in the entirety of the text - Complete Text of Norm 36201 Declares a state of national emergency for the situation caused by extreme hydrometeorological conditions, which have affected the Central Pacific, North, South, Central Valley, and Guanacaste, and tropical waves at the regional level in the Caribbean Sea Complete Text of record: EE098 No. 36201-MP (This decree was repealed by Article 1 of Executive Decree No. 37597 of February 25, 2013) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred upon them by Articles 140, subsections 3) and 18), and 180 of the Political Constitution, Articles 25, subsection 1); 27, subsection 1); 28, subsection b) of Law No. 6227 of May 2, 1978, which is the General Law of Public Administration, and Law No. 8488 of January 11, 2006, which is the National Law for Risk Prevention and Emergency Response.

1. 1That for several weeks, specifically beginning in the month of August, the country has been affected by various events generated by adverse meteorological conditions that have produced abundant rainfall in various parts of the country, the Central Valley (Greater Metropolitan Area), and the geographic zones encompassing the Central Pacific and South Pacific. This, combined with the events that have occurred since September 20 due to storm conditions in the Central Pacific, North, and South, the Central Valley (Greater Metropolitan Area and the Guanacaste Mountain Range), associated with Tropical Storm Nicole in the Caribbean Sea, characterized by rainfall of variable intensity, associated with low-pressure systems over Central America and the positioning of the Intertropical Convergence Zone (confluence of winds from the southwest and northeast).
2. 2That as of September 20, the Central Valley and the geographic zone encompassing the Pacific Slope of the country have been affected by intense rains, generating floods and substantial damage in several sectors; since that same day, rains have intensified in the aforementioned zones. In the province of Heredia, a landslide (derrumbe) occurred generated by the intense rains; in the Central Valley and on the Pacific Slope, rains occurred during the afternoon, night, and early morning, causing soil saturation, swelling of watercourses, and a considerable increase in surface runoff (escorrentía superficial), mainly in urban streams (quebradas) and rivers, given that the indices of soil moisture, combined with steep slopes, have generated constant landslides (deslizamientos) with loss of sections of the road surface, collapses, and floods on the main national routes of the affected zones, causing their closure due to impassability. That such conditions will persist during the coming days, and the National Meteorological Institute (IMN) is warning that during the months of October, November, and December of this year, adverse weather conditions will increase until the end of the year, due to the effects of low-pressure systems, tropical depressions, and other phenomena that will significantly affect the already damaged road infrastructure and other infrastructure that has not yet shown impacts but is in a highly vulnerable condition due to conditions of extreme soil saturation, increased surface runoff, and an increased threat of floods and landslides.

3º—These phenomena have caused floods, landslides, and damage to property and persons, affecting the road infrastructure of the National Road Network administered by CONAVI, interrupting the continuity of routes and seriously affecting land communication, agriculture, and public services, for which reason the National Commission for Risk Prevention and Emergency Response (Comisión Nacional de Prevención de Riesgos y Atención de Emergencias) has maintained, since August 30, a permanent state of GREEN ALERT in the Central Valley, the Pacific, and the northern zone of the country, with YELLOW ALERTS in response to specific events warned of by the National Meteorological Institute, in order to activate the institutions of the National Subsystem for Preparedness and Response, in addressing all the incidents that arise, to ensure humanitarian assistance to the affected populations.

1. 4That as a consequence of these phenomena, it has been necessary to temporarily evacuate many affected persons and place them in different shelters (albergues) set up by the National Commission for Risk Prevention and Emergency Response, but given the poor condition of the national routes, it has been difficult to provide adequate attention to said citizens.
2. 5That the life of the population and the continuity of public transportation services are matters of public interest and are protected by the State, which must ensure their protection and the safety of the inhabitants, and in general the preservation of social order.
3. 6That the National Law for Risk Prevention and Emergency Response provides that, in the event of a public calamity caused by acts of nature or of man that are unforeseeable, or foreseeable but inevitable, and cannot be controlled, managed, or overcome with the ordinary powers available to the Government, therefore, the Executive Branch may declare a national emergency in any part of the national territory, in order to integrate and define the responsibilities and functions of all organizations, and public and private entities, and to provide a solution commensurate with the magnitude of the disaster.
4. 7That by reason of the foregoing, the promulgation of a legal framework to take the exceptional measures indicated by the Political Constitution and the National Law for Risk Prevention and Emergency Response is necessary to address the effects caused by the hydrometeorological phenomena of the rainy period beginning in August 2010, and to mitigate the consequences caused by their impact on the different zones of the country. Therefore,

1. 1Que desde hace varias semanas, específicamente a partir del mes de agosto el país se ha visto afectado por diversos eventos, generados por condiciones meteorologías adversas que han generado abundantes lluvias en diversos puntos de país, Valle Central (Gran Área Metropolitana), las zonas geográficas que abarcan el Pacífico Central y Pacífico Sur. Esto, unido a los eventos que desde día 20 de setiembre se han presentado por las condiciones de temporal en el Pacífico Central, Norte y Sur, Valle Central (Gran Área Metropolitana y Cordillera de Guanacaste), asociado a la Tormenta Tropical Nicole en el Mar Caribe, con características de lluvias de variable intensidad, asociados a sistemas de baja presión sobre Centroamérica y al posicionamiento de la zona de convergencia Intertropical (confluencia de vientos del suroeste u noreste).
2. 2Que a partir del día 20 de setiembre el Valle Central y la zona geográfica que abarca la Vertiente Pacífica del país, se han visto afectados por intensas lluvias generando inundaciones y daños cuantiosos en varios sectores; desde ese mismo día se han intensificado las lluvias en las zonas antes mencionadas. En la provincia de Heredia se produjo un derrumbe generado por las intensas lluvias, en el Valle Central y en la Vertiente Pacífica se presentaron lluvias durante la tarde, noche y madrugada, provocando saturación de los suelos, crecimientos de los cauces y aumento considerable de escorrentía superficial principalmente en quebradas y ríos urbanos, siendo que los índices de humedad en el suelo, unido a las altas pendientes, han generado constantes deslizamientos con pérdida de secciones de la calzada, derrumbes e inundaciones en las principales rutas nacionales de las zonas afectadas, provocando el cierre por intransitabilidad de las mismas. Que tales condiciones persistirán durante los próximos días y el Instituto Meteorológico Nacional está advirtiendo que durante los meses de octubre, noviembre y diciembre del presente año, las condiciones adversas del clima se incrementarán hasta finalizar el año, debido a los efectos de sistemas de baja presión, depresiones tropicales, y otros fenómenos que afectarán sensiblemente la infraestructura vial ya dañada y otras que hasta la fecha no han presentado afectaciones, pero que se encuentran en condición altamente vulnerable por las condiciones de saturación extrema de los suelos, aumento de la escorrentía superficial e incremento de la amenaza de inundaciones y deslizamientos.

3º-Estos fenómenos han ocasionado inundaciones, deslizamientos y daños a los bienes y a las personas, afectando la infraestructura vial de la Red Vial Nacional que administra el CONAVI, interrumpiendo la continuidad de las vías y afectando gravemente la comunicación terrestre, la agricultura, y los servicios públicos, por lo que la Comisión Nacional de Prevención de Riegos y Atención de Emergencias mantiene desde el 30 de agosto un estado de ALERTA VERDE permanente en el Valle Central, Pacífico y zona norte del país, con ALERTAS AMARILLAS ante eventos puntuales advertidos por el Instituto Meteorológico Nacional, para activar a las instituciones del Subsistema Nacional de Preparativos y Respuesta, en la atención de todos los incidentes que se generan, para asegurar la asistencia humanitaria a las poblaciones afectadas.

1. 4Que como consecuencia de estos fenómenos se ha debido evacuar temporalmente a muchas personas damnificadas y ubicarlas en diferentes albergues instalados por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, pero ante el mal estado de las rutas nacionales se ha dificultado brindar la adecuada atención a dichos ciudadanos.
2. 5Que la vida de la población y la continuidad de los servicios públicos de transporte son de interés público y tutelados por el Estado, que debe velar por su protección y por la seguridad de los habitantes, y en general por la conservación del orden social.
3. 6Que la Ley Nacional de Prevención del Riesgo y Atención de Emergencias dispone que en caso de calamidad pública ocasionada por hechos de la naturaleza o del hombre que son imprevisibles, o previsibles, pero inevitables y no puedan ser controlados, manejados ni dominados con las potestades ordinarias de que dispone el Gobierno, siendo así, el Poder Ejecutivo podrá declarar emergencia nacional en cualquier parte del territorio nacional, a fin de integrar y definir las responsabilidades y funciones de todos los organismos, entidades públicas, privadas y poder brindar una solución acorde a la magnitud del desastre.
4. 7Que en razón de lo expuesto se hace necesaria la promulgación de un marco jurídico para tomar las medidas de excepción que señala la Constitución Política y la Ley Nacional de Prevención de Riesgos y Atención de Emergencias, para hacerle frente a los efectos ocasionados por los fenómenos hidrometeorológicos del período de lluvias a partir del mes de agosto del 2010, y mitigar las consecuencias que ocasionó su impacto en las diferentes zonas del país. Por tanto,
