I.-That it is an essential function of the State to protect the health and life of persons and animals, as well as to guarantee the protection of crops from pests and diseases that may put agricultural protection at risk or cause damage.
II.-That the Ministry of Agriculture and Livestock, through the State Phytosanitary Service, is responsible for controlling the phytosanitary quality of propagating plant material.
III.-That it is in the interest of the State to protect plant propagation materials reproduced in laboratories for sexual or asexual plant reproduction, seed plots, seedbeds, nurseries, germplasm banks, seed production fields, or other propagation materials. With the purpose of obtaining plants for planting of good phytosanitary quality to be used as propagation materials.
IV.-That the reproduction and trade of propagating plant material, without phytosanitary control, can become a means of propagation and dissemination of pests.
V.-That, knowing the economic damages that the use of propagating plant material of poor phytosanitary quality can cause, it is urgently necessary to establish phytosanitary measures aimed at establishing mandatory procedures for the regulated parties.
VI.-That according to internal control report AI-SFE-SA-INF-002-2016: Results of the Audit Study on the Evaluation of the Internal Control System related to the substantive Process called "Pest Surveillance and Control", 2016, it issues the recommendation to analyze the sufficiency and pertinence of the provisions of Article 13 of the "Regulation for Nurseries, Seedbeds, Seed Plots, and Budwood Banks" (Decreto Ejecutivo No. 33927-MAG).
VII.-That to date, Decreto Ejecutivo No. 33927-MAG exists, which is the Regulation for Nurseries, Seedbeds, Seed Plots, and Budwood Banks, published in the Official Gazette La Gaceta number 208 of October 30, 2007, however, it is necessary to adjust the regulations to the new practices of propagation of propagating plant material in order to regulate and facilitate the registration and monitoring process for such materials.
VIII.-That this Decreto Ejecutivo complies with the principles of regulatory improvement, according to report No. DMRDAR-INF-083-19 issued by the Directorate of Regulatory Improvement, on September 19, 2019. Therefore, They Decree:

For the purposes of this Regulation, the following is defined as:
Pest: Any species, race, or biotype of plant or animal, or pathogenic agent harmful to plants or plant products (FAO, 1990; revised FAO, 1995; IPPC, 1997)

REGISTRATION
CHAPTER III
In the event of non-compliance for not being registered with the SFE, action will be taken in accordance with the stipulations of the Phytosanitary Protection Law No. 7664, its regulations, and related legislation.
If incomplete, a warning will be issued to the interested party to correct the non-conformity; if not corrected within a period of 10 business days according to Article 60 of Law No. 8220, the application will be archived. Once the information is verified and if it is complete, they will evaluate the information on its merits and conduct a site visit, within a maximum period of 10 business days, and issue a technical report within that period, which testifies to what was stated in the application. If there are regulations with specific phytosanitary measures for one or several of the species reproduced at the site, it must indicate whether or not they conform to the standards, and then forward the file to the central offices for approval and registration.
The registration may be renewed once the validity period has ended. For the registration renewal process, the user must comply with what is requested in Article 6 of this regulation.
Only one registration per natural (*) or legal person shall be permitted. If the interested party possesses more than one production unit nationwide, they are registered under the same code in a single file, but they must have a logbook at each of the production units for the phytosanitary inspector to record the notes of each inspection visit.

These shall be paid prior to the delivery of the approval resolution. The cost of the registration service for the registry of the Programa Nacional de Material Vegetal Propagativo shall be in accordance with the current Decreto Ejecutivo No. 27763-MAG. "Setting of tariffs for the services of the Ministry of Agriculture and Livestock"
The SFE, through the Departamento de Operaciones Regionales, via the Regional Operational Units, shall suspend the registration in the following cases:
(*) d) For non-compliance with technical recommendations.
The Departamento de Operaciones Regionales, through the Programa Nacional de Material Propagativo, may suspend the registration in the following case:
(*) (Corrected by Errata and published in La Gaceta No. 34 of February 20, 2020, page No. 84) e) When the lease contract for the facilities declared in the registration has expired and a new contract extending the term has not been submitted.
The suspension of the registration shall occur after notification sent to the legal representative of the establishment via an administrative resolution issued by the Regional Operational Units or, where appropriate, by the head of the Programa Nacional de Material Propagativo, detailing the reason for it. A period of three business days will be granted for the defense, before issuing the respective resolution.
The suspension shall be lifted by issuing an administrative resolution once the deficiencies that gave rise to it have been corrected.
The SFE, through the Departamento de Operaciones Regionales, via the head of the Programa Nacional de Material Vegetal Propagativo, may cancel the registration in the following cases:
The Programa Nacional de Material Vegetal Propagativo, competent in registry administration matters, shall be responsible for carrying out the administrative procedure for the cancellation of the registration.
Any declaration made to the registry may be modified at the request of a party, and approved or denied via an administrative resolution. Registration rights may be transferred by assignment.
Registered natural or legal persons must inform the competent registry body of any changes that have occurred in (*) the declarations made in the application.

