Complete Text of record: D03E2 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE (INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA) A.J.D.I.P./118-2010.—Puntarenas, on the sixteenth day of the month of April, 2010.
1.—That in accordance with Law No. 7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the authority and competence of INCOPESCA to establish, based on technical, scientific, economic, and social criteria, closed seasons (épocas de veda) or zones, whether by area or by specific species, in order to protect and sustainably utilize hydrobiological resources.
2.—That it is technically demonstrated that one of the means of conserving hydrobiological resources and ensuring sustainable use is by establishing closed seasons and areas, which it is advisable to define for application.
3.—That the Gulf of Nicoya is a natural refuge for a wide variety of species and is considered one of the most important fishing zones in the country.
4.—That according to the results of investigations that, in recent years, have been carried out by researchers from the INCOPESCA Department of Research and Development, the School of Biological Sciences of the Universidad Nacional, and the Center for Marine Research (Centro de Investigaciones Marinas) of the Universidad de Costa Rica, it is urgent and necessary to implement management measures for the main species of commercial value whose habitat is the Gulf of Nicoya. Therefore:
