1That in accordance with subsection e) of Article 6 of Law 8495 of April 6, 2006, the Law of the National Animal Health Service (SENASA), it is the competence of said Service ".To issue the pertinent technical standards, prepare procedure manuals, as well as execute and control animal welfare measures, veterinary inspection, internal displacement, import, export, transit, sanitary cordons, prohibition of displacement to infected zones or premises, prohibition or controlled use of veterinary medications and veterinary laboratory reagents, epidemiological surveillance and investigation, and sanitary and veterinary measures in general, for all domestic, wild, aquatic or other animals, their genetic material, their products, by-products, derivatives, their waste, hazardous substances, and animal feed. This Law includes the competence to know and regulate any other measure or product that technology develops and that affects animal health or production..."
2That likewise, subsection k) of the referred Article 6 of the aforementioned Law 8495 establishes that it is the competence of the National Animal Health Service (SENASA)". To establish the national traceability system for animals, their products and by-products, and for the inputs used in animal production."
3That in fine, Article 6 of the referred Law 8495 establishes that SENASA shall be considered a health authority and that, therefore, every person, natural or juridical, is subject to the mandates of this Law, its Regulations, and the general and particular orders, ordinary and emergency, that this authority issues in the exercise of its competences.
4That Law Nº 8799 of April 17, 2010, the Law for the Control of Bovine Cattle, Prevention and Sanction of its Robbery, Theft, and Receiving, has as its purpose to define the procedures, mechanisms, and responsibilities to control, regulate, prevent, and sanction the slaughter, killing, seizure, movement, transport, commercialization, contraband, and negotiation of bovine cattle, as well as their products and by-products, within the national territory.
5That livestock activity is one of the historically most important economic activities, its impact on the population's nutrition, food security, job creation, and foreign currency income to the economy being undeniable, and therefore it is key for the State to promote and support it.
6That given that the aforementioned law establishes a series of measures and procedures that create the need for certain cattle commercialization and movement processes to be modified from its entry into force, SENASA, in partnership with the Livestock Development Corporation (Corporación de Fomento Ganadero, CORFOGA), the Chamber of United Ranchers of the South (Cámara de Ganaderos Unidos del Sur, CGUS), the Chamber of Independent Ranchers of the South, and Subasta Cotobruseña S.A., have developed a pilot plan for the control of movement and traceability of bovine cattle in the Brunca Region, and this experience will be of the utmost importance for the purposes of standardizing processes throughout the country on the occasion of the entry into force of the aforementioned Law Nº 8799 and eventually the implementation of the Traceability Program, ordered by Law Nº 8495 under the responsibility of SENASA. Therefore, it is convenient to formalize it within the framework of Law Nº 8495, as well as the official movement guide instrument developed within the framework of said pilot plan. Therefore,

THE GENERAL DIRECTOR OF THE NATIONAL ANIMAL HEALTH SERVICE OF THE MINISTRY OF AGRICULTURE AND LIVESTOCK Issues the following Sanitary Directive:

PILOT PLAN FOR THE CONTROL OF MOVEMENT AND GROUP TRACEABILITY OF BOVINE CATTLE IN THE BRUNCA REGION Purpose and definitions

Considering:

ANNEX 1

Veterinary Operation Certificate (Certificado Veterinario de Operación): Certificate issued by SENASA, by means of which authorization shall be recorded so that the establishment may engage in one or several of the activities listed in Article 56 of the SENASA Law, Nº 8495.

Unique Identification Code or Establishment Code (Código de Identificación Único o Código de Establecimiento): Unique identification code assigned by SENASA, which identifies the establishment at the national level.

CVO: Veterinary Operation Certificate (Certificado Veterinario de Operación).

Shipment (Embarque): a group of bovines that are moved from the same origin to the same destination, at the same time and by the same means. It may consist of one or more animals. A shipment constitutes the transfer unit.

Establishment: Any installation, construction, vehicle, or in the case of open-air establishments, any area or land situated in a determined location, under the responsibility of a holder and dedicated to some livestock activity that is of productive, sanitary, and/or epidemiological interest to SENASA.

Primary Production Establishment (Farm) (Establecimiento de Producción Primaria (Finca)): Any extension of land or area dedicated totally or partially to the livestock production of one or more species, regardless of the title, legal form, or size, under the management and responsibility of a principal holder. The productive unit may be constituted by aggregated or disaggregated areas in lots or land owned or not as long as they are not located at a distance greater than 1 km from the administrative center of the farm, are exploited under the same administration, and share the same means of production such as labor, machinery, and work equipment.

Origin establishment (Establecimiento de origen): establishment where the movement of an animal or group of animals, covered by a movement guide, originates.

Official movement guide (Guía oficial de movilización): official public document, with the character of a sworn statement by the person responsible or owner of the animals, regarding the information contained therein, with which the transport and movement of animals on public streets or roads from a registered establishment is permitted, to the extent that the information provided is complete and in compliance with the regulations of the law and its Regulation.

Sanitary guide (Guía sanitaria): Sanitary transport guide: Official document issued by the corresponding authority (SENASA), when a sanitary emergency has been declared, in which case its use shall be mandatory for those animals that are transported and which shall be done under controlled conditions and with a specific destination according to the directives of the sanitary authority.

MAG: Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería).

Owner (Propietario): Natural or juridical person who is the holder, by any legal means, of a property or bovines.

Traceability (Rastreabilidad/trazabilidad): the ability to follow the movement of a bovine or batch of bovines and their parts through specific stages of production, commercialization, transformation, and distribution.

Representative (Representante): that natural or juridical person designated by the person responsible for the establishment to process or respond on their behalf, regarding administrative aspects linked to the establishment.

