SummaryResumen
In this substantive ruling, the Agrarian Court decides a possessory information proceeding regarding a forested property located outside protected wild areas. The central issue is whether forests on untitled land retain a public-domain character that prevents private appropriation through the Possessory Information Law. The Court holds that the enactment of the current Forestry Law, which amended Article 7 of the Possessory Information Law, resulted in the declassification of such lands from the public domain. Therefore, private parties may title forested land outside protected areas provided they prove ten-year possession, protection of the natural resource, and proper demarcation of the property. The decision relies on the constitutional validity of Article 7 affirmed by Constitutional Chamber ruling 4587-97, and on prior Agrarian Court precedents interpreting State forest property in relation to private ownership.

The Court does not share that view, considering that these lands were declassified from the public domain with the entry into force of the current Forestry Law, which amended Article 7 of the Possessory Information Law. That provision, regarding forested properties located outside protected wild areas, states: "... Farms located outside those areas and that have forests may only be titled if the applicant demonstrates being the holder of legal rights of ten-year possession, exercised for at least ten years, and having protected that natural resource, on the understanding that the property must be properly demarcated and with fences or clean paths." The constitutionality of this provision and of the interpretation previously given by this Court was challenged, which led to Constitutional Chamber ruling 4587-97, precisely cited by the appellant. In that ruling the Chamber declared the provision constitutional, maintaining its validity.

“III- Regarding the possibility for private parties to register forest-covered property located on untitled land, this Tribunal has ruled: “In connection with the arguments made by the State’s representative concerning the State forest estate (patrimonio forestal del Estado), it is appropriate to make brief reference to the matter. To that end, it is appropriate to cite Voto Nº51, issued at 15 hours 15 minutes on 26 de mayo de 1995 by the Sala Primera de la Corte Suprema de Justicia, which states, insofar as relevant: “IX.- The State forest estate includes the entire national territory (Articles 4, 32 through 42), which may in turn be subdivided into three areas: A) The area governed by the forestry regime (régimen forestal) (Articles l, 2, 7, 47 through 54, 66 through 81); B) Forest harvesting (aprovechamientos forestales) on privately owned land (Articles 43 through 46, 60 through 65, 82 through 91); and C) national reserves (reservas nacionales) (Articles 32 et seq.)......
In general, those reserves have been subject to restrictions on possession, as well as limits—in terms of surface area—on registration through possessory title proceedings (informaciones posesorias). .... XI.- Diametrically opposed to national reserves is private property, referred to in the law as ‘Forest Harvesting on Privately Owned Land.’ In the interests of social policy, these lands form part of the State forest estate. This is so because private parties—operating under any system (agricultural or livestock enterprise, subdivision (parcelación), or colonization, whether involving Costa Rican nationals or foreigners)—whose work plans include forest exploitation or forest removal in any form must necessarily obtain express approval from the Dirección General Forestal, under the terms of the Ley Forestal and its regulations (Article 60). The State forest estate therefore applies to all property in the national territory containing natural forest resources.
To exploit their own timber resources, private parties must prepare technical forestry plans (planes técnicos forestales), and the Dirección will grant them long-term concessions (Article 6l). The foregoing entails voluntary submission to the forestry regime. This is a legal presumption (presunción legal), since it is the sole alternative available to a private party, who is prohibited from cutting trees or harvesting or exploiting forest products on that party’s own property without prior authorization from the Dirección General Forestal (Articles 63 and 65)..... It follows from the foregoing that the State forest estate consists of real property not subject to private ownership and not registered in the Registro Público de la Propiedad, under Articles 267 and 486 of the Código Civil, according to the reference made to the ruling of the Sala Constitucional de la Corte Suprema de Justicia.
Alongside this estate, there is also private property. Throughout the development of forestry legislation, possessors of parcels who had already perfected their ownership rights through acquisitive prescription (usucapión) were afforded the opportunity to obtain title to them. That possibility is available through compliance with the requirements of the Ley de Informaciones Posesorias; accordingly, persons are expressly authorized to obtain title registrable in the Registro Público for land located in protected wildlife areas (áreas silvestres protegidas), regardless of their management category, upon the title applicant proving possession for more than 10 years before the effective date of the law or decree creating the relevant protected wildlife area (Articles 1 and 7 of the Ley de Informaciones Posesorias). (Voto 100-F-09 of the Tribunal Agrario). Regarding the public-domain status (carácter demanial) of forests and the impossibility of obtaining title to them under the Ley de Informaciones Posesorias, this Tribunal has declared: ‘The Tribunal does not share that view, finding that those properties were removed from the public domain (desafectación) when the current Ley Forestal entered into force and amended Article 7 of the Ley de Informaciones Posesorias.
With respect to forested properties located outside protected wildlife areas, that provision states: “... Properties located outside those areas and containing forests may be titled only if the petitioner proves that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and has protected that natural resource, on the understanding that the property must be properly demarcated and enclosed by fences or cleared boundary paths.” The constitutionality of that provision and of the interpretation given to it at one point by this Tribunal was challenged, resulting in the issuance of Voto 4587-97 by the Sala Constitucional, which was specifically cited by the appellant. In that decision, the Sala upheld the constitutionality of the provision, leaving it in force. Under those circumstances, the appropriate course in this case is to affirm the Judge’s ruling, because the petitioner proved compliance with the requirements established in that article, namely: ten-year possession, protection of the natural resource, and demarcation of the property by fences or cleared boundary paths.’ (Voto 573-F-09)”
(Voto 573-F-09)”
