It is agreed:

• A)As part of the coastal planning process that has been carried out by the Instituto Costarricense de Turismo in support of the Municipalities of Carrillo and Santa Cruz, and in accordance with the powers granted to this Institute in Article 27 of the Marine-Coastal Zone Law, it proceeded to reconsider the declarations of marine-coastal zone issued in previous years for both cantons, taking into account that, to date, the respective classifications and certifications of State Natural Heritage are already available.

By virtue of the foregoing, in accordance with the technical analysis established in the Institutional Procedure MPD-PT-FPP-06 for conducting the Declaration of Tourism Suitability or Non-Suitability in the Marine-Coastal Zone, this Board of Directors resolves the following:

1. To declare of tourism suitability the sectors of the marine-coastal zone located on the coastal front of the canton of Carrillo, province of Guanacaste, including the zones adjacent to mangroves, comprised between the following CRTM 05 coordinates:

1170555 N - 316643 E 1159829 N - 303302 E 2. To declare of tourism suitability the sectors of the marine-coastal zone located on the coastal front of the canton of Santa Cruz, province of Guanacaste, including the zones adjacent to mangroves, comprised between the following CRTM 05 coordinates:

1159829 N - 303302 E 1104905 N - 314090 E 3. Excluded from this agreement are all those coastal sectors that the Área de Conservación Tempisque has classified and certified as State Natural Heritage, as well as those sectors that in the future may be reclassified by said entity using the Methodology established for such purpose.

4. Excluded from this agreement are sectors that are affected by the provisions of Articles 6 and 73 of the Marine-Coastal Zone Law, as well as the lands of the Polo Turístico Golfo de Papagayo, governed by Regulatory Law 6758.

5. Any prior declaration of tourism suitability or non-suitability made in previous years for the cantons of Carrillo and Santa Cruz is hereby repealed, and the declaration included in this agreement shall take effect once it has been formalized through its publication in La Gaceta.

• B)Instruct the Administration to carry out the necessary steps to publish in the Official Gazette La Gaceta the formalization of this agreement, as established in Article 27 of the Marine-Coastal Zone Law.
• C)Acknowledge receipt of official communication N° MPD-P-093-2015 prepared by the Planning and Development Directorate, concerning the recommendation to declare the Marine-Coastal Zone of the Cantons of Carrillo and Santa Cruz as Tourism Suitability.
• D)Request said Directorate to communicate this resolution to all interested parties.

Se acuerda:

• A)Como parte del proceso de planificación costera que se ha venido realizando por el Instituto Costarricense de Turismo en apoyo a las Municipalidades de Carrillo y Santa Cruz, y de conformidad con las competencias dadas a éste Instituto en el Artículo 27 de la Ley de la Zona Marítimo Terrestre, se procedió a reconsiderar las declaratorias de zona marítimo terrestre emitidas en años anteriores para ambos cantones, tomando en cuenta que a la fecha ya se cuenta con las respectivas clasificaciones y certificaciones de Patrimonio Natural del Estado.

Por lo anterior, de conformidad con el análisis técnico establecido en el Procedimiento institucional MPD-PT-FPP-06 para practicar la Declaratoria Turística o No Turística en la Zona Marítimo Terrestre, esta Junta Directiva resuelve lo siguiente:

1. Declarar de aptitud turística los sectores de zona marítimo terrestre localizadas en el frente costero del cantón de Carrillo, provincia de Guanacaste, incluyendo las zonas aledañas a los manglares, comprendido entre las siguientes coordenadas CRTM 05:

Declarar de aptitud turística los sectores de zona marítimo terrestre localizadas en el frente costero del cantón de Santa Cruz, provincia de Guanacaste, incluyendo las zonas aledañas a los manglares, comprendido entre las siguientes coordenadas CRTM 05:

1159829 N - 303302 E 1104905 N - 314090 E margin-right:0cm;margin-bottom:0cm; margin-left:24.0pt;margin-bottom:.0001pt'>3. Quedan excluidas de este acuerdo, todos aquellos sectores costeros que el Área de Conservación Tempisque, hayan clasificado y certificado como Patrimonio Natural del Estado, así como aquellos sectores que a futuro se reclasifiquen por dicha entidad con la Metodología establecida para tal propósito.

4. Quedan excluidas de éste acuerdo, los sectores que se encuentren afectados por lo establecido en los Artículos 6 y 73 de la Ley de la Zona Marítimo Terrestre, así como los terrenos del Polo Turístico Golfo de Papagayo, regidos por la Ley Reguladora 6758.

5. Queda derogada toda aquella declaratoria de aptitud turística o no turística que se haya practicado en años anteriores para los cantones de Carrillo y Santa Cruz, entrando a regir la incluida en el presente acuerdo una vez que se haya oficializado mediante su publicación en La Gaceta.

• B)Instruir a la Administración para que se realicen las gestiones de publicar en el Diario Oficial La Gaceta la oficialización de este acuerdo, según lo establece el Artículo 27 de la Ley de la Zona Marítimo Terrestre.
• C)Dar por recibido el oficio N° MPD-P-093-2015 elaborado por la Dirección Planeamiento y Desarrollo, relativo a recomendación para declarar de Aptitud Turística la Zona Marítimo Terrestre de los Cantones de Carrillo y Santa Cruz.
• D)Solicitar a dicha Dirección comunicar la presente resolución a todos los interesados.
