(This Agreement was thus amended by Agreement AJDIP/329-2016).

1. 1That in accordance with Agreement AJDIP/082-2015, a proposal is likewise received from Mr. Edwin Salazar Serrano, Head of the Protection and Registration Department, for the adoption of a proposed Agreement allowing for the regulation of engine replacements for those vessels belonging to the small-scale artisanal fleet that operate within the Gulf of Nicoya.
2. 2That in conformity with Law 7384 and Law 8436 it is the responsibility of INCOPESCA to promote the sustainable use and conservation of existing marine resources.
3. 3That INCOPESCA is the National Authority that regulates and establishes the conditions, fishing zones, types of gear, and characteristics of vessels for the exercise of fishing activity in our jurisdictional waters or beyond them.
4. 4That according to technical information, a fishing effort has been taking place in the catch of shrimp and croaker in the inner part of the Gulf of Nicoya that has been increasing in recent months, which has caused a decrease in populations, sizes, and yields, much of which is due to the use of engines with horsepower exceeding the maximum required for the exercise of fishing activity in those zones.
5. 5That an adequate use of the existing fishery resources in the inner part of the Gulf of Nicoya contributes to the improvement and diversification of the fishery, improving the socioeconomic conditions of the fishers.
6. 6That it is the responsibility of INCOPESCA to adopt regulations to reduce the negative impacts on marine species populations, adequately regulating sustainable extraction in a manner that guarantees their renewal, conservation, and reasonable use.
7. 7That according to the documentation kept by the Protection and Registration Department, a history of engines of a certain horsepower is evident, both for the inner part of the Gulf of Nicoya and for the outer part, which reveals an established trend regarding the limit utilized by the small-scale artisanal fleet.
8. 8That under these assessments, the Board Members consider that it is advisable to endorse the proposal submitted, reason for which, the Board of Directors, in use of its powers and competencies, Therefore;

AGREES:

1º-Engine replacement will only be permitted for vessels that engage in small-scale commercial artisanal fishing activity in the inner part of the Gulf of Nicoya as long as they do not exceed 65 horsepower (HP). However, in exceptional cases, duly justified and where the advisability or technical reasonableness of using an engine of greater horsepower than that indicated is determined, it will be permitted for those fishers who carry out their activity in the outer part of the inner part of the Gulf of Nicoya.

2º-For the purposes of this regulation, the following is defined as:

Inner Part of the Gulf of Nicoya: Area comprised between the imaginary straight line that extends from the westernmost point of the city of Puntarenas (9°57´59",43 north latitude and 84°51´01",31 west longitude), to the easternmost point of Punta Gigante on the Nicoya Peninsula (9°54´12",52 north latitude and 84°54´53",37 west longitude) and from this line, inshore skirting the coast on both sides of the gulf, until reaching the imaginary straight line that extends between Puerto Níspero (10°12´40",7 north latitude and 85°14´01",58 west longitude) and Puerto Moreno (10°12´15",8 north latitude and 85°14´42",45 west longitude) at the mouth of the Tempisque River.

Outer Part of the Gulf of Nicoya: Area comprised between the imaginary straight line that extends from the westernmost point of the city of Puntarenas (9°57´59",43 north latitude and 84°51´01",31 west longitude), to the easternmost point of Punta Gigante on the Nicoya Peninsula (9°54´12",52 north latitude and 84°54´53",37 west longitude) and from this line, offshore skirting the coast on both sides of the gulf, until reaching the imaginary straight line that extends between Cabo Blanco (9°33´08",06 north latitude and 85°06´23",15 west longitude) and Punta Herradura (9°39´02",29 north latitude and 84°40´50",58 west longitude).

3º-Those permit holders who, prior to the entry into force of this agreement, have engines installed in their vessels exceeding those regulated in the previous article and require replacement thereof, must conform to this regulation henceforth.

4º-It takes effect upon its publication.

5º-Final Agreement Technical Secretariat of the Board of Directors.

Considering:

(Este Acuerdo fue así modificado mediante Acuerdo AJDIP/329-2016).

