Complete Text of record: CCA19 No. 35604-MAG (Note from Sinalevi: By means of article 1 of directive No. SENASA-DG-D014-209, of December 4, 2009, a moratorium is established on the application of the tariffs set forth in this decree, until January 10, 2010, with the exception of the tariffs established in subsection C.15, the moratorium for which shall be until April 1, 2010) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8) and 18) and 146 of the Political Constitution; the General Law of Public Administration, No. 6227 of May 2, 1978; the Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, No. 7064 of April 29, 1987; the General Law of the National Animal Health Service, No. 8495 of April 6, 2006; the Extraordinary Budget Law, No. 7138 of November 16, 1989, article 46, subsection 22, which authorizes the opening of Special Accounts for resources coming from the sale of Marketing, Health and Livestock Production and Agricultural Research services; the Agreement on Sanitary and Phytosanitary Measures approved by means of the Law for the Implementation of the Agreements of the Uruguay Round of Multilateral Trade Negotiations, No. 7473 of December 20, 1994; the Law for the Promotion of Competition and Effective Consumer Defense, No. 7472 of December 20, 1994.
I.-That it is an essential function of the State to protect the health of people, primary production systems, animals, and the environment, as well as to guarantee the protection of crops from pests and diseases that may put at risk or cause damage to agricultural production.
II.-That for the national economy and food security, the sanitary protection of products of animal origin is fundamental, especially for those that are essential in the diet of Costa Ricans, which obliges the State to adopt all necessary prevention, surveillance, and control measures to avoid the entry and spread of pests and diseases that endanger or may cause harm to people or to the national livestock patrimony.
III.-That it is equally an essential function of the State to establish the necessary mechanisms and controls to guarantee the safety of food for human and animal consumption, thereby protecting Public Health.
IV.-That by means of Law No. 8495 of April 6, 2006, the National Animal Health Service, (SENASA), was created as a deconcentrated body with instrumental legal personality of the Ministry of Agriculture and Livestock, repealing Law No. 6343 of May 2, 1978, the Animal Health Law, and substituting for all legal effects the Animal Health Directorate of the Ministry of Agriculture and Livestock.
V.-That through the National Animal Health Service (SENASA), a series of services are provided to producers and agricultural establishments, and through their sale the necessary resources are generated for the sustainability of the Service, thereby allowing the coverage of expenses related to salaries and social charges, the replacement and purchase of equipment, materials, reagents, and other inputs necessary for the proper functioning and timely attention to the requirements formulated to SENASA.
VI.-That in accordance with the mandate established in article 8 bis of Decree No. 27763-MAG of March 10, 1999 and its reforms, it is established that the amounts of the tariffs for the services stipulated in that Decree are subject to an annual increase effective as of February 1 of each year, which shall be calculated automatically based on the value of the consumer price index from the previous year.
VII.-That by means of Decree No. 35504-MAG of August 6, 2009, published in La Gaceta No. 186 of September 24, 2009, articles 3 and 4 were modified and an article 4 bis was inserted into Decree No. 27763-MAG of March 10, 1999, published in Supplement No. 26 of La Gaceta No. 68 of April 9, 1999 and its reforms, for the purpose of introducing some new tariffs that derive directly from the aforementioned Law No. 8495 and making public the current price of the tariffs charged by this Service, given that its last general publication was made in 2005.
VIII.-That for reasons of a technological nature for their implementation in the information systems and coordination with other public institutions, as well as errors contained in the publication of the reference decree, it is not possible to immediately apply the established tariffs, for which reason, through Directive SENASA-DG-D007-2009 of eight o'clock on September twenty-fifth of this year, a moratorium of up to sixty days was established on the application of the established tariffs while a new executive provision is issued that circumvents the inconveniences and errors detected. Transitory Provisions
In the interim, the services provided for fumigation, fogging and spraying shall be charged according to the tariffs established in article 4 of the current Decree No. 27763-MAG.

