For the purposes of this Regulation, the following will be understood by:
?Collective supply: When a single connection provides wastewater collection service to more than one consumption unit.
?Individual supply: When a single connection provides collection service ?Water connection: Length of pipe installed from the distribution network to the point of installation of the service connection; it extends to the property boundary.
?Sanitary sewer connection: Length of pipe installed from the collection network to the outlet fitting of the inspection chamber.
?Aqueduct: The set of sources, water treatment plants, storage tanks, conveyance and distribution networks, and other elements necessary for supplying water to a population.
? Potable water: Treated water that meets the provisions for recommended or maximum permissible aesthetic, organoleptic, physical, chemical, biological, and microbiological values, established in the AyA's Reglamento de Calidad de Agua Potable.
? Wastewater: Water that has received a use and has been contaminated with organic matter, chemical substances, or suspended solids. To be received into the public sanitary sewer system, it must comply with the environmental regulations issued by the competent authorities.
? Special type wastewater: Wastewater of a type different from ordinary.
? Ordinary type wastewater: Wastewater generated by domestic human activities (use of toilets, showers, washbasins, sinks, laundry, etc.).
? Treated water: Wastewater that has undergone physical-chemical and biological purification processes in a treatment plant and meets the conditions necessary for disposal in a body of water or reuse.
?Billing adjustment: Modification to billed amounts when high consumption occurs.
? Sanitary sewer: Public network of pipes used to collect and transport wastewater from the user's inspection chamber (caja de registro) or discharge point to the treatment and disposal site. This concept is understood as synonymous with a collection network or system.
? Works approval: Action resulting from validating a water or sanitation work or infrastructure built by a private party, once the fulfillment of the required conditions has been technically and legally verified.
?Biosolids: Sludge that has undergone treatment processes and which, due to its organic matter content, nutrients, and characteristics acquired after its treatment, can be utilized or disposed of at sites authorized by the competent entities.
?Special biosolids: Treated special sludge.
?Sanitary biosolids: Treated sanitary sludge.
?Septic biosolids: Treated septic sludge.
? Inspection chamber (Caja de Registro): Underground container generally built on the sidewalk and used to interconnect wastewater coming from the property with the sanitary sewer network. It also serves to define the boundary between the public system and the private system, as well as to facilitate unblocking tasks.
? Street or public thoroughfare: Any public access area for the free transit of people and/or vehicles.
? Hydraulic capacity: Corresponds to the condition of the installed infrastructure of the sanitation systems to convey the flows for the provision of services.
? Collection capacity: Existing condition of technical and administrative feasibility for the collection, treatment, and disposal of wastewater by the Municipality.
?Council: the Concejo Municipal of the Municipality of Alajuela.
?Condominium: Real estate susceptible to independent use by different owners, with indivisible common elements. Condominiums may be of the lot, horizontal, vertical, combined, and mixed types, or others.
?Combined condominium: A project where different uses and types of buildings are combined; they must be compatible with each other and must conform to the regulations governing the zone where they are located.
?Lot condominiums: Those where the subsidiary properties (fincas filiales) correspond to horizontal lots, which can be intended for industrial, tourism, commercial, residential, and recreational use. They may be intended for the provision of services or for building constructions.
In horizontal lot condominiums, each subsidiary property (finca filial) will be called an individualized primary subsidiary property.
?Sub-condominium condominium: One constituted on a parent subsidiary property (finca filial matriz), containing several internal condominiums or parent properties. Internal condominiums may be of lots, horizontal, vertical, mixed, combined, condohotel, or other types.
?Horizontal condominium: The modality where each condominium owner is the exclusive owner of their own plot of land and the building constructed on it, and a co-owner of the common areas.
?Mixed condominium: Those where vertical and horizontal condominiums may be present on the same parent property (finca matriz).
?Residential condominium: The condominium constituted as such from the moment all projected buildings, such as dwellings, buildings, accesses, and common areas, have been completed and duly approved.
