The Iguanita National Wildlife Refuge is created, located in Bahía Iguanita at the head of Bahía Culebra, part of the Quebrada Grande watershed. This Refuge comprises the surface described below: located in the districts of Nacascolo and Sardinal, cantons of Liberia and Carrillo, respectively; topographic map sheet Carrillo Norte No. 3047 I, scale 1:50,000, of the Instituto Geográfico Nacional, starting from a point with coordinates 290400 N - 357900 E, located at the high-water mark (pleamar), on Playa Iguanita; the boundary begins with a northeasterly direction (rumbo noreste), passing through the following points: 290650 N - 358300 E, 290700 N - 358500 E, 290650 N - 358700 E, 290000 N - 358900 E; from here the boundary continues with a southwesterly direction (rumbo suroeste) following the 100 meters above sea level (msnm) contour line, to the point with coordinates 288950 N - 357900 E; it continues with a northwesterly direction (rumbo noroeste) to the point with coordinates 289150 N - 357700 E, located on the coastline. From here the boundary continues with a northeasterly direction (rumbo noreste) along the ordinary high-water mark (línea de pleamar ordinaria) to the point with coordinates 290400 N - 357900 E, which corresponds to the point of origin of this description.

In a strip of 50 horizontal meters on both banks of the Quebrada Grande, the provisions established for protective zones (zonas protectoras) shall apply, in accordance with the provisions of Article 33 of the Forest Law (Ley Forestal), No. 7575, of February 13, 1996, and its amendments.

The administration, protection, and management of the Iguanita National Wildlife Refuge shall be the responsibility of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), of the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE)(*), through the Tempisque Conservation Area (Área de Conservación Tempisque), in accordance with Article 22 of the Biodiversity Law (Ley de biodiversidad), No. 7788, of April 30, 1998, and its amendments.

(*)(Thus modified in its denomination by Article 11 of the Law "Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012) The Costa Rican Tourism Board (ICT) is authorized to transfer to MINAE(*), upon the publication of this Law, the section of land of the maritime-terrestrial zone (zona marítimo-terrestre), included within the Refuge, for its administration, protection, management, and development, through the National System of Conservation Areas.

(*)(Thus modified in its denomination by Article 11 of the Law "Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012) Public Administration institutions, public companies, and municipalities are authorized to donate financial and material resources to the National System of Conservation Areas, for the achievement of the objectives of this Law.

The Directorate of the Tempisque Conservation Area and the administration of the Refuge shall carry out the administrative and technical steps to achieve broad participation by the communities, institutions, and the private sector in the implementation of the Management Plan (Plan de manejo) for the Iguanita National Wildlife Refuge, considering the regulations of the Master Plan (Plan maestro) of the Polo Turístico Golfo de Papagayo of the ICT.

In compliance with the provisions of this Law, the National System of Conservation Areas is authorized to enter into cooperation agreements with the municipalities of Liberia and Carrillo, the ICT, the Polo Turístico Golfo de Papagayo, private tourism companies, local and international organizations, as well as with other interested natural or legal persons, for the procurement of resources that assist the protection, management, and development of the Refuge, development projects, and community participation.

It shall become effective upon its publication.

Créase el Refugio Nacional de Vida Silvestre Iguanita, ubicado en bahía Iguanita al fondo de bahía Culebra, parte de la cuenca Quebrada Grande. Este Refugio comprende la superficie descrita a continuación: ubicado en los distritos de Nacascolo y Sardinal, cantones de Liberia y Carrillo, respectivamente; hoja cartográfica Carrillo Norte N.º 3047 I, escala 1:50.000, del Instituto Geográfico Nacional, a partir de un punto de coordenadas 290400 N - 357900 E, ubicado en la pleamar, en playa Iguanita; el límite inicia con rumbo noreste, pasa por los siguientes puntos: 290650 N - 358300 E, 290700 N - 358500 E, 290650 N - 358700 E, 290000 N - 358900 E; a partir de aquí el límite continúa con rumbo suroeste siguiendo la curva de nivel de los 100 msnm, hasta el punto de coordenadas 288950 N - 357900 E; continúa con rumbo noroeste hasta el punto de coordenadas 289150 N-357700 E, ubicado en la línea de costa. A partir de aquí el límite continúa con rumbo noreste por la línea de pleamar ordinaria hasta el punto de coordenadas 290400 N-357900 E, que corresponde al punto de origen de la presente descripción.

En una franja de 50 m horizontales en ambas márgenes de la Quebrada Grande, serán aplicables las disposiciones establecidas para las zonas protectoras, de conformidad con lo que establece el artículo 33 de la Ley forestal, N.º 7575, de 13 de febrero de 1996, y sus reformas.

La administración, la protección y el manejo del Refugio Nacional de Vida Silvestre Iguanita le corresponderá al Sistema Nacional de Áreas de Conservación, del Ministerio del Ambiente y Energía (Minae)(*), por medio del Área de Conservación Tempisque, de conformidad con el artículo 22 de la Ley de biodiversidad, N.° 7788, de 30 de abril de 1998, y sus reformas.

(*)(Así modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012) Se autoriza al Instituto Costarricense de Turismo (ICT) para que traslade al Minae(*), a partir de la publicación de esta Ley, la sección de terreno de la zona marítimo-terrestre, comprendida dentro del Refugio, para su administración, protección, manejo y desarrollo, por medio del Sistema Nacional de Áreas de Conservación.

(*)(Así modificada su denominación por el artículo 11 de la Ley "Traslado del sector Telecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012) Se autoriza a las instituciones de la Administración Pública, las empresas públicas y las municipalidades, para que donen recursos financieros y materiales al Sistema Nacional de Áreas de Conservación, para la consecución de los objetivos de esta Ley.

La Dirección del Área de Conservación Tempisque y la administración del Refugio realizarán las diligencias administrativas y técnicas, para lograr una amplia participación de las comunidades, las instituciones y el sector privado en la implementación del Plan de manejo del Refugio Nacional de Vida Silvestre Iguanita, considerando la reglamentación del Plan maestro del Polo Turístico Golfo de Papagayo del ICT.

En cumplimiento con lo dispuesto en la presente Ley, se autoriza al Sistema Nacional de Áreas de Conservación para que suscriba convenios de cooperación con las municipalidades de Liberia y de Carrillo, el ICT, el Polo Turístico Golfo de Papagayo, las empresas turísticas privadas, las organizaciones locales e internacionales, así como con otras personas físicas o jurídicas interesadas, para la consecución de recursos que ayuden a la protección, el manejo y el desarrollo del Refugio, los proyectos de desarrollo y la participación comunal.
