in the entirety of the text - Full Text of Regulation 34973 The canton of Turrialba is included within the emergency declaration contemplated in DE-34906 of November 26, 2008 Full Text of record: E51A9 Nº 34973-MP Nº 34973-MP (This decree was repealed by article 1 of Executive Decree N° 37140 of February 13, 2012) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred upon them by articles 140, subsections 3) and 18), 146, and 180 of the Political Constitution, articles 25 subsection 1), 27 subsection 1), 28 subsections b) and j), of Law Nº 6227 of May 2, 1978, which is the General Law of Public Administration, and article 29 of Law Nº 8488 of January 11, 2006, which is the National Law of Emergencies and Risk Prevention.

1. 1That a cold front that affected the country from the 20th of November, 2008, as well as the combination of a low-pressure system located in Panama and the Costa Rican Caribbean, in addition to a high-pressure system located north of Central America, phenomena which interacted generating and maintaining conditions of winds of variable intensity and a rainy pattern in the Caribbean, Northern Zone and Central Valley, causing a significant accumulation of precipitation and flooding. Conditions that prevailed from the 20th of November until the 4th of December, all of which is recorded in the reports issued by the National Commission for Risk Prevention and Emergency Attention.

2º-These phenomena caused flooding in the Chirripó Atlántico, Sixaola, and Reventazón river basins, with extensive overflows in the basins of the Matina, Barbilla, Reventazón, Palacios, Hone Creek, Rojo, Sarapiquí rivers and sectors adjacent to the coast.

3º-The above caused damage to property and persons, impacts on road infrastructure, communications, agriculture, public services, and housing, for which the National Commission for Risk Prevention and Emergency Attention declared green, yellow, and red alerts for the most affected regions and cantons of the country.

1. 4That as a consequence of these phenomena, it was necessary to evacuate the affected persons and place them in different shelters set up by the National Commission for Risk Prevention and Emergency Attention.
2. 5That on November 26, 2008, the Executive Branch signed National Emergency Decree number 34906-MP, which included all the cantons of the province of Limón, the canton of Sarapiquí of the province of Heredia, the cantons of Moravia and Coronado of the province of San José. The above in accordance with the damage report produced that existed on the date of signing the decree.
3. 6That the effects of the event that generated the emergency continued until December 4, 2008, such that on the 5th, the National Commission for Risk Prevention and Emergency Attention lifted the existing alerts.
4. 7That on November 27, 2008, the municipal emergency committee of the Canton of Turrialba issued a report on significant damages in that canton of the province of Cartago, in which relevant impacts in the place are reported.
5. 8That the life of the population is a public-interest asset protected by the State, which must ensure its protection and the security of the inhabitants and, in general, the preservation of social order.
6. 9That the National Law of Emergencies and Risk Prevention provides that, in the event of a public calamity, caused by acts of nature or of man, which are unforeseeable or foreseeable but inevitable and cannot be controlled, managed, or overcome with the ordinary powers available to the Government, the Executive Branch may declare a national emergency in order to integrate and define the responsibilities and functions of all agencies, public and private entities, and to be able to provide a solution commensurate with the magnitude of the disaster.

10.-That by reason of the foregoing, the enactment of a legal framework is necessary to take the exceptional measures indicated by the Political Constitution and the National Law of Emergencies and Risk Prevention, to address the effects caused by this hydrometeorological phenomenon and mitigate the consequences its impact caused in the different zones of the country. Therefore,

1. 1Que un frente frío que afectó al país desde el día 20 de noviembre de 2008, así como, la suma de un sistema de baja presión, ubicado en Panamá y el Caribe costarricense, además, de un sistema de alta presión ubicado al norte de Centroamérica, fenómenos que interactuaron generando y manteniendo condiciones de vientos de intensidad variable y un patrón lluvioso en el Caribe, Zona Norte y Valle Central, provocando un acumulado importante de precipitación e inundaciones. Condiciones qué prevalecieron desde el 20 de noviembre y hasta el día 04 de diciembre, todo lo cual consta en los informes emitidos por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias.

2º-Estos fenómenos ocasionaron inundaciones en la cuenca del río Chirripó Atlántico, Sixaola, Reventazón, con desbordamientos extensivos en las cuencas de los ríos Matina, Barbilla, Reventazón, Palacios, Hone Creek, Rojo, Sarapiquí y sectores aledaños a la costa.

3º-Lo anterior provocó daños a los bienes y a las personas, afectaciones de la infraestructura vial, las comunicaciones, la agricultura, los servicios públicos y las viviendas, por lo que la Comisión Nacional de Prevención del Riegos y Atención de Emergencias, declaró alertas verde, amarilla y roja para las regiones y cantones más afectados del país.

1. 4Que como consecuencia de estos fenómenos se debió evacuar a las personas damnificadas y ubicarlas en diferentes albergues instalados por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias.
2. 5Que para el día 26 de noviembre de 2008, el Poder Ejecutivo firmó el Decreto de Emergencia Nacional, número 34906-MP, que incluyó, todos los cantones de la provincia de Limón, el cantón de Sarapiquí de la provincia de Heredia, los cantones de Moravia y Coronado de la provincia de San José. Lo anterior de acuerdo con el informe de daños producidos, que existía a la fecha de la firma del decreto.
3. 6Que los efectos del evento que generó la emergencia, se prolongaron hasta el 4 de diciembre de 2008, siendo que para el día 5, la Comisión Nacional de Prevención de Riesgo y atención de emergencias, levantó las alertas existentes.
4. 7Que el día 27 de noviembre de 2008, el comité municipal de emergencias del Cantón de Turrialba, emite un reporte sobre daños importantes en ese cantón de la provincia de Cartago, en el que se da cuenta de afectaciones de relevancia en el lugar.
5. 8Que la vida de la población es un bien de interés público tutelado por el Estado, quien debe velar por su protección y por la seguridad de los habitantes y en general por la conservación del orden social.
6. 9Que la Ley Nacional de Emergencias y Prevención del Riesgo dispone que, en caso de calamidad pública, ocasionada por hechos de la naturaleza o del hombre, que son imprevisibles o previsibles pero inevitables y no puedan ser controlados, manejados ni dominados con las potestades ordinarias de que dispone el Gobierno, el Poder Ejecutivo podrá declarar emergencia nacional, a fm de, integrar y definir las responsabilidades y funciones de todos los organismos, entidades públicas y privadas y poder brindar una solución acorde a la magnitud del desastre.

10.-Que en razón de lo medidas de excepción, que señala la Constitución Política y la Ley Nacional de Emergencias y Prevención del Riesgo, para hacerle frente a los efectos ocasionados por este fenómeno hidrometeorológico y mitigar las consecuencias que ocasionó su impacto en las diferentes zonas del país. Por tanto,