?Vertical condominium: Modality whereby each condominium owner is the exclusive owner of part of the building composed of several floors and is a common owner of all the land and buildings or installations of general use.
?Proof of service availability (Constancia de disponibilidad de servicios): Document issued by the Municipality to certify to the interested party, the real existence on a property of the capacity for collection and treatment of its wastewater, allowing the eventual request for services; without causing detriment to the rights of existing users.
?Proof of sanitation capacity (Constancia de capacidad de saneamiento): Document issued by the operating entity in the event of a denial of service availability, certifying that the sanitary sewer has the capacity for the availability of collection, treatment, and disposal service to the property; subject to the construction by the interested party of the infrastructure indicated in this document.
? Connection: The joining of the public sanitary sewer system with the private system.
? Cross connections: Interconnection of systems (water, wastewater, stormwater runoff, non-potable industrial water, or others) that pose a risk of contaminating the water system, the integrity of the sanitation system, and the stormwater system.
? Fraudulent connection: A connection that, having been suspended, is reconnected to the water and/or sanitation systems without the authorization of the system operator; or that, while active, is detected using a means that falsifies the actual consumption of the service.
? Unauthorized or illicit connection: A connection made by third parties to the water and/or sanitation systems without the due authorization of the Municipality.
?Construction: that technical and constructive activity carried out by the Municipality through the Actividad de Alcantarillado pluvial involving the execution of new works to extend the system to unserved areas of the canton.
?Consumption: The recorded monthly consumption where there is no evidence of impact from leaks in the internal or foreseen connections.
?Average consumption: The average of the normal potable water consumption recorded in the last 6 months.
? Continuity of service: A quality of service indicating the duration of uninterrupted service over a given period.
? Taxpayer: the natural or legal person obliged to pay the rate for the stormwater sewer service.
? Cost: the financial cost incurred by the Municipality for the maintenance, repair, and construction of works related to the stormwater sewer system, including expenses for personal and non-personal services, materials and supplies, depreciation of machinery, equipment, and installations, administrative ?Vegetative growth: Corresponds to the increase of new services for a dwelling or a business on an individual property with water consumption less than or equal to one service equivalent and up to six subdivisions (fraccionamientos) of the property and with frontage on a public street or access easement (servidumbre), where distribution and/or collection networks exist. Urban developments do not fall under this concept. In any case, the monthly water consumption must not exceed six service equivalents.
?Wastewater spill: Discharge of wastewater from the sanitation system.
? Service availability: Real and current existence, not future or potential, of the works and overall necessary infrastructure and collection and treatment capacity to meet the service needs of a specific population.
?Suitable document: Reference sketch and location of the property, deed, document proving, confirming, or justifying certain information, which must be tailored to the specific case, in accordance with the application of the principle of reasonableness and logic.
?Branch extension: Increase in the length of a segment of the aqueduct network and/or the collection system to a specific point.
?Technical feasibility: Study to verify that a specific action can be carried out under the appropriate conditions.
?Invoice: A printed or digital document periodically issued by the operator, showing the items, consumption, due date, amounts to be charged for services provided, and, among others, information of interest to the user. It may also present information on overdue accounts receivable.
?Billing: The process by which the items, volumes, and amounts to be paid by the user are determined.
?Subsidiary property (Finca filial): A privately owned unit within a condominium, constituting an autonomous portion equipped for independent use and enjoyment, directly connected to the public thoroughfare or to a specific common space leading to it.
?Parent property (Finca matriz): The real estate giving rise to the condominium, constituted by two or more subsidiary properties (fincas filiales) and their corresponding common areas.
?Parent subsidiary property (Finca filial matriz): Any subsidiary property (finca filial) that, due to its own characteristics regarding size, availability of accesses and services, allows the constitution of a new condominium within the initial condominium.
