1. 1That by means of Executive Decree No. 37305-MP, of September 24, 2012; published in Alcance No. 141 to La Gaceta No. 187 of September 27, 2012, a State of Emergency was declared, as a result of the conditions and damages caused by the strong earthquake felt on September 5, 2012, at eight forty-two in the morning, in the cantons of: Abangares, Liberia, Carrillo, Santa Cruz, Nicoya, Hojancha, Nandayure, Tilarán, Bagaces and Cañas, of the province of Guanacaste; central canton of Puntarenas and Montes de Oro, of the province of Puntarenas; Naranjo, Valverde Vega, Atenas, San Ramón, Grecia and Alfaro Ruiz, of the province of Alajuela and Sarapiquí of the Province of Heredia.
2. 2That by means of official letter DESGR-OF-0529-2018, dated September 21, 2018, the Strategic Development Unit of the National Risk Management System of the National Commission for Risk Prevention and Emergency Response (Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, CNE), submitted the follow-up report for the General Emergency Plan, under Decree No. 37305-MP, which for its preparation, considered the account of the actions and works developed with resources from the National Emergency Fund (Fondo Nacional de Emergencias, FNE), through the executing units appointed by the Board of Directors of the CNE, under the exceptional framework and the contents of the General Emergency Plan (Plan General de Emergencia, PGE).
3. 3That the General Emergency Plan has a legal validity of 5 years. Therefore, on September 27, 2017, the deadline established from the issuance of the executive decree expired, meaning that the report issued by the Strategic Development Unit of the National Risk Management System of the CNE, corresponds to the closure report for the Plan.
4. 4That by means of Ordinary Session of the Board of Directors of the National Commission for Risk Prevention and Emergency Response (CNE) No. 01-01-19, held on January 16, 2019, through Agreement No. 004-01-19, the Closure of Decree No. 37305-MP "Sámara Earthquake"; of September 5, 2012, was determined. The foregoing, because the circumstances that led to the declaration of a State of Emergency by the Executive Branch concluded, and the attention to the three phases of the emergency set forth in the General Emergency Plan of said decree was fulfilled. Therefore,

DECLARATION OF THE CESSATION OF THE STATE OF EMERGENCY DECLARED THROUGH EXECUTIVE DECREE NO. 37305-MP, OF SEPTEMBER 24, 2012

Considering:

1. 1Que mediante Decreto Ejecutivo Nº 37305 -MP, del 24 de setiembre de 2012; publicado en el Alcance Nº 141 a La Gaceta Nº 187 del 27 de setiembre de 2012, se declaró Estado de Emergencia, producto de condiciones y daños provocados por el fuerte sismo sentido el día 5 de setiembre del 2012, a las ocho horas con cuarenta y dos minutos de la mañana, en los cantones de: Abangares, Liberia, Carrillo, Santa Cruz, Nicoya, Hojancha, Nandayure, Tilarán, Sagaces y Cañas, de la provincia de Guanacaste; cantón central de Puntarenas y Montes de Oro, de la provincia de Puntarenas; Naranjo, Valverde Vega, Atenas, San Ramón, Grecia y Alfara Ruiz, de la provincia de Alajuela y Sarapiquí de la Provincia de Heredia.
2. 2Que mediante oficio DESGR-OF-0529-2018, de fecha 21 de setiembre del año 2018, la Unidad de Desarrollo Estratégico del Sistema Nacional de Gestión del Riesgo de la Comisión Nacional de Prevención y atención de Emergencias (CNE), presenta el informe de seguimiento al Plan General de la Emergencia, bajo Decreto Nº 37305-MP, el cual para efectos de su elaboración, consideró el recuento de las acciones y obras desarrolladas con recursos del Fondo Nacional de Emergencia (FNE), por medio de las unidades ejecutoras nombradas por la Junta Directiva de la CNE, al amparo del marco de excepción y los contenidos del Plan General de Emergencia (PGE).
3. 3Que el Plan General de la Emergencia tiene una vigencia por Ley de 5 años. Por tanto, el 27 de setiembre del 2017, venció el plazo establecido a partir de la emisión del decreto ejecutivo, esto quiere decir que el informe emitido por la Unidad de Desarrollo Estratégico del Sistema Nacional de Gestión del Riesgo de la CNE, corresponde al informe de cierre del Plan.
4. 4Que mediante Sesión Ordinaria de la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias Nº 01-01-19, celebrada el día 16 de enero de 2019, mediante Acuerdo Nº 004-01-19, se determinó el Cierre del Decreto Nº 37305-MP "Terremoto de Sámara"; del 05 de setiembre de 2012. Lo anterior, debido a que las circunstancias que condujeron a declarar Estado de Emergencia por parte del Poder Ejecutivo, concluyeron y se cumplió con la atención de las tres fases de la emergencia consignadas en el Plan General de la Emergencia de dicho decreto. Por tanto,
