throughout the entire text - Complete Text of Norm 39283 Amendment to the Regulation for the control of noise emitted by the exhaust of automotive vehicles Complete Text acta: 1085FD N° 39283-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT Based on the powers conferred in articles 140 subsections 3) and 18) and 146 of the Political Constitution of Costa Rica and in accordance with the provisions of Law Nº 3155 "Ley Orgánica del Ministerio de Obras Públicas y Transportes", of August 5, 1963; amended by Law N° 4786 "Crea Ministerio de Transportes en sustitución del actual Ministerio de Obras Públicas" of July 5, 1971; Law N° 9078 "Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial" of October 4, 2012 and Law N° 6324 "Ley de Administración Vial" of May 24, 1979 and its amendments.

1. 1That by means of Executive Decree Nº 38937-MOPT, published in the Official Gazette La Gaceta N° 78 of April 23, 2015, the Regulation for the Control of Noise Emitted by the Exhaust of Automotive Vehicles was issued, the purpose of which is to regulate the provisions for the control of noise emitted by the tailpipe (tubo de escape) and the engine brake (freno motor) in internal combustion vehicles;
2. 2That due to the importance of the matter it addresses, any noise test must comply with the guidelines established in the Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, N° 9078, such that its provisions apply to all automotive vehicles circulating on public roads, regardless of their date of first registration, whether or not they were required to have a muffler (silenciador).
3. 3That for the indicated purposes, said decree establishes that the Vehicle Inspection (Inspección Vehicular, IVE) must include the inspection and measurement of muffler noise and engine brake (freno de motor) noise and that, when a vehicle exceeds the established noise limits, the respective technical inspection will not be approved, in addition to the fact that all vehicles must use mufflers or other mechanisms that contribute to reducing exhaust and engine brake noise levels.
4. 4That the provisions contained in Executive Decree Nº 38937-MOPT take effect six months after its publication: that is, as of October 23 of the year 2015, as stipulated in article 18.
5. 5That said Regulation, in its article 17, establishes regarding those responsible for carrying out noise measurement, that "the provider of the Vehicle Technical Inspection Service is in charge of applying, in the Vehicle Inspection Centers (Centros de Inspección Vehicular, CIVE), the provisions of this regulation, once the corresponding matters have been incorporated into the respective Procedures Manual." Likewise, said decree indicates, that "MOPT will determine, for its part, those responsible for carrying out measurements on the road, ensuring that the equipment is used in accordance with the provisions of this regulation, and that the corresponding technical competence exists."
6. 6That the Ley General de la Administración Pública establishes that the activity of public entities must be subject in its entirety to the fundamental principles of public service, to ensure its continuity, its efficiency, its adaptation to any change in the legal regime or in the social need they satisfy, and equality in the treatment of recipients, users, or beneficiaries. Likewise, that the issuance of administrative acts must be consistent with the unambiguous rules of science and technique, and with the elementary principles of justice, logic, and convenience.
7. 7That in order to comply with the provisions of article 17 and for its execution to be consistent with the other provisions of the Regulation for the Control of Noise Emitted by the Exhaust of Automotive Vehicles and in harmony with the principles established in the Political Constitution of Costa Rica and with the regulations regarding public service contained in the Ley General de la Administración Pública; it is necessary to have a longer period than that established in article 18 of Executive Decree Nº 38937-MOPT, after verifying the concrete actions that must be carried out for its full execution.
8. 8That the provisions contained in this executive decree were known and approved by the Board of Directors of the Consejo de Seguridad Vial in Article V, of Ordinary Session N° 2817-15, of August 31, 2015. Therefore,

Amendment to Article 18 of Executive Decree N° 38937-MOPT Regulation for the Control of Noise Emitted by the Exhaust of Automotive Vehicles

