Each of the points included in that document is explained below to facilitate its completion. It is recommended to consult the full text of the regulation to understand the context of the application of these Reports. Complementarily, regarding aspects related to sampling, it is recommended to read Executive Decree No. 39813-S-MTSS, "Reglamento sobre la configuración de los sitios de muestreo en chimeneas y ductos para la medición de contaminantes atmosféricos provenientes de fuentes fijas".
Additional doubts that may arise when preparing the Operational Report can be clarified at the Standardization Unit (Unidad de Normalización) of the Directorate of Radiological Protection and Environmental Health (Dirección de Protección Radiológica y Salud Ambiental, DPRSA) or at the Health Governing Areas or Regional Offices of the Ministry of Health.
The information that generating entities record in the operational reports, as well as the records supporting it, may be verified at any time by officials of the Ministry of Health.
1. GENERAL INFORMATION:
Generating entity: natural or legal person, public or private, responsible for the emission of atmospheric pollutants from boilers and indirect-type furnaces.
CIIU Code: record the number of the International Standard Industrial Classification in force in the country for the activity served by the reported boiler or indirect-type furnace.
Sanitary Operating Permit Number and effective date: record the certificate number issued by the Ministry of Health authorizing the operation of the establishment and the date on which it expires.
Exact Address: record the exact address (province, canton, district, and street address) of the generating entity.
Name, email, and signature of the Technical Person Responsible for the report: Indicate the full name and signature of the responsible, board-certified professional to whom the generating entity has delegated the obligation to prepare the operational report.
The technical responsible persons who prepare and sign the operational reports must have training and experience in the field of boilers and furnaces: interpretation of physical and chemical parameters; evaluation of emission control processes; evaluation of the production processes that use thermal energy, etc., and be duly registered, as well as active members of the corresponding Professional Association (Colegio Profesional).
Sampling Date: record the date on which the sampling was carried out.
Operational Report Date: record the date of submission to the Ministry of Health.
Date and Number of the Laboratory Report: record the date on which the Laboratory contracted by the industry or company prepared the Laboratory Report (attaching the original document) with the chemical analysis results, which must not have been issued more than 30 calendar days prior (Article 26 of this regulation). Also record the number that the laboratory assigned to the report.
The execution of the sampling must not have been carried out more than 30 calendar days prior to the moment of submitting the operational report.
Reporting period: The operational reports must be submitted with the following frequency:
a. Category A and B boilers and indirect-type furnaces: two reports must be submitted per year, distributed one during the first half of the year and the next in the second half of the year, to be submitted before June 30 and before November 30 of each year, respectively. The operational report for the first half of the year must state "From January 1 to June 30" and for the second half of the year it must state "From July 1 to December 31." b. Category C and D boilers: one annual report, before November 30 of each year.
c. Category C Indirect Furnaces: one annual report, before November 30 of each year.
For those generating entities that operate the equipment regulated in this regulation for periods equal to or less than six months per year, they must submit an emission analysis report within a period of no less than thirty calendar days from the start of their annual production process (operation of the equipment in steady state and at a high-demand requirement level). The operational report must be delivered within a period of no more than 30 calendar days after having carried out the sampling.
2. TECHNICAL DATA OF EACH BOILER AND INDIRECT FURNACE . Boiler and furnace category: For boilers, in accordance with the provisions of Executive Decree No. 26789-MTSS, Reglamento de Calderas, La Gaceta No. 65 of April 2, 1998, and its reforms. Indicate whether it is category A, B, C, or D. In the case of direct and indirect type furnaces, record the category in accordance with the provisions of Article 1 of this Regulation.
. Type of fuel: specify if it is bunker fuel, diesel, mineral coal, LP gas, IFOs, gasóleo, fuels derived from thermal processes, biofuels, treated used oil, oily sludge and similar materials, biomass fuel (wood, bagasse, coffee husk, etc.), or others.
. Fuel consumption: record the daily consumption in cubic meters of each boiler. For solid fuels, record the value in kilograms. If two fuels are used alternately in the equipment, then the consumption of each must be indicated in each operational report.
Process Flow Diagram with Mass and Energy Balance: (include if the changes proposed in the Corrective Action Plan require it, in accordance with Article 31 and Article 35 of this regulation).
. Operating schedule: record the hours of each daily start-up and shutdown per boiler and indirect-type furnace.
. Chimney duct dimension: record the diameter of the duct in meters at the gas sampling point going to the atmosphere, if it is circular. For square or rectangular ducts, record their width and length in meters.
. Total height of the chimney duct: record the height in meters from ground level to the point of discharge of the gases into the atmosphere.
