in the entirety of the text - Complete Text of Regulation 35504 Amends Executive Decree No. 27763 "Setting of tariffs for the services of the Ministry of Agriculture and Livestock", and its amendments Complete Text record: CB9AC No. 35504 No. 35504-MAG (This decree was Repealed by article 3 of Executive Decree No. 35604 of October 28, 2009) (Sinalevi Note: By means of directive No. 007 of September 25, 2009, a moratorium is established on the application of the tariffs established in this decree, for a term of sixty days, a period within which a new provision on the matter must be issued) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8) and 18), and 146 of the Political Constitution; the General Law of Public Administration, No. 6227 of May 2, 1978; the Law for the Promotion of Agricultural and Livestock Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, No. 7064 of April 29, 1987; the General Law of the National Animal Health Service, No. 8495 of April 6, 2006; the Extraordinary Budget Law, No. 7138 of November 16, 1989, article 46, subsection 22), which authorizes the opening of Special Accounts for resources from the sale of Marketing, Health and Livestock Production, and Agricultural Research services; the Agreement on Sanitary and Phytosanitary Measures approved by the Law for the Implementation of the Uruguay Round Agreements of Multilateral Trade Negotiations, No. 7473 of December 20, 1994; the Law for the Promotion of Competition and Effective Consumer Defense, No. 7472 of December 20, 1994.

Considering (Considerando):

1That it is an essential function of the State to protect the health of people, primary production systems, animals, and the environment, as well as to guarantee the protection of crops from pests and diseases that may endanger or cause damage to agricultural and livestock production.
2That for the national economy and food security, the sanitary protection of products of animal origin is fundamental, especially for those that are essential in the diet of Costa Ricans, which obliges the State to adopt all necessary prevention, surveillance, and control measures to prevent the entry and spread of pests and diseases that endanger or may cause harm to people or the national livestock patrimony.
3That it is likewise an essential function of the State to establish the necessary mechanisms and controls to guarantee the safety (inocuidad) of food for human and animal consumption, thereby protecting Public Health.
4That it is a fundamental right of the State, within the framework of the Agreement on the Application of Sanitary and Phytosanitary Measures, to adopt those that are necessary to protect the health and life of people, animals, and plants, basing those measures on an assessment appropriate to the circumstances and the potential risks that this entails.
5That by means of Law No. 8495 of April 6, 2006, the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA), was created as a deconcentrated body with instrumental legal personality of the Ministry of Agriculture and Livestock, repealing Law No. 6343 of May 2, 1978, the Animal Health Law, and thereby substituting for all legal purposes the Directorate of Animal Health of the Ministry of Agriculture and Livestock.
6That through the National Animal Health Service (SENASA) a series of services are provided to agricultural and livestock producers and establishments, and the sale of these generates the necessary resources for the sustainability of the Service, thereby allowing it to cover expenses related to salaries and social charges, the replacement and purchase of equipment, materials, reagents, and other supplies necessary for the proper functioning and timely attention to the requirements made to SENASA.
7That in accordance with the mandate established in article 8 bis of Decree No. 27763-MAG of March 10, 1999, and its amendments, it is established that the amounts of the tariffs for the services stipulated in that Decree are subject to an annual increase effective as of February 1 of each year, which will be calculated automatically based on the value of the consumer price index of the previous year.
8That it is necessary to introduce some new tariffs derived directly from the aforementioned Law No. 8495 and publicize the current price of the tariffs charged by this Service, given that its last general publication was in 2005. Therefore (Por tanto),

en la totalidad del texto - Texto Completo Norma 35504 Modifica decreto ejecutivo N° 27763 "Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería", y sus reformas Texto Completo acta: CB9AC Nº 35504 Nº 35504-MAG (Este decreto fue Derogado por el artículo 3° del decreto ejecutivo N° 35604 del 28 de octubre de 2009) (Nota de Sinalevi: Mediante directriz N° 007 del 25 de setiembre de 2009, se establece una moratoria en la aplicación de las tarifas establecidas en este decreto, por un término de sesenta días, plazo dentro del cual se deberá dictar una nueva disposición al respecto) EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8) y 18), y 146 de la Constitución Política; la Ley General de la Administración Pública, Nº 6227 del 2 de mayo de 1978; la Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, Nº 7064 del 29 de abril de 1987; la Ley General del Servicio Nacional de Salud Animal, Nº 8495 del 6 de abril del 2006; la Ley de Presupuesto Extraordinario, Nº 7138 del 16 de noviembre de 1989, artículo 46, inciso 22), que autoriza la apertura de Cuentas Especiales para recursos provenientes de venta de servicios de Mercadeo, Salud y Producción Pecuaria e Investigación Agrícola; el Acuerdo de Medidas Sanitarias y Fitosanitarias aprobado mediante Ley de Ejecución de los Acuerdos de la Ronda Uruguay de Negociaciones Comerciales Multilaterales, Nº 7473 del 20 de diciembre del 1994; Ley de la Promoción de la Competencia y Defensa Efectiva al Consumidor, Nº 7472 del 20 de diciembre de 1994.

1Que es función esencial del Estado proteger la salud de las personas, sistemas de producción primarios, los animales y el medio ambiente, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agropecuaria.
2Que para la economía nacional y la seguridad alimentaria, la protección sanitaria de los productos de origen animal resulta fundamental, en especial en aquellos que son esenciales en la dieta de los costarricenses, lo que obliga al Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para evitar el ingreso y diseminación de plagas y enfermedades que pongan en peligro o puedan causar daño a las personas o al patrimonio pecuario nacional.
3Que igualmente es una función esencial del Estado, establecer los mecanismos y controles necesarios para garantizar la inocuidad de los alimentos de consumo humano y animal, protegiéndose con ello la Salud Pública.
4Que es un derecho fundamental del Estado, en el marco del Acuerdo para la aplicación de las Medidas Sanitarias y Fitosanitarias, adoptar aquellas que resulten necesarias para proteger la salud y la vida de las personas, de los animales y vegetales, basando esas medidas en una evaluación adecuada a las circunstancias y los riesgos eventuales que ello conlleve.
5Que mediante Ley Nº 8495 del 6 de abril del 2006, se creó el Servicio Nacional de Salud Animal, (SENASA), como un órgano de desconcentración y personería jurídica instrumental del Ministerio de Agricultura y Ganadería, derogándose la Ley Nº 6343 del 2 de mayo de 1978, Ley sobre Salud Animal y sustituyendo por ello para todo efecto legal a la Dirección de Salud Animal del Ministerio de Agricultura y Ganadería.
6Que a través del Servicio Nacional de Salud Animal (SENASA) se brindan una serie de servicios a los productores y establecimientos agropecuarios y con cuya venta se generan los recursos necesarios para la sostenibilidad del Servicio, permitiéndose con ello cubrir gastos relativos a salarios y cargas sociales, la reposición y compra de equipos, materiales, reactivos y otros insumos necesarios para la buena marcha y la atención oportuna de los requerimientos que se le formulan al SENASA.
7Que conforme al mandato establecido en el artículo 8 bis del Decreto Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, se establece que los montos de las tarifas por los servicios estipulados en ese Decreto están sujetas a un incremento anual que rige a partir del 1º de febrero de cada año, que se calculará automáticamente con base en el valor del índice de precios al consumidor del año anterior.
8Que es menester introducir algunas nuevas tarifas que se derivan directamente de la Ley Nº 8495 antes citada y publicitar el precio actual de las tarifas que cobra este Servicio, dado que su última publicación general se realizó en el año 2005. Por tanto,
