vertedero de basura de Tilarán, fueron obviados o han sido del todo incumplidos durante los más de veintisiete años que tiene este vertedero de estar en operación y por ello, se está presentando actualmente el serio problema que denuncia el recurrente, cuya propiedad se encuentra contiguo al vertedero y que ha sido corroborado por las propias autoridades de la Secretaría Técnica Ambiental, Ministerio de Ambiente y Energía, del Ministerio de Agricultura y Ganadería del Instituto Costarricense de Acueductos y Alcantarillado, oficiales de la Fuerza Pública y del Ministerio de Salud, quienes en este último caso, a pesar que los vecinos presentaron una denuncia por este problema en el año 2004, no es hasta en el año 2006 que las autoridades sanitarias giran un par de ordenes sanitarias que obligan a la Municipalidad a fumigar el lugar y nuevamente hasta el año 2007 y en forma posterior a la presentación del presente recurso de amparo que los funcionarios del Area de Salud de Tilarán dictan otra orden con la finalidad que la Municipalidad accionada recoja los depósitos de basura que se encuentran en la entrada y en los márgenes del vertedero, entre otros.
Por otra parte, el 17 de abril de 2007 un grupo de vecinos presentaron una denuncia por contaminación ambiental producida por el basurero de Tilarán ante el Area de Conservación Arenal – Tempisque del Minae y a la fecha de interposición del este amparo tampoco había realizado ninguna diligencia para comprobar lo denunciado, a pesar que está de por medio la contaminación de una quebrada y una naciente de agua.
VIII.Ahora bien, la Sala observa que en el presente caso las autoridades competentes en salvaguardar el ambiente y salud de los habitantes no han ejercido sus funciones correctamente por cuanto no han ejecutado ninguna acción oportuna para frenar la causa de contaminación ambiental en general que produce el vertedero de basura en cuestión, en especial a la quebrada La Cabra y a la finca de empresa recurrente que colinda con la propiedad, que se dedica a actividades ganaderas. Además, según las últimas inspecciones realizadas por funcionarios de la Dirección Ambiental de Recurso Hídrico del Instituto de Acueductos y Alcantarillados , así como del Area de Conservación de Arenal Tempisque, hacen constar que en dicho lugar existe proliferación de plagas, que la quebrada La Cabra se encuentra contaminada por todos los desechos que provienen del vertedero, tales como llantas, bolsas de basura y otros, todo lo cual fue confirmado por los funcionarios del Departamento Auditoría y Seguimiento Ambietal de la Setena que concluyeron que el manejo realizado en el vertedero ha generado un impacto negativo en el medio ambiente circundante y que la contaminación de la quebrada Cabra repercute en los usuarios del agua (personas, animales doméstivcos, animales silvestres), tanto de dicha quebrada como del afloramiento de agua que se encuentra en la propiedad.
En virtud de lo anterior, la Sala considera que a pesar que en el mes de mayo de 2007 el Ministerio de Salud mediante orden sanitaria No. 015-07 ordenó al Alcalde Municipal realizar una serie de medidas de índole sanitaria con respecto al vertedero de desechos sólidos y por su parte la Municipalidad alega que ha cumplido, las actas de inspección realizadas por diferentes funcionarios públicos que constan en el expediente, demuestran que tanto las actuaciones de la Municipalidad como las órdenes del Ministerio de Salud no han sido lo suficientemente efectivas ni oportunas como para impedir que se siga dando contaminación en el ambiente y se siga poniendo en peligro la salud de la población y de los animales. Debe recordarse que esta Sala ya ha dicho que en materia de protección al ambiente, además de una actitud correctiva, también se debe tener una actitud preventiva porque los errores son irreversibles y de un alto costo ambiental y en ese sentido, en sentencia No. 05906-99, dispuso esta Sala que "la acción que la Constitución Política impone al Estado frente a los focos de contaminación ambiental es multidireccional y definitivamente activa, absolutamente intolerante frente a situaciones que amenazan o afectan las condiciones ambientales óptimas que están garantizadas por ella misma a los habitantes", con lo cual, es válida cualquier acción encaminada a la protección del ambiente, pero también se hace necesario que las medidas adoptadas no solamente se queden en el papel, sino que efectivamente sean ejecutadas.
Por tal razón, en el caso concreto, considera la Sala que el Ministerio de Ambiente y Energía, el Ministerio de Salud y la Municipalidad recurrida , han incumplido con la obligación básica, principal e ineludible que tienen estas entidades de vigilar por el cumplimiento de requisitos de este tipo de vertederos cuando se encuentran en su jurisdicción y de ejercer las medidas que sean necesarias para garantizar que tales actividades se realicen y se desarrollen ajustadas a derecho a efecto de que se garantice el derecho de los ciudadanos a disfrutar de un ambiente sano y ecológicamente equilibrado. De esta forma, los órganos citados no deben sentirse satisfechos con solo dictar recomendaciones o comprobar mejoras pues si bien es cierto, la eliminación de desechos sólidos es una actividad de por sí odiosa, también es lo cierto que, por ende, las normas que la rigen y las disposiciones particulares como las órdenes sanitarias que se dicten, deben interpretarse de manera extensiva, tratando de aplicarlas continuamente de la manera más rigurosa que técnicamente sea posible, motivo por el cual no es aceptable para la Administración una actitud complaciente y que se tranquilice con solo saber que se está haciendo algo pues mientras tanto, la afectación al ambiente y a la salud se sigue dando de manera reiterada.
