Regulation of Plant Nurseries, Seedbeds, and Germplasm BanksReglamento de Viveros, Almácigos, Semilleros y Bancos de Yemas

Act (Acta): Document by which recommendations of a technical nature and certification of compliance or non-compliance with those recommendations, or of the execution of phytosanitary measures (medidas fitosanitarias) in accordance with the Law of Phytosanitary Protection and its regulations, are given.

Seedbed (Almácigo): A defined area where developing plant material is located, which will be selected for transfer to the nursery (vivero) or definitive field.

Budwood Bank (Banco de Yemas): A group of plants of recognized origin, genetic identity, and phytosanitary quality (calidad fitosanitaria), destined for obtaining budwood (yemas) for reproduction.

Phytosanitary Quality (Calidad fitosanitaria): It is the physical and health condition of every plant produced in a nursery (vivero), germination bed (semillero), seedbed (almácigo), or budwood bank (banco de yemas).

Phytosanitary Certification (Certificación fitosanitaria): Use of phytosanitary procedures leading to the issuance of a phytosanitary certificate.

Certificate (Certificado): Official document that attests to the phytosanitary status of any shipment subject to phytosanitary regulations.

Phytosanitary Certificate (Certificado fitosanitario): Certificate designed according to the certificate models of the International Plant Protection Convention (IPPC).

Devitalization (Desvitalización): Procedure that eliminates the capacity for germination, growth, or subsequent reproduction of plants or plant products.

Technical Provisions (Disposiciones Técnicas): All measures that the phytosanitary authorities of the Directorate recommend to obtain a good phytosanitary quality (calidad fitosanitaria) of the produced plant material.

Fruit Trees (Frutales): Trees and shrubs that produce fruit, all citrus trees, and avocado are included within this concept.

Germplasm (Germoplasma): Plants intended for use in improvement or conservation programs. (Food and Agriculture Organization of the United Nations, FAO, 1990), (Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019) Reproduction Material (Material de Reproducción): It is plants or parts of them intended for propagation.

Phytosanitary Measure (Medida Fitosanitaria): Any legislation, regulation, or official procedure that has the purpose of preventing the introduction and/or dissemination of quarantine pests or limiting the economic repercussions of regulated non-quarantine pests (International Standards for Phytosanitary Measures - ISPM No. 5).

Pest (Plaga): Any species, race, or biotype of plant or animal, or pathogenic agent harmful to plants or plant products (FAO, 1990: revised FAO, 1995; IPPC, 1997) (Thus reformed the previous definition by Article 1 of Executive Decree No. 42167 of October 29, 2019) Mother Plant (Planta Madre): Plant used as a producer of seed or vegetative parts intended for reproduction.

Plants (Plantas): Living plants and parts thereof, including seeds (semillas) and germplasm (germoplasma) (Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019) Plants for Planting (Plantas para plantar): Plants intended to remain planted, to be planted, or replanted (International Standards for Phytosanitary Measures-ISPM No. 5).

(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019) Commercial Producer (Productor Comercial): Refers to any natural or legal person engaged in the production or commercialization of plant material.

National Program for Propagative Plant Material (Programa Nacional de Material Vegetal Propagativo): The competent body for registration administration and responsible for carrying out the administrative procedure thereof.

(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019) Seeds (Semillas): Class of basic commodity corresponding to seeds for planting or intended to be planted and not for consumption or processing (see grain) (Food and Agriculture Organization of the United Nations, FAO, 1990), revised by the Interim Commission on Phytosanitary Measures - ICPM, 2001.

(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019) Varieties (Variedades): Any plant material used for propagation, duly selected for its permanent genetic characteristics.

Nursery (Vivero): Site where plants from seedbeds (almácigos) or germinators are located to be grafted or recreated.

Surveillance (Vigilancia): An official process by which information on the presence or absence of a pest (plaga) is collected and recorded using surveys, monitoring, or other procedures (International Standards for Phytosanitary Measures-ISPM No. 5).

Budwood (Yemas): Shoot of a plant from which branches, leaves, and flowers develop.

SFE: State Phytosanitary Service (Servicio Fitosanitario de Estado).

