in the entirety of the text - Complete Text of Regulation 40710 Operational Regulations of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning (SEPLASA) No. 40710 MP--MINAE-PLAN THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF THE PRESIDENCY, THE MINISTER OF ENVIRONMENT AND ENERGY, AND THE MINISTER OF NATIONAL PLANNING AND ECONOMIC POLICY In use of the powers conferred in articles 140 subsections 3), 8), 18), and 20) and 146 of the Political Constitution, 25.1 and 27.1 of the General Law of Public Administration, No. 6227 of May 2, 1978, 4 of the Law of the Financial Administration of the Republic and Public Budgets, No. 8131 of September 18, 2001, 77, 78, 79, and 81 of the Organic Law of the Environment, No. 7554 of October 4, 1995, Chapters I, II, IV, and VI of the National Planning Law, No. 5525 of May 2, 1974, the General Regulations of the National Planning System, Executive Decree No. 37735-PLAN of May 6, 2013, the Regulations for Article 11 of the National Planning Law, Executive Decree No. 35056-PLAN-RE of November 12, 2008, Executive Decree 37658-MINAET of January 29, 2013, regarding the Creation of the National Environmental Information System (SINIA), and articles 2, 3, 4, 5, 6, 10, 11, 12, and 15 of the Organic Regulations of the Executive Branch, Executive Decree No. 38536-MP-PLAN of July 25, 2014, and Executive Decree No. 35669, Organic Regulations of the Ministry of Environment and Energy, of December 4, 2009.

1. That article 140 subsection 8) of the Political Constitution, with the aim of achieving unity of the State's administrative action, establishes the principle of State coordination in its duty to monitor the proper functioning of public services and administrative dependencies as attributions and duties of the respective competent Minister and of the President of the Republic.

2. That the National Planning Law establishes that the bodies of the National Planning System (SNP) shall collaborate in the preparation of the National Development and Public Investment Plan (Plan Nacional de Desarrollo y de Inversión Pública, PNDIP)(*) under the guidelines that the Ministry of National Planning and Economic Policy issues.

That the General Regulations of the National Planning System aims to regulate the constitution, organization, functions, and relationships of the National Planning System, as an articulated set of public institutions, subsystems, and regulations, under the political direction of the President of the Republic and the technical stewardship of the Ministry of National Planning and Economic Policy, MIDEPLAN, to define binding actions that enhance the country's development, with citizen participation.

4. That the Organic Regulations of the Executive Branch establishes the sectoral organization of the Executive Branch, understood as a grouping of centralized and decentralized public institutions with related and complementary actions in areas of public endeavor, governed by the designated Rector Minister, established with the aim of providing a greater degree of coordination, efficacy, and efficiency in Public Administration. administrative as attributions and duties of the respective competent Minister and of the President of the Republic.

5. That according to said Organic Regulations, one of the aforementioned sectors is the Environment, Energy, Seas, and Land-Use Planning Sector, which is under the stewardship of the Minister of Environment and Energy. Stewardship being understood as the authority held by the President of the Republic together with the line Minister to coordinate, articulate, and conduct the activities of each sector and ensure that these are fulfilled in accordance with the orientations of the National Development and Public Investment Plan (Plan Nacional de Desarrollo y de Inversión Pública, PNDIP)(*).

That among the responsibilities granted to the Rector Minister, according to the decree cited above, it corresponds to direct and coordinate the respective sector in order to build the National Sectoral Plan, the policies, plans, programs, projects, and studies related to their sector linked to the National Development and Public Investment Plan (Plan Nacional de Desarrollo y de Inversión Pública, PNDIP)(*).

That as consultative and coordination bodies for the Rector Minister, the National Sectoral Councils are created in order to coordinate the plans, programs, and goals that each sector is responsible for executing according to governmental policies and the National Development Plan (PND).

8. That the Sectoral Council for Environment, Energy, Seas, and Land-Use Planning is composed of the Ministry of Environment and Energy (MINAE), the Ministry of Housing and Human Settlements (MIVAH), the Ministry of Agriculture and Livestock (MAG), the Ministry of Public Works and Transport (MOPT), the Costa Rican Tourism Institute (ICT), the Costa Rican Electricity Institute (ICE), the Costa Rican Institute of Aqueducts and Sewers (AyA), the National Institute of Housing and Urbanism (INVU), the Rural Development Institute (INDER), the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), the Costa Rican Petroleum Refinery S.A. (RECOPE), the National Commission for Risk Prevention and Emergency Response (CNE), and the National Coast Guard Service of the Public Force of the Ministry of Public Security and the National Service of Groundwater, Irrigation, and Drainage (SENARA).

9. That each of the National Sectoral Councils shall have a Sectoral Planning Secretariat as a support and advisory body on planning for the Rector Minister, with the functions of supporting the processes of coordination, programming, execution, monitoring, and evaluation of the policies, plans, programs, and projects of the Sector. National Sectoral, the policies, plans, programs, projects, and studies related to their sector linked to the National Development Plan (PND).

10. That the directive relationship on the part of the Minister of Environment and Energy in their capacity as Rector Minister is to order activity within a relationship of trust incompatible with orders, instructions, or circulars.