3. RESULTS OF CHEMICAL LABORATORY ANALYSIS BY EQUIPMENT:
. Observation: the results of the sampled and analyzed emissions must be reported on a dry basis and referenced to the applicable oxygen percentage, according to Article 14 of this regulation, using the following formulas:

Where EBS = Emission on a dry basis EBH = Emission on a wet basis %H2O = Moisture content of the gases Formula to correct the emissions of the gases on a dry basis to the reference oxygen percentage Where Er = Emission calculated to the reference value EBS = Emission measured on a dry basis Or = Reference level for O2 (5%, 7%, or 10%, as applicable) Om = Measured value for O2 . m3 (TPN) (normal conditions of pressure and temperature): refers to the fact that volume calculations must be corrected to normal conditions, i.e., 101.3 kPa (760 mm Hg or one atmosphere) and 273.15 K (0°C).
. Measurement period: record the total duration in hours of the sampling of the physical and chemical parameters, indicating the start time and the end time.
. Distance (*):
A= record the length in meters to the sampling point from the chimney discharge.
B = record the length in meters to the sampling point from the last restriction (elbows, valves, pumps, emission control equipment, etc.) of the flow.
(*) Important note: the values of the mentioned distances "A" and "B," as well as other information related to the subject, are found in Annex I ("CONDITIONS PRIOR TO SAMPLING") of Executive Decree No. 39813-S-MTSS, Reglamento sobre la configuración de los sitios de muestreo en chimeneas y ductos para la medición de contaminantes atmosféricos provenientes de fuentes fijas.
4. ANALYTICAL RESULTS OF THE FUELS:
Record the sulfur and nitrogen concentrations (percentage by mass) of samples of the fuel used by the equipment during the chimney emission sampling carried out, attaching the corresponding original laboratory report, as applicable, of the fuel used during the gas monitoring, except for diesel, LP gas, and biomass.
If fuels derived from thermal processes or treated used oils, oily sludge, or similar materials are used, also indicate the content of the parameters in Table No. 10 of Article 15. The original laboratory report of the chemical analysis must be attached to the operational report, in conformity with Article 15 of this regulation.
Furthermore, for the data on "flash point" and "Ash," the results are mandatory to report for comparative purposes on fuel quality control.
Note: If the equipment uses two types of fuels during the reporting period, the analytical results for each fuel must be presented in the corresponding operational report.
5. METHODS OF ANALYSIS, SAMPLING METHODS, AND REFERENCE STANDARDS FOR EACH PARAMETER ANALYZED IN THE FUELS BY THE CHEMICAL LABORATORY.
The sampling and chemical analysis methods used by the laboratory, as well as the reference standards (ASTM in the case of sulfur and nitrogen analysis) used by the Laboratory contracted by the generating entity for each parameter analyzed, shall be recorded in this section. It is recommended to consult the relevant articles of the regulation.
In the case of fuels of the "treated used oils, sludge, and similar" type, this section shall additionally record which sampling and chemical analysis methods were used by the laboratory, as well as the reference standards (EPA, See Table No. 10 of Article 15, except in the case of ash (ASTM)) used by the Laboratory contracted by the generating entity for each parameter analyzed.
6. FAILURE LOG.
All important anomalous situations that have affected the operation of the boiler(s) and indirect-type furnace(s) or the control systems mentioned in Article 10 of this regulation, e.g., preheating equipment for liquid fossil fuels, devices for analyzing gases resulting from the combustion process, emission control equipment, etc., shall be explained in this section. This information must be consistent with what is recorded in the authorized logbooks.
7. EVALUATION OF THE CURRENT STATE OF THE SYSTEM (BOILER(S), INDIRECT FURNACE(S), AND THE RESPECTIVE EMISSION CONTROL EQUIPMENT).
A comment shall be written in this section by the technical responsible person regarding the state of the boiler(s), indirect furnace(s), and the control system(s) mentioned in point 5 above at the end of the reporting period, based on the information from point 3 of this Guide: Results of laboratory analyses per boiler and indirect furnaces, and on the inspections that may have been carried out by the professional(s) responsible for their operation and maintenance.
8. CORRECTIVE ACTION PLAN. If necessary, the Corrective Action Plan shall be proposed in this section for the purpose of ensuring that the emissions from the boiler(s) and indirect furnace(s) comply with the emission values established in Article 9 of this regulation.
This Plan must include at least the following information:
. Activities to be performed and objectives/goals . Start date and end date of each activity.
. Name of the activity responsible on behalf of the generating entity.
. Observations.