Establishments (natural or legal persons) that exclusively commercialize propagating plant material and are not dedicated to reproduction are exempted. In this case, they must maintain an updated record of the propagating plant material from their suppliers to guarantee the traceability of the material moved from the propagation site. This exception does not exempt from phytosanitary control and pest surveillance, nor from the obligation to comply with technical recommendations issued by the phytosanitary authority(ies) and from the eventual closure of the facilities for non-compliance with technical recommendations based on regulations given by an SFE official competent in the matter.
Procedure
CHAPTER IV
When the issued norms and technical recommendations based on regulations given by an SFE official competent in the matter are breached, the competent regional office of the SFE may order the total or partial closure of the propagation site or establishment via an administrative resolution; this will cause the immobilization of the propagating plant material in the closed area.
Propagation sites shall keep a logbook in which the visits of SFE officials will be recorded. This logbook must be available to the officials and in a place that allows its safekeeping. The logbook will be provided by the competent body of the SFE, which will be its owner.
In the case of regulated quarantine or non-quarantine pests, the establishment shall be obligated to comply with the technical and legal measures issued by the SFE, among which is the production of propagating plant material under a protected environment, in order to minimize the risk of dissemination of a pest.
For the purposes of this Regulation, the following is defined as:
Germplasm: Plants intended for use in improvement or conservation programs. (Food and Agriculture Organization of the United Nations, acronym in English FAO, 1990).
Phytosanitary Measure: Any legislation, regulation, or official procedure having the purpose of preventing the introduction and/or spread of quarantine pests or limiting the economic impact of regulated non-quarantine pests (International Standards for Phytosanitary Measures - ISPM No. 5).
Plants: Living plants and parts thereof, including seeds and germplasm.
Plants for Planting: Plants intended to remain planted, to be planted, or replanted (International Standards for Phytosanitary Measures - ISPM No. 5).
Programa Nacional de Material Vegetal Propagativo: competent body in registry administration matters and responsible for carrying out its administrative procedure.
Seeds: A class of basic product corresponding to seeds for planting or intended to be planted and not for consumption or processing (see grain) (Food and Agriculture Organization of the United Nations, acronym in English FAO, 1990), revised by the Interim Commission on Phytosanitary Measures - ICPM, 2001.
Surveillance: An official process whereby information on the presence or absence of a pest is collected and recorded using surveys, monitoring, or other procedures (International Standards for Phytosanitary Measures - ISPM No. 5).
UOR: Unidad Operativa Regional
Encompasses all laboratories for sexual and asexual plant reproduction, seed plots, seedbeds, nurseries, germplasm banks, seed production fields, or other propagation materials intended for production for commercialization.

Single Transitory: The owners or occupants, under any title, of propagation and commercialization establishments for propagating plant material shall have a period of up to six months, from the publication of this decree, for their registration, in accordance with the guidelines established in the administrative and technical procedures issued by the SFE, based on this Decree.