11. That in order to put into operation the organizational structure of the Environment, Energy, Seas, and Land-Use Planning Sector, it is necessary to regulate its operation. Therefore, the Ministry of National Planning and Economic Policy approved on March 8, 2017, through official communication DM-131-17, the creation of the Sectoral Planning Secretariat for Environment (SEPLASA) as an advisory unit hierarchically dependent on the Ministerial Office, being a support unit for the Minister in their capacity as Rector Minister of the Environment, Energy, Seas, and Land-Use Planning Sector, according to the "General Guidelines for Administrative Reorganizations" (LGRA).

Therefore; THEY DECREE:

"Operational Regulations of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning (SEPLASA)"

Planning Sector

Considering:

Chapter I: On Organization

Section I: On the Stewardship of the Environment, Energy, Seas, and Land-Use

All institutions of the Sector, to the extent of their possibilities, shall contribute to the full compliance with the functions and responsibilities of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning, including contributions in human, operational, and financial resources.

38536-MP-PLAN of July 25, 2014, shall be the establishment of environmental policy and the approval of the policies, the plans, projects, and programs, and the endorsement of international cooperation projects of the institutions of the Environment, Energy, Seas, and Land-Use Planning Sector, as well as their coordination and evaluation with the obligatory coordination and participation of the other institutions that make up the sector.

Section II: On the Subsectors

a. Water Subsector: The Ministry of Environment and Energy (MINAE), Ministry of Health (MINSA), the Costa Rican Institute of Aqueducts and Sewers (AyA), the National Service of Groundwater, Irrigation, and Drainage (SENARA), and the Costa Rican Electricity Institute (ICE).

b. Seas Subsector: The Ministry of Environment and Energy (MINAE), the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), and the National Coast Guard Service of the Public Force of the Ministry of Public Security.

c. Energy Subsector: Shall be constituted and governed by what is established in the Organizational Regulations of the Energy Sub-Sector, Executive Decree No. 35991-MINAET of January 19, 2010, and its amendments.

d. Environment Subsector: The Ministry of Environment and Energy (MINAE), the Ministry of Housing and Human Settlements (MIVAH), the Ministry of Agriculture and Livestock (MAG), the Costa Rican Tourism Institute (ICT), the National Institute of Housing and Urbanism (INVU), the National Commission for Prevention of Risks and Emergency Response (CNE).

e. Environmental Quality Subsector: The Ministry of Environment and Energy (MINAE), the Ministry of Agriculture and Livestock (MAG), the Ministry of Public Works and Transport (MOPT), the Ministry of Health (MINSA), and the National Commission for Prevention of Risks and Emergency Response (CNE).

f. Soils and Subsoils Subsector: The Ministry of Environment and Energy (MINAE) and the Ministry of Agriculture and Livestock (MAG), and the Rural Development Institute (INDER).

And their functions are the following:

a. Collection and analysis of information for the planning, execution, and evaluation of the plans and programs proposed by the sector. Environmental Quality Subsector: The Ministry of Environment and Energy (MINAE), the Ministry of Agriculture and Livestock (MAG), the Ministry of Public Works and Transport (MOPT), the Minister of Health (MINSA), and the National Commission for Prevention of Risks and Emergency Response (CNE).

b. Act as a sectoral technical liaison for the planning and monitoring of the execution and evaluation of the sectoral strategic goals and objectives of the PND.

c. Preparation of technical reports requested by the Executive Director.

d. Advise and support the Regional Councils established in Decree No. 38536 Organic Regulations of the Executive Branch in the strategic programming, monitoring, and evaluation of sectoral actions at the regional level.

Seas, and Land-Use Planning Sector

Chapter II: On the Instances of Coordination of the Rector of the Environment, Energy,

Section I: On the instances of coordination

a. National Sectoral Council for Environment, Energy, Seas, and Land-Use Planning.

b. The Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

a. To understand and guide the sectoral policy, the sectoral investment programs and projects, and international cooperation executed by the institutions of the sector.

(Thus amended the previous subsection by article 2 of executive decree No. 41135 of April 9, 2018) b. To formulate and execute sectoral and regional goals within the PND.

c. To consider and assess, for decision-making, the information generated by the National Center for Geo-Environmental Information (CENIGA).

Land-Use Planning

Section III: On the Sectoral Planning Secretariat for Environment, Energy, Seas, and

The Energy Subsector Planning Secretariat, established in Executive Decree 35991-MINAET and its amendments, shall form part of SEPLASA, and any other Subsectoral Secretariat created in the future. For administrative purposes, it shall function as an advisory unit hierarchically dependent on the Ministerial Office.

a. To advise, prepare, and evaluate the plans, programs, projects, and proposals in accordance with the National Planning Law and other related legal provisions.

b. To conduct, in an integrated and participatory manner, the formulation process of the National Development Plan, as well as other sectoral policies required to give coherence and consistency to the goals, their monitoring, and evaluation.

c. To provide the planning, evaluation, and monitoring inputs of the Sector in order to provide elements to the Rector Minister for an efficient and effective implementation of public policies.

d. To advise and support the Rector Minister and the National Sectoral Council for Environment, Energy, Seas, and Land-Use Planning in the coordination, programming, monitoring, and evaluation processes of the policies and programs of the PND and other medium and long-term public policy instruments linked to the sector, in accordance with the guidelines contained in the political reference framework established by the Minister of Environment themselves, with the National Planning Law and other related legal provisions.

a. An Executive Director who shall hold a confidential, appointed, and freely removable position by the Rector Minister, who at least meets the following requirements: a bachelor's degree and duly registered with the professional association, 5 years of experience in public service and in environmental matters and planning processes.

b. An Administrative Sectoral Coordinator: with a minimum of a bachelor's degree relevant to the position, appointed by the Executive Director of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

c. A Sectoral International Cooperation Coordinator with a minimum of a bachelor's degree relevant to the position, appointed by the Executive Director of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

d. A Sectoral Climate Change Coordinator with a minimum of a bachelor's degree relevant to the position, appointed by the Executive Director of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

e. A Sectoral Land-Use Planning Coordinator with a minimum of a bachelor's degree relevant to the position, appointed by the Executive Director of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

f. A Sectoral Technical Committee. Composed of the Executive Director of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning, who shall preside over it, and by the heads or responsible persons of the planning units of the institutions that make up the Sector.

