ADDITION OF ARTICLE 42 BIS, OF A SUBSECTION D) TO ARTICLE 50 AND OF TRANSITORY PROVISIONS XIII, XIV, AND XV TO LAW NO. 8839, LAW FOR INTEGRATED WASTE MANAGEMENT, OF 24 JUNE 2010, LAW FOR THE PROHIBITION OF EXPANDED POLYSTYRENE SOLE ARTICLE- A new article 42 bis, a new subsection d) to article 50, and transitory provisions XIII, XIV, and XV are added to Law No. 8839, Law for Integrated Waste Management, of 24 June 2010. The following are exempted from this prohibition:
Notwithstanding the foregoing, the Executive Branch, through the regulation of this law, may define new cases of exception, based on technical criteria.
The following shall be considered minor infractions, without prejudice to whether they constitute a crime:

Within the twenty-four months mentioned in this article, the State shall promote and incentivize the productive reconversion of industries engaged in the importation and manufacture of receptacles, containers, or packaging made from expanded polystyrene, fostering the development of more environmentally friendly productive alternatives. For these purposes, such industries shall have the possibility of accessing credit for their development, in accordance with the provisions of article 7 of Law No. 8634, Development Banking System, of 23 April 2008, and state commercial banks, in accordance with the provisions of Law No. 1644, Organic Law of the National Banking System, of 26 September 1953.
Said plan must include a component of awareness-raising in industries, businesses, and the general population about the need to make this change, as well as establishing incentives and informing and educating consumers about the impact of products made from expanded polystyrene on the environment and the various available alternatives, this as part of its obligations, pursuant to subsection g) of article 7 of Law No. 8839, Law for Integrated Waste Management, of 24 June 2010.
It shall be effective upon its publication.

ADICIÓN DEL ARTÍCULO 42 BIS, DE UN INCISO D) AL ARTÍCULO 50 Y DE LOS TRANSITORIOS XIII, XIV Y XV A LA LEY N. º 8839, LEY PARA LA GESTIÓN INTEGRAL DE RESIDUOS, DE 24 DE JUNIO DE 2010, LEY PARA LA PROHIBICIÓN DEL POLIESTIRENO EXPANDIDO ARTÍCULO ÚNICO- Se adicionan un nuevo artículo 42 bis, un nuevo inciso d) al artículo 50 y los transitorios XIII, XIV y XV a la Ley N. º 8839, Ley para la Gestión Integral de Residuos, de 24 de junio de 201 O. Los textos son los siguientes:
DECRETA:
Se exceptúan de esta prohibición:
Sin perjuicio de lo anterior, el Poder Ejecutivo, mediante el reglamento de la presente ley, podrá definir nuevos casos de excepción, con base en criterios técnicos.
Se considerarán infracciones leves, sin perjuicio de que constituya delito, las siguientes:

Dentro de los veinticuatro meses mencionados en el presente artículo, el Estado promoverá e incentivará la reconversión productiva de las industrias dedicadas a la importación y fabricación de recipientes, envases o empaques elaborados con poliestireno expandido, fomentando el desarrollo de alternativas productivas más amigables con el ambiente. Para estos fines, dichas industrias tendrán la posibilidad de acceder al crédito para su desarrollo, de conformidad con lo establecido en el artículo 7 de la Ley N. º 8634, Sistema de Banca para el Desarrollo, de 23 de abril de 2008 y la banca comercial estatal, de conformidad con lo dispuesto en la Ley N.º 1644, Ley Orgánica del Sistema Bancario Nacional, de 26 de setiembre de 1953.
Dicho plan deberá incluir un componente de concienciación en industrias, comercios y población en general, sobre la necesidad de dar este cambio, así como establecer incentivos e informar y educar a las personas consumidoras acerca del impacto de los productos elaborados a base de poliestireno expandido sobre el ambiente y las diversas alternativas disponibles, esto como parte de sus obligaciones, según el inciso g)del artículo 7 de la Ley N. º 8839, Ley de Gestión Integral de Residuos, de 24 de junio de 2010.
