THEY DECREE:

Amendment of articles 11, 13 second paragraph, 23 subsection p), 24, 28 subsection p), 33, 34, 35, and 37 and repeal of article 36 of Executive Decree N° 31857-MAG "Regulation to the Law of the National Institute of Innovation and Transfer in Agricultural Technology (INTA), of May 19, 2004.

31857-MAG of May 19, 2004 "Regulation to the Law of the National Institute of Innovation and Transfer in Agricultural Technology (INTA)." so that they read as follows:

"Article 11. -INTA shall be composed of the following bodies:

• a)A Board of Directors composed of seven members and a comptroller, and two Advisory Units, consisting of an Internal Audit and a Service Comptrollership.
• b)An Executive Directorate, composed of the Executive Director and four Units consisting of three advisory Units, an Institutional Planning Unit, a Legal Advisory Unit and a Technical Cooperation Unit and a Technical Information Management Unit of an operational nature.
• c)A Directorate of Research and Technological Development which shall be composed of the following Departments:

• d)A Financial Administrative Directorate consisting of the following three Departments:

"Article 13. -The Institute shall have a Board of Directors composed of seven members, in whom the highest direction shall reside. It shall be integrated as follows: (.)

The Executive Director of the Institute must attend the sessions of the Board of Directors, having a voice but no vote. Likewise, the comptroller designated by the Board of Directors. (.)

p. The functions detailed in the Internal Rules of Procedure of the Board of Directors of the National Institute of Innovation and Transfer in Agricultural Technology.

The Internal Audit shall oversee, with functional and criteria independence, the operations and the effectiveness of risk administration, control and governance processes, as well as advise within its scope of competence, contributing positively and constructively to the protection of resources, the strengthening of the internal control system and the achievement of institutional objectives.

It shall function and be organized in accordance with the provisions of Chapter IV of the General Law of Internal Control Nº 8292, the Regulation to said Law, the Regulation of Organization and Operation of the Internal Audit and the technical standards and provisions issued by the Comptroller General of the Republic. The Board of Directors of INTA shall define and establish through agreements, the administrative regulations applicable to the Internal Auditor in the terms indicated by Article 24 of Law Nº 8292. The Internal Auditor must present to the Board of Directors the Annual Work Plan, an Annual Report of its execution and the status of recommendations and provisions, without prejudice to the preparation of other reports, should circumstances warrant it. When it deems it necessary, and without detriment to the provisions of Chapter IV of Law Nº 8292, the Board of Directors shall request the Internal Auditor to include in the Annual Work Plan, special audits or studies.

The Service Comptrollership shall function and be organized in accordance with the provisions of Chapter II, Section III of Law 9158 and Chapter IV of Executive Decree 39096-PLAN and the Regulation for the Creation, Operation and Functioning of the Service Comptrollership of the National Institute of Innovation and Transfer in Agricultural Technology, published in the Official Gazette La Gaceta N° 208, of October 29, 2014.

p. Assign functions and responsibilities to his/her advisory and support team composed of the Institute's Legal Advisory Unit, the Institutional Planning Unit and the Technical Cooperation Unit, as well as matters concerning the Information and Communication Technologies and Institutional Image Areas.

1). Institutional Planning Unit is responsible for guiding the strategic and operational planning process of INTA in accordance with its objectives. It shall be in charge of the following functions:

• a)Propose policy guidelines and strategic and operational actions for INTA.
• b)Coordinate and actively participate in the formulation of the Institutional Strategic Plan (PEI), as a medium- and long-term instrument.
• c)Prepare and propose to the institutional head the Annual Operational Plan (POA) and articulate the Preliminary Draft Annual Institutional Budget, in accordance with the National Public Development and Investment Plan (PNDIP)(*), the PEI and the legislation in force, to guarantee its financing.

(*)(Note from Sinalevi: Name thus modified by subsection a) of article 43 of the Regulation for the Implementation of Law N°10441 of March 13, 2024 and the Operation of the National Public Investment System, approved by executive decree N° 45163 of August 8, 2025. Previously it was stated as "National Development Plan (PND)") d) Formulate and implement the Strategic Institutional Public Investment Program, with the support of the institution's Executing Units within the framework of the Public Investment Subsystem.

• e)Be part of the monitoring and evaluation system (SINE) for the evaluation of governmental management in relation to institutional performance, the country's development and citizen welfare, through a procedure of analysis, monitoring and evaluation of the results of the goals established in the PND, Sectoral Plan and other planning instruments f) Apply the coordination mechanisms by MIDEPLAN, Ministry of Finance and Comptroller General of the Republic, to link the processes of planning, programming, budget execution, monitoring and evaluation, and accountability.
• g)Define, implement, apply and evaluate indicators of technical-administrative efficiency and effectiveness and institutional impact, which allow verifying the operation of the Institute.
• h)Accompany, establish regulations, provide advice and be an active part in the formulation of investment programs and projects and institutional action plans, as well as research projects, aligned with the Institutional Strategic Plans, Sectoral Plan and National Development Plan.
• i)Follow up on the agreements and contracts signed by INTA that are directly related to project execution, as well as technical, administrative and financial monitoring and evaluation of the projects.
• j)Keep the database of assets acquired as a result of project execution updated.
• k)Maintain statistics of the institution's activities (research, services, transfer) l) Analyze, propose, coordinate and execute the design and redesign of organizational and administrative processes for adequate institutional management, in compliance with established functions and regulatory provisions m) Develop all those actions derived from the fulfillment of institutional functions in relation to the SNP.
• n)Document, record and systematize the information of plans, programs and projects.
• o)Advise, support, and formulate strategic and priority projects for INTA, according to directives of the Executive Directorate, for the directorates and departments of INTA interested in submitting projects.
• p)Maintain close relationship and coordination with SEPSA and other instances of the Agricultural Sector and Science and Technology.
• q)Contribute to the drafting of the report for accountability to Costa Rican society.
• r)Comply with the policies, functions, responsibilities, procedures, measurement models and methodology for the administration and control of the different types of risk to which the Institution's processes are exposed, as a result of its operation.
• s)Formally review and validate the information provided by the units in the forms, matrices or other specific document required in each process.
• t)Coordinate the self-evaluation that leads to the improvement of the Internal Control System for which it is responsible.
• u)Supervise the implementation of permanent and centralized records or files of the documentation supporting the actions taken to comply with each of the institution's different processes.
• v)Any other assigned by the Executive Directorate.

2). Legal Advisory Unit. It is responsible for advising and issuing criteria effectively and efficiently, on those legal matters submitted for its knowledge, in accordance with the national and international regulations in force for the entire Agricultural Sector.

This Advisory Unit shall depend hierarchically on the Executive Directorate and shall be in charge of the following functions:

• a)Advise and guide the Head in their work to improve the legal contribution within the decision-making process when so required.
• b)Provide advice and support to the Executive Directorate in the legal area on the competencies and acts carried out by INTA in relation to the procedures to be followed in accordance with the General Law of Public Administration and other applicable regulations.
• c)Draft bills, Executive Decrees, regulations or other legal instruments.
• d)Advise INTA personnel on the application of national and international regulations in agri-food legal matters.
• e)Guarantee the objectivity, impartiality and uniformity of the criteria issued by INTA.
• f)Contribute to the processes of accountability and evaluation of management.
• g)Accompany external processes involving legal-legal actions in defense of institutional interests at the judicial and administrative level.
• h)Seek alternative solutions to conflicts that arise in inter-organizational labor relations.
• i)Facilitate access to reliable legal information through technological resources for institutional decision-making.
• j)Address, investigate, analyze, resolve, propose and draft consultations and provisions of a legal nature.
• k)Prepare and review resolutions, agreements, contracts, procedures and any other legal document that INTA must sign.
• l)Address the instructions of the head in administrative procedures.
• m)Attend to any other function assigned that is of a legal nature.

3). Technical Cooperation Unit. It is responsible for identifying, planning, coordinating, programming and supporting the procurement of International Cooperation resources (technical and financial) and pre-investment, required by INTA, in a way that contributes to the effective and efficient development of the Institution, agricultural producers and the Agricultural Sector. It shall be in charge of the following functions:

• a)Actively participate in the strategic and operational planning processes and activities of INTA.
• b)Collect, characterize and keep updated information on sources of technical and financial cooperation, and contacts of national and international organizations, public or private.
• c)Coordinate internally within INTA and with other directorates of the MAG and institutions of the agricultural sector, the identification and formulation of comprehensive, multidisciplinary, inter-institutional and international projects, as warranted.
• d)Maintain a portfolio of agreements and memoranda of understanding with universities and research centers at the international level.
• e)Manage resources with the identified cooperation and financial sources and define contacts for the efficient processing and execution of projects.
• f)Maintain strict coordination with the Ministries of National Planning and Economic Policy, Foreign Trade, Foreign Affairs and Worship and with technical and financial cooperation entities of an international, bilateral and multilateral nature.
• g)Establish internal protocols for carrying out negotiations and formalizing national or international treaties or agreements.
• h)Process the reports required by national and international cooperating entities, and by any other unit that so requires.
• i)Keep the inventory of projects in process and in execution updated.
• j)Propose the establishment of agreements or similar of interest to INTA with public or private national or international institutions k) Request and channel resource requests at the internal level of INTA.
• l)Maintain constant communication with INTA's regional representatives, to identify and establish cooperation links with organizations and companies.
• m)Promote associativity and collaborative work for the development of research and innovation projects.
• n)Represent INTA before various institutions or organizations by delegation of the Executive Director o) Any other assigned by the Executive Directorate.

This Directorate groups the technical part of the institution and is composed of five Departments: the Department of Research and Innovation, Department of Technology Transfer, Department of Laboratories, Department of Directorate is responsible for providing support to researchers for the generation of technology, the transfer of technology, the provision of research services in laboratories, experimental stations and in the management of basic land studies, in order to efficiently respond to the demands of service users. The functions of this Directorate are:

This Directorate is responsible for:

• a)Actively participating in the strategic and operational planning processes and activities of INTA.
• b)Exercising immediate supervision over the Department Heads and supervision of the personnel of the Directorate under its charge.
• c)Consolidating, prioritizing and responding to the needs for research, innovation and transfer of technology demanded by users at the local, regional and national levels.
• d)Coordinating, advising and guiding agricultural research and technology transfer, to meet the objectives and goals established in institutional policies.
• e)Actively participating in the review and supervision of projects for research, innovation and transfer of technology.
• f)Maintaining close connections with the National System of Agricultural Technology Research and Transfer (SNITTA), the information services of the agricultural sector, the National Directorate of Agricultural Extension and other national and external organizations dedicated to the generation of science and technology.
• g)Formulating and drafting technical and administrative documents for the heads.
• h)Rendering accounts to superior authorities.
• i)Any other assigned by the Executive Directorate.

This Department has five Units which are: Basic Grains Unit, Vegetables Unit, Roots and Tubers Unit, Fruit Crops Unit and Livestock Unit. This department is responsible for:

• a)Identifying and prioritizing the needs for research and innovation of agricultural technology at the local, regional and national level, in accordance with the particular production system taking into account the agricultural chain.
• b)Formulating and executing research and innovation projects, using the scientific method in its area of competence, achieving the proposed objectives and goals for the benefit of producers.
• c)Validating the technology generated from projects within its competence, allowing assessment of its technical relevance and improving the effectiveness of its adoption by users.
• d)Advising in specific complementary areas of agricultural research, such as crop protection, genetic improvement, agronomy, biostatistics, socio-economics and other related areas.
• e)Actively participating in the strategic and operational planning processes and activities of INTA.
• f)Coordinating and collaborating with the Department of Technology Transfer, the dissemination of technological options generated by INTA.
• g)Developing links with the National System of Agricultural Technology Research and Transfer -SNITTA-, the information services of the Agricultural Sector, the National Directorate of Agricultural Extension and other organizations dedicated to science and technology of the Agricultural Sector and at the national and international scientific level.
• h)Formulating the consolidated PAO/Budget and Procurement Plan.
• i)Preparing annual, semi-annual and technical reports.
• j)Coordinating meetings and working sessions with the technical groups comprising each unit and other units for the development of research and innovation projects.
• k)Drafting scientific articles or other technical publications in order to appropriately disseminate the work of INTA at the national and international level.
• l)Any other assigned by the Directorate of Research and Technological Development.