I.-Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la protección agrícola.
II.-Que le corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado, controlar la calidad fitosanitaria del material vegetal propagativo.
III.-Que es de interés del Estado proteger los materiales vegetales de propagación reproducidos en los laboratorios de reproducción sexual o asexual de vegetales, semilleros, almacigales, viveros, bancos de germoplasma, campos de producción de semillas u otros materiales de propagación. Con la finalidad de obtener plantas para plantar de buena calidad fitosanitaria para ser utilizadas como materiales de propagación.
IV.-Que la reproducción y el comercio de material vegetal propagativo, sin control fitosanitario, se puede constituir en un medio de propagación y diseminación de plagas.
V.-Que, conociendo los daños económicos que puede originar la utilización de material vegetal propagativo, de mala calidad fitosanitaria, es de urgente necesidad el establecimiento de medidas fitosanitarias dirigidas a establecer los procedimientos de observancia obligatoria para los administrados.
VI.-Que según el informe AI-SFE-SA-INF-002-2016 de control interno: Resultados del Estudio de Auditoria sobre la Evaluación del Sistema de Control Interno relativo al Proceso sustantivo denominado "Vigilancia y Control de Plagas", 2016, emite la recomendación de analizar la suficiencia y pertinencia de lo dispuesto en el artículo 13 del "Reglamento de viveros, Almácigos, Semilleros y Bancos de Yemas" (Decreto Ejecutivo N° 33927-MAG).
VII.-Que a la fecha se cuenta con el Decreto Ejecutivo N° 33927-MAG, que es el Reglamento de Viveros, Almácigos, Semilleros y Bancos de Yemas, publicado en el Diario Oficial La Gaceta número 208 del 30 de octubre del 2007, sin embargo, se hace necesario ajustar las regulaciones a las nuevas prácticas de propagación de material vegetal propagativo con la finalidad de regular y facilitar el proceso de registro y seguimiento de dichos materiales.
VIII.-Que el presente Decreto Ejecutivo cumple con los principios de mejora regulatoria, de acuerdo al informe No.DMRDAR- INF-083-19 emitido por la Dirección de Mejora Regulatoria, en fecha 19 de setiembre del 2019. Por tanto,
REFORMA Y ADICIÓN AL REGLAMENTO DE VIVEROS, ALMÁCIGOS, SEMILLEROS Y BANCOS DE YEMAS N° 33927-MAG

Para los efectos de este Reglamento, se define como:
Plaga: Cualquier especie, raza o biotipo vegetal o animal o agente patógeno dañino para las plantas o productos vegetales (FAO, 1990: revisado FAO, 1995; CIPF, 1997)

PNMVP: Programa Nacional de Material Vegetal Propagativo
DEL REGISTRO
CAPÍTULO III
En caso de incumplimiento de no estar registrados ante el SFE, se actuará conforme a lo estipulado en la Ley de Protección Fitosanitaria N' 7664, sus reglamentos y legislación conexa.
Una vez verificada la información y si está completa calificaran por el fondo la información, y realizarán una visita al sitio, esto en un plazo máximo de 10 días hábiles y emitirán un informe técnico dentro de ese plazo, en el que se testimonia lo dicho en la solicitud y si existe regulación con medidas fitosanitarias especificas para una o varias de las especies que se reproducen en el sitio, deberá indicar la conformidad o no de estas con lo normado, luego remitirán el expediente a oficinas centrales, para su aprobación y registro.
El registro podrá ser renovado una vez finalizado el periodo de vigencia. Para el proceso de renovación del registro, el usuario deberá cumplir con lo que se solicita el en artículo 6 de este reglamento.
Sólo se permitirá un registro por persona física(*) o jurídica. Si el interesado posee más de una unidad productiva a nivel nacional, se registran bajo el mismo código en un único expediente, pero deberá contar con un libro de actas, en cada una de las unidades productivas para que el inspector fitosanitario realice las anotaciones de cada visita de inspección.

Serán cancelados previo a la entrega de la resolución de aprobación. El costo del servicio de inscripción al registro del Programa Nacional de Material Vegetal Propagativo será de conformidad con el Decreto Ejecutivo N° 27763-MAG vigente. "Fijación de tarifas de los servicios del Ministerio de Agricultura y Ganadería"
El SFE a través del Departamento de Operaciones Regionales, mediante las Unidades Operativas Regionales, suspenderá el registro en los siguientes casos:
(*)d) Por incumplimiento de las recomendaciones técnicas.
El Departamento de Operaciones Regionales, mediante el Programa Nacional de Material Propagativo, podrá suspender el registro en el siguiente caso:.
(*) (Corregido mediante Fe de Erratas y publica en La Gaceta N° 34 del 20 de febrero del 2020, página N° 84) e) Cuando el contrato de arrendamiento de las instalaciones declaradas en el registro haya expirado y no se haya presentado un nuevo contrato de ampliación del plazo.
La suspensión del registro será posterior a la notificación enviada al representante legal del establecimiento mediante una resolución administrativa emitida por las Unidades Operativas Regionales o en su efecto por el encargado del Programa Nacional de Material Propagativo, en donde se detalla el porqué de la misma y se dará un plazo de tres días hábiles para el descargo, antes de emitir la resolución respectiva.
La suspensión será levantada mediante la emisión de una resolución administrativa una vez que se hayan subsanado las deficiencias que han dado origen a la misma.
El SFE a través del Departamento de Operaciones Regionales, mediante el encargado del Programa Nacional de Material Vegetal Propagativo, podrá cancelar la inscripción del registro en los siguientes casos:
El Programa Nacional de Material Vegetal Propagativo, competente en materia de administración del registro, será el responsable de llevar a cabo el procedimiento administrativo para la cancelación del registro.
Cualquier declaración hecha al registro puede modificarse a solicitud de parte, y aprobada o denegada vía resolución administrativa. Se puede transferir los derechos de registro por cesión.
Las personas físicas o jurídicas registradas deberán de informar al órgano competente del registro los cambios que hayan ocurrido en(*) las declaraciones realizadas en la solicitud.

Se exceptúan los establecimientos (personas físicas o jurídicas), que comercializan únicamente material vegetal propagativo y no se dedican a la reproducción. En este caso deberán mantener un registro actualizado del material vegetal propagativo de sus proveedores para garantizar la trazabilidad del material que se moviliza del sitio de propagación. Esta excepción no exime del control y vigilancia fitosanitaria de plagas, y de la obligatoriedad de cumplir con las recomendaciones técnicas emitidas por autoridad(es) fitosanitaria(s) y del eventual cierre de las instalaciones por incumplimiento de recomendaciones técnicas basadas en normativa dadas por un funcionario del SFE con competencia en la materia.

Cuando se incumplan las normas emitidas y las recomendaciones técnicas basadas en normativa dadas por un funcionario del SFE con competencia en la materia, la oficina regional del SFE con competencia podrá ordenar la clausura total o parcial del sitio de propagación o establecimiento vía resolución administrativa, esto provocará la inmovilización del material vegetal propagativo del área clausurada.
Los sitios de propagación llevarán un libro de actas en que se anotarán las visitas de los funcionarios del SFE, el mismo debe estar disponible para los funcionarios y en un lugar que permita su resguardo, el libro será proporcionado por el órgano competente del SFE que será el propietario del mismo.
En el caso de aquellas plagas reglamentadas cuarentenarias o no cuarentenarias, el establecimiento estará en la obligatoriedad de acatar las medidas técnicas y legales emitidas por el SFE, entre las cuales se establece la producción del material vegetal propagativo bajo un ambiente protegido, con el fin de minimizar el riesgo de diseminación de una plaga.
Para los efectos de este Reglamento, se define como:
Germoplasma: Plantas destinadas para uso en programas de mejoramiento o conservación. (Organización de las Naciones Unidas para la Agricultura y la Alimentación, siglas en inglés FAO, 1990), Medida Fitosanitaria: cualquier legislación reglamento o procedimiento oficial que tenga el propósito de prevenir la introducción y/o diseminación de plagas cuarentenarias o de limitar las repercusiones económicas de las plagas no cuarentenarias reglamentadas (Normativa Internacional para Medidas Fitosanitarias- NIMF N° 5).
Plantas: Plantas vivas y partes de ellas, incluidas las semillas y el germoplasma Plantas para plantar: plantas destinadas a permanecer plantadas, a ser plantadas o replantadas (Normativa Internacional para Medidas Fitosanitarias-NIMF N° 5).
Programa Nacional de Material Vegetal Propagativo: órgano competente en materia de administración del registro y responsable de llevar a cabo el procedimiento administrativo del mismo.
Semillas: Clase de producto básico correspondiente a las semillas para plantar o destinadas a ser plantadas y no al consumo o elaboración (véase grano) (Organización de las Naciones Unidas para la Agricultura y la Alimentación, siglas en inglés FAO, 1990), revisado por el Comité Internacional de Medidas Fitosanitarias- CIMF, 2001.
Vigilancia: Un proceso oficial, mediante el cual se recoge y registra información sobre la presencia o ausencia de una plaga utilizando encuestas, monitoreo u otros procedimientos (Normativa Internacional para Medidas Fitosanitarias-NIMF N° 5).
UOR: Unidad Operativa Regional
Comprende a todos los laboratorios de reproducción sexual y asexual de vegetales, semilleros, almácigos, viveros, bancos de germoplasma, campos de producción de semillas u otros materiales de propagación con fines de producción para la comercialización.
Transitorio único: Los propietarios u ocupantes por cualquier título de establecimientos de propagación y comercialización de material vegetal propagativo, contarán con un plazo de hasta seis meses, a partir de la publicación del presente decreto para su registro, de acuerdo con los lineamientos establecidos en los procedimientos administrativos y técnicos emitidos por el SFE, con base en este Decreto.
