in the entirety of the text - Complete Text of Regulation 01 Regulation for the Use of Parks and Playgrounds Complete Text of acta: CEF00 MUNICIPALITY OF SAN PABLO DE HEREDIA REGULATION FOR THE USE OF PARKS AND PLAYGROUNDS In accordance with the powers conferred by subsection c) of Article 13 of the Código Municipal, Law No. 7794, this Regulation is issued, which governs the use of public parks owned by the Municipality of San Pablo.

Park: Public area for the recreation and sport of children and adults. They may be composed of green zones, a children's playground area (área de juegos infantiles), and sports and common-use infrastructure.

Green zones (Zonas verdes): Area intended for the planting of trees with the primary purpose of achieving an improvement in scenic beauty and a regulation of ambient temperature through natural shade. It may also be complemented with grass and ornamental plants.

Children's playground area (Área de juegos infantiles): Zone intended for the enjoyment of children between two and twelve years of age, under adult supervision.

Sports infrastructure (Infraestructura deportiva): Constituted by areas for the practice of different sports.

Common-use infrastructure (Infraestructura de uso común): Constituted by pedestrian transit areas and services for users (water tap, shelter, sanitary services, others).

However, as long as the administration of these is not delegated, the permits will be granted by the Municipal Mayor (Alcalde Municipal) in the first instance; and by the Concejo Municipal in the second instance. To grant such permits, the provisions of this Regulation must be considered.

Therefore, sitting on their backrests, resting one's feet, or lying down on the part intended for sitting is prohibited. Likewise, causing damage to the park's electrical facilities is not permitted. In general, making use of gardens, lawns, etc., different from that for which they were created is prohibited.

Children must be accompanied by an adult parent or guardian.

However, the park may remain open until 10 p.m., provided that the community where the public area is located guarantees or designates one or more persons as responsible for opening and closing the public property (bien demanial) within the previously defined hours.

However; by mutual agreement with the responsible neighborhood organization, the Municipality may establish a different schedule, which must be endorsed by the Concejo Municipal through a firm agreement.

Those who misuse the facilities or cause damage for any reason (negligence) must be reported to the competent authorities so that those responsible pay for the costs of repair or replacement of what was damaged.

This regulation was approved by the Concejo Municipal of San Pablo de Heredia in ordinary session No. 01-2010, of January 20, 2010, by agreement No. 10-14.

If this occurs, the droppings shall be picked up by the owner thereof.

Pets must be provided with a leash and led at all times by their responsible parties. The latter must prevent their pets from causing nuisances to other users and other animals present, in accordance with the provisions of the Regulation for the Responsible Reproduction and Ownership of Companion Animals (Reglamento para la Reproducción y Tenencia Responsable de Animales de Compañía), Executive Decree No. 31626-S, published in La Gaceta No. 26 of February 06, 2004, and other applicable legislation on the matter.

en la totalidad del texto - Texto Completo Norma 01 Reglamento para el uso de parques y juegos infantiles Texto Completo acta: CEF00 MUNICIPAL SAN PABLO DE HEREDIA REGLAMENTO PARA EL USO DE PARQUES Y JUEGOS INFANTILES Conforme a las atribuciones que confiere el inciso c) del artículo 13 del Código Municipal, Ley N° 7794, se emite el presente Reglamento, que regula el uso de los parques públicos propiedad de la Municipalidad de San Pablo.

Parque: Área pública para la recreación y deporte de niños y adultos. Pueden estar compuestos de zonas verdes, área de juegos infantiles e infraestructura deportiva y de uso común.

Zonas verdes: Área destinada a la siembra de árboles con el propósito principal de lograr un mejoramiento de la belleza escénica y una regulación de la temperatura ambiental por medio de sombras naturales. También se puede complementar con zacate y plantas ornamentales Área de juegos infantiles: Zona destinada para el disfrute de niños entre los dos a doce años de edad, bajo la supervisión de adultos.

Infraestructura deportiva: La constituye áreas para la práctica de diferentes deportes.

Infraestructura de uso común: La constituye las áreas de transito peatonal y servicios para los usuarios (toma de agua, refugio, servicios sanitarios, otros).

No obstante, mientras no se delegue la administración de éstos, los permisos los otorgará el Alcalde Municipal en primera instancia; el Concejo Municipal en segunda instancia. Para otorgar dichos permisos, deberá considerarse lo dispuesto en el presente Reglamento.

Por tanto, se prohíbe sentarse en los respaldares de los mismos; apoyar sus pies o acostarse en la parte destinada para sentarse. De igual manera, no se permitirá causar destrozos en las instalaciones eléctricas del parque. En general, se prohíbe hacer uso de los jardines, prados, etc., diferente de aquel para el que fueron creados.

Los niños deben de estar acompañados de un adulto padre o encargado.

No obstante, el parque podrá permanecer abierto hasta las 10 pm, siempre y cuando la comunidad en donde se ubica el área pública, garantice o designe a una o varias personas como encargadas de abrir y cerrar el bien demanial en el horario definido anteriormente.

Empero; de manera consensuada con la organización vecinal encargada, la Municipalidad podrá establecer un horario distinto, lo cual deberá ser avalado por el Concejo Municipal mediante acuerdo firme.

Quienes hagan mal uso de las instalaciones o causen daño por cualquier origen (imprudencia) deberán ser denunciados ante las autoridades competentes para que los responsables paguen por los costos de reparación o sustitución de lo dañado.

El presente reglamento fue aprobado por el Concejo Municipal de San Pablo de Heredia en la sesión ordinaria Nº 01-2010, del 20 de enero del 2010 por acuerdo Nº 10-14.

Si esto ocurriese, las deyecciones serán recogidas por el propietario del mismo.

Las mascotas deben estar provistas de correa y ser conducidas en todo momento por sus responsables. Estos últimos deben evitar que sus mascotas causen molestias a otras personas usuarias y demás animales presentes, de acuerdo con lo establecido en el Reglamento para la Reproducción y Tenencia Responsable de Animales de Compañía, Decreto Ejecutivo N° 31626-S, publicado en La Gaceta N° 26 del 06 de febrero de 2004 y en la demás legislación vigente atinente al tema.

San Pablo de Heredia Regulation for the Use of Parks and PlaygroundsReglamento para el uso de parques y juegos infantiles

Artículo 1 — Definitions:

Artículo 3 — Permits for holding cultural, sports, or other types of events in the parks will be granted by the organization to which their administration has been entrusted by delegation of the Concejo Municipal.

Artículo 4 — No permit will be granted for activities that go against the morality and good customs of its inhabitants to be carried out in the parks.

Artículo 5 — As established in Article 74 of the Código Municipal, the municipality will charge rates for the maintenance of parks and public green zones, for each of the districts according to the investment cost for each one of them.

Artículo 6 — The use of amphitheaters for cultural activities is authorized as long as these do not harm the people who visit their facilities.

Artículo 7 — The installation of carousels and temporary commercial stands will only be permitted with prior permission granted by the Concejo Municipal, and with the consent, if any, of the organization that administers it, in accordance with Article 2 of this Regulation.

Artículo 8 — Affixing commercial or partisan political propaganda is prohibited, as is damaging the facilities with animals or objects and causing accidents to the users thereof.

Artículo 9 — People are prohibited from climbing on shrubs, cutting these, their flowers, or any plant planted therein, except for their proper maintenance.

Artículo 10 — It is prohibited to misuse the seats installed in the park.

Artículo 11 — The distribution, possession, or consumption of any type of drug or liquor in the park is prohibited, as is using personal equipment at high volume.

Artículo 12 — The hours of use for the children's area within the park shall be from six (6) hours to eighteen (18) hours, every day.

Artículo 13 — Whenever space, conditions, and resources permit, in public parks there will exist common infrastructure for public service, which may consist of: a sanitary services module, water tap, containers for garbage disposal, and for the recycling of solid waste.

Artículo 14 — In all parks, the play of adults with balls, sports implements, or other objects that endanger other people, or that could damage the plants or facilities of the park, is prohibited when areas for this do not exist.

Artículo 15 — The Community Policing (Policía de Proximidad) and the Municipal Police (Policía Municipal) must enforce the provisions governing the use of parks.

Artículo 16 — The Municipality will regulate, by the mechanisms it deems appropriate, the planting of trees and plants in tree-lined walks, parks, and green zones for reasons of safety and protection of public infrastructure.

Artículo 17 — It becomes effective upon publication in the Official Gazette (Diario Oficial La Gaceta).

Artículo 18 — Responsibility of pet owners: As an unavoidable hygienic measure, people who walk their pets inside parks or other public spaces must prevent them from depositing their droppings on sidewalks, green zones, children's playground areas, or any other area thereof.

Artículo 1 — Definiciones:

Artículo 2 — Corresponde a la Municipalidad podrá administrar directamente los parques públicos o bien delegar ésta en organizaciones constituidas en el ámbito comunal, local, distrital o cantonal, mediante convenios formales, dando prioridad a las Asociaciones de Desarrollo Comunal.

Artículo 3 — Los permisos para celebración de actos culturales, deportivos u otro tipo en los parques, los otorgará la organización que por delegación del Concejo Municipal se le haya encomendado su administración.

Artículo 4 — No se otorgará permiso para que los parques se realicen actividades que vayan contra la moral y las buenas costumbres de sus habitantes.

Artículo 5 — Conforme lo establece el artículo 74 del Código Municipal, la municipalidad cobrará tasas para el mantenimiento de parques y zonas verdes públicas, para cada uno de los distritos conforme el costo de inversión para cada uno de ellos.

Artículo 6 — El uso de los anfiteatros para actividades culturales se autoriza siempre y cuando éstas no perjudiquen a las personas que visitan sus instalaciones.

Artículo 7 — La instalación de carruseles y puestos comerciales de carácter temporal solo será permitida previo permiso otorgado por el Concejo Municipal, y con la anuencia si existiese, de la organización que lo administra, de conformidad con el art.

Artículo 8 — Se prohíbe pegar propaganda comercial o político partidaria, así como deteriorar las instalaciones con animales u objetos y causar accidentes a los usuarios del mismo.

Artículo 9 — Se prohíbe a las personas subir a los arbustos, cortar éstos, sus flores o cualquier planta sembrada en el mismo, salvo para su debido mantenimiento.

Artículo 10 — Es prohibido hacer mal uso de los asientos instalados en el parque.

Artículo 11 — Es prohibido la distribución, tenencia o consumo de cualquier tipo de droga o licor en el parque, así como utilizar equipos personales con alto volumen.

Artículo 12 — El horario de uso del área infantil dentro del parque será de las seis (6) horas a las dieciocho (18) horas, todos los días.

Artículo 14 — Se prohíbe en todos los parques el juego de personas adultas con bolas, implementos deportivos u otros objetos que pongan en peligro a otras personas, o que puedan dañar las plantas o instalaciones del parque, cuando no existan áreas para ello.

Artículo 15 — La Policía de Proximidad y la Policía Municipal deberán hacer cumplir con las disposiciones que regulan el uso de los parques.

Artículo 16 — La Municipalidad regulará por los mecanismos que estime conveniente, la siembra de árboles y plantas en alamedas, parques y zonas verdes por razones de seguridad y protección a la infraestructura pública.

Artículo 17 — Rige a partir de la publicación en el Diario Oficial La Gaceta.
