Law for the Sustainable Development of the Sarapiquí River Basin and Protection of its Main ChannelLey para el desarrollo sostenible de la cuenca del río Sarapiquí y la protección de su cauce principal

An environmental safeguard (salvaguarda ambiental) is declared along the entire length of the main channel of the Sarapiquí River and its banks, from its headwaters (nacimiento) to its mouth at the San Juan River, for a period of twenty-five years, renewable, with the purpose of maintaining it in the best ecological conditions.

During the term of the environmental safeguard (salvaguarda ambiental), no new hydroelectric projects may be developed, nor may new concessions for the extraction of mining materials be granted.

The Commission for the Sustainable Development of the Sarapiquí River Basin is created, hereinafter Codesosa.

This Commission shall have the purpose of coordinating the public actions necessary for the integral, inclusive, and sustainable management of the natural, economic, and cultural resources of the Sarapiquí River basin, for which it shall have the following powers:

• a)To prepare and approve, within its body, the Integral Plan for Territorial-Environmental Management and Land-Use Planning of the Sarapiquí River Basin in accordance with current legislation, which shall be submitted for the information of the public institutions that comprise it.
• b)To coordinate all actions related to the protection and sustainable development of the Sarapiquí River hydrographic basin.
• c)To manage technical and financial support, national and international, public or private, for carrying out the actions required by the Commission for its operation.
• d)To promote the training of the inhabitants of said areas in matters of sustainable development.
• e)To promote the direct, active, and informed participation of the inhabitants in decision-making and other activities directly related to the integral management of the Sarapiquí River basin; for this purpose, Codesosa, in coordination with the involved entities, shall issue the necessary regulations and publicize them.
• f)To submit to the competent authorities the projects of public interest that are carried out, in order to maintain the sustainable environmental balance of the Sarapiquí River hydrographic basin.
• g)To manage cooperation agreements with different institutions for the development of its objectives and activities.
• h)To keep the heads of public institutions and civil society in general informed of the actions carried out within the framework of the Commission.
• i)To promote recognition of the economic, historical, environmental, and social value of the basin.
• j)To provide the technical criteria for the extension of the safeguard (salvaguarda) and the application of the established exceptions according to the criteria established in this law and applicable national legislation.
• k)To issue its organizational regulations and everything necessary for the fulfillment of its competencies.
• l)Any other function assigned to it by law or regulation.

The institutions participating in the Commission must include in their annual reports and on their websites reports on the actions carried out to fulfill the objectives of this law.

The Commission shall be composed as follows:

• a)The Minister of Environment and Energy, or the person he or she designates.
• b)The Minister of Agriculture and Livestock, or the person he or she designates.
• c)The Executive President of the Costa Rican Tourism Institute, or the person he or she designates.
• d)The Minister of Public Health, or the person he or she designates.
• e)The Mayor of the Municipality of Sarapiquí, or the person he or she designates.
• f)A representative of the Chamber of Sustainable Tourism of Sarapiquí (Catusa).
• g)Two representatives of non-governmental organizations.
• h)A representative of the integral development associations of Sarapiquí.
• i)A representative of the Association for the Protection of the Sarapiquí River Basin (Aprocsara).
• j)A representative of the Commission for the Safeguard of the Sarapiquí River Basin.
• k)A representative of the Universidad Nacional.
• l)A representative of the Universidad Estatal a Distancia.

Participation in this Commission does not generate per diem payments or compensation for the performance of the position.

The Commission shall appoint from its body a coordinator and a sub-coordinator for a period of two years, who shall be responsible for issuing calls for meetings, keeping the minutes, and managing the agreements before the competent authorities.

The Commission must hold ordinary sessions four times a year and extraordinarily when convened by its coordinator or by a written request from one-quarter of its members.

The Municipality of Sarapiquí may provide space in its facilities for the technical and logistical support that the Commission requires to carry out its functions. This Commission may convene and coordinate for the exercise of its functions with public institutions, social organizations, academia, and the private sector.

For the sustainable development of the Sarapiquí River basin and the protection of its main channel, the Water Directorate of the Ministry of Environment and Energy must transfer, at the beginning of the fiscal year following the budget liquidation of the immediately preceding fiscal year, the equivalent of one percent (1%) of the amounts collected from the fees established in Law N° 276, of August 27, 1942, and its amendments.

Furthermore, Codesosa may be financed by national public institutions, duly recognized national and international non-governmental organizations, and by duly accredited and state-regulated private companies or organizations.

Codesosa must submit and publish quarterly a report on the results of the implementation of the Integral Development and Zone Management Plan for the Sarapiquí River Basin.

The project results must be disseminated throughout the community and will be available on the MINAE website.