En ese contexto, tampoco es válida la justificación que da el Alcalde recurrido en el sentido de que hay carencia de recursos pues de admitir tal explicación se estaría aceptando y legitimando que las lesiones al ambiente se pueden medir en función de los recursos económicos de que se dispongan, lo cual es del todo errado. En consecuencia, resulta evidente que la desatención por más de veintisiete años, que la Municipalidad y el Ministerio de Salud han tenido con respecto al problema de contaminación aquí planteado es el principal motivo para estimar el presente recurso. En un caso similar la Sala en sentencia No. 20006-08983 de las once horas dieciséis minutos del veintitrés de junio de 2006 dispuso: “ Estima este Tribunal Constitucional que el Ministerio de Salud ha sido omiso en el cumplimiento de sus obligaciones en tutela del derecho a la salud del amparado y demás vecinos de la urbanización de marras, al no hacer uso de sus potestades legales con el fin de solucionar, definitivamente, el problema sanitario que les afecta y que han denunciado formalmente, pues ha realizado una actividad insuficiente, inoportuna e ineficaz que se comprueba con el hecho de que el problema subsiste, al no haber concretado ninguna acción en ejercicio del poder de policía que le asiste por ley para hacer cumplir sus órdenes.
Queda así en los miembros de este Tribunal Constitucional la percepción de que ha sido la actuación de una “ Administración de papel”, que agota su actividad en meros trámites burocráticos, simplemente limitándose a realizar inspecciones y girar recomendaciones u órdenes sanitarias, sin que se tome medida alguna para corroborar que se hayan cumplido y, lo que es peor, sin que se evidencien de su parte acciones eficaces, verdaderamente encaminadas a resolver en definitiva la problemática sanitaria expuesta, como corresponde para cumplir el fin público que se le ha encomendado, lo que redunda en detrimento de la salud y el medio ambiente y, por consiguiente, en violación del artículo 50 constitucional, situación que resulta intolerable para esta Sala
VIII.La Sala concluye que en el presente caso nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad de Tilarán; y en reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. De los documentos y los informes rendidos bajo juramento que constan en el presente expediente, se desprende que las autoridades recurridas, a pesar que desde hace años tienen conocimiento del problema aquí expuesto, no han realizado los actos necesarios para garantizar la salud de los habitantes y la protección al medio ambiente. De esta forma, las autoridades recurridas son responsables del daño a los derechos fundamentales de las personas amparadas, por la omisión en velar pronta y eficazmente por la salud de esa población, y al medio ambiente.
La persistencia del problema demuestra que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del medio ambiente por parte del Misterio de Salud, de la Municipalidad de Tilarán, del Ministerio de Ambiente y Energía y de la Setena dentro del marco de sus competencias, han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesiona el derecho constitucional innominado o atípico de los administrados a que les presten servicios públicos eficientes y eficaces. De lo dicho y por estimarse que con los hechos denunciados y con las pocas actuaciones efectivas que han sido desarrolladas por los recurridos, se ha estado lesionado seriamente al ambiente y el derecho a la salud de los habitantes del cantón de Tilarán, se procede a la estimación del recurso. Ahora bien, esta declaratoria implica, para el Ministerio de Salud y para la Municipalidad de Tilarán, la inmediata puesta en ejecución de las medidas técnicas respectivas para solucionar este problema.
Por su parte, el Ministerio de Ambiente y Energía, como órgano rector de la materia ambiental, y mediante la Secretaría Técnica Ambiental deberá ejercer una activa actitud vigilante del cumplimiento de lo que aquí se está ordenando y dictar las medidas que, dentro del ámbito de sus competencias sean procedentes para darle cumplimiento efectivo a las ordenes sanitarias que se dicten. De igual manera deberán las autoridades recurridas proceder a dictar y ejecutar los actos que en derecho correspondan a fin de darle una solución definitiva e integral al problema de los desechos sólidos en el cantón de Tilarán.
Por tanto:
Se declara con lugar el recurso por daño ambiental. Se ordena a Jovel Arias Ortega , en su condición de Alcalde Municipal de Tilarán, y a Hilda María Barrantes Guerrero en su condición de Directora del Area Rectora de Salud de Tilarán o a quienes ocupen dichos cargos, adoptar cada uno dentro del ámbito de sus competencias, las medidas que sean necesarias para darle una solución integral al problema de contaminación ambiental que presenta el vertedero de basura de Tilarán a partir de la notificación de esta sentencia. Se ordena a Tatiana Cruz Ramírez en su condición de Secretaria General de la Secretaria Técnica Nacional Ambiental o a quien ocupe su cargo, a María Elena Madrigal, en su calidad de Directora del Area de Conservación Arenal- Tempisque del Ministerio de Ambiente y Energía y a María Luisa Avila Agüero en su condición de Ministra de Salud o a quien ocupe su cargo, verificar lo anteriormente ordenado y proceder, si es del caso, como en derecho corresponda.
Se le advierte a los recurridos citados que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se le podrá imponer prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien no cumpliera o hiciera cumplir esta orden. Se condena a la Municipalidad del Cantón de Tilarán al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria por el daño ambiental ocasionado, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Jovel Arias Ortega , Hilda María Barrantes Guerrero , Tatiana Cruz Ramírez, María Elena Madrigal y a María Luisa Avila Agüero en forma personal.
