El decreto autoriza a las instituciones públicas, entes autónomos y municipalidades a transferir fondos, donaciones y prestar colaboración a la CNE. Se permite la utilización de fondos remanentes de otras emergencias y la imposición de servidumbres legales en predios privados cuando sea absolutamente indispensable. THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY In exercise of the powers conferred upon them by articles 140, subsections 3) and 18) and 180 of the Political Constitution, articles 25 subsection 1), 2.7 subsection 1), 28 subsection b), of Law Nº 6227 of May 2, 1978, which is the General Law of Public Administration, and Law Nº 8488 of January 11, 2006, which is the National Law on Risk Prevention and Emergency Response.
Considering:
This, together with the events that since October 10 have occurred due to storm conditions in the Central and North Pacific, Central Valley, and the Guanacaste Mountain Range, associated with a low-pressure system, at a regional level in the Caribbean Sea, with characteristics of intermittent rainfall of variable intensity, associated with low-pressure systems over Central America, and the positioning of the Intertropical Convergence Zone (confluence of southwest or northeast winds).
That such conditions persisted on October 14, 15, and 16, inclusive, due to the conditions generated by the presence of a new tropical wave that is affecting the country.
Therefore, THEY DECREE:
Given at the Presidency of the Republic.-San José, on the seventeenth day of October, two thousand seven.

EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE LA PRESIDENCIA En ejercicio de las facultades que les confieren los artículos 140, incisos 3) y 18) y 180 de la Constitución Política, artículos 25 inciso 1), 2.7 inciso 1), 28 inciso b), de la Ley Nº 6227 del 2 de mayo de 1978 que es Ley General de la Administración Pública, y la Ley Nº 8488 del 11 de enero del 2006, que es la Ley Nacional de Prevención de Riesgo y Atención de Emergencias.
Considerando:
Esto unido a los eventos que desde día 10 de octubre se han presentado por las condiciones de temporal en el Pacífico Central y Norte, Valle Central y Cordillera de Guanacaste, asociado a un sistema de baja presión, a nivel regional en el mar caribe, con características de lluvias intermitentes de variable intensidad, asociados a sistemas de baja presión sobre Centroamérica, y al posicionamiento de la zona de convergencia Intertropical (confluencia de vientos del suroeste u noreste).
Que tales condiciones persisten los días 14, 15 y 16 de octubre, inclusive, debido a las condiciones generadas por la presencia de una nueva onda tropical que está afectando el país.
Por tanto,
DECRETAN:
Dado en la Presidencia de la República.-San José, a los diecisiete días del mes de octubre del dos mil siete.