The liquidations of resources must be submitted to the Comptroller General of the Republic and to the Technical Secretariat of the Budgetary Authority. The latter must analyze compliance with current regulations.

The promotion of the sustainable development of the Sarapiquí River hydrographic basin shall be carried out through an integral development plan for the management of zones of the basin approved by Codesosa. The plan shall be implemented by the institutions and organizations that comprise it, according to their competencies.

The safeguard (salvaguarda) may be temporarily suspended in the following cases:

• a)By emergency declaration, when required by the National Emergency Commission, and for a defined period.
• b)For projects that benefit the communities located in the basin. For this purpose, they must have the approval of the Commission for the Sustainable Development of the Sarapiquí River Basin.

The safeguard (salvaguarda) of the Sarapiquí River basin may be extended for equal periods when the objectives of this law for safeguarding the basin have not been met.

The foregoing shall be defined according to prior technical analysis and studies carried out by MINAE in coordination with Codesosa.

The protection of the Sarapiquí River basin and its banks is declared to be of public interest. The State shall support local development initiatives and activities related to tourism development that seek to maintain, protect, and enhance the region. All within a framework of environmental protection and sustainability.

The Costa Rican Tourism Institute shall include within the National Tourism Development Plan and its annual marketing and investment attraction plans, actions that promote the integral development of the tourist destination.

The cancellation, following prior application of due process, of those concessions that do not comply with the required conditions shall immediately proceed.

Likewise, all applications for permits or concessions that are in the same condition of non-compliance must be archived without further processing.

It shall take effect upon its publication.

Done in the Municipality of Sarapiquí, Heredia, on the thirty-first day of March of the year two thousand twenty-two.

Se declara una salvaguarda ambiental a todo lo largo del cauce principal del río Sarapiquí y su ribera, desde su nacimiento hasta la desembocadura en el río San Juan, por un periodo de veinticinco años prorrogables, con la finalidad de mantenerlo en las mejores condiciones ecológicas.

Durante la vigencia de la salvaguarda ambiental no podrán desarrollarse nuevos proyectos hidroeléctricos ni otorgar nuevas concesiones de extracción de materiales mineros.

Se crea la Comisión del Desarrollo Sostenible de la Cuenca del Río Sarapiquí, en adelante Codesosa.

Esta Comisión tendrá como finalidad coordinar las acciones públicas necesarias para el manejo integral, inclusivo y sostenible de los recursos naturales, económicos y culturales de la cuenca del río Sarapiquí, para lo cual tendrá las siguientes facultades:

• a)Elaborar y aprobar, dentro de su seno, el Plan Integral de Manejo y Ordenamiento Territorial-Ambiental de la Cuenca del Río Sarapiquí de acuerdo con la legislación vigente, que será remitido a conocimiento de las instituciones públicas que la integran.
• b)Coordinar todas las acciones vinculadas a la protección y el desarrollo sostenible de la cuenca hidrográfica del río Sarapiquí.
• c)Gestionar apoyo técnico y financiero, nacional e internacional, público o privado, para la realización de las acciones que requiera la Comisión para su funcionamiento.
• d)Promover la capacitación de los pobladores de dichas zonas en materia de desarrollo sostenible.
• e)Promover la participación directa, activa e informada de los pobladores en la toma de decisiones y otras actividades relacionadas directamente con el manejo integral de la cuenca del río Sarapiquí, para dicho fin la Codesosa, en coordinación con los entes involucrados, emitirá los reglamentos necesarios y los publicitará.
• f)Elevar ante las autoridades competentes los proyectos de interés público que se realicen, con el fin de mantener el equilibrio ambiental sostenible de la cuenca hidrográfica del río Sarapiquí.
• g)Gestionar convenios de cooperación con diferentes instituciones para el desarrollo de sus objetivos y actividades.
• h)Mantener informados a los jerarcas de las instituciones públicas y a la sociedad civil en general, de las acciones desarrolladas en el marco de la Comisión.
• i)Promover el reconocimiento del valor económico, histórico, ambiental y social de la cuenca.
• j)Brindar los criterios técnicos para la prórroga de la salvaguarda y aplicación de las excepciones establecidas según los criterios establecidos en la presente ley y legislación nacional aplicable.
• k)Dictar su reglamento de organización y todo lo necesario para el cumplimiento de sus competencias.
• l)Cualquier otra función que le se asignado por ley o por reglamento.

Las instituciones que participan en la Comisión deberán incluir dentro de sus memorias anuales y en sus sitios web informes sobre las acciones desarrolladas para el cumplimiento de los objetivos de esta ley.