The Executive Director shall also have the following functions:

a. To advise and support the Rector Minister and the institutional heads in the direction of the Sector's development.

b. To act as Secretary of the Sectoral Council and participate in sessions with a right to voice, as well as to follow up on the agreements reached.

c. To organize the control and monitoring of the PND, through the subsectoral and transversal coordinators and the strategic coordination of the Sector and its bodies.

d. To coordinate the execution and monitoring of sectoral plans and programs linked to the PND, in support of sectoral policies.

e. To coordinate the evaluations of the Sector and the corresponding actions for continuous improvement. To act as Secretary of the Sectoral Council and participate in sessions with a right to voice, as well as to follow up on the agreements reached.

f. To propose to the Rector Minister the appointment of regular and temporary technical and administrative personnel of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

g. To establish technical and coordination relationships with programs and projects of a sectoral and intersectoral nature.

h. To preside over the Sectoral Technical Committee.

i. To prepare, review, and evaluate the Plan-Budget of the Secretariat.

j. At the request of the Rector Minister, to represent them in commissions and events of a sectoral, intersectoral, and international nature.

k. To present to the Rector Minister periodic reports on the fulfillment of the sectoral policy and the annual report.

Moreover, they shall have the following functions:

a. To systematize, with the subsectoral coordinators, the information of each subsector.

b. To advise the Rector Minister and the heads of each institution that makes up the sector on their specific topics.

c. To provide support to the Executive Director.

d. To prepare reports at the request of the Executive Director.

e. To prepare the planning of the transversal area.

f. To follow up on the rulings of the Office of the Comptroller General of the Republic with respect to the provisions it issues to the Sector and the Rector Minister on topics of land-use planning and climate change.

g. To prepare, for the Rector Minister, reports during the first quarter of each year on the state of the situation of each respective topic, indicating the existing pressures, the status, the responses offered, and challenges to consider, in order to issue accountability for the fulfillment of public policies, the Annual Sectoral Plan, and the National Development Plan when applicable.

a)To prepare an inventory containing the projects and priority actions in cooperation matters, in accordance with the country's international cooperation priorities and the National Development Plan.
b)To follow up on the cooperation projects linked and prioritized within the scope of action of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning. To prepare technical reports on the cooperation projects under execution and executed by public institutions within the framework of sectoral and intersectoral actions under the scope of the Environment Secretariat.
c)To provide advice in the preparation of projects, documents, and reports assigned to it in relation to the different cooperation topics under the scope of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.
d)Other functions that are prioritized by the Minister of MINAE in their capacity as Rector to achieve the best management.

a)To serve as the technical body for sectoral and intersectoral climate change coordination.
b)To formulate, coordinate, and manage public climate change policy, promoting the integration of a sectoral, intersectoral, and territorial agenda.
c)To support senior management in the design of a priority agenda at the national and international level for climate change.
d)To coordinate the Interministerial Technical Committee on Climate Change and serve as its technical secretariat, established in Executive Decree No. 36823-MINAE and its amendments.
e)To direct the formulation and planning of climate policies, including the National Climate Change Strategy and its Action Plan, and the updates derived thereof to achieve the implementation of the goals and commitments established in the Nationally Determined Contribution of Costa Rica.
j)To promote and facilitate the implementation of climate policies by fostering the adoption of ministerial, organizational, sectoral, and territorial plans, programs, and projects for climate change.
g)To promote spaces for multisectoral participation that encourage the involvement of the private sector and civil society in climate action.
h)To coordinate the formulation and facilitate the sectoral implementation of climate action and its different instruments: Low Carbon Development Strategies, Nationally Appropriate Mitigation Actions (or NAMAs), the National Adaptation Plan, and Nationally Appropriate Adaptation Actions (NAPAs), Climate Financing Strategies, and any others that are generated.

a)To coordinate, manage, and formulate public land-use planning policy.
b)To coordinate and integrate the land-use planning agenda of the Sector.
c)To support senior management in the design and execution of a priority agenda at the local, national, and international level for land-use planning.
d)To coordinate and follow up on ministerial, organizational, and sectoral plans for land-use planning.
e)To formulate and follow up on projects linked and prioritized within the scope of action of the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning in matters of land-use planning.
f)To prepare technical reports on the projects or programs related to land-use planning in the country at the national, regional, and local scale, as well as those linked to the generation of geospatial and georeferenced information.
g)To follow up on the agreements of the National Environmental Council, the Sectoral Environment Council, the National Urban Planning Council, and on those topics referring to land-use planning, rural territorial development under the scope of action of SEPLASA.

a)Coordinating and promoting the planning process in the institutions that make up the Sector.
b)Collaborating in the structuring of work programs, according to the agreements emanating from the Rector Minister and the Sectoral Council for Environment, Energy, Seas, and Land-Use Planning.
c)Providing the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning with the information requested for the development of its functions and all the collaboration required for the formulation and updating of the National Development Plan.
d)Serving as a link within the institutions in the preparation of the studies, investigations, and evaluations that are necessary.
e)Following up on the recommendations and actions necessary to achieve the effective integration of policies and the coordination of the action of the participating bodies.
f)Serving as a consultative body for the Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning.

Chapter III: Final Provisions

Section I: Amendments and Additions

35669-MINAE of December 4, 2009, so that it reads as follows:

"Article 43.- On the functions of the Climate Change Directorate. The functions of the Climate Change Directorate shall be the following:

a. To coordinate and manage public climate change policy, promoting the integration of an intra-ministerial climate change agenda in its various dimensions.

b. To support the Rector Minister and SEPLASA in the execution of the priority agenda at the national and international level on climate change.

c. To serve as the focal point for the United Nations Framework Convention on Climate Change in its various areas and support the governing body in the negotiation process under the Convention and its instruments.

d. To serve as the Technical Secretariat of the Domestic Carbon Market and its structures.

e. To design and administer the Registry of Carbon Credits and/or Units of Compensation that are generated or traded in Costa Rican territory, with the objective of avoiding double accounting, and to establish links with the National Climate Change Metrics System (SINAMECC).

f. To coordinate and promote the implementation of the C-Neutrality Country Program with the various actors and sectors of national activity and other programs that are generated to consolidate the implementation of climate action.

g. To promote spaces for multisectoral participation that encourage the involvement of the private sector and civil society in climate action."

29540-MINAE of May 11, 2001, and its amendments, so that it reads as follows:

"Article 3- On the objectives: The National Center for Geo-Environmental Information shall have the following objectives:

f)The National Center for Geo-Environmental Information (CENIGA) shall be responsible for designing, building, developing, and administering the National Environmental Information System (SINL4), to facilitate decision-making for the Environment, Energy, Seas, and Land-Use Planning Sector established in decree 38536-MP-PLAN. Furthermore, it shall ensure the development of national reports on the state of the environment.

k)Support the Sectoral Planning Secretariat for Environment, Energy, Seas, and Territorial Planning (SEPLASA) in the production and management of information that supports decision-making in the sectoral and intersectoral spheres."

38536-MP-PLAN- of July 25, 2014, is amended to read as follows:

"Article 15. Integration of the sectors. The sectors shall be composed of the following institutions:

(.-) f) Environment, Energy, Seas, and Territorial Planning: (..) and Ministry of Health (MINSA)."

Section II: Repeals

29540-MINAE of May 11, 2001", Executive Decree No. 37658-MINAE- Establishment of the National Environmental Information System (SINIA), are hereby repealed.

Section III: Effective Date

Given at the Presidency on the fourth of August of the year two thousand seventeen.

1. Que el artículo 140 inciso 8) de la Constitución Política con el fin de lograr la unidad de la actuación administrativa del Estado, establece el principio de coordinación del Estado en su deber de· vigilar el buen funcionamiento de los servicios públicos y dependencias administrativas como atribuciones y deberes del Ministro competente respectivo y del Presidente de la República.

2. Que la Ley de Planificación Nacional establece que los organismos del Sistema Nacional de Planificación (SNP) colaborarán en la elaboración del Plan Nacional de Desarrollo y de Inversión Pública (PNDIP)(*) bajo los lineamientos que el Ministerio de Planificación Nacional y Política Económica emita.

Que el Reglamento General del Sistema Nacional de Planificación, tiene por objeto regular la constitución, organización, funciones y relaciones del Sistema Nacional de Planificación, como conjunto articulado de instituciones públicas, subsistemas y normativa, bajo la dirección política del Presidente de la República y la rectoría técnica del Ministerio de Planificación Nacional y Política Económica, MIDEPLAN, para definir acciones vinculantes que potencien el desarrollo del país, con participación ciudadana.

4. Que el Reglamento Orgánico del Poder Ejecutivo, establece la organización sectorial del Poder Ejecutivo entendido como una agrupación de instituciones públicas centralizadas y descentralizadas con acciones afines y complementarias entre sí en áreas del quehacer público, regido por el Ministro Rector establecido con el fin de brindar un mayor grado de coordinación, eficacia y eficiencia en la Administración Pública. administrativas como atribuciones y deberes del Ministro competente respectivo y del Presidente de la República.

5. Que según dicho Reglamento Orgánico uno de los sectores antes indicados es el Sector de Ambiente; Energía, Mares y Ordenamiento Territorial el cual se encuentra bajo la rectoría del Ministro de Ambiente y Energía. Entendiéndose la rectoría como la potestad que tiene el Presidente de la República en conjunto con el Ministro del ramo para coordinar, articular y conducir las actividades de cada sector y asegurarse que éstas sean cumplidas conforme a las orientaciones del Plan Nacional de Desarrollo y de Inversión Pública (PNDIP)(*).

Que dentro de las responsabilidades otorgadas al Ministro Rector, según el decreto supra citado, le corresponde dirigir y coordinar al respectivo sector con el fin de construir el Plan Nacional Sectorial, las políticas, planes, programas, proyectos y estudios relacionados con su sector vinculado al Plan Nacional de Desarrollo y de Inversión Pública (PNDIP)(*).

Anteriormente se indicaba "Plan Nacional de Desarrollo (PND)") 7 Que como órganos de consulta y coordinación del Ministro Rector se crean los Consejos Nacionales Sectoriales con el fin de coordinar los planes, programas y metas que le corresponde ejecutar a cada sector según las políticas gubernamentales y el Plan Nacional de Desarrollo (PND).

8. Que el Consejo Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial está conformado por el Ministerio de Ambiente y Energía (MINAE), el Ministerio de Vivienda y Asentamientos Humanos (MIVAH), el Ministerio de Agricultura y Ganadería (MAG), el Ministerio de Obras Públicas y Transportes (MOPT), el Instituto Costarricense de Turismo (ICT), el Instituto Costarricense de Electricidad (ICE), el Instituto Costarricense de Acueductos y Alcantarillados (AyA), el Instituto Nacional de Vivienda y Urbanismo (INVU), el Instituto de Desarrollo Rural (INDER), el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), la Refinadora Costarricense de Petróleo S.A. (RECOPE), la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE) y el Servicio Nacional de Guardacostas de la Fuerza Pública del Ministerio de Seguridad Pública y el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA).

9. Que cada uno de los Consejos Nacionales Sectoriales tendrá una Secretaría de Planificación Sectorial como órgano de apoyo y asesoría en planificación del Ministro Rector con las funciones de apoyar los procesos de coordinación, programación, ejecución, seguimiento y evaluación de las políticas, planes, programas y proyectos del Sector. Nacional Sectorial, las políticas, planes, programas, proyectos y estudios relacionados con su sector vinculado al Plan Nacional de Desarrollo (PND).

10. Que la relación de dirección por parte del Ministro de Ambiente y Energía en su calidad de Ministro Rector, es la de ordenar la actividad dentro de una relación de confianza incompatible con órdenes, instrucciones o circulares.

11. Que a efecto de poner en funcionamiento la estructura organizacional del Sector Ambiente, Energía, Mares y Ordenamiento Territorial , se hace necesario reglamentar su operación. Por lo que el Ministerio de Planificación Nacional y Política Económica aprobó el 8 de marzo del 2017 mediante oficio DM-131-17, la creación de la Secretaría de Planificación Sectorial de Ambiente (SEPLASA) como una unidad asesora dependiente jerárquicamente del Despacho Ministerial, siendo una unidad de apoyo al Ministro en su condición de Ministro Rector del Sector Ambiente, Energía, Mares y Ordenamiento Territorial según los "Lineamientos Generales para Reorganizaciones Administrativas" (LGRA) Por tanto;

Considerando:

DECRETAN:

Capítulo I: De la organización

Sección I: De la Rectoría del Sector Ambiente, Energía, Mares y Ordenamiento

Todas las instituciones del Sector en la medida de sus posibilidades deberán contribuir al cabal cumplimiento de las funciones y responsabilidades de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial incluyendo aportes en recursos humanos, operativos y financieros.

Sección II: De los Subsectores

a. Subsector Hídrico: El Ministerio de Ambiente y Energía (MINAE), Ministerio de Salud (MINSA), el Instituto Costarricense de Acueductos y Alcantarillados (AyA), el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), y el Instituto Costarricense de Electricidad (ICE).

b. Subsector Mares: El Ministerio de Ambiente y Energía (MINAE), el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) y el Servicio Nacional de Guardacostas de la Fuerza Pública del Ministerio de Seguridad Pública.

c. Subsector Energía: Será conformado y regido por lo establecido en el Reglamento de organización del Sub-Sector Energía, Decreto Ejecutivo N° 35991- MINAET del 19 de enero del 2010 y sus reformas.

d. Subsector Ambiente: El Ministerio de Ambiente y Energía (MINAE), el Ministerio de Vivienda y Asentamientos Humanos (MIVAH), el Ministerio de Agricultura y Ganadería (MAG), el Instituto Costarricense de Turismo (ICT), el Instituto Nacional de Vivienda y Urbanismo (INVU), la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE).

e. Subsector calidad ambiental: El Ministerio de Ambiente y Energía (MINAE), el Ministerio de Agricultura y Ganadería (MAG), el Ministerio de Obras Públicas y Transportes (MOPT), el Ministerio de Salud (MINSA) y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE).

f. Subsector suelos y subsuelos: El Ministerio de Ambiente y Energía (MINAE) y el Ministerio de Agricultura y Ganadería (MAG) y el Instituto de Desarrollo Rural (INDER)

Y sus funciones son las siguientes:

a. Recopilación y análisis de la información para la planificación, ejecución y evaluación de los planes y programas propuestos por el sector. Subsector calidad ambiental: El Ministerio de Ambiente y Energía (MINAE), el Ministerio de Agricultura y Ganadería (MAG), el Ministerio de Obras Públicas y Transportes (MOPT), el Ministerio de Salud (MINSA) y la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE).

b. Actuar como enlace técnico sectorial para la planificación y el seguimiento de la ejecución y evaluación de las metas y objetivos estratégicos sectoriales del PND.

c. Preparación de informes técnicos solicitados por el Director Ejecutivo.

d. Asesorar y apoyar a los Consejos Regionales establecidos en el Decreto N° 38536 Reglamento Orgánico del Poder Ejecutivo en la programación estratégica, seguimiento y evaluación de las acciones sectoriales, en el nivel regional.

Energía, Mares y Ordenamiento Territorial

Capítulo II: De las Instancias de coordinación del rector del Sector Ambiente,

Sección I: De las instancias de coordinación

a. Consejo Nacional Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

b. La Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

a. Conocer y orientar la política sectorial, los programas y proyectos sectoriales de inversiones y cooperación internacional ejecutados por las instituciones del sector.

(Así reformado el inciso anterior por el artículo 2° del decreto ejecutivo N° 41135 del 9 de abril del 2018) b. Formular y ejecutar metas sectoriales y regionales en el PND.

c. Considerar y valorar para la torna de decisiones la información generada por el Centro Nacional de Información Geoambiental (CENIGA).

Ordenamiento Territorial

Sección III: De la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y

Formará parte de SEPLASA la Secretaría de Planificación del Subsector Energía, establecida en el Decreto Ejecutivo 35991-MINAET y sus reformas, y cualquier otra Secretaría Subsectorial que se cree en el futuro. Para fines administrativos funcionará como una unidad asesora dependiente jerárquicamente del Despacho Ministerial.

a. Asesorar, elaborar y evaluar los planes, programas, proyectos y propuestas de conformidad con la Ley de Planificación Nacional y otras disposiciones legales conexas.

b. Conducir en forma integrada y participativa el proceso de formulación del Plan Nacional de Desarrollo, así como de otras políticas sectoriales requeridas para dar coherencia y consistencia a las metas, su seguimiento y evaluación.

c. Brindar los insumos de planificación, evaluación y seguimiento del Sector con el fin de proporcionar elementos al Ministro Rector, para una eficiente y efectiva implementación de las políticas públicas.

d. Asesorar y apoyar al Ministro Rector y al Consejo Nacional Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial en los procesos de coordinación, programación, seguimiento y evaluación de las políticas y los programas del PND y a otros instrumentos de política pública de mediano y largo plazo vinculadas al sector, de conformidad con los lineamientos contenidos en el marco de referencia política establecida por el propio Ministro de Ambiente, con la Ley de Planificación Nacional y otras disposiciones legales conexas.

a. Un Director Ejecutivo que ocupará una plaza de confianza de nombramiento y libre remoción del Ministro Rector que al menos cuente con los siguientes requisitos: licenciatura y debidamente incorporado al colegio profesional, experiencia de 5 años en la función pública y en materia ambiental y procesos de planificación.

b. Un coordinador Sectorial Administrativo: con grado mínimo de licenciatura atinente al cargo, nombrado por el Director Ejecutivo de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

c. Un coordinador Sectorial de Cooperación Internacional con grado mínimo de licenciatura atinente al cargo, nombrado por el Director Ejecutivo de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

d. Un coordinador Sectorial de Cambio Climático con grado mínimo de licenciatura atinente al cargo, nombrado por el Director Ejecutivo de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

e. Un coordinador Sectorial de Ordenamiento Territorial con grado mínimo de licenciatura atinente al cargo, nombrado por el Director Ejecutivo de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.

f. Un Comité Técnico Sectorial. Conformado por el Director Ejecutivo de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial, quien lo presidirá y por los jefes o responsables de las unidades de planificación de las instituciones que conforman el Sector.

El Director Ejecutivo tendrá además las siguientes funciones:

a. Asesorar y apoyar al Ministro Rector y a los jerarcas institucionales en la conducción del desarrollo del Sector.

b. Fungir como Secretario de Consejo Sectorial y participar en las sesiones con derecho a voz, así como dar seguimiento a los acuerdos tomados.

c. Organizar el control y seguimiento del PND, por medio de los coordinadores subsectoriales y transversales y la coordinación estratégica del Sector y sus órganos.

d. Coordinar la ejecución y seguimiento de los planes y programas sectoriales vinculados al PND, en apoyo a políticas sectoriales.

e. Coordinar las evaluaciones del Sector y las acciones correspondientes para la mejora continua. Fungir como Secretario del Consejo Sectorial y participar en las sesiones con derecho a voz, así como dar seguimiento a los acuerdos tomados.

f. Proponer al Ministro Rector el nombramiento de personal técnico y administrativo de carácter regular y temporal de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial g. Establecer relaciones técnicas y de coordinación con programas y proyectos de índole sectorial e intersectorial.

h. Presidir el Comité Técnico Sectorial.

i. Elaborar, revisar y evaluar el Plan - Presupuesto de la Secretaría.

j. A solicitud del Ministro Rector, representarlo en comisiones y eventos de naturaleza sectorial, intersectorial e internacional.

k. Presentar al Ministro Rector informes periódicos del cumplimiento de la política sectorial y el informe anual.

Además tendrán las siguientes funciones:

a. Sistematizar con los coordinadores subsectoriales la información de cada subsector.

b. Asesorar al Ministro Rector y a los jerarcas de cada institución que conforma el sector en sus temas específicos c. Brindar apoyo al Director Ejecutivo d. Elaborar informes a solicitud del Director Ejecutivo e. Elaborar la planificación del área transversal f. Dar seguimiento a los dictámenes de la Contraloría General de la República con respecto a las disposiciones que emite al Sector y al Ministro rector en temas de ordenamiento territorial y cambio climático.

g. Elaborar al Ministro Rector informes durante el primer trimestre de cada año sobre el estado de situación de cada tema respectivo indicando las presiones existentes, el estado, las respuestas ofrecidas y desafíos a considerar con el fin de emitir rendición de cuentas sobre el cumplimiento de las políticas públicas, del Plan Anual Sectorial y el Plan Nacional de Desarrollo cuando corresponda.