The functions of this Department are:

• a)Collecting, characterizing and systematizing verified and/or validated technological options to transfer them to different users.
• b)Permanently feeding and updating the institutional technical platforms for technological information.
• c)Designing, coordinating, organizing and executing training and dissemination events for technological information through the different state and private extension services.
• d)Requesting, centralizing and channeling resource requests at the internal level of INTA.
• e)Designing and applying methodologies, mechanisms and tools for knowledge management, information, communication and transfer according to the different users and production typologies.
• f)Promoting, sponsoring and disseminating the publication of technical documents.
• g)Maintaining close coordination with the National System of Agricultural Technology Research and Transfer -SNITTA-, the information services of the Agricultural Sector and the state extension service.
• h)Promoting alliances with producer organizations, public and private institutions of a national and international nature, in matters of its competence.
• i)Any other assigned by the Head of the Directorate.

This department is responsible for the implementation of methodologies, the analysis of samples, issuance of diagnoses, the in vitro multiplication of germplasm and execution of specific studies that complement the lines of research, innovation and validation of the Directorate of Research and Technological Development, therefore it shall have multidisciplinary personnel, professionals and technicians trained in the different fields of action to ensure their competence.

The Department shall be composed of laboratory areas that allow it to execute the following functions:

• a)Develop procedures and implement methodologies for analysis and diagnoses in plant protection, animal nutrition, soil, plant and water chemistry and physics, chemical and microbiological characteristics of agricultural inputs and organic fertilizers, among others required in the institution to support the scientific backing of research.
• b)Support genetic improvement assisted by molecular markers.
• c)Develop and implement techniques for the mass reproduction of germplasm of interest.
• d)Support the development and execution of research proposals according to institutional guidelines.
• e)Develop and update the technical and administrative procedures and activities of the Department.
• f)Provide services to users in its area of competence according to the rates authorized by the Board of Directors.
• g)Coordinate with the Department of Technology Transfer the training of officials and Users in matters of its competence.
• h)Coordinate with other internal or external units in order to execute special activities required in the agricultural sector, in accordance with the competencies and capacities of the Department.
• i)Perform other functions assigned by the hierarchical superior.

This Department is sub-divided into four stations, Enrique Jiménez Núñez Experimental Station (Chorotega Region), Los Diamantes Experimental Station (Caribbean Region), Carlos Durán Experimental Station (Central Eastern Region), La Managua Experimental Station (Central Pacific Region), each at the unit level, which are differentiated by their specificity in addressing themes and crops based on their geographic location (agro-climatic regions), which shall support the research, innovation and validation developed by the Directorate of Research and Technological Development. This department is responsible for:

• a)Providing services to the agricultural sector according to its needs by placing high-quality products of importance for the sector.
• b)Contributing to the improvement and sustainability of the agricultural sector, through the generation, innovation, validation, research and dissemination of technology, for the benefit of Costa Rican society.
• c)Coordinating with the Department of Technology Transfer the training of officials and users in matters of its competence.
• d)Supporting the research, innovation and validation led by officials of the Directorate of Research and Technological Development.
• e)Conserving germplasm collections to supply quality genetic material for research and national production.
• f)Articulating the development of research, innovation, validation, transfer and production projects carried out by INTA.
• g)Addressing the needs for information, advice, services and agricultural technological products of technicians and producers.
• h)Capturing the needs for research, innovation and transfer of technology for the comprehensive analysis of demand at INTA and the preparation of the Annual Tactical and Annual Operational Plan of each station, to address information, training, services and products for research and production.
• i)Establishing Information and Training Centers for professionals, technicians and farmers in the different agroecological zones, in coordination with the Department of Technology Transfer.
• j)Developing projects according to the needs of the region through Institutional initiative or in coordination with other Institutions or entities in the area of influence or the country.
• k)Carrying out the relevant procedures for the operation of each of the line items, projects or programs developed in each unit, in order to ensure the respective oversight and efficient use of resources.
• l)Conducting sales of agricultural research services in accordance with what is stipulated, as long as it does not undermine the attention to socially relevant research demands.
• m)Ensuring the care and safeguarding of livestock and crops that are in its Experimental Stations, as well as their sale when appropriate, in accordance with the Internal Regulation for the Sale of Services and Ancillary Goods and the rates approved by the Board of Directors of INTA.
• n)Any other assigned by the Immediate Supervisory Head.

6. Department of Basic Land Studies. Based on what is stipulated in Article 20 of Law N°8149, this Department shall contribute to conducting studies related to the proper use of land, agroecological classification and zoning of crops, as well as land-use planning and territorial planning with a participation in the preparation and execution of national plans for soil management, conservation and recovery, as established by the Law for the Use, Management and Conservation of Soils number 7779 and its Regulation, likewise it shall collaborate with the Directorate of Research and Technological Development, in the research and innovations that are developed.

This department is responsible for:

• a)Conduct investigations and studies related to what is authorized in Articles 6 subsections a), b) and c), 27, 49 and 66 of Law No. 7779 and of Executive Decrees No. 29375-MAG-MINAE-S-H-MOPT and No. 30636-MAG, regarding conforming land use (uso conforme del suelo), issuance of technical criteria for authorizations and permits.
• b)Sell services to users in its area of competence according to the rates authorized by the Board of Directors.
• c)Conduct semi-detailed soil surveys and agroecological land capability (capacidad de uso de las tierras) assessments of the country, as well as agroecological zoning (zonificación agroecológica) of crops, within the framework of land-use planning and land management (planificación y ordenamiento territorial), supporting the execution of the National Plans for soil management, conservation, and recovery.
• d)Collaborate with the INTA Directorate of Research and Technological Development in the research and innovations developed.
• e)Request, centralize, and channel resource requests at INTA’s internal level.
• f)Maintain updated databases available to users regarding soils, lands, and waters corresponding to the information generated by INTA.
• g)Participate in agricultural zoning studies at the national, regional, or local level to contribute to efficiently guiding production.
• h)Keep the geographic information system updated to facilitate land management (ordenamiento territorial) in the medium and long terms.
• i)Any other duty assigned by the Directorate Head.

It is responsible for coordinating and making decisions on INTA’s own administrative matters, as well as serving as the liaison with other institutions and entities for budget planning and execution, resource management, procurement of goods and services, communication, and the planning and development of programs and projects.