Responsible Person or Holder (Responsable o Titular): natural or juridical person who is responsible for deciding on the production or other activities of the establishment and takes responsibility for it and for the animals found therein before SENASA.

SENASA: National Animal Health Service (Servicio Nacional de Salud Animal), created by Law Nº 8495 of April 6, 2006.

Transporter (Transportista): Natural or juridical person who is engaged habitually or occasionally in the transport of live animals or products and by-products of animal origin in vehicles.

System components

a)Registration and identification of establishments and commercial operators b) Identification of bovines c) Record of movements d) Record of livestock departures (egresos), entries (ingresos), and stock (existencias ganaderas) Of the registration and identification of establishments and commercial operators

a)Primary production establishments (farms) that can be the origin or destination of transfers of live bovine cattle.
b)Commercialization establishments for live bovine cattle, without prejudice to the provisions of Executive Decree (Decreto Ejecutivo) Nº 34976-MAG-MEIC-SP, "Regulation for the Operation and Commercialization of Live Cattle at Auction and the Granting of the Veterinary Operation Certificate (Certificado Veterinario de Operación)" and other related regulations.
c)Transporters of live bovines or their derivatives. Vehicles for the transport of bovines, including trailers, must also comply, in addition to the regulations of the Ministry of Public Works and Transport, with SENASA's approval once they have been inspected and verified to comply with the specific requirements that ensure adequate sanitary conditions and animal welfare (bienestar animal).
d)Slaughterhouses (mataderos) authorized for the slaughter and processing of bovine cattle, without prejudice to the provisions of Decree Nº 29588-MAG-S, "Sanitary and Veterinary Inspection Regulation for Slaughterhouses, Production, and Meat Processing" and other related regulations.

Any change in the ownership or holder condition of the establishment must be reported to SENASA as soon as possible.

The information provided by the holder shall be used solely for sanitary purposes and for the purposes of this system.

The loss or deterioration of the identification plate must be reported by the holder to the Brunca Regional Directorate of SENASA immediately. The unique identification code must be indicated on every official document where it is necessary to identify the establishment and the animals found therein and may not be used by any other establishment other than the one for which it was issued.

Of the identification of bovines

For this procedure, they must have the authorization of the person responsible for the establishment when it is not the same person.

If the animal has several brands, the brand declared on the movement guide shall be taken as valid.

Of the record of movements and movement guides

In each guide, the total number of animals to be moved, the quantity per category (sex and age group), the origin and destination of the animals to be moved, as well as the details of their identification, must be declared.

The persons who are registered as responsible persons in the official register of livestock establishments established in Article 4 of this Directive, or their representatives, are authorized to request them. The Brunca Regional Directorate of SENASA shall keep a record of the receipt books assigned to each responsible person, assigning them a unique numbering sequence. The responsible person must maintain custody of the forms and ensure their correct use, and shall likewise report immediately to the Brunca Regional Directorate of SENASA on the loss, deterioration, theft, or unauthorized use of the receipt book or its sheets, in which case the Brunca Regional Directorate of SENASA may annul their validity.

The information corresponding to the origin and destination data of the shipment as well as the characteristics and identification of the animals to be transported must be completed according to the procedure and the application guide that for such purposes the Brunca Regional Directorate of SENASA indicates.

When the movement originates in a commercialization center, the guide must also indicate the name and ID number of the buyer and seller of the animals, who shall be those responsible for the ownership of the same.

The person responsible for the origin establishment of the shipment shall keep a copy of each guide attached to the receipt book, which shall form part of the traceability record of their establishment, according to Articles 22, 23, and 24 of this Pilot Plan. Commercialization centers may keep an electronic record of the issued guides, which shall complement the physical record.

Likewise, they must deliver the original guide at the destination location of the animals.

The Brunca Regional Directorate of SENASA shall keep a record of logbooks assigned to each transporter, assigning them a unique numbering sequence. The responsible person must maintain custody of the logbook and ensure its correct use, and shall likewise report immediately to the Brunca Regional Directorate of SENASA on its loss, deterioration, theft, or unauthorized use, in which case SENASA may annul its validity.

If more than one shipment is moved in the same means of transport, the transporter must carry a movement guide for each one and ensure that the animals of each shipment are kept separated within the vehicle or, failing that, are identified in a way that allows the animals to be associated with the corresponding guide.

Of the record of departures (egresos), entries (ingresos), and livestock stock (existencias ganaderas)

Likewise, the movement guides corresponding to all animal entries (ingresos) from another establishment must be kept. The movement guides and the movement record may be required at any time by the Brunca Regional Directorate of SENASA. In the absence of these documents or of what is established in Article 23 of this Pilot Plan, the holder shall assume the sanitary and legal responsibility for the animals that have entered and/or left from or to their establishment.

Likewise, they must keep a physical or electronically supported record of the issued movement guides, in addition to keeping the movement guides corresponding to all entries (ingresos) in order to send them to the Brunca Regional Directorate of SENASA within a period not exceeding eight business days. Commercialization establishments outside the Brunca Region shall continue with their currently established procedures.

They must also have an internal or process traceability program endorsed by the indicated Regional Directorate, which allows identifying and relating the process batches with the origin of the animals according to the information recorded in the movement guide with which they entered the establishment. Similarly, they must complement this process with the implementation of records that allow the traceability of their products to their clients (forward traceability (rastreabilidad hacia adelante)).

Of the control of bovine transport on the road

It corresponds to the police authorities of the control posts to review and verify that the required information is complete and that there is correspondence regarding the number of animals in the shipment, their identification, and their characteristics, as well as the transporter's data and the vehicle.

Controls in bovine commercialization centers and slaughterhouses (mataderos)

In these cases, the person responsible for receiving animals at the establishment must notify the Brunca Regional Directorate of SENASA in writing regarding the matter.