a)Elaborar un inventario que contenga los proyectos y las acciones prioritarias en materia de cooperación conforme con las prioridades de cooperación internacional del país y el Plan Nacional de Desarrollo.
b)Dar seguimiento a los proyectos de cooperación vinculados y priorizados en el ámbito de acción de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial Preparar informes técnicos sobre los proyectos de cooperación en ejecución y ejecutados por las instituciones públicas en el marco de acciones sectoriales e intersectoriales bajo el ámbito de la Secretaría de Ambiente.
c)Brindar asesoría en la elaboración de proyectos, documentos e informes que se le asignen en relación a los diferentes temas de cooperación bajo el ámbito de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.
d)Otras que sean priorizadas por el Ministro del MINAE en su calidad de Rector para lograr la mejor gestión.

a)Servir de órgano técnico de la coordinación sectorial e intersectorial de cambio climático b) Formular, coordinar, gestionar la política pública de cambio climático, promoviendo la integración de una agenda sectorial, intersectorial y territorial.
c)Apoyar a nivel superior en el diseño de una agenda prioritaria a nivel nacional e internacional de cambio climático.
d)Coordinar el Comité Técnico Interministerial de Cambio Climático y servir de secretaria técnica establecido en el Decreto Ejecutivo Nº36823-MINAE y sus reformas.
e)Dirigir la formulación y planificación de las políticas climáticas, incluidas la Estrategia Nacional de Cambio Climático y su Plan de Acción, y las actualizaciones que se deriven para lograr la implementación de las metas y compromisos establecidos en la Contribución Nacionalmente Determinada de Costa Rica.
j)Promover y facilitar la implementación de las políticas climáticas mediante el fomento para la adopción de planes, programas y proyectos ministeriales, organizacionales, sectoriales y territoriales para el cambio climático.
g)Promover espacios de participación multisectorial que fomenten el involucramiento del sector privado y sociedad civil en la acción climática.
h)Coordinar la formulación y facilitar la implementación sectorial de la acción climática y sus distintos instrumentos: Estrategias de Desarrollo Bajo en Carbono, Acciones de Mitigación Nacionalmente Apropiadas (o NAMAS por sus siglas en inglés), Plan Nacional de Adaptación y Acciones de Adaptación Nacionalmente Apropiadas (NAPAs por sus siglas en inglés), Estrategias de Financiamiento Climático, y cualquier otro que se genere.

a)Coordinar, gestionar, formular la política pública de ordenamiento territorial.
b)Coordinar e integrar la agenda de ordenamiento territorial del Sector.
c)Apoyar a nivel superior en el diseño y ejecución de una agenda prioritaria a nivel local, nacional e internacional de ordenamiento territorial.
d)Coordinar y dar seguimiento a los planes ministeriales, organizacionales y sectoriales para el ordenamiento territorial.
e)Formular y dar seguimiento a los proyectos vinculados y priorizados en el ámbito de acción de la Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial en materia de ordenamiento territorial.
f)Preparar informes técnicos sobre los proyectos o programas relacionados con ordenamiento territorial en el país en la escala nacional, regional y local, así como aquellos vinculados con la generación de información geoespacial y georreferenciada.
g)Dar seguimiento a los acuerdos del Consejo Nacional Ambiental, Consejo Sectorial de Ambiente, Consejo Nacional de Planificación Urbana y en aquellos temas referentes al ordenamiento territorial, desarrollo territorial rural bajo el ámbito de acción de SEPLASA.

a)Coordinar y promover el proceso de planificación en las instituciones que conforman el Sector.
b)Colaborar en la estructuración de los programas de trabajo, según los acuerdos emanados del Ministro Rector y del Consejo Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial.
c)Suministrar a la Secretaría de Planificación del Sector Ambiente, Energía, Mares y Ordenamiento Territorial la información que le sea solicitada para el desarrollo de sus funciones y toda la colaboración que requiera para la formulación y actualización del Plan Nacional de Desarrollo.
d)Servir de enlace en las instituciones en la elaboración de los estudios, investigaciones y evaluaciones que sean necesarias.
e)Dar seguimiento a las recomendaciones y acciones necesarias para lograr la eficaz integración de las políticas y la coordinación de la acción de los organismos participantes.
f)Servir de órgano de consulta de la Secretaría de Planificación del Sector Ambiente, Energía, Mares y Ordenamiento Territorial.

Capítulo III: Disposiciones Finales

Sección I: Reformas y Adiciones

"Artículo 43.- De las funciones de la Dirección de Cambio Climático. Serán funciones de la Dirección de Cambio Climático las siguientes:

a. Coordinar y gestionar la política pública de cambio climático, promoviendo la integración de una agenda intra-ministerial de cambio climático en sus distintas dimensiones.

b. Apoyar al Ministro Rector y a SEPLASA en la ejecución de la agenda prioritaria a nivel nacional e internacional de cambio climático.

c. Ejercer la focalía de la Convención Marco de Cabio Climático en sus distintos ámbitos y apoyar al ente rector en el proceso de negociación bajo la Convención y sus instrumentos.

d. Fungir como Secretaría Técnica del Mercado Doméstico de Carbono y sus estructuras.

e. Diseñar y administrar el Registro de Créditos de Carbono y/o Unidades de Compensación que se generen o transen en el territorio costarricense con el fin de evitar la doble contabilidad y establecer los vínculos con el Sistema Nacional de Métrica de Cambio Climático (SINAMECC).

f Coordinar e impulsar la implementación del Programa País de C- Neutralidad con los diversos actores y sectores del quehacer nacional y de otros programas que se generen para consolidar la implementación de la acción climática.

g. Promover espacios de participación multisectorial que fomenten el involucramiento del sector privado y sociedad civil en la acción climática".

"Artículo 3- De los objetivos: El Centro Nacional de Información Geoambiental tendrá los siguientes objetivos:

f)El Centro Nacional de Información Geoambiental (CENIGA) será el responsable de diseñar, construir, desarrollar y administrar el Sistema Nacional de Información Ambiental (SINL4), para facilitar la toma de decisiones del Sector Ambiente, Energía, Mares y Ordenamiento Territorial establecido en el decreto 38536-MP-PLAN. Además deberá velar por el desarrollo de los informes nacionales sobre el estado del medio ambiente.

k)Apoyar a Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial (SEPLASA) en la producción y gestión de información que apoye la toma decisiones en el ámbito sectorial e intersectorial".

"Artículo 15. Integración de los sectores. Los sectores estarán integrados por las siguientes instituciones:

Artículo 1 — The Minister of Environment and Energy is the Rector of the Environment, Energy, Seas, and Land-Use Planning Sector, composed of the centralized and decentralized institutions established in the Organic Regulations of the Executive Branch, Executive Decree 38536-PLAN.

Artículo 2 — The functions of the Rector Minister, in addition to those established in article 6 of the Organic Regulations of the Executive Branch, Executive Decree No.

Artículo 5 — The Rector Minister of the Environment, Energy, Seas, and Land-Use Planning Sector, in order to coordinate, articulate, and conduct the activity of the Sector, shall have the following instances:

Artículo 7 — The functions of the National Sectoral Council for Environment, Energy, Seas, and Land-Use Planning, in addition to those established in article 12 of the Organic Regulations of the Executive Branch, are the following:

Artículo 9 — The Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning shall have, in addition to the functions established in article 3 of the Organic Regulations of the Executive Branch, the following functions:

Artículo 10 — The Sectoral Planning Secretariat for Environment, Energy, Seas, and Land-Use Planning shall be structured in the following manner:

Artículo 11 — The Executive Director is responsible for planning, coordinating, and supervising the execution of the work of the subsector coordinators and the Sectoral Coordinators for the transversal thematic areas (International Cooperation, Climate Change, Land-Use Planning).

Artículo 12 — The sectoral coordinators in Administrative, International Cooperation, Climate Change, and Land-Use Planning topics shall have the function of articulating the information from the subsectoral coordinators with regard to their respective subject matter.

Artículo 13 — In addition to the functions indicated in this decree, the functions of the Sectoral International Cooperation Coordinator shall be the following:

Artículo 15 — The functions of the sectoral Land-Use Planning coordinator shall be, in addition to those stipulated in this decree, the following:

Artículo 1 — El Ministro de Ambiente y Energía es el Rector del Sector Ambiente, Energía, Mares y Ordenamiento Territorial conformado por las instituciones centralizadas y descentralizadas establecidas en el Reglamento Orgánico del Poder Ejecutivo, Decreto Ejecutivo 38536-PLAN.

Artículo 5 — El Ministro Rector del Sector de Ambiente, Energía, Mares y Ordenamiento Territorial con el fin de coordinar, articular y conducir la actividad del Sector contará con las siguientes instancias:

Artículo 7 — Las funciones del Consejo Nacional Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial, además de las establecidas en el artículo 12 del Reglamento Orgánico del Poder Ejecutivo, son las siguientes:

Artículo 9 — La Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial tendrá además de las funciones establecidas en el artículo 3 del Reglamento Orgánico del Poder Ejecutivo, las siguientes funciones:

Artículo 10 — La Secretaría de Planificación Sectorial de Ambiente, Energía, Mares y Ordenamiento Territorial se conformará de la siguiente forma:

Artículo 11 — Al Director Ejecutivo le corresponde planear, coordinar y supervisar la ejecución de las labores de los coordinadores subsectoriales y los coordinadores Sectoriales de las áreas temáticas transversales (Cooperación Internacional, Cambio Climático, Ordenamiento Territorial).

Artículo 12 — Los coordinadores sectoriales en temas Administrativo, de Cooperación Internacional, Cambio Climático y Ordenamiento Territorial tendrán la función de articular la información de los coordinadores subsectoriales en cuanto a su materia se refiera.

Artículo 13 — Además de las funciones indicadas en este decreto serán funciones del coordinador Sectorial de Cooperación Internacional las siguientes:

Artículo 14 — Además de las funciones indicadas en este decreto serán funciones del coordinador sectorial de Cambio Climático las siguientes:

Artículo 15 — Serán funciones del coordinador sectorial de Ordenamiento Territorial, además de las estipuladas en el presente decreto las siguientes:

Artículo 16 — Le corresponde al Comité Técnico Sectorial:

Artículo 18 — Refórmese el artículo 43 del Reglamento Orgánico del Ministerio de Ambiente y Energía, Decreto Ejecutivo N°35669-MINAE del 4 de diciembre del 2009, pala que se lea de la siguiente forma:

Artículo 20 — Refórmese el artículo 15 inciso f del Reglamento Orgánico del Poder Ejecutivo, Decreto Ejecutivo N°38536-MP-PLAN- del 25 de julio de 2014, para que se lea de la siguiente manera:
