in the entirety of the text - Full Text of Norm 41979 Declaration of public utility of the Rural Aqueduct Association of Residents of Tárcoles Full Text of record: 17808F N° 41979-MJP (This executive decree was rendered without effect by article 1 of executive decree N° 45126 of June 23, 2025) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations N° 218 of August 8, 1939, and articles 27 and following of the Regulation to the Law of Associations N° 29496-J, published in La Gaceta N° 96 of May 21, 2001, as well as the provisions of article 3, subsection ch) of the Income Tax Law N° 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures N° 4755.
I.-Article 32 of the Law of Associations N° 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State and that thereby contribute to meeting a social need.
II.-The Rural Aqueduct Association of Residents of Tárcoles (Asociación Acueducto Rural de Vecinos de Tárcoles), legal entity identification number N° 3-002-247752, was registered in the Associations Registry of the Public Registry on July 22, 1999, volume 463, entry 13437.
III.-The purposes pursued by the Association, according to its bylaws, are: "[...] a. To build the aqueduct of Tárcoles de Puntarenas; b. To administer, operate, and maintain in good condition the aqueduct in accordance with the provisions and regulations issued in this regard by the Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), hereinafter AyA; c. To obtain the effective participation of the community in the construction and maintenance of the aqueduct; d. Collaboration in educational programs and campaigns that they undertake; e. I.-El artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado y que por ello contribuyan a solventar una necesidad social.
II.-La Asociación Acueducto Rural de Vecinos de Tárcoles, cédula de persona jurídica N° 3-002-247752, se inscribió en el Registro de Asociaciones del Registro Público desde el día 22 de julio del 1999, tomo 463, asiento 13437.
III.-Los fines que persigue la Asociación, según sus estatutos, son: "[...] a. Construir el acueducto de Tárcoles de Puntarenas; b. Administrar, operar y conservar en buenas condiciones el acueducto de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto Costarricense de Acueductos y Alcantarillados en adelante AyA; c. Obtener la participación efectiva de la comunidad, en la construcción y mantenimiento del acueducto; d Colaboración en los programas y campañas de índole educativa que emprendan; e.