Obligations

a)To enable and maintain the official register of livestock establishments and transporters.
b)To attend to registration and update requests for establishments and transporters.
c)To supervise establishments to verify the registry information and compliance with the requirements for the authorization of the activities they carry out.
d)To make available to users the official movement guide forms and the instructions for the use of the guide forms and use of movement logbooks (bitácoras de movilización).
e)To define the procedures for the acquisition, technical requirements, and use of bovine identification devices, when applicable.
f)To inform users about the scope and specific regulations of this program and the procedures for its application.
g)To maintain and supervise the animal movement record and movement guides, in which the issuance and tracking of movement documents is managed.
h)To operationally maintain the official information system on sanitary traceability, in which the information from all program components is entered, processed, and consulted in an integrated manner.
i)To design and execute the necessary controls for the proper operation of the system.
j)To make the necessary reports to the General Directorate of SENASA for the purpose of imposing the corresponding sanctions derived from non-compliance with the standards contained in Law Nº 8495, related to this matter and this pilot plan when applicable.
k)To establish coordination mechanisms with the Livestock Development Corporation (Corporación de Fomento Ganadero, CORFOGA), the Chamber of United Ranchers of the South (Cámara de Ganaderos Unidos del Sur, CGUS); the Chamber of Independent Ranchers of the South, and Subasta Cotobruseña S.A., among others, to facilitate the procedures to which the different operators of the movement control and group traceability system for bovines to be developed in the Brunca Region must submit through this Pilot Plan.

a)To request the registration of their establishment in the official register of livestock establishments and to process the CVO for their establishment.
b)To provide the information required by the Brunca Regional Directorate of SENASA for the establishment's registration.
c)To acquire the movement guide forms for their establishment.
d)To truthfully, completely, and correctly complete the movement guide form at the time of the shipment (embarque) of the animals at the establishment and to sign the document, or failing that, to authorize a representative for these purposes.
e)To keep a physical or electronic record of all bovine entries (ingresos) and departures (salidas) to their establishment and to allow the authorities of the Brunca Regional Directorate of SENASA access to this record when so requested.
f)To keep the farm identification plate in the place assigned to it and to report its loss or deterioration to the regional authorities of SENASA.
g)To keep the animals they own duly identified.
h)To declare before the Brunca Regional Directorate of SENASA within a period not exceeding 30 business days, any change that modifies the condition originally declared for the establishment, such as segregation, sale, division, or termination of the contractual condition.
i)To maintain custody of the guides and records established in this Directive and to ensure their correct use. Similarly, they must immediately report the loss, theft, or unauthorized use of any of the documents they hold under their responsibility and custody.
j)To respect the withdrawal periods for all medications applied to the animals before their movement or to warn otherwise on the movement guide.
k)To attend to all other obligations that apply according to Law Nº 8495.

a)To register as a transporter with the Brunca Regional Directorate of SENASA.
b)To process the CVO for the vehicles they will use for the transport of animals, products, or by-products.
c)To carry, during transport and in the means of transport, the movement guide corresponding to the animals of the shipment or the commercial invoices for products or by-products.
d)To verify that the characteristics and identification of the animals they transport correspond to the data recorded on the movement guide and that the establishment code corresponds to the shipment establishment.
e)To complete the information regarding the transporter on the movement guide.
f)To keep a movement logbook (bitácora de movilización) in which they shall chronologically record every animal transfer they make, the date on which the movement is made, the code of the origin establishment and the destination of the movement.
g)To present the movement guide and the logbook to any police, administrative, or judicial authority when required.
h)To permit the inspection of the vehicle and its load and to provide the information required by the competent authority when requested.
i)To ensure animal welfare (bienestar animal), transporting the animals in adequate conditions, avoiding mistreatment or suffering, and ensuring compliance with good transport practices.
j)To ensure that animals from different shipments are kept separated in the vehicle during transport, or failing that, are identified in a way that allows the animals to be associated with the pertinent guide.
k)To deliver the movement guide at the destination location of the shipment.
l)To comply with the orders of the competent authority when anomalies arise that justify the detention of the cargo.
m)Inform the police, the veterinary regent of the destination establishment, or the Brunca Regional Directorate of SENASA of the death, loss of animals, or any other situation that may represent a change with respect to the information declared in the official movement guide (guía oficial de movilización).
n)Renew the movement logbook (bitácora de movilización) with SENASA when it has been completed, or proceed to its return when the Brunca Regional Directorate of SENASA so requests.
o)Maintain custody of the guides during transport, as well as of the other documents established in this Directive and ensure their correct use; likewise, must immediately report to the Brunca Regional Directorate of SENASA the loss, theft, deterioration, or unauthorized use of any of the documents kept under its responsibility and custody.
p)Address all other corresponding obligations in accordance with Law No. 8495.

a)Verify during the visual inspection that the animals are in good sanitary conditions.
b)In the case of animals from herds subjected to sanitation for infectious-contagious diseases and identified as such in the Brunca Region, the regent veterinary doctor must require the sanitary guide issued by the official or accredited veterinary doctor and must ensure compliance with the measures indicated for these cases by the Brunca Regional Directorate of SENASA.
c)Ensure compliance with the regulations established in this Pilot Plan and immediately inform the Regional Directorate in the event of non-compliance by those responsible for the marketing establishments or slaughterhouses, as applicable.
d)Address all other corresponding obligations in accordance with Law No. 8495.

Regarding Non-Compliance, Infringements, or Omissions

Non-compliance, infringements, alterations, or omissions with respect to the provisions of this Pilot Plan shall be made known to the General Directorate of SENASA in order to initiate proceedings to impose administrative sanctions according to the seriousness of the fault, in accordance with the provisions of Chapter IX of Law No. 8495 of April 6, 2006. When any non-compliance is detected that is considered to constitute a crime, the corresponding complaint shall be filed with the appropriate Public Prosecutor's Office.

