in the entirety of the text - Full Text of Norm 36081 Recognition and enabling of extension of the term of fishing licenses for foreign tuna purse-seine vessels, holding a license to carry out activities in Costa Rican jurisdictional waters, and reform of Executive Decree No. 23943 of 01/05/1995 Full Text of act: D1519 No. 36081-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by articles 140, subsections 3), 8), 18), and 20), 50, and 146 of the Political Constitution; articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 7384 of March 16, 1994, Law for the Creation of the Costa Rican Institute of Fisheries and Aquaculture, and Law No. 8436 of March 1, 2005, Fisheries and Aquaculture Law.
1st—That through Executive Decree No. 23943 of January 5, 1995, published in La Gaceta No. 10 of January 13 of the same year, which is in effect, the "Regulatory framework governing the procedure for granting fishing licenses to foreign vessels wishing to engage in fishing activity in Costa Rican jurisdictional waters" was issued, in which the applicable general regulations and amounts that must be paid by foreign-flagged tuna vessels, interested in carrying out the fishing activity for said resource, are defined.
2nd—That both in the indicated Decree, and in Law No. 8436, of March 1, 2005, Fisheries and Aquaculture Law, upon establishing the period of validity of the original or primary license, which is granted to foreign tuna vessels, for sixty calendar days as a fishing trip, they raise the possibility that the vessels must make forced arrivals (arribos forzosos) at port for reasons of fortuitous event (caso fortuito) or force majeure (fuerza mayor) that must be duly communicated to INCOPESCA; however, the incidence or the effect of those situations is not regulated, regarding the original term of the license, namely the sixty days and the recognition or enabling of the days of suspension of the fishing operations for reasons not attributable to the shipowner (armador).
3rd—That by reason of the foregoing, it is necessary and opportune for clarity and transparency in the administrative action and in defense of the applicable interests in carrying out the activities and the sustainable use of the tuna resource, to add the corresponding regulation to the indicated Decree. Therefore,

"Article 7—.

1Que mediante Decreto Ejecutivo Nº 23943 del 5 de enero de 1995, publicado en La Gaceta Nº 10 del 13 de enero del mismo año, el cual se encuentra vigente, se emitió el "Reglamento regulador del procedimiento para otorgar licencias de pesca a buques extranjeros que deseen ejercer la actividad de pesca en aguas jurisdiccionales costarricenses", en el cual se definen las regulaciones generales aplicables y montos que se deben cancelar por las embarcaciones atuneras de bandera extranjera, interesadas en realizar la actividad de pesca de dicho recurso.
2Que tanto en el Decreto indicado, como en la Ley Nº 8436, del 1º de marzo del 2005, Ley de Pesca y Acuicultura, al establecerse el plazo de vigencia de la licencia original o primaria, que se otorga a las embarcaciones extranjeras atuneras, por sesenta días naturales como viaje de pesca, plantean la posibilidad de que las naves deban realizar arribos forzosos a puerto por razones de caso fortuito o fuerza mayor que deben ser debidamente comunicadas al INCOPESCA, sin embargo no se regula la incidencia o el efecto de esas situaciones, respecto del plazo original de la licencia, sean los sesenta días y el reconocimiento o habilitación de los días de suspensión de las faenas de pesca por causas no atribuibles al armador.
3Que en razón de lo anterior es necesario y oportuno por claridad y transparencia en la actuación administrativa y en defensa de los intereses aplicables en la realización de las actividades y el aprovechamiento sostenible del recurso atunero, adicionar al Decreto indicado la regulación correspondiente. Por tanto,
