Nº 33826-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred upon them by subsections 3) and 18) of article 140 and 146 of the Political Constitution, Forestry Law No. 7575 and its amendments, published in La Gaceta No. 72 of 16 April 1996, and article 27 of the General Law of Public Administration, No. 6227, of 2 May 1978, and
First.—That article 1 of Forestry Law No. 7575, establishes as an essential and priority function of the State to ensure the conservation, protection, and administration of natural forests and the production, utilization (aprovechamiento), industrialization, and promotion of the country's forest resources.
Second.—That the State has a national planning instrument called the National Forest Development Plan 2001 - 2010.
Third.—That this National Forest Development Plan 2001 - 2010 incorporates Costa Rica's global environmental policies defined by the Ministry of Environment and Energy, formalized in 2001, inspired by international forestry principles promoted by the United Nations Organization.
Fourth.—That the National Forest Development Plan 2001 -2010 and its future plans are constituted as fundamental elements to strengthen a commitment to the environment with the National Development Plan, through which the sitting Government strengthens a commitment to the environment.
Fifth.—That to fulfill this commitment, it is required to form and formalize an Inter-institutional Monitoring Commission for the National Forest Development Plan, in order to monitor and evaluate the actions taken by governmental bodies.
Sixth.—That as part of the goals of the National Forest Development Plan 2001 -2010 and its future plans, it is desired to contribute to the creation and implementation of technological tools that promote the development of an information system that streamlines and guarantees adequate management of information related to the forestry sector.
Seventh.—That by virtue of the foregoing, it is required to create and formalize a Forestry Resources Information System of Costa Rica, defined in the National Forest Development Plan 2001 -2010, to guarantee free and easy access to forest information for both forestry sector entities and civil society, in accordance with the provisions of article 30 of our Political Constitution. Therefore, THEY DECREE:

It shall be under the supervision and support of various bodies, such as SINAC, the National Forest Financing Fund (FONAFIFO), and the National Forestry Office (ONF).

They shall have a voice but no vote in the corresponding sessions.

By virtue of what is established in this article, SINAC must seek the appointment or hiring of a Program Coordinator who shall have the authority to request from all public entities and bodies the information, studies, and data required for the better fulfillment of its functions. To this end, all public offices must provide the information it requires.
Likewise, all actions may participate financially with other entities in joint programs or projects, provided that it is a matter of fulfilling the objective of article 3.

Primero.-Que el artículo 1º de la Ley Forestal Nº 7575, establece como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, aprovechamiento, industrialización y fomento de los recursos forestales del país.
Segundo.-Que el Estado cuenta con un instrumento de planificación nacional, denominado Plan Nacional de Desarrollo Forestal 2001 - 2010.
Tercero.-Que este Plan Nacional de Desarrollo Forestal 2001 - 2010, incorpora políticas ambientales globales de Costa Rica, definidas por el Ministerio del Ambiente y Energía, oficializadas en el año 2001, inspirado en los principios forestales internacionales promovidos por la Organización de las Naciones Unidas.
Cuarto.-Que el Plan Nacional de Desarrollo Forestal 2001 -2010 y sus planes futuros, se constituyen como elementos primordiales fortalecer un compromiso con el ambiente Nacional de Desarrollo, a través del Gobierno en ejercicio fortalece un compromiso con el ambiente.
Quinto.-Que para cumplir con este compromiso, se requiere conformar y oficializar una Comisión Interinstitucional de Seguimiento al Plan Nacional de Desarrollo Forestal, con el fin de dar seguimiento y evaluar las acciones tomadas por las instancias gubernamentales.
Sexto.-Que como parte de las metas del Plan Nacional de Desarrollo Forestal 2001 -2010 y sus planes futuros, se quiere contribuir con la creación e implementación de herramientas tecnológicas que promuevan el desarrollo de un sistema de información que agilice y garantice una adecuada gestión de la información relacionada al sector forestal.
Sétimo.-Que en virtud de lo anterior, se requiere crear y oficializar un Sistema de Información de los Recursos Forestales de Costa Rica, definido en el Plan Nacional de Desarrollo Forestal 2001 -2010, para garantizar el libre y fácil acceso a la información forestal, tanto a las entidades del sector forestal como a la sociedad civil, conforme a lo estipulado en el artículo 30 de nuestra Constitución Política. Por tanto,

La misma, estará bajo la supervisión y respaldo de diversas instancias, tales como el SINAC, el Fondo Nacional de Financiamiento Forestal (FONAFIFO) y la Oficina Nacional Forestal (ONF).

Los mismos tendrán voz más no voto en las sesiones correspondientes.

En virtud de lo establecido en este artículo, el SINAC deberá procurar la asignación o contratación de un Coordinador de Programa que tendrá la facultad de solicitar a todos los entes y órganos públicos; información, estudios y datos que requiera, para el mejor cumplimiento de sus funciones. Para ello, todas las oficinas públicas, deberán facilitar la información que éste requiera.
Asimismo, todas las acciones podrán participar financieramente con otras entidades en programas o proyectos conjuntos, siempre que se trate de cumplir con el objetivo del artículo 3º.