Transitory Provisions

8495. Likewise, the Brunca Regional Directorate of SENASA may establish specific regulations that include individual identification and traceability for imported animals, in the border zone under its jurisdiction, in sanitation zones in herds subjected to disease control campaigns, or when the epidemiological situation so justifies it.

1Que de conformidad con el inciso e) del artículo 6 de la Ley 8495 del 6 de abril del 2006, Ley del Servicio Nacional de Salud Animal (SENASA), es competencia de dicho Servicio ".Dictar las normas técnicas pertinentes, elaborar los manuales de procedimientos, así como ejecutar y controlar las medidas de bienestar animal, inspección veterinaria, desplazamiento interno, importación, exportación, tránsito, cordones sanitarios, prohibición de desplazamiento a zonas o locales infectados, prohibición o uso controlado de medicamentos veterinarios y reactivos de laboratorio veterinario, vigilancia e investigación epidemiológica y medidas sanitarias y veterinarias en general, de todo animal doméstico, silvestre, acuático u otros, su material genético, sus productos, subproductos, derivados, sus desechos, las sustancias peligrosas y los alimentos para animales. Se incluye en esta Ley, la competencia para conocer y regular cualquier otra medida o producto que la tecnología desarrolle y afecte la salud o la producción animal..."
2Que igualmente el inciso k) del referido artículo 6 de la Ley 8495 antes citada, establece que es competencia del Servicio Nacional de Salud Animal (SENASA)". Establecer el sistema nacional de trazabilidad/rastreabilidad de animales, sus productos y subproductos, y de los insumos utilizados en la producción animal."
3Que in fine el artículo 6 de la Ley 8495 referido establece que el SENASA se considerará una autoridad en salud y que por ello, toda persona, natural o jurídica, queda sujeta a los mandatos de esta Ley, sus Reglamentos y a las órdenes generales y particulares, ordinarias y de emergencia, que esta autoridad dicte en el ejercicio de sus competencias.
4Que la Ley Nº 8799 del 17 de abril del 2010, Ley de Control de Ganado Bovino, Prevención y Sanción de su Robo, Hurto y su Receptación tiene por objeto definir los procedimientos, los mecanismos y las responsabilidades para controlar, regular, prevenir y sancionar el destace, la matanza, el apoderamiento, la movilización, el transporte, la comercialización, el contrabando y la negociación de ganado bovino, así como de sus productos y subproductos, en el territorio nacional.
5Que la actividad ganadera es una de las actividades económicas históricamente más importantes siendo innegable su incidencia en la nutrición de la población, la seguridad alimentaria, la generación de empleo y el ingreso de divisas a la economía y por ello resulta clave para el Estado promoverla y apoyarla.
6Que dado que la ley antes indicada establece una serie de medidas y procedimientos que provocan la necesidad de que a partir de su vigencia se modifiquen ciertos procesos de comercialización y movilización de ganado, el SENASA en asocio de Corporación de Fomento Ganadero (CORFOGA), la Cámara de Ganaderos Unidos del Sur (CGUS), la Cámara de Ganaderos Independientes del Sur y la Subasta Cotobruseña S.A. han desarrollado un plan piloto para el control de movilización y rastreabilidad de ganado bovino en la Región Brunca y cuya experiencia será de la mayor importancia a los efectos de estandarizar procesos en todo el país con ocasión de la entrada en vigencia de la Ley Nº 8799 antes indicada y eventualmente la implementación del Programa de Trazabilidad, que ordena la Ley Nº 8495 a cargo del SENASA, por lo que conviene oficializarlo dentro del marco de la Ley Nº 8495, así como al instrumento guía oficial de movilización desarrollado dentro del marco de dicho plan piloto. Por tanto,

LA DIRECTORA GENERAL DEL SERVICIO NACIONAL DE SALUD ANIMAL DEL MINISTERIO DE AGRICULTURA Y GANADERÍA Emite la siguiente Directriz Sanitaria:

PLAN PILOTO DE CONTROL DE MOVILIZACIÓN Y RASTREABILIDAD GRUPAL DE GANADO BOVINO EN LA REGIÓN BUNCA Objeto y definiciones

Considerando:

ANEXO 1

Certificado Veterinario de Operación: Certificado que emite el SENASA, mediante el cual se hará constar la autorización, a fin de que el establecimiento se dedique a una o varias actividades de las enumeradas en el artículo 56 de la Ley SENASA, Nº 8495.

Código de Identificación Único o Código de Establecimiento: Código de identificación único asignado por el SENASA, que identifica al establecimiento en el ámbito nacional.

CVO: Certificado Veterinario de Operación.

Embarque: conjunto de bovinos que se movilizan desde un mismo origen a un mismo destino, en el mismo momento y por el mismo medio. Puede estar conformado por uno o más animales. Un embarque constituye la unidad de traslado.

Establecimiento: Cualquier instalación, construcción, vehículo o en el caso de establecimientos al aire libre, cualquier área o terreno situado en una ubicación determinada, bajo responsabilidad de un titular y dedicado a alguna actividad pecuaria que resulte de interés productivo, sanitario y/o epidemiológico para el SENASA.

Establecimiento de Producción Primaria (Finca): Toda extensión de tierra o área dedicada total o parcialmente a la producción pecuaria de una o más especies, independientemente del título, forma jurídica o tamaño, bajo gerencia y responsabilidad de un titular principal. La unidad productiva puede estar constituida por áreas agregadas o desagregadas en lotes o terrenos propios o ajenos siempre y cuando no se encuentren a una distancia mayor a 1 km del centro administrativo de la finca, se exploten bajo una misma administración y se compartan los mismos medios de producción tales como mano de obra, maquinaria y equipo de trabajo.

Establecimiento de origen: establecimiento donde se origina el movimiento de un animal o grupo de animales, amparados a una guía de movilización.

Guía oficial de movilización: documento público oficial, con carácter de declaración jurada por parte del responsable o propietario de los animales, sobre la información ahí consignada, con el que se permite el transporte y movilización de animales en calles o caminos públicos desde un establecimiento registrado, en la medida en que la información consignada sea completa y en apego a las regulaciones de la ley y su Reglamento.

Guía sanitaria: Guía sanitaria de transporte: Documento oficial emitido por la autoridad correspondiente (SENASA), cuando se hubiere declarado emergencia sanitaria en cuyo caso será obligatorio el uso de la misma para aquellos animales que se transporten y lo cual se hará bajo condiciones controladas y con un destino específico de acuerdo a las directrices de la autoridad sanitaria.

MAG: Ministerio de Agricultura y Ganadería.

Propietario: Persona física o jurídica titular por cualquier medio legal de un inmueble o de bovinos.

Rastreabilidad/trazabilidad: capacidad de seguir el movimiento de un bovino o lote de bovinos y sus partes a través de etapas especificas de producción, comercialización, transformación y distribución.

Representante: aquella persona física o jurídica designada por el responsable del establecimiento para tramitar o responder en su nombre, aspectos administrativos vinculados con el establecimiento.

Responsable o Titular: persona física o jurídica, a quien corresponde decidir sobre la producción o demás actividades del establecimiento y se responsabiliza del mismo y de los animales que se encuentran en el ante el SENASA.

SENASA: Servicio Nacional de Salud Animal, creado mediante la Ley Nº 8495 del 6 de abril del 2006.

Transportista: Persona física o jurídica que se dedica de forma habitual u ocasional al transporte de animales vivos o productos y subproductos de origen animal en vehículos.

Componentes del sistema

a)Registro e identificación de establecimientos y operadores comerciales b) Identificación de bovinos c) Registro de los movimientos d) Registro de egresos, ingresos y existencias ganaderas Del registro e identificación de establecimientos y operadores comerciales

a)Los establecimientos de producción primaria (fincas) que pueden ser origen o destino de los traslados de ganado bovino en pie.
b)Los establecimientos de comercialización de ganado bovino en pie, sin perjuicio de lo establecido en el Decreto Ejecutivo Nº 34976-MAG-MEIC-SP, "Reglamento para Funcionamiento y Comercialización de Ganado en Pie en Subasta y Otorgamiento del Certificado Veterinario de Operación" y demás normativa conexa.
c)Los transportistas de bovinos en pie o sus derivados. Los vehículos para el transporte de bovinos, incluyendo los remolques, deberán de cumplir además de las regulaciones propias del Ministerio de Obras Públicas y Transportes, con la aprobación del SENASA una vez que se hayan inspeccionado y constatado que cumplen con los requisitos específicos que aseguren condiciones sanitarias y de bienestar animal adecuadas.
d)Los mataderos autorizados para la matanza y proceso de ganado bovino, sin perjuicio de lo establecido en el Decreto Nº 29588-MAG-S, "Reglamento Sanitario y de Inspección Veterinaria de Mataderos, Producción y Procesamiento de Carnes" y demás normativa conexa.

Cualquier cambio en la condición de propiedad o titularidad del establecimiento deberá ser reportado al SENASA a la mayor brevedad.

La información suministrada por el titular se utilizará únicamente con fines sanitarios y para efectos de este sistema.

La pérdida o deterioro de la placa de identificación deberá ser reportada por el titular a la Dirección Regional Brunca del SENASA de forma inmediata. El código de identificación único deberá de indicarse en todo documento oficial donde sea necesario identificar el establecimiento y los animales que se encuentren en él y no podrá ser utilizado por ningún otro establecimiento que no sea aquel para el cual fue expedido.

De la identificación de los bovinos

Para este trámite deberá de contar con la autorización del responsable del establecimiento cuando no se trate de la misma persona.

Si el animal presenta varias marcas se tomará como vigente la marca que se declare en la guía de movilización.

Del registro de los movimientos y las guías de movilización

En cada guía se deberá de declarar el número de total de animales a movilizar, la cantidad por categoría (sexo y grupo etario), el origen y destino de los animales a movilizar así como los detalles de su identificación.

Quedan autorizadas para solicitarlas las personas que se encuentran registradas como responsables en el registro oficial de establecimientos pecuarios que se establece en el artículo 4 de esta Directriz o sus representantes. La Dirección Regional Brunca del SENASA llevará un registro de los talonarios asignados a cada responsable asignándole una secuencia de numeración única. El responsable debe mantener la custodia de los formularios y velar por su correcto uso, de igual forma deberá reportar de forma inmediata a la Dirección Regional Brunca del SENASA sobre la pérdida, deterioro, robo o uso no autorizado del talonario o sus folios, en cuyo caso la Dirección Regional Brunca del SENASA podrá anular su vigencia.

La información correspondiente a los datos de origen y destino del embarque así como las características e identificación de los animales a transportar debe de completarse según el procedimiento y la guía de aplicación que para tales fines indique la Dirección Regional Brunca del SENASA.

Cuando el movimiento se origine en un centro de comercialización deberá de indicarse además en la guía el nombre y cédula del comprador y vendedor de los animales, quienes serán los responsables sobre la propiedad de los mismos.

Los centros de comercialización podrán llevar un registro electrónico de las guías emitidas el cual completará el registro físico.

Asimismo deberá entregar la guía original en el lugar de destino de los animales.

La Dirección Regional Brunca del SENASA llevará un registro de bitácoras asignadas a cada transportista asignándole una secuencia de numeración única. El responsable debe mantener la custodia de la bitácora y velar por su correcto uso, de igual forma deberá reportar de forma inmediata a la Dirección Regional Brunca del SENASA sobre la pérdida, deterioro, robo o uso no autorizado en cuyo caso el SENASA podrá anular su vigencia.

Si en un mismo medio de transporte se moviliza más de un embarque, el transportista debe de portar una guía de movilización por cada uno y asegurarse de que los animales de cada embarque se encuentren separados dentro del vehículo o en su defecto se encuentren identificados de manera que permita asociar los animales con la guía que les corresponda.

Del registro de egresos, ingresos y existencias ganaderas

De la misma forma se deberán conservar las guías de movilización correspondientes a todos los ingresos de animales desde otro establecimiento. Las guías de movilización y el registro de movilización podrán ser requeridos en cualquier momento por la Dirección Regional Brunca del SENASA. Ante la ausencia de estos documentos o de lo establecido en el artículo 23 de este Plan Piloto, el titular asumirá la responsabilidad sanitaria y legal sobre los animales que hayan ingresado y/o salido desde o hacia su establecimiento.

Asimismo deberán llevar un registro físico o con soporte electrónico de las guías de movilización emitidas, además conservar las guías de movilización correspondientes a todos los ingresos a fin de remitirlas a la Dirección Regional Brunca del SENASA en un plazo no mayor de ocho días hábiles. Los establecimientos de comercialización fuera de la Región Brunca continuarán con sus procedimientos actualmente establecidos.

Deberán de contar además con un programa de rastreabilidad interna o de proceso avalado por la Dirección Regional señalada, que permita identificar y relacionar los lotes de proceso con el origen de los animales de acuerdo con la información consignada en la guía de movilización con que ingresaron al establecimiento. De igual forma deberán de complementar este proceso con la implementación de registros que permitan la rastreabilidad de sus productos hacia sus clientes (rastreabilidad hacia adelante).

Del control del transporte de bovinos en carretera

Les corresponde a las autoridades de policía de los puestos de control revisar y verificar que la información requerida sea completa y que exista correspondencia en cuanto al número de animales del embarque, su identificación y sus características, así como los datos del transportista y el vehículo.

Controles en centros de comercialización de bovinos y mataderos

En estos casos el responsable de recibo de los animales del establecimiento deberá de notificar por medio escrito sobre el particular a la Dirección Regional Brunca del SENASA.

Obligaciones

a)Habilitar y mantener el registro oficial de establecimientos pecuarios y transportistas.
b)Atender las solicitudes de registro y actualización de establecimientos y transportistas.
c)Supervisar los establecimientos para verificar la información del registro y el cumplimiento de los requisitos para la autorización de las actividades que realiza.
d)Poner a disposición de los usuarios los formularios de guías oficiales de movilización y los instructivos para el uso de los formularios de guías y uso de bitácoras de movilización.
e)Definir los procedimientos para adquisición, exigencias técnicas y uso de los dispositivos de identificación de bovinos, cuando corresponda.
f)Informar a los usuarios sobre los alcances y regulaciones propias de este programa y los procedimientos para su aplicación.
g)Mantener y supervisar el registro de movilización de animales y guías de movilización, en el que se administra la emisión y seguimiento de los documentos de movilización.
h)Mantener de forma operativa el sistema oficial de información sobre rastreabilidad sanitaria, en el que se ingresa, procesa y consulta la información de todos los componentes del programa de forma integrada.
i)Diseñar y ejecutar los controles necesarios para la buena operatividad del sistema.
j)Realizar los informes necesarios a la Dirección General del SENASA a efectos de que se impongan las sanciones que correspondan derivadas del incumplimiento de normas contenidas en la Ley Nº 8495, relativas a esta materia y este plan piloto cuando así corresponda.
k)Establecer mecanismos de coordinación con la Corporación de Fomento Ganadero (CORFOGA), la Cámara de Ganaderos Unidos del Sur (CGUS); la Cámara de Ganaderos Independientes del Sur y la Subasta Cotobruseña S.A., entre otros, para facilitar los trámites a los cuales deberán someterse los distintos operadores del sistema de control de movilización y rastreabilidad grupal de bovinos a desarrollarse en la Región Brunca a través del presente Plan Piloto.

a)Solicitar la inscripción de su establecimiento en el registro oficial de establecimientos pecuarios y tramitar el CVO para su establecimiento.
b)Facilitar la información requerida por la Dirección Regional Brunca del SENASA para el registro del establecimiento.
c)Adquirir los formularios de guías de movilización para su establecimiento.
d)Completar de forma veraz, completa y correcta el formulario de guía de movilización al momento del embarque de los animales en el establecimiento y firmar el documento, o en su defecto autorizar a un representante para estos fines.
e)Llevar un registro físico o electrónico de todos los ingresos y salidas de bovinos a su establecimiento y permitir a las autoridades de la Dirección Regional Brunca del SENASA el acceso a este registro cuando así sea solicitado.
f)Mantener la placa de identificación de finca en el lugar que le ha sido asignado y reportar su pérdida o deterioro ante las autoridades regionales del SENASA.
g)Mantener los animales de su propiedad debidamente identificados.
h)Declarar ante la Dirección Regional Brunca del SENASA en un plazo no mayor de 30 días hábiles, sobre cualquier cambio que modifique la condición declarada originalmente para el establecimiento, tales como segregación, venta, división o finiquito de la condición contractual.
i)Mantener la custodia de las guías y los registros que se establecen en esta Directriz y velar por su correcto uso, de igual forma deberá reportar de forma inmediata sobre la pérdida, robo o uso no autorizado de cualquiera de los documentos que mantiene bajo su responsabilidad y custodia.
j)Respetar los períodos de retiro de todos los medicamentos aplicados a los animales antes de su movilización o advertir de lo contrario en la guía de movilización.
k)Atender todas las demás obligaciones que correspondan de acuerdo a la Ley Nº 8495.

