THE PRESIDENT OF THE REPUBLIC THE MINISTER OF THE PRESIDENCY AND THE MINISTER OF HEALTH In exercise of the powers conferred upon them by articles 50, 140, subsections 3) and 180 of the Political Constitution, articles 25 subsection 1), 27 subsection 1), 28 subsections b) and j), of Law Nº 6227 of May 2, 1978, which is the General Law of Public Administration, and Law Nº 8488 of January 11, 2006, which is the National Law on Risk Prevention and Emergency Response:
Considering:
The date on which the entry of waste to said sanitary landfill ceased and the entirety of the technical closure works remained unfinished.
It has been verified, under the protection of said report, that there is mixing of rainwater and leachates in concrete ditches, that there are ditches without impermeable material covering, that there are leachate seepages, that there are gullies on the waste slopes, that there is water runoff in the southern sector of the landfill, and that there are cracks in some sections of the Asilo hill. All of the foregoing puts at risk the health and lives of the inhabitants in the surroundings of the Río Azul sanitary landfill and the environment.
Also, by not being treated, the leachate is being channeled to the Churruca stream, which results in the discharge of an effluent with a very high contaminant load and loaded with heavy metals. Erosion conditions and the formation of gullies persist due to surface runoff and the inadequate channeling of rainwater, which saturated the landfill mass and caused the mixing of rainwater with leachate, increasing its arrival at a treatment plant that is not functioning, causing the destabilization of the slopes, especially in the southern sector. This constitutes a danger that warrants carrying out the necessary sealing and slope stabilization works, as well as the construction of the rainwater infrastructure. The temporary rainwater channeling works are filled with sediments, which may contribute to landslides that put the health and safety of people at risk.
Therefore, THEY DECREE:
NATIONAL STATE OF EMERGENCY FOR THE SITUATION OF THE RÍO AZUL SANITARY LANDFILL
All of which must be recorded in the General Emergency Plan approved by the Board of Directors of the National Commission for Risk Prevention and Emergency Response, in order to be subject to attention in accordance with the concept of emergency.

EL PRESIDENTE DE LA REPÚBLICA EL MINISTRO DE LA PRESIDENCIA Y LA MINISTRA DE SALUD En ejercicio de las facultades que les confieren los artículos 50, 140, incisos 3) y 180 de la Constitución Política, artículos 25 inciso 1), 27 inciso 1), 28 incisos b) y j), de la Ley Nº 6227 del 2 de mayo de 1978 que es Ley General de la Administración Pública, y la Ley Nº 8488 del 11 de enero del 2006, que es la Ley Nacional de Prevención de Riesgo y Atención de Emergencias:
Considerando:
Fecha en la cual cesó el ingreso de residuos a dicho relleno sanitario y quedó inconclusa la totalidad de las obras de cierre técnico.
Se ha comprobado, al amparo de dicho informe que existe mezcla de aguas pluviales y lixiviados en cunetas de concreto, que hay cunetas sin cobertura de material impermeable, que hay afloramientos de lixiviados, que hay cárcavas en taludes de basura, que hay escurrimiento de agua en el sector sur del relleno y que hay grietas en algunas secciones del cerro Asilo. Todo lo anterior pone en riesgo la salud, la vida de los habitantes de los alrededores del relleno sanitario de Río Azul y el medio ambiente.
También, al no ser tratado el lixiviado está siendo conducido a la quebrada Churruca, lo que origina el vertido de un efluente con una carga contaminante muy alta y cargado de metales pesados. Se mantienen condiciones erosión y formación de cárcavas por la escorrentía superficial y la no adecuada conducción de aguas pluviales, lo que saturó la masa del relleno y la mezcla de la lluvia con el lixiviado, haciendo que aumente su llegada a una planta de tratamiento que no está funcionando, provocando la desestabilización de los taludes, especialmente en el sector sur. Esto constituye un peligro que amerita la realización de obras necesarias de sellado y estabilización de taludes, así como la construcción de la infraestructura pluvial. Las obras temporales de conducción de aguas pluviales, están colmadas de sedimentos, lo cual puede contribuir a deslizamientos que ponen en riesgo la salud y seguridad de las personas.
Por tanto,
ESTADO DE EMERGENCIA NACIONAL LA SITUACIÓN DEL RELLENO SANITARIO DE RÍO AZUL
DECRETAN:
Todo lo cual debe constar en el Plan General de la Emergencia aprobado por la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, para poder ser objeto de atención conforme al concepto de emergencia.