On Administrative Organization

• a)Provide guidelines and policies on phytosanitary matters related to the management and traceability of propagative plant material at the national level, from the production stage to its establishment in the field.
• b)Establish and follow up on the technical and administrative procedures for the registration and phytosanitary control of sites dedicated to the production and commercialization of propagative plant material.
• c)Coordinate and supervise the programming and development of technical, phytosanitary, legal, and administrative activities of the Program, in coordination with the Regional Operational Units (UOR), as well as with other Departments of the SFE or other instances of the agricultural sector.
• d)Establish the technical phytosanitary measures, control mechanisms, inspection, and traceability of sites intended for the production and commercialization of propagative plant material.
• e)In collaboration with the Regional Operational Units (UOR), keep the registry of establishments intended for the production and commercialization of propagative plant material updated.

ON REGISTRATION

In case of non-compliance for not being registered with the SFE, action will be taken in accordance with the provisions of Law of Phytosanitary Protection No. 7664, its regulations, and related legislation.

• a)Submit a formal registration application before the Regional Operational Unit (UOR) of the SFE according to the territorial location detailed in said application.
• b)For a natural person, present an identity card for verification. In the case of a foreign person, they must present the migratory identity document for foreigners (DIMEX).
• c)For a legal person, present a valid legal standing for verification.
• d)Be up to date with the obligations of the Costa Rican Social Security Fund (Caja Costarricense del Seguro Social). These will be verified internally.
• e)Indicate the species and varieties (variedades) to be reproduced.
• f)Present a location map of the production site.
• g)In cases where the property where the activity is carried out is under a lease or loan condition, a lease or loan agreement must be presented with an expiration date and authenticated by a notary public.
• h)Present proof of payment prior to the delivery of the approval resolution.

8220, the application will be archived. Once the information is verified and if it is complete, they will qualify the information based on its substance and will conduct a site visit, this within a maximum period of 10 business days, and will issue a technical report within that period, which certifies the content of the application, and if there is regulation with specific phytosanitary measures (medidas fitosanitarias) for one or several of the species reproduced on the site, it must indicate whether or not these conform to the regulations, then the expediente will be sent to the central offices for approval and registration.

The registration may be renewed once the validity period has ended. For the registration renewal process, the user must comply with what is requested in Article 6 of this regulation.

Only one registration per natural(*) or legal person shall be allowed. If the interested party has more than one productive unit at the national level, they are registered under the same code in a single expediente, but each productive unit must have an act book (libro de actas) so that the phytosanitary inspector can make the notes of each inspection visit.

They shall be paid prior to the delivery of the approval resolution. The cost of the service for registration in the registry of the National Program for Propagative Plant Material shall be in accordance with the current Executive Decree No. 27763-MAG. "Setting of tariffs for the services of the Ministry of Agriculture and Livestock." (Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)

The SFE, through the Department of Regional Operations (DOR), by means of the Regional Operational Units (UOR), shall suspend the registration in the following cases:

• a)When there is a phytosanitary risk that endangers the plant heritage of the state.
• b)When the owner or occupant, by official letter, declares a temporary cessation of the activity.
• c)Not reporting changes in the requirements indicated in the registration application.

(*)d) For non-compliance with technical recommendations.

The Department of Regional Operations (DOR), through the National Program for Propagative Material, may suspend the registration in the following case:

(*) (Corrected by means of an Erratum and published in La Gaceta No. 34 of February 20, 2020, page No. 84) e) When the lease agreement for the facilities declared in the registration has expired and a new agreement extending the term has not been presented.

The suspension of the registration will be subsequent to the notification sent to the legal representative of the establishment by means of an administrative resolution issued by the Regional Operational Units (UOR) or, where appropriate, by the person in charge of the National Program for Propagative Material, detailing the reasons for it, and a period of three business days for the defense statement will be granted, before issuing the respective resolution.

The suspension shall be lifted by issuing an administrative resolution once the deficiencies that gave rise to it have been corrected.