a)Inscribirse como transportista ante la Dirección Regional Brunca del SENASA.
b)Tramitar el CVO de los vehículos que vaya a utilizar para el transporte de los animales, productos o subproductos.
c)Portar durante el transporte y en el medio de transporte la guía de movilización correspondiente a los animales del embarque o las facturas comerciales en caso de productos o subproductos.
d)Verificar que las características e identificación de los animales que transporta correspondan con los datos consignados en la guía de movilización y que el código de establecimiento corresponda con el establecimiento de embarque.
e)Completar en la guía de movilización la información referente al transportista.
f)Llevar una bitácora de movilización en la cual registrará de forma cronológica todo traslado de animales que realice, la fecha en que se realice el movimiento, el código del establecimiento de origen y de destino del movimiento.
g)Presentar la guía de movilización y la bitácora a toda autoridad policial, administrativa o judicial cuando ésta lo requiera.
h)Permitir la inspección del vehículo y su carga y suministrar la información requerida por la autoridad competente cuando se le solicite.
i)Velar por el bienestar animal, transportando los animales en condiciones adecuadas, evitando el maltrato o sufrimiento y velando por el cumplimiento de las buenas prácticas de transporte.
j)Asegurarse que los animales de diferentes embarques se mantengan separados en el vehículo durante el transporte o en su defecto se encuentren identificados de manera que permita asociar los animales con la guía pertinente.
k)Entregar la guía de movilización en el lugar de destino del embarque.
l)Atender las órdenes de la autoridad competente cuando se presenten anomalías que justifiquen la retención del cargamento.
m)Informar a la policía, al regente veterinario del establecimiento de destino o a la Dirección Regional Brunca del SENASA, sobre la muerte, pérdida de animales o cualquier otra situación que pueda representar un cambio con respecto a la información declarada en la guía oficial de movilización.
n)Renovar la bitácora de movilización ante el SENASA cuando ésta se haya completado, o proceder a su devolución cuando la Dirección Regional Brunca del SENASA se lo solicite.
o)Mantener la custodia de las guías durante el transporte, así como de los demás documentos que se establecen en esta Directriz y velar por su correcto uso, de igual forma deberá reportar de forma inmediata a la Dirección Regional Brunca del SENASA sobre la pérdida, robo, deterioro o uso no autorizado de cualquiera de los documentos que mantiene bajo su responsabilidad y custodia.
p)Atender todas las demás obligaciones que correspondan de acuerdo con la Ley Nº 8495.

a)Verificar durante la inspección ocular que los animales se encuentren en buenas condiciones sanitarias.
b)En caso de animales provenientes de rebaños sometidos a saneamiento por enfermedades infectocontagiosas e identificados como tales en la Región Brunca, el médico veterinario regente deberá de exigir la guía sanitaria emitida por el médico veterinario oficial o acreditado y deberá velar por el cumplimiento de las medidas que para estos casos indique la Dirección Regional Brunca del SENASA.
c)Velar por el cumplimiento de las regulaciones establecidas en este Plan Piloto e informar inmediatamente a la Dirección Regional en caso de incumplimiento por parte de los responsables de los establecimientos de comercialización o de los mataderos según corresponda.
d)Atender todas las demás obligaciones que correspondan de acuerdo con la Ley Nº 8495.

Sobre los incumplimientos, infracciones u omisiones

Los incumplimientos, infracciones, alteraciones u omisiones a las disposiciones del presente Plan Piloto, serán puestos en conocimiento de la Dirección General del SENASA a los efectos de que se inicien los procedimientos para imponer las sanciones administrativas según la gravedad de la falta, de conformidad con lo establecido en el Capítulo IX de la Ley N° 8495 del 6 de abril del 2006. Cuando en la especie se detecte algún incumplimiento que se considere comisión de delito se realizará la correspondiente denuncia ante la Oficina del Ministerio Publico que corresponda.

Disposiciones Transitorias

De igual forma la Dirección Regional Brunca del SENASA podrá establecer regulaciones específicas que incluyen la identificación y la rastreabilidad individual para los animales importados, en la zona fronteriza bajo su jurisdicción, en zonas de saneamiento en hatos sometidos a campañas de control de enfermedades o cuando la situación epidemiológica así lo justifique.

Pilot Plan for Bovine Cattle Movement Control and Group Traceability in the Brunca RegionPlan Piloto de Control de Movilización y Rastreabilidad Grupal del Ganado Bovino de la Región Brunca

Artículo 2 — Definitions and abbreviations:

Artículo 3 — The official pilot system for the Control of Movement and Group Traceability of Bovines is composed of the following constituent elements:

Artículo 6 — The identification code shall be delivered to the responsible person in printed form and must be placed in the administrative center of the establishment in a visible manner.

Artículo 7 — Every owner of bovines, regardless of the number of animals they own, shall be obliged to have their personal brand duly registered in the Official Registry of Cattle Brands (Registro Oficial de Marcas de Ganado).

Artículo 8 — Bovines must be identified with the registered brand, stamped on the animal's skin by any physical or chemical method that guarantees an indelible, visible, legible, and identifiable brand.

Artículo 9 — The Brunca Regional Directorate of SENASA may authorize other complementary identification methods upon request of the person responsible for the establishment or owner of the animals.

Artículo 10 — Every cattle owner who has a registered brand must register it at the primary production establishment(s) (farms) where the animals will remain.

Artículo 11 — Every transported bovine must present the brand clearly visible, legible, and identifiable, matching the design declared on the movement guide or, failing that, identified in accordance with the provisions of Article 9 of this Pilot Plan.

Artículo 12 — Every bovine that needs to be transferred from one establishment to another, within the territory of the Brunca Region or outside of it, must be moved along with the official movement guide established as such for these purposes.

Artículo 13 — The official movement guide has the character of a sworn statement by the owner of the animals or their representative, is valid for a single destination and for a period not exceeding 24 hours after its issuance.

Artículo 14 — The receipt books (talonarios) with the official movement guides must be requested at the offices that the Brunca Regional Directorate of SENASA enables.

Artículo 16 — The movement guide must be issued by the owner of the animals or their representative from the establishment where the shipment (embarque) of the animals originates.

Artículo 17 — The holder of the origin establishment shall be responsible before the Brunca Regional Directorate of SENASA for the sanitary condition of the animals listed on the movement guides associated with their establishment.

Artículo 18 — The movement guide must be delivered to the transporter at the time of the shipment of the animals.

Artículo 20 — Every registered transporter shall keep a logbook (bitácora de movilización) in which they shall sequentially record every animal transfer they make.

Artículo 21 — Those animals that have the same origin and destination are considered part of the same shipment (embarque).

Artículo 22 — Every establishment must enable a physical or electronically supported record where the information of all bovines that enter and/or leave the same is sequentially recorded.

Artículo 23 — Every bovine entering a primary production establishment (farm) must be permanently identified with any system that allows the animal to be securely associated with the movement guide, without prejudice to the provisions of Articles 8 and 9 of this Pilot Plan.

Artículo 24 — The copies of each issued movement guide form part of the record of departures (salidas) from the establishment.

Artículo 28 — Every movement guide may be validated at the police control post of the Ministry of Public Security closest to the place of shipment (embarque) of the animals.

Artículo 33 — The obligations of the Brunca Regional Directorate of SENASA are the following:

Transitorio III — —Livestock establishments in the Brunca Region that are in an official disease prevention, control, or eradication program must comply, in addition to the obligations imposed by this Pilot Plan, with the specific rules of each program regarding identification and traceability.

Artículo 1 — Objeto: El presente documento contiene las definiciones y procedimientos del Plan Piloto de Control de Movilización y Rastreabilidad Grupal de Bovinos a desarrollarse en la Región Brunca a cargo del Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería.

Artículo 2 — Definiciones y abreviaciones:

Artículo 3 — El sistema piloto oficial de Control de Movilización y Rastreabilidad Grupal de Bovinos está integrado por los siguientes elementos constitutivos:

Artículo 6 — El código de identificación le será entregado al responsable en forma impresa y deberá de ser colocado en el centro administrativo del establecimiento de manera visible.

Artículo 7 — Cada propietario de bovinos, independientemente de la cantidad de animales que posea, estará obligado a tener su marca personal debidamente registrada en el Registro Oficial de Marcas de Ganado.

Artículo 8 — Los bovinos deberán de identificarse con la marca registrada, estampada en la piel del animal con cualquier método físico o químico que garantice una marca indeleble, visible, legible e identificable.

Artículo 9 — La Dirección Regional Brunca del SENASA podrá autorizar otros métodos de identificación complementarios previa solicitud del responsable del establecimiento o propietario de los animales.

Artículo 10 — Todo propietario de ganado que tenga una marca registrada deberá de asentarla en el o los establecimientos de producción primaria (fincas) donde permanecerán los animales.

Artículo 11 — Todo bovino transportado deberá presentar la marca claramente visible, legible e identificable, guardando concordancia con el diseño declarado en la guía de movilización o en su defecto identificado de acuerdo con el establecido en el artículo 9 de este Plan Piloto.

Artículo 12 — Todo bovino que requiera ser trasladado de un establecimiento a otro, dentro del territorio de la Regio Brunca o fuera de este, deberá ser movilizado junto con la guía oficial de movilización establecida como tal para los presentes efectos.

Artículo 13 — La guía oficial de movilización tiene carácter de declaración jurada por parte del propietario de los animales o su representante, es válida para un único destino y por un período no mayor de 24 horas después de su emisión.

Artículo 14 — Los talonarios con las guías oficiales de movilización se deberán solicitar en las oficinas que la Dirección Regional Brunca del SENASA habilite.

Artículo 16 — La guía de movilización debe ser emitida por el propietario de los animales o su representante desde el establecimiento donde se origine el embarque de los animales.

Artículo 17 — El titular del establecimiento de origen será responsable ante la Dirección Regional Brunca del SENASA de la condición sanitaria de los animales consignados en las guías de movilización asociadas a su establecimiento.

Artículo 20 — Todo transportista registrado, llevará una bitácora de movilización en la cual registrará de forma secuencial todo traslado de animales que realice.

Artículo 21 — Se consideran parte de un mismo embarque, aquellos animales que tengan un mismo origen y destino.

Artículo 22 — Todo establecimiento deberá de habilitar un registro físico o con soporte electrónico donde se registre de forma secuencial la información de todos los bovinos que ingresen y/o salgan del mismo.

Artículo 24 — Forman parte del registro de salidas del establecimiento, las copias de cada guía de movilización emitida.

Artículo 28 — Toda guía de movilización podrá ser convalidada en el puesto de control de la policía del Ministerio de Seguridad Pública más cercano al lugar de embarque de los animales.

Artículo 33 — Son obligaciones de la Dirección Regional Brunca del SENASA las siguientes:

Artículo 38 — Las especies de animales diferentes a la bovina (Bos Taurus / Bos Indicus) continuarán siendo movilizadas conforme al documento y procedimientos establecidos para esos efectos en el Decreto Ejecutivo Nº 28432-MAG-SP del 13 de enero del dos mil.
