It is agreed:
- a)To accept the recommendation given by MBA Rodolfo Lizano Rodríguez in official communication DPD-ZMT-369-2005 and to approve the Comprehensive Planning Proposals prepared by the Costa Rican Tourism Institute for the Sustainable Tourism Development Centers defined in the General Land Use Plans of the Tourism Planning units of Southern Guanacaste and Golfito Corcovado, defined as follows:
a.1 Comprehensive Regulatory Plan of Sámara-Carrillo, Municipalities of Nicoya and Hojancha, province of Guanacaste, comprised between the following geographic coordinates:

- b)The holding of the public consultation of the planning proposals, at the national and regional level, where they will be made known to the public to receive observations and comments, will take place once MINAE has officially delivered the forest areas and lands of forest aptitude, within the Maritime Terrestrial Zone subject to the Comprehensive Plan.
CONDITIONS:
- 1)The consultation process will begin once the delimitation of the forest zones and lands of forest aptitude, officially indicated by MINAE within the area of the Comprehensive Regulatory Plan, is available. Likewise, the submission of the official Documentation to the Municipalities and the National Institute of Housing and Urbanism will occur at the moment said information has been incorporated into the Planning Proposals.
- 2)All properties duly registered in the period during which the Third Transitional Provision of Law No. 4558 on Tourism Urbanization of the Maritime Terrestrial Zone was in force, which period runs from May 12, 1970, to October 14, 1971, are excluded from the application of the provisions of the Comprehensive Regulatory Plans.
- 3)It is warned that any construction existing to date, in sectors where the Requirements of Law 6043 and its Regulation have not existed to date, and which is contained in this Institutional Comprehensive Regulatory Plan Proposal, are in principle infringing said regulations; therefore, the corresponding Municipality must necessarily apply the procedure established in Legal Opinion C-230-97 dated December 3, 1997, issued by the Attorney General's Office of the Republic, addressed to the General Management of the Costa Rican Tourism Institute.
