The municipalities and the municipal district councils shall calculate three percent (3%) of the free budget surplus (superávit presupuestario libre), provided for in the preceding article, based on the budget liquidation (liquidación presupuestaria) as of June 30 of the current year, having concluded the effectively acquired commitments from the previous period in accordance with what is permitted by Article 116 of Law 7794, Municipal Code, of 30 April 1998.
These resources shall be executed by each municipal entity and shall be allocated, exclusively, to the strengthening of technical capacity and municipal processes in risk management, to the prevention and attention of emergencies, including those not covered by an emergency decree. The municipalities shall create their own fund for these same purposes and the resources of this fund shall be governed by the principles of multi-year budgeting (presupuestación plurianual) and therefore what they do not execute at the end of each fiscal year shall not constitute a surplus.
No later than the month of February, each municipality and municipal district council shall certify to the Commission the execution of the amount corresponding to three percent (3%) during the previous year and compliance with the cited purposes.
**SOLE TRANSITORY PROVISION-** With the entry into force of this law, all pending tax debts, as well as the accrued interest, owed by all municipalities and municipal district councils for the application of Article 46 of Law 8488, National Emergency and Risk Prevention Law, of 22 November 2005, are hereby forgiven.
It shall take effect from its publication.