This Directorate shall have three Administrative Units: the Procurement Department, the General Services Department, and the Resource Administration Department. This Directorate has the following functions:

• a)Plan, coordinate, and supervise the administrative support functions necessary to achieve the proper technical, administrative, and financial functioning of INTA.
• b)Prepare and process, in coordination with the rest of INTA’s units, the ordinary and extraordinary budgets; as well as the corresponding execution reports.
• c)Prepare, in coordination with the competent Departments, the studies and proposals for updating and adjusting rates for the payment of INTA products and services, which must be approved by the Board of Directors.
• d)Propose to the Executive Directorate the draft regulations, manuals, procedures, and instructions necessary for INTA’s administrative and financial management.
• e)Render accounts to INTA’s higher authorities.
• f)Administer INTA’s physical and financial resources.
• g)Ensure that INTA maintains an adequate financial position.
• h)Any other duty assigned by the Executive Directorate.

Its operation is governed by the Administrative Contracting Law Number 7494 and its Regulations; it is the Department competent to process the administrative contracting procedures of interest to the Institute, as well as to carry out the processes of storage and distribution or movement of goods and to keep a permanent inventory of all its assets. It shall function and be organized in accordance with the provisions of the Regulation for the Operation of Institutional Procurement Departments of the Government Ministries Number 30640-H and the Regulation for the registration and control of assets of the central administration and reform Regulation to the Law of the Financial Administration of the Republic and Public Budgets Number 40797-H, as well as other applicable regulations.

This Department has the following functions:

• a)Prepare and manage the approval and application of the procedure manuals for its processes.
• b)Plan, direct, coordinate, and supervise the technical and administrative activities related to the provision of transportation services.
• c)Design and implement the administrative processes required for the proper functioning of the Institute.
• d)Establish and execute general and preventive maintenance plans for equipment, movable, and immovable property.
• e)Any other duty assigned by its immediate Supervisor.

This Department has the following functions:

• a)Prepare and manage the corresponding approvals of the regulations, procedure manuals, and instructions that are necessary in administrative, financial, budgetary, and accounting matters.
• b)Prepare and apply the regulations and manuals necessary to regulate the service relationship between INTA and its officials, to foster a healthy work environment and achieve the optimization of human resources.
• c)Prepare the accounting and budget records and prepare the corresponding statements and reports in accordance with accepted standards and techniques regarding PAO-Presupuesto.
• d)Control and safeguard financial resources and movable and immovable property.
• e)Coordinate the formulation of the budget with the Institutional Planning Unit and other INTA Directorates.
• f)Process and negotiate with the appropriate parties the budgets necessary for the proper functioning of INTA.
• g)Any other duty assigned by the Head of the Administrative-Financial Directorate.

It takes effect upon its publication in the Official Gazette.

Given at the Presidency of the Republic on the twentieth day of October of the year two thousand twenty.

"Artículo 11. -El INTA estará conformado por los siguientes órganos:

• a)Una Junta Directiva conformada por siete miembros y un fiscal, y dos Unidades de naturaleza asesora, constituidas por una Auditoría Interna y una Contraloría de Servicios.
• b)Una Dirección Ejecutiva, conformada por el Director(a) Ejecutivo (a) y cuatro Unidades constituidas por tres Unidades de carácter asesor, una Unidad de Planificación Institucional, una Unidad de Asesoría Jurídica y una Unidad de Cooperación Técnica y una Unidad de Gestión de Información Técnica de carácter operativo.
• c)Una Dirección de Investigación y Desarrollo Tecnológico que estará conformada por los siguientes Departamentos:

1. Departamento de Investigación e Innovación, conformado por cinco unidades, Unidad de Granos Básicos, Unidad de Hortalizas, Unidad de Raíces y Tubérculos, Unidad de Frutales y Unidad Pecuaria.

2. Departamento de Transferencia de Tecnología.

3. Departamento de Laboratorios.

4. Departamento de Estaciones Experimentales el cual se divide en cuatro unidades a saber: Unidad Estación Experimental Enrique Jiménez Núñez (Región Chorotega), Unidad Estación Experimental Los Diamantes (Región Caribe), Unidad Estación Experimental Carlos Durán (Región Central Oriental) y Unidad Estación Experimental La Managua (Región Pacífico Central).

5. Departamento de Estudios Básicos de Tierras.

• d)Una Dirección Administrativa Financiera que consta de los siguientes tres Departamentos:

1. Departamento de Proveeduría.

2. Departamento de Servicios Generales y, 3. Departamento de Administración de Recursos." "Artículo 13. -El Instituto tendrá una Junta Directiva compuesta por siete miembros, en quienes recaerá la máxima dirección. Estará integrada de la siguiente manera: (.)

A las sesiones de la Junta Directiva deberá asistir el Director Ejecutivo del Instituto, quien tendrá voz, pero no voto. De igual manera el fiscal designado por la Junta Directiva. (.)

p. Las funciones que se detallan en el Reglamento Interno de Funcionamiento de la Junta Directiva del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria.

La Auditoria Interna fiscalizará con independencia funcional y de criterio, las operaciones y la efectividad en la administración del riesgo, el control y los procesos de dirección, así como asesorar en el ámbito de su competencia, contribuyendo en forma positiva y constructiva a la protección de los recursos, el fortalecimiento del sistema de control interno y el logro de los objetivos institucionales.

Funcionará y se organizará de conformidad con lo señalado en el Capítulo IV de la Ley General de Control Interno Nº 8292, el Reglamento a dicha Ley, el Reglamento de Organización y Funcionamiento de la Auditoría Interna y las normas técnicas y disposiciones que emita la Contraloría General de la República. La Junta Directiva del INTA definirá y establecerá mediante acuerdos, las regulaciones de tipo administrativo aplicables al (la) Auditor(a) Interno (a) en los términos que señala el Artículo 24 de la Ley Nº 8292. El (la) Auditor (a) Interno (a) deberá presentar a la Junta Directiva el Plan Anual de Trabajo, un Informe Anual de su ejecución y del estado de recomendaciones y disposiciones, sin perjuicio de que se elaboren otros informes, en caso de que las circunstancias lo ameriten. Cuando lo considere necesario, y sin detrimento de lo señalado en el Capítulo IV de la Ley Nº 8292, la Junta Directiva solicitará al (la) Auditor (a) Interno(a) incluir en el Plan Anual de Trabajo, auditorías o estudios especiales.

La Contraloría de Servicios funcionará y se organizará de conformidad con las disposiciones del Capítulo II, Sección III de la Ley 9158 y el Capítulo IV del Decreto Ejecutivo 39096-PLAN y el Reglamento de Creación, Funcionamiento y Operación de la Contraloría de Servicios del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria, publicado en el Diario Oficial La Gaceta N° 208, del 29 de octubre de 2014.

p. Asignar funciones y responsabilidades a su equipo asesor y de apoyo conformado por la Unidad de Asesoría Jurídica del Instituto, la Unidad de Planificación Institucional y la Unidad de Cooperación Técnica, así como lo concerniente a las Áreas de Tecnologías de Información y Comunicación e Imagen Institucional.

1). Unidad de Planificación Institucional le corresponde orientar el proceso de planificación estratégico y operativo del INTA en función de sus objetivos. Tendrá a su cargo las siguientes funciones:

• a)Proponer lineamientos de política y acciones estratégicas y operativas para el INTA.
• b)Coordinar y participar activamente en la formulación del Plan Estratégico Institucional (PEI), como instrumento de mediano y largo plazo.
• c)Elaborar y proponer al jerarca institucional el Plan Operativo Anual (POA) y articular el Anteproyecto Anual de Presupuesto Institucional, de acuerdo con el Plan Nacional de Desarrollo y de Inversión Pública (PNDIP)(*), el PEI y la legislación vigente, para garantizar su financiamiento.

(*)(Nota de Sinalevi: Así modificada su denominación por el inciso a) del artículo 43 del Reglamento para la Implementación de la Ley N°10441 del 13 de marzo del 2024 y el Funcionamiento del Sistema Nacional de Inversión Pública, aprobado mediante decreto ejecutivo N° 45163 del 8 de agosto del 2025. Anteriormente se indicaba "Plan Nacional de Desarrollo (PND)") d) Formular e implementar el Programa Estratégico Institucional de Inversiones Públicas, con el apoyo de las Unidades Ejecutoras de la institución en el marco del Subsistema de Inversión Pública.

• e)Ser parte del sistema de seguimiento y evaluación (SINE) para la evaluación de la gestión gubernamental en relación con el desempeño institucional, el desarrollo del país y el bienestar ciudadano, por medio de un procedimiento de análisis, monitoreo y evaluación de los resultados de las metas establecidas en el PND, Plan Sectorial y en otros instrumentos de planificación f) Aplicar los mecanismos de coordinación por parte de MIDEPLAN, Ministerio de Hacienda y Contraloría General de la República, para vincular los procesos de planificación, programación, ejecución presupuestaria, seguimiento y evaluación, y rendición de cuentas.
• g)Definir, implementar, aplicar y evaluar indicadores de eficiencia y eficacia técnico administrativa y de impacto institucional, que permitan verificar la operación del Instituto.
• h)Acompañar, establecer la normativa, brindar asesoría y formar parte activa en la formulación de programas y proyectos de inversión y planes de acción institucionales, así como los proyectos de investigación, alineados a los Planes Estratégico Institucional, Plan sectorial y Plan Nacional de Desarrollo.
• i)Dar seguimiento a los convenios y contratos que suscribe el INTA que tengan relación directa con la ejecución de proyectos, así como seguimiento y evaluación técnica, administrativa y financiera a los proyectos.
• j)Mantener actualizada la base de datos de bienes adquiridos producto de la ejecución de los proyectos.
• k)Mantener estadísticas de las actividades de la institución (investigación, servicios, transferencia) l) Analizar, proponer, coordinar y ejecutar el diseño y rediseño de los procesos de organización y administrativos para una adecuada gestión institucional, en cumplimiento a las funciones y disposiciones normativas establecidas m) Desarrollar todas aquellas acciones que se deriven del cumplimiento de las funciones institucionales en relación con el SNP.
• n)Documentar, registrar y sistematizar la información de los planes, programas y proyectos.
• o)Asesorar, apoyar, y formular proyectos estratégicos y prioritarios para el INTA, según directrices de la Dirección Ejecutiva, a las direcciones y departamentos del INTA interesados en la presentación de proyectos.
• p)Mantener estrecha relación y coordinación con SEPSA y otras instancias del Sector Agropecuario y de Ciencia y Tecnología.
• q)Coadyuvar en la redacción del informe para la rendición de cuentas a la sociedad costarricense.
• r)Cumplir las políticas, funciones, responsabilidades, procedimientos, modelos de medición y metodología para la administración y control de los distintos tipos de riesgo a que están expuestos los procesos de la Institución, como resultado de su operatividad.
• s)Revisar y validar formalmente la información suministrada por las dependencias en los formularios, matrices u otro documento específico que se requiera en cada proceso.
• t)Coordinar la autoevaluación que conduzcan al perfeccionamiento del Sistema de Control Interna del cual es responsable.
• u)Supervisar la implementación de registros o archivos permanentes y centralizados de la documentación que respalde las acciones realizadas para cumplir con cada uno de los diferentes procesos de la institución.
• v)Cualquier otra que le asigne la Dirección Ejecutiva.

2). Unidad de Asesoría Jurídica. Le corresponde asesorar y emitir criterios de manera eficaz y eficiente, en aquellos asuntos jurídicos sometidos a su conocimiento, conforme a la normativa nacional e internacional vigente a todo el Sector Agropecuario.

Esta Unidad Asesora dependerá jerárquicamente de la Dirección Ejecutiva y tendrá a sucargo las siguientes funciones:

• a)Asesorar y orientar al Jerarca en su quehacer para mejorar el aporte jurídico dentro del proceso de toma de decisiones cuando así lo requiera.
• b)Brindar asesoría y acompañamiento a la Dirección Ejecutiva en el área jurídica sobre las competencias y actos que realice el INTA en relación con los procedimientos a seguir de conformidad con la Ley General de la Administración Pública y la demás normativa aplicable.
• c)Elaborar proyectos de Ley, Decretos Ejecutivos, reglamentos u otros instrumentos legales.
• d)Asesorar al personal del INTA en la aplicación de la normativa nacional e internacional en materia jurídica agroalimentaria.
• e)Garantizar la objetividad, imparcialidad y uniformidad de los criterios emitidos por el INTA.
• f)Contribuir con los procesos de rendición de cuentas y evaluación de la gestión.
• g)Acompañar los procesos externos donde medien acciones de carácter jurídico legal en defensa de los intereses institucionales a nivel judicial y administrativo.
• h)Procurar soluciones alternativas a los conflictos que se originen en las relaciones laborales inter orgánicas.
• i)Facilitar el acceso a la información jurídica confiable mediante los recursos tecnológicos para la toma de decisiones institucionales.
• j)Atender, investigar, analizar, resolver, proponer y redactar consultas y disposiciones de carácter jurídico.
• k)Elaborar y revisar las resoluciones, convenios, contratos, acuerdos, procedimientos y cualquier otro documento jurídico que deba suscribir el INTA.
• l)Atender las instrucciones del jerarca en procedimientos administrativos.

m)Atender cualquier otra función que le sea asignada de carácter jurídico.

3). Unidad de Cooperación Técnica. Le corresponde identificar, planificar, coordinar, programar y apoyar la obtención de recursos de Cooperación Internacional (técnica y financiera) y de pre-inversión, que requiere el INTA, de manera que contribuya al desarrollo eficaz y eficiente de la Institución, de los productores agropecuarios y del Sector Agropecuario. Tendrá a su cargo las siguientes funciones:

• a)Participar activamente en los procesos y actividades de planificación estratégica y operativa del INTA.
• b)Recopilar, caracterizar y mantener actualizada la información sobre fuentes de cooperación técnica, de financiamiento, y contactos de organismos nacionales e internacionales, públicos o privados.
• c)Coordinar a lo interno del INTA y con otras direcciones del MAG e instituciones de sector agropecuario, la identificación y formulación de proyectos integrales, mutidisciplinarios, interinstitucionales e internacionales, según se amerite.
• d)Mantener un portafolio de convenios y cartas de entendimiento con universidades y centros de investigación a nivel internacional.
• e)Gestionar recursos con las fuentes de cooperación y financiera identificadas y definir contactos para la eficiente tramitación y ejecución de los proyectos.
• f)Mantener una estricta coordinación con los Ministerios de Planificación Nacional y Política Económica, de Comercio Exterior, de Relaciones Exteriores y Culto y con entes de cooperación técnica y financiera de índole internacional, bilateral y multilateral.
• g)Establecer protocolos internos para llevar a cabo las negociaciones y formalización de tratados o convenios nacionales o internacionales.
• h)Tramitar los informes requeridos por los entes cooperantes nacionales e internacionales, y por cualquier otra dependencia que así lo requiera.
• i)Mantener actualizado el inventario de proyectos en trámite y en ejecución.
• j)Proponer el establecimiento de convenios o similares de interés del INTA con instituciones públicas o privadas nacionales o internacionales k) Solicitar y canalizar las solicitudes de recursos al nivel interno del INTA.
• l)Mantener constante comunicación con los representantes regionales del INTA, para identificar y establecer vínculos de cooperación con organizaciones y empresas.
• m)Promover la asociatividad y el trabajo colaborativo para el desarrollo de proyectos de investigación e innovación.
• n)Representar al INTA ante las diversas instituciones u organizaciones por delegación del Director Ejecutivo o) Cualquier otra que le asigne la Dirección Ejecutiva.

Esta Dirección agrupa la parte técnica de la institución y está conformada por cinco Departamentos: el Departamento de Investigación e Innovación, Departamento de Transferencia de Tecnología, Departamento de Laboratorios, Departamento de Estaciones Experimentales y Departamento de Estudios Básicos de Tierras. A esta Dirección le corresponde brindar apoyo a los investigadores para la generación de tecnología, la transferencia de tecnología, la prestación de servicios de investigación en laboratorios, estaciones experimentales y en la gestión los estudios básicos de la tierra, con el fin de responder eficientemente a las demandas de los usuarios de los servicios. Las funciones de esta Dirección son:

1. De la Dirección de Investigación y Desarrollo Tecnológico. A esta Dirección le corresponde:

• a)Participar activamente en los procesos y actividades de planificación estratégica y operativa del INTA.
• b)Ejercer la jefatura inmediata de los Jefes de Departamento y supervisión del personal de la Dirección a su cargo.
• c)Consolidar, priorizar y dar respuesta a las necesidades de investigación, innovación y transferencia de tecnología que demandan los usuarios en los ámbitos local, regional y nacional.
• d)Coordinar, asesorar y orientar la investigación y la transferencia de tecnología agropecuaria, para cumplir con los objetivos y metas establecidas en las políticas institucionales.
• e)Participar de manera activa en la revisión y supervisión de proyectos de investigación, innovación y transferencia de tecnología.
• f)Mantener estrecha vinculación con el Sistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria (SNITTA), los servicios de información del sector agropecuario, la Dirección Nacional de Extensión Agropecuaria y otros organismos nacionales y externos, dedicados a la generación de ciencia y tecnología.
• g)Formular y elaborar documentos técnicos y administrativos para los jerarcas.
• h)Rendir cuentas a las autoridades superiores.
• i)Cualquier otra que le asigne la Dirección Ejecutiva.

2. Del Departamento de Investigación e Innovación. Este Departamento cuenta con cinco Unidades que son: Unidad de Granos Básicos, Unidad de Hortalizas, Unidad de Raíces y Tubérculos, Unidad de Frutales y Unidad Pecuaria. A este departamento le corresponde:

• a)Identificar y priorizar las necesidades de investigación e innovación de tecnología agropecuaria al nivel local, regional y nacional, de acuerdo con el sistema productivo particular tomando en cuenta la agrocadena.
• b)Formular y ejecutar proyectos de investigación e innovación, utilizando el método científico en el área de su competencia alcanzando los objetivos y metas propuestas en beneficio de los productores.
• c)Validar la tecnología generada de los proyectos de su competencia, que permita valorar su pertinencia técnica y mejorar la efectividad de su adopción por parte de los usuarios.
• d)Asesorar en áreas específicas complementarias de investigación agropecuaria, tales como protección de cultivos, mejoramiento genético, agronomía, bioestadística, socio economía y otras relacionadas.
• e)Participar activamente en los procesos y actividades de planificación estratégica y operativa del INTA.
• f)Coordinar y colaborar con el Departamento de Transferencia de Tecnología, la difusión de las opciones tecnológicas generadas por el INTA.
• g)Desarrollar vínculos con el Sistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria -SNITTA-, los servicios de información del Sector Agropecuario, la Dirección Nacional de Extensión Agropecuaria y otros organismos dedicados a la ciencia y tecnología del Sector Agropecuario y en el nivel científico nacional e internacional.
• h)Formular el consolidado del PAO/ Presupuesto y Plan de compras.
• i)Elaborar informes anuales, semestrales y técnicos.
• j)Coordinar reuniones y sesiones de trabajo con los grupos técnicos integrantes de cada unidad y de otras unidades para la elaboración de proyectos de investigación e innovación.
• k)Redactar artículos científicos u otras publicaciones técnicas a fin de divulgar apropiadamente la labor del INTA en el ámbito nacional e internacional.
• l)Cualquier otra que le asigne la Dirección de Investigación y Desarrollo Tecnológico.

3. Del Departamento de Transferencia de Tecnología. Las funciones de este Departamento son:

• a)Recopilar, caracterizar y sistematizar las opciones tecnológicas verificadas y/o validadas para transferirlas a los diferentes usuarios.
• b)Alimentar y actualizar permanentemente las plataformas técnicas institucionales de información tecnológica.
• c)Diseñar, coordinar, organizar y ejecutar eventos de capacitación y difusión de la información tecnológica a través de los diferentes servicios de extensión estatales y privados.
• d)Solicitar, centralizar y canalizar solicitudes de recursos al nivel interno del INTA.
• e)Diseñar y aplicar las metodologías, mecanismos y herramientas de gestión de conocimiento, información, comunicación y transferencia de acuerdo con los diferentes usuarios y tipologías de producción.
• f)Promover, auspiciar y difundir la publicación de documentos técnicos.
• g)Mantener estrecha coordinación con el Sistema Nacional de Investigación y Transferencia de Tecnología Agropecuaria SNITTA-, los servicios de información del Sector Agropecuario y el servicio de extensión del Estado.
• h)Promover alianzas con organizaciones de productores, instituciones públicas y privadas de carácter nacional e internacional, en materia de su competencia.
• i)Cualquier otra que le asigne la Jefatura de la Dirección.

4. Del Departamento de Laboratorios. A este departamento le corresponde la implementación de metodologías, el análisis de muestras, emisión de diagnósticos, la multiplicación in vitro de germoplasma y ejecución de estudios específicos que complementen las líneas de investigación, innovación y validación de la Dirección de Investigación y Desarrollo Tecnológico por lo que contará con personal multidisciplinario, profesionales y técnicos formados en los diferentes campos de acción que aseguren su competencia.

El Departamento estará conformado por áreas laboratoriales que le permitan ejecutar las siguientes funciones:

• a)Desarrollar los procedimientos e implementar metodologías para análisis y diagnósticos en fitoprotección, nutrición animal, química y física de suelos, plantas y aguas, características química y microbiológica de insumos agrícolas y abonos orgánicos, entre otros requeridos en la institución que soporten el respaldo científico de las investigaciones.
• b)Acompañar el mejoramiento genético asistido por marcadores moleculares.
• c)Desarrollar e implementar técnicas de reproducción masiva de germoplasma de interés.
• d)Apoyar el desarrollo y ejecución de propuestas de investigación según los lineamientos institucionales.
• e)Desarrollar y actualizar los procedimientos y actividades técnicas y administrativas del Departamento.
• f)Brindar servicios a usuarios en el área de su competencia según las tarifas autorizadas por la Junta Directiva.
• g)Coordinar con el Departamento de Transferencia de Tecnología la capacitación a funcionarios y Usuarios en materias de su competencia.
• h)Coordinar con otras dependencias internas o externas a fin de ejecutar actividades especiales requeridas en el sector agropecuario, de acuerdo con las competencias y capacidades del Departamento.
• i)Desarrollar otras funciones que le asigne el superior jerárquico.

5. Del Departamento de Estaciones Experimentales. Este Departamento se encuentra sub dividido en cuatro estaciones, Estación Experimental Enrique Jiménez Núñez (Región Chorotega), Estación Experimental Los Diamantes (Región Caribe), Estación Experimental Carlos Durán (Región Central Oriental), Estación unidad, las cuales se diferencian por su especificidad en el abordaje de temas y cultivos con base a su ubicación geográfica (regiones agro climáticas), las cuales apoyarán la investigación, innovación y validación que desarrolle la Dirección de Investigación y Desarrollo Tecnológico. A este departamento le corresponde:

• a)Brindar servicios al sector agropecuario de acuerdo a sus necesidades colocando productos de alta calidad e importancia para el sector.
• b)Contribuir al mejoramiento y la sostenibilidad del sector agropecuario, por medio de la generación, innovación, validación, investigación y difusión de tecnología, en beneficio de la sociedad costarricense.
• c)Coordinar con el Departamento de Transferencia de Tecnología la capacitación a funcionarios y usuarios en materias de su competencia.
• d)Apoyar la investigación, innovación y validación que lideran funcionarios de la Dirección de Investigación y Desarrollo Tecnológico.
• e)Conservar las colecciones de germoplasma para abastecer de material genético de calidad a la investigación y la producción nacional.
• f)Articular el desarrollo de proyectos de investigación, innovación, validación, transferencia y producción que realiza el INTA.
• g)Atender las necesidades de información, asesoría, servicios y productos tecnológicos agropecuarias de los técnicos y productores.
• h)Captar las necesidades de investigación, innovación y transferencia de tecnología para el análisis integral de la demanda en el INTA y la elaboración del Plan Anual Táctico y Anual Operativo de cada estación, para atender con información, capacitación, servicios y productos a la investigación y producción.
• i)Establecer Centros de Información y de capacitación a profesionales, técnicos y agricultores en las diferentes zonas agroecológicas, en coordinación con el Departamento de Transferencia de Tecnología.
• j)Desarrollar proyectos de acuerdo a necesidades de la región mediante iniciativa Institucional o en coordinación con otras Instituciones o instancias del área de influencia o el país.
• k)Realizar las gestiones pertinentes para la operación de cada uno de los rubros, proyectos o programas desarrollados en cada unidad, a fin de velar por la respectiva fiscalización y uso eficiente de los recursos.
• l)Realizar ventas de servicios de investigación agropecuaria de conformidad con lo estipulado siempre y cuando, no menoscabe la atención de las demandas de investigaciones de interés social.

m)Velar por el cuido y resguardo de los semovientes y cultivos que se encuentran en sus Estaciones Experimentales, así como su venta cuando proceda, de conformidad con Reglamento Interno para la Venta de Servicios y Bienes accesorios y las tarifas aprobadas por la Junta Directiva del INTA.

