in the entirety of the text - Full Text of Regulation 34417 Declaration of Public Interest and National Convenience of the Los Santos Wind Project Full Text record: F0DD3 Nº 34417 Nº 34417 text-align:center; text-autospace:none'>THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by Articles 11, 140 subsections 3) and 18) and 146 of the Political Constitution and section 27 of the General Law of Public Administration No. 6227 of May 2, 1978, and Articles 3 subsection m), 19 subsection b), 33 and 34 of the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996, and Article 2 of Executive Decree (Decreto Ejecutivo) No. 25721-MINAE.
I.-That Articles 19, subsection b) and 34 of the Forestry Law (Ley Forestal) No. 7575 prohibit land-use change (cambio de uso del suelo) and the cutting of trees on lands covered by forest (terrenos cubiertos de bosque) and in protection areas, except for those state or private projects that the Executive Branch declares of National Convenience.
II.-That Article 3 subsection m) of the Forestry Law (Ley Forestal) No. 7575 declares as activities of national convenience those carried out by centralized State agencies, autonomous institutions, or private companies, whose social benefits are greater than the socio-environmental costs.
III.-That Executive Decree (Decreto Ejecutivo) No. 26728-MP-MINAE of February 20, 1998, provides in its Article 1, to declare of public interest projects for the generation, transmission, and distribution of electrical energy.
IV.-That the Law on Participation of Rural Electrification Cooperatives and Municipal Public Service Companies in National Development, No. 8345 of February 26, 2003, in its Article 3, declared of public utility and interest the activities of generation, distribution, and commercialization of electrical energy carried out by cooperative associations and municipal public service companies covered by said law.
V.-That the current National Development Plan in Chapter 4, Section 3.2.4 establishes that: "Technologically improve and reestablish the levels of reliability, quality, and security in the energy supply, reducing the use of hydrocarbons in the production of electrical energy, and laying the foundations to be, in the year 2021, the first country in the world to produce 100% of the electricity it consumes from renewable energy sources." VI.-That among the fundamental objectives of the Energy Policy enacted by the Ministry of Environment and Energy in relation to the energy supply, it is established: Public and private investment: Increase investment and the inclusion of actors in the sector through the active participation of the public and private sectors, giving priority to the utilization of all clean and renewable national energy sources.
VII.-That the efficient and timely supply of electrical services not only forms part of the government's policies for the country's development, but also entails the improvement of the citizens' quality of life.
VIII.-That the Rural Electrification Cooperative Los Santos, R.L. (Coopesantos, R. L.), with legal identification number 3-004-045260, requires constructing the Los Santos Wind Project (Proyecto Eólico Los Santos) in the district of San Isidro, canton El Guarco, province of Cartago and the district of San Cristóbal, canton Desamparados, province of San José; taking advantage of the wind resources of the area, with the objective of improving the electrical supply service to its associates, through the implementation of renewable energy generation projects of this type, which also provide benefits such as the reduction of carbon dioxide and minimize the greenhouse effect.
IX.-That the project will harness the force of the wind for the generation of electrical energy, and consists of three stages, each with a total capacity of 5.4 MW and with six 900 kW wind turbines. The first stage is located in the Sector de la Paz del Guarco. The second and third stages are located in Casamata del Garco and San Cristóbal de Desamparados.
X.-That the Environmental Impact Study for the Los Santos Wind Project First Stage, case file No. 739-2003-SETENA, was duly approved by the National Environmental Technical Secretariat (SETENA) through resolution No. 1330-2005-SETENA and was extended through resolution No. 1054-2007-SETENA. For the second and third stages, the environmental assessment process was initiated before SETENA, through the submission of form D1.
XI.-That the placement of wind turbine towers of the Los Santos Wind Project on the properties map sheets C-899662-2003, C-608650-1985, C-1013392-2005 for the first stage, on the properties map sheet SJ-158204-1993 for the second stage, and the properties map sheets C-696642-1987, C-689164-1987, C-689165-1987, SJ-79992-1992, SJ-980041-2005, and SJ-1412266-2010 for the third stage, could require the cutting of trees in pasture areas to allow the circulation of air currents, with the possibility that some forest species are declared under a ban (veda) or in danger of extinction, or are located in protection zones or forests according to Articles 33 and 34 of the Forestry Law (Ley Forestal) No. 7575. Therefore, (Thus amended the preceding considering by Article 1 of executive decree No. 36535 of February 15, 2011) They Decree:
DECLARATION OF PUBLIC INTEREST AND NATIONAL CONVENIENCE OF THE LOS SANTOS WIND PROJECT
Considering:
L., upon prior authorization from the corresponding office of the National System of Conservation Areas (SINAC), shall proceed with the cutting of trees located in protection areas, as indicated in the project.
L., and its contractors must replace and maintain them for a minimum period of three years, at a ratio of no less than ten to one, which will be included in the direct or indirect area of influence of the project, whichever is more suitable according to good technical and environmental practices.
For follow-up and control of the above, the Cooperativa de Electrificación Rural Los Santos R. L. shall submit a report to the corresponding office of the SINAC, which in turn shall certify compliance with the replacement.
The species conservation strategies shall be presented to the SINAC of the Ministry of Environment and Energy, so that the State Forestry Administration (AFE) can carry out the technical analysis and grant the corresponding approval.
For this purpose, SINAC shall sign letters of understanding with those academic entities or others with experience in the matter, which will specify the technical responsibilities that those in charge of the corresponding conservation strategy will have and will act as the executors and direct managers of the same. On the other hand, the AFE shall be responsible for ensuring compliance with the corresponding implementation.
The cost of the easements (servidumbres) and of the project lands shall be assumed by the Cooperativa de Electrificación Rural Los Santos R. L.

I.-Que los artículos 19, inciso b) y 34 de la Ley Forestal Nº 7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenos cubiertos de bosque y en áreas de protección, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional.
II.-Que el artículo 3 inciso m) de la Ley Forestal Nº 7575 declara como actividades de conveniencia nacional las realizadas por las dependencias centralizadas del Estado, instituciones autónomas o empresas privadas, cuyos beneficios sociales sean mayores a los costos socio-ambientales.
III.-Que el Decreto Ejecutivo Nº 26728-MP-MINAE del 20 de febrero de 1998, dispone en su artículo 1º, declarar de interés público los proyectos de generación, transmisión y distribución de energía eléctrica.
IV.-Que la Ley de Participación de Cooperativas de Electrificación Rural y de las Empresas de Servicios Públicos Municipales en el Desarrollo nacional, Nº 8345 del 26 de febrero del 2003 en su artículo 3, declaró de utilidad e interés público las actividades de generación, distribución y comercialización de la energía eléctrica que realicen las asociaciones cooperativas y las empresas de servicios públicos municipales amparadas a la citada ley.
V.-Que el Plan Nacional de Desarrollo vigente en el Capítulo 4. Sección 3.2.4 establece que se debe: "Mejorar tecnológicamente y reestablecer los niveles de confiabilidad, calidad y seguridad en el suministro de energía, reduciendo el uso de hidrocarburos en la producción de energía eléctrica, y sentando las bases para ser, en el año 2021, el primer país del mundo que produzca el 100% de la electricidad que consume a partir de fuentes renovables de energía." VI.-Que entre los objetivos fundamentales de la Política Energética promulgada por el Ministerio del Ambiente y Energía en relación con la oferta energética se establece: Inversión pública y privada: Aumentar la inversión y la inclusión de actores en el sector mediante la participación activa de los sectores público y privado, otorgando prioridad al aprovechamiento de todas las fuentes energéticas nacionales limpias y renovables.
VII.-Que el suministro eficiente y oportuno de los servicios eléctricos, no solo forma parte de las políticas del gobierno para el desarrollo del país, sino que conlleva el mejoramiento de la calidad de vida de la ciudadanía.
VIII.-Que la Cooperativa de Electrificación Rural Los Santos, R.L. (Coopesantos, R. L.), con cédula jurídica Nº 3-004-045260 requiere construir el proyecto Eólico Los Santos en el distrito de San Isidro, cantón El Guarco, provincia de Cartago y el distrito San Cristóbal, cantón Desamparados, provincia de San José; aprovechando los recursos eólicos de la zona, con el objetivo de mejorar el servicio de suministro eléctrico a sus asociados, mediante la implementación de proyectos de generación de energía renovable de este tipo, que además otorgan beneficios como la reducción de dióxido de carbono y minimizan el efecto invernadero.
IX.-Que el proyecto aprovechará la fuerza del viento para la generación de energía eléctrica, y consta de tres etapas, cada una con potencia total de 5,4 mw y con seis aerogeneradores de 900 kw. La primera etapa se ubica en el Sector de la Paz del Guarco. Las etapas segunda y tercera se ubican en Casamata del Garco y San Cristóbal de Desamparados.
X.-Que el Estudio de Impacto Ambiental para el proyecto Eólico Los Santos Primera Etapa, expediente Nº 739-2003-SETENA fue debidamente aprobado por la Secretaría Técnica Nacional Ambiental mediante la resolución Nº 1330-2005-SETENA y se prorroga mediante resolución Nº 1054-2007-SETENA. Para la segunda y tercera etapa se inició el proceso de evaluación ambiental ante la Secretaría Técnica Nacional Ambiental (SETENA), mediante la presentación del formulario D1.
XI.-Que la colocación de torres de los aerogeneradores del Proyecto Eólico Los Santos en las fincas planos C-899662-2003, C-608650-1985, C-1013392-2005 para la primera etapa, en las fincas planos SJ-158204-1993 para la segunda etapa y las fincas planos C-696642-1987, C-689164-1987, C-689165-1987, SJ-79992-1992, SJ-980041-2005 y SJ-1412266-2010 para la tercera etapa, podrían requerir la corta de árboles en áreas de potrero para permitir la circulación de las corrientes de aire, existiendo la posibilidad de que algunas especies forestales estén declaradas en veda o en peligro de extinción o se encuentren ubicadas en zonas de protección o bosques según los artículos 33 y 34 de la Ley Forestal N° 7575. DECLARATORIA DE INTERÉS PÚBLICO Y CONVENIENCIA NACIONAL DEL PROYECTO EÓLICO LOS SANTOS
Considerando:

L., previa autorización de la oficina correspondiente del Sistema Nacional de Áreas de Conservación, procederá a la corta de árboles ubicados en las áreas de protección, según se indica en el proyecto.
L., y sus contratistas deberán reponer y dar mantenimiento por un período mínimo de tres años, en una proporción no menor de diez a uno, que se incluirán en el área de influencia directa o indirecta del proyecto, según sea más conveniente desde las buenas prácticas técnicas y ambientales.
Para seguimiento y control de lo anterior la Cooperativa de Electrificación Rural Los Santos R. L. rendirá un informe a la oficina correspondiente del Sistema Nacional de Áreas de conservación, la que por su parte certificará el cumplimiento de la reposición.
Las estrategias de conservación de especies serán presentadas al Sistema Nacional de Áreas de Conservación (SINAC) del Ministerio del Ambiente y Energía, para que la Administración Forestal del Estado (AFE) realice el análisis técnico y otorgue la aprobación correspondiente.
Para ello, el SINAC suscribirá cartas de entendimiento con aquellas entidades académicas u otras con técnicas que tendrán los encargados de la estrategia de conservación correspondiente y fungirán como los ejecutores y responsables directos de las mismas. Por otra parte, la AFE, será responsable de velar por el cumplimiento de la implementación correspondiente.
El costo de las servidumbres y de las tierras del proyecto serán asumidos por la Cooperativa de Electrificación Rural Los Santos R. L.