" Texto Completo acta: CCA19 Nº 35604-MAG (Nota de Sinalevi: Mediante el artículo 1 de la directriz N° SENASA-DG-D014-209, del 4 de diciembre de 2009, se establece una moratoria en la aplicación de las tarifas establecidas en este decreto, hasta el 10 de enero de 2010, con la salvedad de las tarifas establecidas en el acápite C.15 cuya moratoria será hasta el 1 de abril de 2010) EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8) y 18) y 146 de la Constitución Política; la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; la Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987; la Ley General del Servicio Nacional de Salud Animal, Nº 8495 del 6 de abril 2006; la Ley de Presupuesto Extraordinario, Nº 7138 del 16 de noviembre de 1989, artículo 46, inciso 22, que autoriza la apertura de Cuentas Especiales para recursos provenientes de venta de servicios de Mercadeo, Salud y Producción Pecuaria e Investigación Agrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias aprobado mediante Ley de Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones Comerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994; Ley de la Promoción de la Competencia y Defensa Efectiva al Consumidor, Nº 7472 del 20 de diciembre de 1994.
I.-Que es función esencial del Estado proteger la salud de las personas, sistemas de producción primarios, los animales y el medio ambiente, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agropecuaria.
II.-Que para la economía nacional y la seguridad alimentaria, la protección sanitaria de los productos de origen animal resulta fundamental, en especial en aquellos que son esenciales en la dieta de los costarricenses, lo que obliga al Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para evitar el ingreso y diseminación de plagas y enfermedades que pongan en peligro o puedan causar daño a las personas o al patrimonio pecuario nacional.
III.-Que igualmente es una función esencial del Estado, establecer los mecanismos y controles necesarios para garantizar la inocuidad de los alimentos de consumo humano y animal, protegiéndose con ello la Salud Pública.
IV.-Que mediante Ley Nº 8495 del 6 de abril del 2006, se creó el Servicio Nacional de Salud Animal, (SENASA), como un órgano de desconcentración y personería jurídica instrumental del Ministerio de Agricultura y Ganadería, derogándose la Ley Nº 6343 del 2 de mayo de 1978, Ley sobre Salud Animal y sustituyendo por ello para todo efecto legal a la Dirección de Salud Animal del Ministerio de Agricultura y Ganadería.
V.-Que a través del Servicio Nacional de Salud Animal (SENASA) se brindan una serie de servicios a los productores y establecimientos agropecuarios y con cuya venta se generan los recursos necesarios para la sostenibilidad del Servicio, permitiéndose con ello cubrir gastos relativos a salarios y cargas sociales, la reposición y compra de equipos, materiales, reactivos y otros insumos necesarios para la buena marcha y la atención oportuna de los requerimientos que se le formulan al SENASA.
VI.-Que conforme al mandato establecido en el artículo 8º bis del Decreto Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, se establece que los montos de las tarifas por los servicios estipulados en ese Decreto están sujetas a un incremento anual que rige a partir del 1 de febrero de cada año, que se calculará automáticamente con base en el valor del índice de precios al consumidor del año anterior.
VII.-Que mediante Decreto Nº 35504-MAG del 6 de agosto del 2009, publicado en La Gaceta Nº 186 del 24 de setiembre del 2009, se modificaron los artículos 3º, 4º y se insertó un artículo 4º bis al Decreto Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 de La Gaceta Nº 68 del 9 de abril de 1999 y sus reformas a los efectos de introducir algunas nuevas tarifas que se derivan directamente de la Ley Nº 8495 antes citada y publicitar el precio actual de las tarifas que cobra este Servicio, dado que su última publicación general se realizó en el año 2005.
VIII.-Que por razones de carácter tecnológico para su implementación en los sistemas de información y de coordinación con otras instituciones públicas, así como de errores contenidos en la publicación del decreto de referencia, no es posible aplicar en forma inmediata las tarifas establecidas, razón por lo cual mediante Directriz SENASA-DG-D007-2009 de las ocho horas del veinticinco de setiembre del presente año, se estableció una moratoria de hasta sesenta días en la aplicación de las tarifas establecidas mientras se dicta una nueva disposición ejecutiva que soslaye las inconveniencias y errores detectados. Disposiciones Transitorias
En ese ínterin, los servicios prestados por fumigación, nebulización y aspersión se cobrarán conforme a las tarifas establecidas en el artículo 4 del Decreto Nº 27763-MAG vigente.