?Subdivision (Fraccionamiento): The division of any real estate for the purpose of selling, transferring, trading, distributing, exploiting, or using separately the resulting parcels; it includes judicial or extrajudicial adjudicatory partitions, allocations of undivided rights, and mere segregations held by the same owner, as well as those located in urbanizations or new constructions relevant to the control of urban formation and use of real estate.
?Leak: Escape of water from the distribution networks or water installations.
?Water meter: Device or instrument for measuring and recording the volume of water.
? Separation of services: The act by which the Municipality, at the request of the interested parties, separates the water or sanitary sewer services for the subsidiary properties (fincas filiales) in condominiums.
? Individualization: The act by which the Municipality, at the request of the interested party, separates the water or sanitary sewer services for each of the consumption units within a single property.
? Property: A duly individualized piece of land listing one or several owners.
? Technical inspections for supplies: Review conducted by the operator, at the request of the user or ex officio, to verify the use of the service and its basic data.
? Connection installation: The action realized when the connection located on a private property is physically integrated into the operator's system.
? Internal installations: Mechanical installations for water supply and sanitation located inside the property.
? Technical inspection: Specialized review carried out by the Municipality or the operator regarding the operation and use of the water, sanitation, and metering systems, located on the public thoroughfare, in public or private easements (servidumbres de paso), or on private properties and buildings.
? Interconnection: Connection of new systems, infrastructure, and urban developments that comply with current technical regulations, to the distribution and collection systems operated by the Municipality or the operator, for enabling water and sanitation services.
?Property boundary for water service: Corresponds to the part of the boundary of the property or of the easement providing access to it, opposite the point where the water meter providing the water service is located. In the case of properties located facing a public thoroughfare or a pipe easement (servidumbre de paso y tubería) constituted in favor of the Municipality, it corresponds to the boundary of the property or the subsidiary property (finca filial). In the case of properties located facing access easements, it corresponds to the frontage of this easement with the public thoroughfare.
?Property boundary for sanitary sewer service: Corresponds to the limit of the public sanitary sewer service provided by the Municipality. It is established at the pipe segment where the inspection chamber (caja de registro) located on the sidewalk begins; it is understood that the inspection chamber (caja de registro) is the property of the service holder, and therefore, its maintenance is their responsibility.
?Sludge: A mixture of solids and waters, a byproduct of the water treatment processes.
?Special sludge: Sludge generated by the treatment of special type wastewater and from water treatment plants, as well as from the treatment of wastewater and sludge with chemical products such as coagulants, polymers, and flocculants.
?Ordinary sludge: Includes sanitary sludge and septic sludge.
?Sanitary sludge: Sludge generated in a treatment plant for ordinary type wastewater.
?Septic sludge: Sludge generated in septic tanks.
?Sludge management and final disposal: Set of operations to which sludge from wastewater treatment plants is subjected, with the aim of avoiding risks to the population's health. It includes, among other stages: storage, transport, treatment, and final disposal.
?Municipality: Understood as the Municipality of the Canton of Alajuela.
?Unauthorized water bypass (bypass): Unauthorized water connection mechanism used to falsify the consumption recorded on the water meter.
?Manhole or inspection chamber: Structure with access and cover used for inspection and maintenance of collection systems. Used where there are changes in direction, slope, or diameter, and the confluence of several pipes.
?Water stub: Length of pipe installed from the distribution network to the point for the service connection; it extends to the property boundary, which has not been connected to the internal installations of the property.
?Sanitary sewer stub: Length of pipe installed from the collection network to provide service to the property but which has not been connected to the inspection chamber (caja de registro).
?Owner: Natural or legal person exercising dominion over real estate through a public deed, duly registered in the Registro Público.
?Wastewater treatment system: Set of physical, chemical, or biological processes, the purpose of which is to improve the quality of the wastewater.
?Urban development project: Infrastructure project for urban purposes, built by opening up spaces (urbanizations, condominiums, shopping centers, residential or office towers, among other infrastructures), intended to meet the population's needs where water and sanitation services will exist.