The presentation of the corrective action plan must be carried out according to the following format:

9. PRODUCTION RECORD.
This information is mandatory. The production record must include the overall production data of the generating entity, in terms of its daily average value during the reported period. The units in which production will be reported will correspond to those typically used by each activity (for example: hectoliters of beer/day, tanned hides/day, tons of processed meat/day, fanegas of coffee/day, or others).
Note: In the event that a piece of equipment uses two types of fuels during the period to be reported, it must present the production record data related to the time of utilization or use of the equipment with a specific fuel in a specific manner, including them in the content of the corresponding operational report.
The Ministry of Health may request clarifications, if necessary, regarding the interpretation of the units reported by the generating entity.

GUIDE FOR THE PREPARATION OF THE OPERATIONAL REPORT FOR EMISSIONS FROM DIRECT-TYPE FURNACES (Hornos de Tipo Directo, HD).
This Guide is prepared in order to comply with the provisions of the Ley General de Salud No. 5395 of October 30, 1973, in its articles 262, 263, 293, 295 and subsequent and concordant articles, and the provisions of this regulation.
In accordance with Article No. 23 and No. 26, in the event that the equipment uses two types of fuels during the period to be reported, it must submit an operational report for the purposes of emission control for each fuel used in the corresponding period. Additionally, it indicates the minimum information of the generating entity.
Article No. 24 of the Regulation lists the minimum aspects that an Operational Report for emissions from Boilers and Direct and Indirect Type Furnaces must contemplate, which requires the preparation of the document "Operational Report for emissions from Direct-Type Furnaces," therefore, each of the points included in that document is explained below with the aim of facilitating its completion. It is recommended to consult the complete text of the Regulation in order to know the context of application of said Reports; especially to be aware of the established exceptions to its submission. Complementarily, on aspects related to sampling, reading of Decreto Ejecutivo N° 39813-SMTSS is recommended.

CIIU Code: record the number of the Código Internacional Industrial Unificado (International Standard Industrial Classification Code) in force in the country for the activity served by the reported boiler or direct and indirect type furnace.
Número de Permiso Sanitario de Funcionamiento and validity date: record the certificate number issued by the Ministry of Health authorizing the operation of the establishment and the date on which it expires.
Exact address: record the exact address (province, canton, district, and landmark address) of the generating entity.
Name, email, and signature of the Technical Responsible for the report: Indicate the full name and signature of the responsible licensed professional to whom the generating entity has delegated the obligation to prepare the operational report. The technical responsible parties who prepare and sign the operational reports must have training and experience in the field of direct-type furnaces: interpretation of physical and chemical parameters; evaluation of emission control processes; evaluation of productive processes that use thermal energy, etc., and be duly incorporated, as well as be active members of the corresponding Colegio Profesional.
Sampling Date: record the date on which the sampling was carried out.
The sampling must not have been carried out more than one calendar month prior to the issuance of the Laboratory Report.
Operational Report Date: record the submission date to the Ministry of Health.
Date and number of the Laboratory Report: record the date on which the Laboratory contracted by the industry or company prepared the Laboratory Report (attaching the original document) with the results of the chemical analysis, which must not be more than 30 calendar days from having been issued (Article No. 26 of this Regulation). Also record the number that the laboratory assigned to the report.
The execution of the sampling must not have been carried out more than 30 calendar days prior to the moment of submitting the operational report.
Reported period: direct furnaces must submit operational reports with the following frequency:
a. Direct furnaces must submit two reports per year, distributed one during the first semester and the next in the second semester, to be submitted before June 30 and before November 30 of each year, respectively. The operational report for the first semester must record "From January 1 to June 30" and for the second semester, it must record "From July 1 to December 31." b. Operational report in periods of less than six months. For those generating entities that operate the equipment regulated in this regulation in periods equal to or less than six months per year, they must submit an emission analysis report, within a period of no less than thirty calendar days from the start of their annual productive process (operation of the equipment in a steady state and at a high demand level). The operational report must be delivered within a period no greater than 30 calendar days after having carried out the sampling.
2. TECHNICAL DATA FOR EACH DIRECT FURNACE (HD) . Category: In the case of direct-type furnaces, record the category according to what is indicated in Article 1 of this Regulation.
. Type of fuel: specify if it is bunker, diesel, mineral coal, LP gas, IFOs, gasóleo, treated used oil, oily sludge or similar, fuels derived from thermal processes, biofuels, biomass fuel (wood, bagasse, coffee husk, etc.) or others. Provide evidence if the equipment uses two types of fuel alternately and indicate which ones.
