in the entirety of the text - Full Text of Norm 36081 Recognition and enabling of extension of the term of fishing licenses for foreign tuna purse-seine vessels, holding a license to carry out activities in Costa Rican jurisdictional waters, and reform of Executive Decree No. 23943 of 01/05/1995 Full Text of act: D1519 No. 36081-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by articles 140, subsections 3), 8), 18), and 20), 50, and 146 of the Political Constitution; articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 7384 of March 16, 1994, Law for the Creation of the Costa Rican Institute of Fisheries and Aquaculture, and Law No. 8436 of March 1, 2005, Fisheries and Aquaculture Law.
Considering:
23943 of January 5, 1995, published in La Gaceta No. 10 of January 13 of the same year, which is in effect, the "Regulatory framework governing the procedure for granting fishing licenses to foreign vessels wishing to engage in fishing activity in Costa Rican jurisdictional waters" was issued, in which the applicable general regulations and amounts that must be paid by foreign-flagged tuna vessels, interested in carrying out the fishing activity for said resource, are defined.
8436, of March 1, 2005, Fisheries and Aquaculture Law, upon establishing the period of validity of the original or primary license, which is granted to foreign tuna vessels, for sixty calendar days as a fishing trip, they raise the possibility that the vessels must make forced arrivals (arribos forzosos) at port for reasons of fortuitous event (caso fortuito) or force majeure (fuerza mayor) that must be duly communicated to INCOPESCA; however, the incidence or the effect of those situations is not regulated, regarding the original term of the license, namely the sixty days and the recognition or enabling of the days of suspension of the fishing operations for reasons not attributable to the shipowner (armador).
Therefore,
RECOGNITION AND ENABLING FOR EXTENSION OF FISHING DAYS IN THE TERM OF FISHING LICENSES FOR FOREIGN TUNA PURSE-SEINE VESSELS DUE TO REASONS OF FORTUITOUS EVENT OR FORCE MAJEURE, THAT HOLD A LICENSE TO CARRY OUT ACTIVITIES IN COSTA RICAN JURISDICTIONAL WATERS
Decrees:
article 7 of Executive Decree No. 23943 of January 5, 1995, and its reforms, a second paragraph, which shall read as follows:
"Article 7—.
For the purposes of unloading the product in Costa Rican ports, with compliance with the normative requirements and the possibility of granting subsequent licenses without the corresponding payment as provided in Law No. 8436, foreign-flagged tuna vessels that, during the validity of the license, had to, for duly justified reasons of force majeure (fuerza mayor) or fortuitous event (caso fortuito) and reported to INCOPESCA, arrive at any port of the Eastern Pacific, shall have the right that the days they must remain in port under the indicated circumstances, duly accredited and documented, be enabled and extended by INCOPESCA within the original term of the fishing license, as well as those periods in which they had to suspend fishing activities due to the application of closed season (veda) periods officially declared by member States of the IATTC."

RECONOCIMIENTO Y HABILITACIÓN PARA EXTENSIÓN DE DÍAS DE PESCA EN EL PLAZO DE LAS LICENCIAS DE PESCA A EMBARCACIONES EXTRANJERAS ATUNERAS DE RED DE CERCO POR RAZONES DE CASO FORTUITO O FUERZA MAYOR, QUE CUENTEN CON LICENCIA PARA REALIZAR ACTIVIDADES EN AGUAS JURISDICCIONALES COSTARRICENSES
Decretan:
"Artículo 7º-.
Para los efectos de la descarga del producto en puertos Costarricenses, con el cumplimiento de los requisitos normativos y la posibilidad del otorgamiento de licencias posteriores sin el pago correspondiente según lo dispuesto en la Ley Nº 8436, los barcos atuneros de bandera extranjera que durante la vigencia de la licencia, tuvieren por razones de fuerza mayor o caso fortuito, debidamente justificados y reportados ante el INCOPESCA, que arribar a cualquier puerto del Pacifico Oriental, tendrán derecho a que los días que deban permanecer en puerto bajo las circunstancias indicadas, debidamente acreditados y documentados, les sean habilitados y extendidos por el INCOPESCA en el plazo original de la licencia de pesca, al igual que aquellos plazos en que tuvieren que suspender las actividades de pesca por aplicación de periodos de veda oficialmente declarados por Estados miembros de la CIAT."
