in the entirety of the text - Full Text of Norm 41985 Declaration of public utility of the Rural Sanitary Water and Sewer Association Calle Valverde San Juan Sur Full Text of record: 132D65 No. 41985-MJP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Associations Law No. 218 of August 8, 1939 and articles 27 and following of the Regulations to the Associations Law No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, as well as the provisions of article 3, subsection ch) of the Income Tax Law No. 7092 and articles 103 and 104 of the Code of Tax Rules and Procedures No. 4755.
I.-Article 32 of the Associations Law No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.-The Rural Sanitary Water and Sewer Association Calle Valverde San Juan Sur, legal entity identification number 3-002-204325, was registered in the Associations Registry of the National Registry as of June 20, 1997, file 8728, volume 439, entry 3603.
III.-The purposes of the Association, according to its bylaws, are: "a) To construct a water system (acueducto) and sewer system (alcantarillado) in Calle Valverde. b) To administer, operate and maintain in good condition the water system (acueducto), in accordance with the provisions and Regulations issued by AyA on the matter. c) To obtain the effective participation of the community, in the construction and maintenance of the water system (acueducto). d) Collaboration in educational programs and campaigns that are undertaken. e) To help explain and disseminate in the community the provisions and Regulations of AyA. f) To cooperate with the plans, projects and works undertaken by AyA in the community. g) To participate in the surveillance and protection of the supply sources of the water system (acueducto), to prevent their contamination and to help protect the hydrographic basins of the region".
IV.-Such purposes solve a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore, They decree:

I.-El artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-La Asociación de Acueducto y Alcantarillado Sanitario Rural Calle Valverde San Juan Sur, cédula de persona jurídica número 3-002-204325, se inscribió en el Registro de Asociaciones del Registro Nacional desde el día 20 de junio de 1997, expediente 8728, tomo 439, asiento 3603.
III.-Los fines de la Asociación, según sus estatutos, son: "a) Construir un acueducto y alcantarillado en Calle Valverde. b) Administrar, operar y conservar en buenas condiciones el acueducto, de acuerdo con las disposiciones y Reglamentos que al respecto emita AyA. c) Obtener la participación efectiva de la comunidad, en la construcción y mantenimiento del acueducto. d) Colaboración en los programas y campañas de índole educativas que se emprendan. e) Ayudar a explicar y divulgar en la comunidad las disposiciones y Reglamentos de AyA. f) Cooperar con los planes, proyectos y obras que emprenda AyA en la comunidad. g) Participar en la vigilancia y protección de las fuentes de abastecimiento del acueducto, evitar las contaminaciones de las mismas y ayudar a la protección de las cuencas hidrográficas de la región".
IV.-Tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado costarricense. Por tanto,
