a. Whoever violates subsections 1. a) and c) and subsections 3) and 4), all of Article 39, the offender must first present up-to-date construction permits, pay for the water connection (paja de agua), pay the estimated or approximate amount for the illicit water consumption and for the damages caused to the Municipal Aqueduct (materials, labor, damages to third parties), and a fine of two base salaries for the offense committed.
b. Whoever violates subsections 1. b) and d) and subsection 5) and 7) of Article 39, the offender must, in addition to correcting and repairing any damage caused to the municipal infrastructure, pay the equivalent of one base salary of the amount assessed or established by Law.
c. Whoever disregards subsection 2) of the cited Article 39, the offender or subscriber must respect the regulations established in the current Ley de Aguas and Ley Forestal, as well as the content of Voto 1923-2004 of the Sala Constitucional and the current Plan Regulador at the time, to guarantee a healthy and ecologically balanced environment, and the Municipal Mayor's Office must forward the complaint to the respective administrative or judicial authorities.
d. Whoever disregards subsection 8 of the cited Article 39, the offender, property owner, or subscriber must pay for all damages caused to the Municipal aqueduct and shall pay a fine of five times the value.
e. Whoever violates subsection 9 of the cited Article 39, the offender shall be subject to a fine of one base salary.
In all of the preceding subsections of this article, the disconnection of the potable water service shall proceed immediately, and the amount of the cost of the disconnection shall be charged to the subscriber or to the offender on their bills. In the event of a repeat offense for any of the preceding sanctions, double the fines indicated in this article shall be charged.
In all of the preceding subsections, the Department of Environmental Management (Departamento de Gestión Ambiental), in coordination with the Department of Financial and Tax Management (Gestión Financiera Tributaria), shall evaluate, by means of a cost sheet, the damages caused to the Municipal Aqueduct, which shall include: direct labor, indirect labor, materials, transport to the location of the damage, overtime, and all costs related to the damage.