The SFE, through the Department of Regional Operations (DOR), by means of the person in charge of the National Program for Propagative Plant Material (PNMVP), may cancel the registration in the following cases:

• a)At the party's request.
• b)When three months have elapsed since the registration was suspended and no action has been taken to reactivate it or to correct the situations that led to the suspension.

The National Program for Propagative Plant Material (PNMVP), competent in matters of registration administration, will be responsible for carrying out the administrative procedure for the cancellation of registration.

Any declaration made to the registry may be modified at the party's request, and approved or denied via an administrative resolution. Registration rights may be transferred by assignment.

Registered natural or legal persons must inform the competent body of the registry of any changes that have occurred in(*) the declarations made in the application.

On the procedure

When the issued standards and the technical recommendations based on regulations given by an SFE official with competence in the matter are breached, the SFE regional office with competence may order the total or partial closure of the propagation site or establishment via an administrative resolution, which will cause the immobilization of the propagative plant material in the closed area.

Propagation sites shall keep an act book (libro de actas) in which the visits of SFE officials shall be recorded; it must be available to the officials and in a place that allows its safekeeping; the book shall be provided by the competent body of the SFE, which shall be its owner.

In the case of those regulated quarantine or non-quarantine pests, the establishment shall be obligated to comply with the technical and legal measures issued by the SFE, among which is the production of propagative plant material under a protected environment, in order to minimize the risk of pest (plaga) dissemination.

Sole Transitory Provision: The owners or occupants by any title of establishments for the propagation and commercialization of propagative plant material shall have a period of up to six months from the publication of this decree for their registration, in accordance with the guidelines established in the administrative and technical procedures issued by the SFE, based on this Decree.

Acta: Documento mediante el cual se dan recomendaciones de carácter técnico y constancia del cumplimiento o no de esas recomendaciones, o bien de la ejecución de medidas fitosanitarias de acuerdo con la Ley de Protección Fitosanitaria y sus reglamentos.

Almácigo: Área determinada donde se localiza material vegetal en desarrollo que será seleccionado para su traslado al vivero o campo definitivo.

Banco de Yemas: Conjunto de plantas de origen, identidad genética y calidad fitosanitaria reconocidas, que se destinan a la obtención de yemas para la reproducción.

Calidad fitosanitaria: Es la condición física y sanitaria de toda planta producida en un vivero, semillero, almácigo o banco de yemas.

Certificación fitosanitaria: Uso de procedimientos fitosanitarios conducentes a la expedición de un certificado fitosanitario.

Certificado: Documento oficial que atestigua el estatus fitosanitario de cualquier envío sujeto a reglamentaciones fitosanitarias.

Certificado fitosanitario: certificado diseñado según los modelos de certificado de la Convención Internacional de Protección Fitosanitaria (CIPF).

Desvitalización: Procedimiento que elimina la capacidad de germinación, crecimiento o reproducción posterior de las plantas o productos vegetales.

Disposiciones Técnicas: Todas las medidas que las autoridades fitosanitarias de la Dirección recomienden para obtener una buena calidad fitosanitaria del material vegetal producido.

Frutales: Se ubican dentro de este concepto los árboles y arbustos que produzcan frutas, todos los cítricos y el aguacate.

Germoplasma: Plantas destinadas para uso en programas de mejoramiento o conservación. (Organización de las Naciones Unidas para la Agricultura y la Alimentación, siglas en inglés FAO, 1990), (Así adicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de octubre de 2019) Material de Reproducción: Son plantas o partes de ellas destinadas a la propagación.

Medida Fitosanitaria: cualquier legislación reglamento o procedimiento oficial que tenga el propósito de prevenir la introducción y/o diseminación de plagas cuarentenarias o de limitar las repercusiones económicas de las plagas no cuarentenarias reglamentadas (Normativa Internacional para Medidas Fitosanitarias- NIMF N° 5).

Plaga: Cualquier especie, raza o biotipo vegetal o animal o agente patógeno dañino para las plantas o productos vegetales (FAO, 1990: revisado FAO, 1995; CIPF, 1997) (Así reformada la definición anterior por el artículo 1° del decreto ejecutivo N° 42167 del 29 de octubre de 2019) Planta Madre: Planta utilizada como productor de semilla o partes vegetales destinadas a la reproducción.