. Fuel consumption: record the daily consumption in cubic meters of each Direct Furnace. For solid fuels, record the value in kilograms. In case of alternately using two fuels in the equipment, then the consumption of each of them must be indicated in the operational report.
Process Flow Diagram with Mass and Energy Balance: (incorporate if the proposed changes in the Corrective Action Plan require it, in accordance with Article No. 31 and No. 35 of this regulation).
. Operating schedule: record the hours of use of the direct-type furnace.
. Dimension of the stack duct: record the diameter of the duct in meters at the sampling point of the gases going into the atmosphere, if it is circular. In the case of square or rectangular ducts, record the width and length in meters of it.
. Total height of the stack duct: record the height in meters from ground level to the discharge point of the gases into the atmosphere.
3. RESULT S OF CHEMICAL LABORATORY ANALYSIS PER EQUIPMENT:
Observation: the results of the sampled and analyzed emissions must be reported on a dry basis and be referenced to the applicable oxygen percentage, according to Article No. 14 of this regulation, using the following formulas:

4. ANALYTICAL RESULTS OF THE FUELS.
Record the concentrations of sulfur and nitrogen (percentage by mass) from fuel samples used by the equipment during the stack emission sampling carried out, attaching the corresponding original laboratory report, as the case may be, of the fuel used during the gas monitoring, except for diesel, LP gas, and biomass. In the case of equipment that uses two types of fuel alternately, the indicated information must be provided for each of them in the same report.
In the case of using fuels derived from thermal processes or treated used oils, oily sludge, or similar, also indicate the content of the parameters from Table No. 10 of Article 15. The original laboratory report(s) of the chemical analysis must be attached to the operational report in accordance with Article No. 15 of this regulation.
Note: In the event that the equipment uses two types of fuels during the period to be reported, it must present the analytical results for each fuel in the corresponding operational report.
5. ANALYSIS METHODS, SAMPLING METHODS, AND REFERENCE STANDARDS FOR EACH PARAMETER ANALYZED IN THE FUELS BY THE CHEMICAL LABORATORY.
This section will record which sampling and chemical analysis methods were used, as well as the reference standards (ASTM for the case of Sulfur and Nitrogen analysis) by the Laboratory contracted by the generating entity for each parameter analyzed. It is recommended to consult the pertinent articles of the Regulation.
In the case of fuels of the type "treated used oils, sludge, and similar," this section will additionally record which sampling and chemical analysis methods were used by the laboratory, as well as the reference standards (EPA, See Table No. 10 of Article No. 15, except in the case of ashes (ASTM)) by the Laboratory contracted by the generating entity for each parameter analyzed.
6. FAILURE RECORD.
This section will explain all significant anomalous situations that have affected the operation of the direct-type furnace or the control systems mentioned in Article 10 of the Regulation, e.g., preheating equipment for liquid fossil fuels, apparatus for analyzing gases resulting from the combustion process, emission control equipment, etc. This information must be consistent with what is recorded in the duly authorized logbooks, should their use be required, this for the case that the Direct Furnace is an industrial-use equipment.
7. EVALUATION OF THE CURRENT STATE OF THE SYSTEM OF DIRECT FURNACE(S) (HD) AND THE RESPECTIVE EMISSION CONTROL EQUIPMENT).
The technical responsible party will write a comment in this section about the state of the direct furnace(s) and the control system(s) mentioned in point 5 above at the end of the reported period, based on the information in point 3 of this Guide: Results of laboratory analysis per furnace and on the inspections carried out by the professional(s) responsible for their operation and maintenance.
8. CORRECTIVE ACTION PLAN.
If it proves necessary, the Corrective Action Plan will be proposed in this section with the purpose of ensuring that the emissions from the direct furnace(s) comply with the emission values established in Article 11 of the Regulation.
This Plan must include at least the following information:
. Activities to be carried out and objectives/goals . Start date and completion date of each activity.
. Name of the person responsible for the activity on behalf of the generating entity.
. Observations The presentation of the corrective action plan must be carried out according to the following format:

1. PRODUCTION RECORD.
This information is mandatory. The production record must include the overall production data of the generating entity, in terms of its daily average value during the reported period. The detail of all materials used or processed in the Direct Furnace must be reported, as well as their daily and monthly quantities, this for each equipment or item of equipment for which the Operational Report is submitted.
Note: In the event that a piece of equipment uses two types of fuels during the period to be reported, it must present the production record data related to the time of utilization or use of the equipment (HD) with a specific fuel in a specific manner, including them in the content of the corresponding operational report. The Ministry of Health may request clarifications, if necessary, regarding the interpretation of the units reported by the generating entity.