?Volumetric Test: Review performed on the water meter to verify the correct recording of water volume. It corresponds to the technical procedure by which a water meter is subjected to different water flows, making a comparison between the recorded volume and a reference standard, in order to obtain the respective error percentages.
?Reception of works: Action resulting from approving and receiving or transferring a work or infrastructure for water or sanitation built by a private party, which then becomes the property of the Municipality, once the fulfillment of the required conditions has been technically and legally verified.
?Networks: System of pipes for water distribution and wastewater collection.
?Public network: System of water or wastewater collection pipes owned by the Municipality.
?Sanitation service: The public sanitation service refers to the activities of collection, treatment, and final disposal of wastewater. The collection may be through the direct connection of the property to a sanitary sewer network; or through on-site collection of sludge from septic tanks or an individualized treatment system using a collection truck for subsequent transport to a treatment plant. Depending on the modality in which collection is provided, a differentiated rate adjusted to its costs will be charged.
?Provisional service: Service that, due to the nature of the activity, is provided for a determined period and will subsequently become a permanent service.
?Temporary service: Service that, due to the nature of the activity, is provided for a determined period.
?Public access easement (Servidumbre de acceso público): Real right of entry or transit for pedestrians and/or vehicles in favor of public entities and over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land thereby losing its condition of private property.
?De facto easement (Servidumbre de hecho): One established over a property by force of use and custom, tolerated by the property owner, without legal imposition or a formal act of constitution through public deed.
?Private access easement (Servidumbre de paso privada): Real right of entry and transit for pedestrians and/or vehicles in benefit of one or several properties, and over a property owned by another. It implies for its owner a limitation on the full exercise of the attributes of property rights, without the portion of land thereby losing its condition of private property.
?Pipe easement (Servidumbre de paso y tubería): Real right to install sanitary sewer pipe on a property owned by another, for operation, administration, and maintenance by the Municipality. It implies a permanent and continuous utility of access for the fulfillment of its public purpose, as well as a limit on the exercise of property rights by its owner.
?Registered pipe easement (Servidumbre de paso y tubería inscrita): Easement (Servidumbre) duly registered over one or several properties in the Registro de la Propiedad.
?Sanitation system: Set of works that include at least the civil and electromechanical components necessary for the collection, treatment, and final disposal of ordinary type wastewater. This concept does not include private treatment and disposal systems for wastewater.
?Treatment system or plant: Set of facilities where physical, chemical, or biological processes are carried out, the purpose of which is to improve the quality of raw wastewater before its final disposal.
?Individualized treatment system: Individualized system for the treatment of ordinary wastewater in places where there is no possibility of connecting to a sanitary sewer system.
?Internal property systems: The internal network and installations, both for water and sanitary sewer, located within a property.
?Private system: Set of water and sanitary sewer installations not administered by the Municipality or another public operator.
?Public system: Set of water and sanitary sewer installations administered and operated by the Municipality.
?Connection requests: Formality, petition, or procedure performed by the interested party to obtain a service for their use.
?Service suspension: Action allowing the interruption of the provision of water supply services, due to non-payment or for reasons inherent to the service operation.
?Septic tank: Specific type of individualized system for the treatment of wastewater based on anaerobic processes and disposal in the soil through infiltration.
?Rate: the charge to be paid to the Municipality by the owners of real estate registered in the Central Canton of Alajuela for the provision of sanitation services.
? Consumption unit: Each of the dwelling, commercial, industrial units, or others, that has its own water and sanitary sewer installations and receives the services provided by the service provider.
?Urbanization: Subdivision (Fraccionamiento) and enabling of land for urban purposes, through the opening of streets and provision of services.
? User: Owner or legitimate possessor of a property in the Canton of Alajuela, who by such condition is obliged to pay the rate charged by the Municipality for sanitation services.
?Bulk water sale: Modality of water sale to another provider, shipping companies operating legally in Costa Rica, and water sellers to third parties operating legally.
?Prepaid sale: Corresponds to the sale of technically defined and paid-up sanitation services in advance, at the request of a user.