La Comisión estará integrada de la siguiente forma:

• a)El ministro o ministra de Ambiente y Energía, o la persona que designe.
• b)El ministro o ministra de Agricultura y Ganadería, o la persona que designe.
• c)La Presidencia Ejecutiva del Instituto Costarricense de Turismo, o la persona que designe.
• d)El ministro o ministra de Salud Pública, o la persona que designe.
• e)El alcalde o la alcaldesa de la Municipalidad de Sarapiquí, o la persona que designe.
• f)Un representante de la Cámara de Turismo Sostenible de Sarapiquí (Catusa).
• g)Dos representantes de las organizaciones no gubernamentales.
• h)Un representante de las asociaciones de desarrollo integral de Sarapiquí.
• i)Un representante de la Asociación Protectora de la Cuenca del Río Sarapiquí (Aprocsara).
• j)Un representante de la Comisión de Salvaguarda de la Cuenca del Río Sarapiquí.
• k)Un representante de la Universidad Nacional.
• l)Un representante de la Universidad Estatal a Distancia.

La participación en esta Comisión no genera dietas ni numeración por el ejercicio del cargo.

La Comisión nombrará de su seno un coordinador y un subcoordinador por un periodo de dos años, quien será el responsable de realizar las convocatorias, llevar las actas y gestionar los acuerdos ante las autoridades competentes.

La Comisión deberá sesionar de forma ordinaria cuatro veces al año y extraordinariamente cuando lo convoque su coordinador o por solicitud escrita de la cuarta parte de sus integrantes.

La Municipalidad de Sarapiquí podrá brindar un espacio en las instalaciones para el apoyo técnico y logístico que requiera la Comisión para realizar sus funciones. Esta Comisión podrá convocar y coordinar para el ejercicio de sus funciones con instituciones públicas, organizaciones sociales, academia y sector privado.

Para el desarrollo sostenible de la cuenca del río Sarapiquí y la protección de su cauce principal, la Dirección de Aguas del Ministerio de Ambiente y Energía deberá trasladar al inicio del ejercicio económico, posterior a la liquidación presupuestaria del ejercicio económico inmediato anterior, el equivalente al uno por ciento (1%) de lo recaudado por los cánones establecidos en la Ley N° 276, de 27 de agosto de 1942, y sus reformas.

Además, Codesosa podrá ser financiada por instituciones públicas nacionales, organizaciones no gubernamentales nacionales e internacionales debidamente reconocidas y por empresa u organizaciones privadas debidamente acreditadas y reguladas por el Estado.

Codesosa deberá rendir y publicar trimestralmente un informe de los resultados de la ejecución del Plan de Desarrollo Integral y Manejo de Zonas de la Cuenca del Río Sarapiquí.

Los resultados del proyecto deberán divulgarse en toda la comunidad y estarán a disposición en el sitio web del Minae.

Las liquidaciones de los recursos deberán ser entregados ante la Contraloría General de la República y ante la Secretaría Técnica de la Autoridad Presupuestaria. Esta última deberá analizar el cumplimiento de la normativa vigente.

La promoción del desarrollo sostenible de la cuenca hidrográfica del río Sarapiquí se realizará mediante un plan de desarrollo integral del manejo de zonas de la cuenca aprobado por Codesosa. El plan será implementado por las instituciones y organizaciones que la integran, según sus competencias.

La salvaguarda podrá ser suspendida en forma temporal, en los siguientes casos:

• a)Por declaratoria de emergencia, cuando sea requerido por la Comisión Nacional de Emergencias, y por un periodo definido.
• b)Para los proyectos de beneficio para las comunidades ubicadas en la cuenca. Para tal efecto, deberán contar con la aprobación de la Comisión del Desarrollo Sostenible de la Cuenca del Río Sarapiquí.

La salvaguarda de la cuenca del río Sarapiquí podrá ser prorrogada por periodos iguales cuando no se hayan cumplido los objetivos de la presente ley para salvaguardar la cuenca.

Lo anterior se definirá según análisis y estudios técnicos previos realizados por el Minae en coordinación con Codesosa.

Se declara la protección de la cuenca del río Sarapiquí y su ribera de interés público El Estado apoyará las iniciativas de desarrollo local y las actividades vinculadas al desarrollo del turismo, que buscan mantener, proteger y potenciar la región. Todo bajo un marco de protección y sostenibilidad del medio ambiente.

El Instituto Costarricense de Turismo incluirá dentro del Plan Nacional de Desarrollo Turístico y sus planes anuales de mercadeo y atracción de inversiones, acciones que promuevan el desarrollo integral del destino turístico.

Inmediatamente se procederá a la cancelación, previa aplicación del debido proceso, de las concesiones que no cumplan con los requisitos solicitados.

Asimismo, se deberán archivar, sin más trámite, todas las solicitudes de permisos o concesiones que se encuentren en esa misma condición de incumplimiento.