1. 1Que en concordancia con el Acuerdo AJDIP/082-2015, igualmente se recibe propuesta por parte del Sr. Edwin Salazar Serrano, Jefe del Departamento de Protección y Registro, para la adopción de una propuesta de Acuerdo que permita la regulación de las sustituciones de motores para aquellas embarcaciones perteneciente a la flota artesanal en pequeña escala que faenen dentro del Golfo de Nicoya.
2. 2Que de conformidad con la ley 7384 y 8436 es responsabilidad del INCOPESCA propiciar el aprovechamiento sostenible y conservación de los recursos marinos existentes.
3. 3Que el INCOPESCA es la Autoridad Nacional que regula y establece las condiciones, zonas de pesca, tipos de artes y características de las embarcaciones para el ejercicio de la actividad pesquera en nuestras aguas jurisdiccionales o fuera de ellas.
4. 4Que según información técnica se ha venido realizando un esfuerzo de pesca en la captura de camarón y corvina en la parte interna del Golfo de Nicoya que ha venido incrementándose en los últimos meses, lo que ha provocado una disminución en las poblaciones, tallas y rendimientos, mucho de lo cual se debe a la utilización de motores de caballaje superior al máximo requerido para el ejercicio de la actividad pesquera en esas zonas.
5. 5Que un adecuado aprovechamiento de los recursos pesqueros existentes en la parte interna del Golfo de Nicoya contribuye al mejoramiento y diversificación de la pesquería, mejorando las condiciones socioeconómicas de los pescadores.
6. 6Que es responsabilidad del INCOPESCA adoptar regulaciones para disminuir los impactos negativos sobre las poblaciones de especies marinas, regulando adecuadamente la extracción sostenible de manera que se garantice su renovación, conservación y aprovechamiento razonable
7. 7Que de acuerdo a la documentación resguardada por el Departamento de Protección y Registro, es notorio un historial de motores de cierto caballaje, tanto para la parte interna del golfo de Nicoya como para la parte externa, lo cual evidencia una tendencia establecida en cuanto al límite utilizado por la flota artesanal en pequeña escala.
8. 8Que bajo esas valoraciones, consideran los Sres. Directivos, que resulta conveniente avalar la propuesta planteada razón por la cual, la Junta Directiva, en uso de sus facultades y competencias, Por tanto;

ACUERDA:

1º-Solo se permitirá la sustitución de motores para embarcaciones que ejerzan la actividad de pesca comercial artesanal en pequeña escala en la parte interna del Golfo de Nicoya en el tanto no superen los 65 caballos de fuerza (HP). No obstante en caso excepcionales, debidamente justificados y que se determine la conveniencia o razonabilidad técnica de utilizar un motor de caballaje mayor al indicado se permitirá para aquellos pescadores que ejerzan su actividad en la parte externa de la parte interna del Golfo de Nicoya.

2º-Para efectos de la presente regulación se define como:

Parte Interna del Golfo de Nicoya: Área comprendida entre la línea recta imaginaria que se extiende desde el extremo más occidental de la ciudad de Puntarenas (9°57´59",43 latitud norte y 84°51´01",31 longitud oeste), hasta el extremo más oriental de Punta Gigante en la Península de Nicoya (9°54´12",52 latitud norte y 84°54´53",37 longitud oeste) y de esta línea, aguas adentro bordeando la costa a ambos lados del golfo, hasta llegar a la línea recta imaginaria que se extiende entre Puerto Níspero (10°12´40",7 latitud norte y 85°14´01",58 longitud oeste) y Puerto Moreno (10°12´15",8 latitud norte y 85°14´42",45 longitud oeste) en la desembocadura del Río Tempisque.

Parte Externa del Golfo de Nicoya: Área comprendida entre la línea recta imaginaria que se extiende desde el extremo más occidental de la ciudad de Puntarenas (9°57´59",43 latitud norte y 84°51´01",31 longitud oeste), hasta el extremo más oriental de Punta Gigante en la Península de Nicoya (9°54´12",52 latitud norte y 84°54´53",37 longitud oeste) y de esta línea, aguas afuera bordeando la costa a ambos lados del golfo, hasta llegar a la línea recta imaginaria que se extiende entre Cabo Blanco (9°33´08",06 latitud norte y 85°06´23",15 longitud oeste) y Punta Herradura (9°39´02",29 latitud norte y 84°40´50",58 longitud oeste).

3º-Aquellos permisionarios que con anterioridad a la entrada en vigencia de este acuerdo tengan instalados en sus embarcaciones motores superiores a los regulados en el artículo anterior y requieran realizar sustitución de los mismos, deberán ajustarse a esta regulación en lo sucesivo.

4º-Rige a partir de su publicación.

5º-Acuerdo Firme Secretaría Técnica de Junta Directiva.
