throughout the entire text - Complete Text of Regulation 35987 Amendment to the Setting of tariffs for the services of the Ministry of Agriculture and Livestock Complete Text of record: D00AC No. 35987-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8) and 18) and 146 of the Political Constitution; the General Law of Public Administration, No. 6227 of May 2, 1978; the Law of Promotion of Agricultural and Livestock Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, No. 7064 of April 29, 1987; the General Law of the National Animal Health Service, No. 8495 of April 6, 2006; the Law for the Control of Bovine Cattle, prevention and sanctioning of its robbery, theft and receiving of stolen goods, No. 8799 of April 17, 2010; the Extraordinary Budget Law, No. 7138 of November 16, 1989, article 46, subsection 22, which authorizes the opening of Special Accounts for resources coming from the sale of services for Marketing, Health and Livestock Production and Agricultural Research; the Agreement on Sanitary and Phytosanitary Measures approved by the Law for the Implementation of the Agreements of the Uruguay Round of Multilateral Trade Negotiations, No. 7473 of December 20, 1994; the Law for the Promotion of Competition and Effective Consumer Defense, No. 7472 of December 20, 1994.

1That it is an essential function of the State to protect the health of people, primary production systems, animals and the environment, as well as to guarantee the protection of crops from pests and diseases that may put at risk or cause damage to agricultural production.
2That for the national economy and food security, the sanitary protection of products of animal origin is fundamental, especially for those that are essential in the diet of Costa Ricans, which obliges the State to adopt all necessary prevention, surveillance and control measures to avoid the entry and dissemination of pests and diseases that endanger or may cause harm to people or to the national livestock patrimony.
3That it is also an essential function of the State to establish the necessary mechanisms and controls to guarantee the safety (inocuidad) of food for human and animal consumption, thereby protecting Public Health.
4That by Law No. 8495 of April 6, 2006, the National Animal Health Service (SENASA) was created, as a deconcentrated body with instrumental legal personality of the Ministry of Agriculture and Livestock, repealing Law No. 6343 of May 2, 1978, the Animal Health Law, and substituting for all legal purposes the Directorate of Animal Health of the Ministry of Agriculture and Livestock.
5That through the National Animal Health Service (SENASA), a series of services are provided to agricultural and livestock producers and establishments, and with their sale the necessary resources are generated for the sustainability of the Service, thereby making it possible to cover expenses relative to salaries and social charges, the replacement and purchase of equipment, materials, reagents and other supplies necessary for the smooth operation and timely attention of the requirements made to SENASA.
6That pursuant to the mandate established in article 8 bis of Decree No. 27763-MAG of March 10, 1999 and its amendments, it is established that the amounts of the tariffs for the services stipulated in that Decree are subject to an annual increase that takes effect as of February 1st of each year, which will be calculated automatically based on the value of the consumer price index of the previous year.
7That by Decree No. 35604-MAG of October 28, 2009, published in La Gaceta No. 236 of December 4, 2009, articles 3 and 4 were modified and an article 4 bis was inserted into Decree No. 27763-MAG of March 10, 1999, published in Supplement No. 26 to La Gaceta No. 68 of April 9, 1999 and its amendments, for the purpose of introducing some new tariffs that derive directly from the aforementioned Law No. 8495 and publicizing the current price of the tariffs that this Service charges.
8That it is the obligation of the different state actors linked to the sectors of import and

are internalized or exported and thereby prevent delays or the increase in cost of said goods due to these processes.

9That the National Animal Health Service and the General Directorate of Customs have established coordination mechanisms in order to facilitate for the administered parties the fulfillment of their sanitary obligations regarding the processes of import and export of goods, adequately protecting public health in general and also allowing said goods to circulate quickly while complying with the customs obligations established for those goods and likewise thereby preventing the country's customs facilities from becoming saturated with merchandise that has not complied or is in the process of complying with sanitary procedures under the charge of this Service, and for which the DUA instrument is a strategic ally in that purpose.

10.-That changes have been generated in the legal environment of the National Animal Health Service (SENASA) on the occasion of the enactment of Law No. 8799 of April 16, 2010, Law for the Control of Bovine Cattle, prevention and sanctioning of its robbery, theft and receiving of stolen goods, and for whose implementation it is necessary to establish tariffs for services ordered by the same law. Therefore, They decree:

en la totalidad del texto - Texto Completo Norma 35987 Reforma Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería Texto Completo acta: D00AC Nº 35987-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8) y 18) y 146 de la Constitución Política; la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; la Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987; la Ley General del Servicio Nacional de Salud Animal, Nº 8495 del 6 de abril 2006; la Ley de Control de Ganado Bovino, prevención y sanción de su robo, hurto y receptación, Nº 8799 del 17 de abril del 2010; la Ley de Presupuesto Extraordinario, Nº 7138 del 16 de noviembre de 1989, artículo 46, inciso 22, que autoriza la apertura de Cuentas Especiales para recursos provenientes de venta de servicios de Mercadeo, Salud y Producción Pecuaria e Investigación Agrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias aprobado mediante Ley de Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones Comerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994; Ley de la Promoción de la Competencia y Defensa Efectiva al Consumidor, Nº 7472 del 20 de diciembre de 1994.

1Que es función esencial del Estado proteger la salud de las personas, sistemas de producción primarios, los animales y el medio ambiente, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agropecuaria.
2Que para la economía nacional y la seguridad alimentaria, la protección sanitaria de los productos de origen animal resulta fundamental, en especial en aquellos que son esenciales en la dieta de los costarricenses, lo que obliga al Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para evitar el ingreso y diseminación de plagas y enfermedades que pongan en peligro o puedan causar daño a las personas o al patrimonio pecuario nacional.
3Que igualmente es una función esencial del Estado, establecer los mecanismos y controles necesarios para garantizar la inocuidad de los alimentos de consumo humano y animal, protegiéndose con ello la Salud Pública.
4Que mediante Ley Nº 8495 del 6 de abril del 2006, se creó el Servicio Nacional de Salud Animal, (SENASA), como un órgano de desconcentración y personería jurídica instrumental del Ministerio de Agricultura y Ganadería, derogándose la Ley Nº 6343 del 2 de mayo de 1978, Ley sobre Salud Animal y sustituyendo por ello para todo efecto legal a la Dirección de Salud Animal del Ministerio de Agricultura y Ganadería.
5Que a través del Servicio Nacional de Salud Animal (SENASA) se brindan una serie de servicios a los productores y establecimientos agropecuarios y con cuya venta se generan los recursos necesarios para la sostenibilidad del Servicio, permitiéndose con ello cubrir gastos relativos a salarios y cargas sociales, la reposición y compra de equipos, materiales, reactivos y otros insumos necesarios para la buena marcha y la atención oportuna de los requerimientos que se le formulan al SENASA.
6Que conforme al mandato establecido en el artículo 8 bis del Decreto Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, se establece que los montos de las tarifas por los servicios estipulados en ese Decreto están sujetas a un incremento anual que rige a partir del 1º de febrero de cada año, que se calculará automáticamente con base en el valor del índice de precios al consumidor del año anterior.
7Que mediante Decreto Nº 35604-MAG del 28 de octubre del 2009, publicado en La Gaceta Nº 236 del 4 de diciembre del 2009, se modificaron los artículos 3, 4 y se insertó un artículo 4 bis al Decreto Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 de La Gaceta Nº 68 del 9 de abril de 1999 y sus reformas a los efectos de introducir algunas nuevas tarifas que se derivan directamente de la Ley Nº 8495 antes citada y publicitar el precio actual de las tarifas que cobra este Servicio.
8Que es obligación de los diferentes actores estatales vinculados a los sectores de importación y

son internalizados o exportados y con ello evitar que se produzcan atrasos o se encarezcan por dichos procesos los bienes antes indicados.

9Que el Servicio Nacional de Salud Animal y la Dirección General de Aduanas han establecido mecanismos de coordinación a efectos de facilitar a los administrados el cumplimiento de sus obligaciones de carácter sanitario en relación a los procesos de importación y exportación de bienes, protegiéndose adecuadamente la salud pública en general y permitiendo igualmente que dichos bienes circulen rápidamente cumpliéndose con las obligaciones aduaneras establecidas para esos bienes y evitando igualmente con ello que las instalaciones aduanales del país se saturen con mercancías que no han cumplido o están en proceso de cumplir con trámites sanitarios a cargo de este Servicio y para lo cual el instrumento DUA resulta un aliado estratégico en ese propósito.

10.-Que se han generado cambios en el entorno jurídico del Servicio Nacional de Salud Animal (SENASA) con ocasión de la promulgación de la Ley Nº 8799 del 16 de abril del 2010, Ley de Control de Ganado Bovino, prevención y sanción de su robo, hurto y receptación y para cuya implementación es necesario establecer tarifas a servicios ordenados por la misma. Por tanto,

Artículo 1 — Amend article 3 of Decree No.

Artículo 3 — Establish the tariffs that will govern for the services provided by the Ministry of Agriculture and Livestock, through the National Animal Health Service (SENASA):

Artículo 2 — —Transitory Provisions:

Transitorio I — —The fee C15 established for quarantine services shall apply for all purposes as of June 1, 2010.

Transitorio II — —During the year 2010, no increase derived from the application of the previous year's consumer price index shall be applied.

Transitorio III — —The amnesty period is maintained in force, for one calendar year, ending on December 4, 2010, regarding the collection for processing the CVO for bovine cattle farms, established in Transitory III of Decreto Nº 35604-MAG of October 28, 2009.

Artículo 3 — —It shall become effective upon its publication in the Diario Oficial La Gaceta.

Artículo 1 — Modifíquese el artículo 3º del Decreto Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 de La Gaceta Nº 68 del 9 de abril de 1999 y sus reformas, para que se lea de la siguiente manera:

Artículo 3 — Fíjense las tarifas que regirán para los servicios que presta el Ministerio de Agricultura y Ganadería, por medio del Servicio Nacional de Salud Animal (SENASA):

Artículo 2 — Disposiciones Transitorias:

Transitorio I — La tarifa C15 establecida para servicios cuarentenarios se aplicará para todo efecto a partir del 1º de junio del 2010.

Transitorio II — Durante el año 2010 no se aplicará incremento alguno derivado de la aplicación del índice de precios al consumidor del año anterior.

Transitorio III — Se mantiene en vigencia el período de amnistía, de un año calendario, que finaliza el 4 de diciembre del 2010, en el cobro de la tramitación del CVO para las fincas de ganado bovino, establecida en el Transitorio III del Decreto Nº 35604-MAG del 28 de octubre del 2009.

Artículo 3 — Rige a partir de su publicación en el Diario Oficial La Gaceta.