• n)Cualquier otra que le sea asignada por la Jefatura Inmediata.

6. Del Departamento de Estudios Básicos de Tierras. Con sustento en lo estipulado en el Artículo 20 de la ley N°8149, este Departamento coadyuvará en la realización de estudios relativos al uso conforme del suelo, clasificación y zonificación agroecológica de los cultivos, así como la planificación y ordenamiento territorial con una participación en la elaboración y ejecución de los planes nacionales de manejo, conservación y recuperación de suelos, como lo establece la ley para el Uso, Manejo y Conservación de Suelos número 7779 y su Reglamento, de igual manera colaborará con la Dirección de Investigación y Desarrollo Tecnológico, en las investigaciones e innovaciones que se desarrollen.

A este departamento le corresponde:

• a)Realizar las investigaciones y estudios relativos a lo autorizado en los Artículos 6 incisos a), b) y c), 27, 49 y 66 de la Ley N°7779 y de los decretos ejecutivos N°29375-MAG-MINAE-S-H-MOPT y N°30636-MAG, en materia de uso conforme del suelo, emisión de criterio técnico para autorizaciones y permisos.
• b)Vender servicios a usuarios en el área de su competencia según las tarifas autorizadas por la Junta Directiva.
• c)Realizar levantamientos semidetallados de suelos y capacidad de uso de las tierras agroecológicas del país, así como la zonificación agroecológica de los cultivos, en el marco de la planificación y ordenamiento territorial, apoyando la ejecución de los Planes Nacionales de manejo, conservación y recuperación de suelos.
• d)Colaborar con la Dirección de Investigación y Desarrollo Tecnológico del INTA, en las investigaciones e innovaciones que se desarrollen.
• e)Solicitar, centralizar y canalizar las solicitudes de recursos al nivel interno del INTA.
• f)Mantener las bases de datos actualizadas y disponibles para los usuarios en materia de suelos, tierras y aguas correspondiente a la información generada por el INTA.
• g)Participar en los estudios de zonificación agropecuaria en el ámbito nacional, regional o local, para contribuir a orientar la producción en forma eficiente.
• h)Mantener actualizado el sistema de información geográfico para facilitar el ordenamiento territorial en el mediano y largo plazos.
• i)Cualquier otra que le asigne la Jefatura de la Dirección.

Le corresponde coordinar y tomar decisiones en temas administrativos propios del INTA, así como ser el enlace con otras instituciones y entidades para la planeación y ejecución de presupuesto, gestión de recursos, aprovisionamiento de bienes y servicios, comunicación, planeación y desarrollo de programas y proyectos.

Esta Dirección contará con tres Unidades Administrativas: el Departamento de Proveeduría, el Departamento de Servicios Generales y el Departamento de Administración de Recursos. A esta Dirección le corresponden las siguientes funciones:

• a)Planear, coordinar y supervisar las funciones administrativas de apoyo, necesarias para alcanzar el adecuado funcionamiento técnico, administrativo y financiero del INTA.
• b)Elaborar y tramitar en coordinación con el resto de dependencias del INTA los presupuestos ordinarios y extraordinarios; así como los informes de ejecución correspondientes.
• c)Elaborar en coordinación con los Departamentos competentes los estudios y propuestas para la actualización y ajuste de tarifas por pago de productos y servicios del INTA, las cuales deben ser aprobadas por la Junta Directiva.
• d)Proponer a la Dirección Ejecutiva los proyectos de reglamentos, manuales, procedimientos e instructivos necesarios para la gestión administrativa y financiera del INTA.
• e)Rendir cuentas a las autoridades superiores del INTA.
• f)Administrar los recursos físicos y financieros del INTA.
• g)Velar porque el INTA mantenga una adecuada posición financiera.
• h)Cualquier otra que le asigne la Dirección Ejecutiva.

2. Del Departamento de Proveeduría. Su funcionamiento se encuentra amparado en la Ley de Contratación Administrativa Número 7494 y su Reglamento; es el Departamento competente para tramitar los procedimientos de contratación administrativa que interesen al Instituto, así como para realizar los procesos de almacenamiento y distribución o tráfico de bienes y llevar un inventario permanente de todos sus bienes. Funcionará y se organizará de conformidad con lo señalado en el Reglamento para el Funcionamiento de las Proveedurías Institucionales de los Ministerios del Gobierno Número 30640-H y el Reglamento para el registro y control de bienes de la administración central y reforma Reglamento a la Ley de la Administración Financiera de la República y Presupuestos Públicos Número 40797-H, así como demás normativa atinente.

3. Del Departamento de Servicios Generales. A este Departamento le corresponden las siguientes funciones:

• a)Elaborar y gestionar la aprobación y aplicación de los manuales de procedimientos de los procesos a su cargo.
• b)Planear, dirigir, coordinar y supervisar las actividades técnicas y administrativas relacionadas con la prestación de servicios de transporte.
• c)Diseñar e implementar los procesos administrativos requeridos para el buen accionar del Instituto.
• d)Establecer y ejecutar planes de mantenimiento, generales y preventivos para el equipo, los bienes muebles e inmuebles.
• e)Cualquier otra que le asigne su Jefatura inmediata.

4. Del Departamento de Administración de Recursos. A este Departamento le corresponden las siguientes funciones:

• a)Elaborar y gestionar las aprobaciones correspondientes de los reglamentos, manuales de procedimientos e instructivos que, en materia administrativa, financiera, presupuestal y contable sean necesarios.
• b)Elaborar y aplicar los reglamentos y manuales necesarios para regular la relación de servicios entre el INTA y sus funcionarios, para propiciar un ambiente sano de trabajo y alcanzar la optimización del recurso humano.
• c)Elaborar los registros de contabilidad y presupuesto y elaborar los estados e informes correspondientes de acuerdo con las normas y técnicas aceptadas en cuanto a PAO-Presupuesto.
• d)Realizar el control y la custodia de los recursos financieros y de bienes muebles e inmuebles.
• e)Coordinar la formulación del presupuesto con la Dependencia de Planificación Institucional y demás Direcciones del INTA.
• f)Tramitar y negociar ante quien corresponda los presupuestos necesarios para el buen accionar del INTA.
• g)Cualquier otra que le asigne la Jefatura de la Dirección Administrativa Financiera.