Plantas: Plantas vivas y partes de ellas, incluidas las semillas y el germoplasma (Así adicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de octubre de 2019) Plantas para plantar: plantas destinadas a permanecer plantadas, a ser plantadas o replantadas (Normativa Internacional para Medidas Fitosanitarias-NIMF N° 5).

Programa Nacional de Material Vegetal Propagativo: órgano competente en materia de administración del registro y responsable de llevar a cabo el procedimiento administrativo del mismo.

Vivero: Sitio donde se ubican las plantas procedentes de almácigos o germinadores para ser injertados o recreados.

Vigilancia: Un proceso oficial, mediante el cual se recoge y registra información sobre la presencia o ausencia de una plaga utilizando encuestas, monitoreo u otros procedimientos (Normativa Internacional para Medidas Fitosanitarias-NIMF N° 5).

Yemas: Brote de una planta a partir del cual se desarrollan las ramas, las hojas y las flores.

SFE: Servicio Fitosanitario de Estado.

De la Organización Administrativa

• a)Dar los lineamientos y políticas en materia fitosanitaria relacionada con el manejo y trazabilidad del material vegetal propagativo a nivel nacional, desde la etapa de producción hasta su establecimiento en el campo.
• b)Establecer y dar seguimiento a los procedimientos técnicos y administrativos para el registro y control fitosanitario de los sitios que se dedican a la producción y comercialización de material vegetal propagativo.
• c)Coordinar y supervisar la programación y desarrollo de actividades técnicas, fitosanitarias, legales y administrativas del Programa, en coordinación con las Unidades Operativas Regionales, así como con otros Departamentos del SFE u otras instancias del Sector agropecuario.
• d)Establecer las medidas técnicas fitosanitarias, mecanismos de control, inspección y trazabilidad de sitios destinados a la producción y comercialización de material vegetal propagativo.
• e)En colaboración con las Unidades Operativas Regionales, mantener actualizado el registro de los establecimientos destinados a la producción y comercialización de material vegetal propagativo.

DEL REGISTRO

En caso de incumplimiento de no estar registrados ante el SFE, se actuará conforme a lo estipulado en la Ley de Protección Fitosanitaria N' 7664, sus reglamentos y legislación conexa.

• a)Presentar solicitud formal de inscripción ante la Unidad Operativa Regional del SFE conforme a la ubicación territorial detallada en dicha solicitud.
• b)Para persona física, presentar cédula de identidad para su verificación. En el caso de persona extranjera debe presentar el documento de identidad migratoria para extranjeros (DIMEX).
• c)Para persona jurídica, presentar personería jurídica vigente para su verificación.
• d)Encontrarse al día con las obligaciones de la Caja Costarricense del Seguro Social. Las mismas se verificarán a lo interno.
• e)Indicar las especies y variedades a reproducir.
• f)Presentar plano de ubicación del sitio de producción.
• g)En casos en que el inmueble donde se desarrolla la actividad se encuentre en condición de arriendo o préstamo, debe presentar contrato de arriendo o préstamo con fecha de vencimiento y autenticado por un notario público.
• h)Presentar comprobante de pago previo a la entrega de la resolución de aprobación.

Una vez verificada la información y si está completa calificaran por el fondo la información, y realizarán una visita al sitio, esto en un plazo máximo de 10 días hábiles y emitirán un informe técnico dentro de ese plazo, en el que se testimonia lo dicho en la solicitud y si existe regulación con medidas fitosanitarias especificas para una o varias de las especies que se reproducen en el sitio, deberá indicar la conformidad o no de estas con lo normado, luego remitirán el expediente a oficinas centrales, para su aprobación y registro.

El registro podrá ser renovado una vez finalizado el periodo de vigencia. Para el proceso de renovación del registro, el usuario deberá cumplir con lo que se solicita el en artículo 6 de este reglamento.

Sólo se permitirá un registro por persona física(*) o jurídica. Si el interesado posee más de una unidad productiva a nivel nacional, se registran bajo el mismo código en un único expediente, pero deberá contar con un libro de actas, en cada una de las unidades productivas para que el inspector fitosanitario realice las anotaciones de cada visita de inspección.

Serán cancelados previo a la entrega de la resolución de aprobación. El costo del servicio de inscripción al registro del Programa Nacional de Material Vegetal Propagativo será de conformidad con el Decreto Ejecutivo N° 27763-MAG vigente. "Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería.

El SFE a través del Departamento de Operaciones Regionales, mediante las Unidades Operativas Regionales, suspenderá el registro en los siguientes casos:

• a)Cuando exista un riesgo fitosanitario que ponga en peligro el patrimonio vegetal del estado.
• b)Cuando el propietario u ocupante, mediante oficio, declare un cese temporal de la actividad.
• c)No reportar los cambios en los requisitos indicados en la solicitud de registro.

(*)d) Por incumplimiento de las recomendaciones técnicas.

El Departamento de Operaciones Regionales, mediante el Programa Nacional de Material Propagativo, podrá suspender el registro en el siguiente caso:

(*) (Corregido mediante Fe de Erratas y publica en La Gaceta N° 34 del 20 de febrero del 2020, página N° 84) e) Cuando el contrato de arrendamiento de las instalaciones declaradas en el registro haya expirado y no se haya presentado un nuevo contrato de ampliación del plazo.

La suspensión del registro será posterior a la notificación enviada al representante legal del establecimiento mediante una resolución administrativa emitida por las Unidades Operativas Regionales o en su efecto por el encargado del Programa Nacional de Material Propagativo, en donde se detalla el porqué de la misma y se dará un plazo de tres días hábiles para el descargo, antes de emitir la resolución respectiva.

La suspensión será levantada mediante la emisión de una resolución administrativa una vez que se hayan subsanado las deficiencias que han dado origen a la misma.

El SFE a través del Departamento de Operaciones Regionales, mediante el encargado del Programa Nacional de Material Vegetal Propagativo, podrá cancelar la inscripción del registro en los siguientes casos:

• a)A solicitud de parte.
• b)Cuando hayan transcurrido tres meses de suspendido el registro y no se haya realizado la gestión para reactivar el mismo o subsanar las situaciones que dieron lugar a la suspensión.

El Programa Nacional de Material Vegetal Propagativo, competente en materia de administración del registro, será el responsable de llevar a cabo el procedimiento administrativo para la cancelación del registro.

Cualquier declaración hecha al registro puede modificarse a solicitud de parte, y aprobada o denegada vía resolución administrativa. Se puede transferir los derechos de registro por cesión.

Las personas físicas o jurídicas registradas deberán de informar al órgano competente del registro los cambios que hayan ocurrido en(*) las declaraciones realizadas en la solicitud.

Del procedimiento

Cuando se incumplan las normas emitidas y las recomendaciones técnicas basadas en normativa dadas por un funcionario del SFE con competencia en la materia, la oficina regional del SFE con competencia podrá ordenar la clausura total o parcial del sitio de propagación o establecimiento vía resolución administrativa, esto provocará la inmovilización del material vegetal propagativo del área clausurada.

Los sitios de propagación llevarán un libro de actas en que se anotarán las visitas de los funcionarios del SFE, el mismo debe estar disponible para los funcionarios y en un lugar que permita su resguardo, el libro será proporcionado por el órgano competente del SFE que será el propietario del mismo.

En el caso de aquellas plagas reglamentadas cuarentenarias o no cuarentenarias, el establecimiento estará en la obligatoriedad de acatar las medidas técnicas y legales emitidas por el SFE, entre las cuales se establece la producción del material vegetal propagativo bajo un ambiente protegido, con el fin de minimizar el riesgo de diseminación de una plaga.

Transitorio único: Los propietarios u ocupantes por cualquier título de establecimientos de propagación y comercialización de material vegetal propagativo, contarán con un plazo de hasta seis meses, a partir de la publicación del presente decreto para su registro, de acuerdo con los lineamientos establecidos en los procedimientos administrativos y técnicos emitidos por el SFE, con base en este Decreto.