Considering:

en la totalidad del texto - Texto Completo Norma 39283 Reforma Reglamento para el control de ruido emitido por el escape de vehículos automotores Texto Completo acta: 1085FD N° 39283-MOPT EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES Con fundamento en las atribuciones conferidas en los artículos 140 incisos 3) y 18) y 146 de la Constitución Política de Costa Rica y conforme las disposiciones de la Ley Nº 3155 "Ley Orgánica del Ministerio de Obras Públicas y Transportes", del 5 de agosto de 1963; reformada mediante Ley N° 4786 "Crea Ministerio de Transportes en sustitución del actual Ministerio de Obras Públicas" del 5 de julio de 1971; Ley N° 9078 "Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial" del 4 de octubre de 2012 y Ley N° 6324 "Ley de Administración Vial" del 24 de mayo de 1979 y sus reformas.

1. 1Que mediante el Decreto Ejecutivo Nº 38937-MOPT, publicado en el Diario Oficial La Gaceta N° 78 del 23 de abril del 2015, se emitió el Reglamento para el Control del Ruido Emitido por el Escape de Vehículos Automotores, cuyo objeto es regular las disposiciones para el control del ruido emitido por el tubo de escape y el freno motor en los vehículos de combustión interna;
2. 2Que por la importancia de la materia que trata, toda prueba de ruido debe cumplir con los lineamientos establecidos en la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, N° 9078, por lo que sus disposiciones alcanzan a todos los vehículos automotores que circulan en vías públicas, sin importar su fecha de primera inscripción, hayan estado o no obligados a contar con silenciador.
3. 3Que para los indicados efectos, se establece en dicho decreto que la Inspección Vehicular (IVE) debe incluir la inspección y medición del ruido de las muflas y del freno de motor y que, cuando un vehículo sobrepase los límites de ruido establecidos, no se aprobará la inspección técnica respectiva, además de que todos los vehículos deberán utilizar silenciadores u otros mecanismos que contribuyan a disminuir los niveles de ruido de escape y de freno motor.
4. 4Que las disposiciones contenidas en el Decreto Ejecutivo Nº 38937-MOPT, empiezan a regir seis meses después de su publicación: es decir, a partir del 23 de octubre del año 2015, según dispone el artículo 18.
5. 5Que dicho Reglamento en su artículo 17 establece respecto de los responsables de realizar la medición de ruido, que "la prestataria del Servicio de Inspección Técnica Vehicular es la encargada de aplicar en los Centros de Inspección Vehicular (CIVE) lo dispuesto en el presente reglamento, una vez que se haya incorporado lo correspondiente en el Manual de Procedimientos respectivo." Asimismo, indica dicho decreto, que "el MOPT determinará, por su parte, los responsables de realizar las mediciones en carretera, velando porque se utilicen los equipos de acuerdo a lo establecido en este reglamento, y exista la competencia técnica correspondiente."
6. 6Que la Ley General de la Administración Pública establece que la actividad de los entes públicos deberá estar sujeta en su conjunto a los principios fundamentales del servicio público, para asegurar su continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal o en la necesidad social que satisfacen y la igualdad en el trato de los destinatarios, usuarios o beneficiarios. Asimismo, que la emisión de los actos administrativos deben ser congruentes con las reglas unívocas de la ciencia y de la técnica, y a los principios elementales de justicia, lógica y conveniencia.
7. 7Que para cumplir con lo dispuesto en el artículo 17 y que su ejecución sea congruente con las demás disposiciones del Reglamento para el Control del Ruido Emitido por el Escape de Vehículos Automotores y en armonía con los principios establecidos en la Constitución Política de Costa Rica y con las regulaciones respecto del servicio público contenidas en la Ley General de la Administración Pública; se hace necesario contar con un mayor plazo al establecido en el artículo 18 del Decreto Ejecutivo Nº 38937-MOPT, luego de constatadas las acciones concretas que deben efectuarse para su ejecución cabal.
8. 8Que las disposiciones contenidas en el presente decreto ejecutivo fueron conocidas y aprobadas por la Junta Directiva del Consejo de Seguridad Vial en el Artículo V, de la Sesión Ordinaria N° 2817-15, del 31 de agosto del año 2015. Por tanto,

La siguiente:
