1. 1That as provided by the Political Constitution, in its Article 50 and numerous Conventions and Treaties signed and approved by Costa Rica, it is the duty of the State to guarantee an ecologically balanced environment, creating internal mechanisms to ensure the use and enjoyment of the vital natural resources for human beings, resources contained in the diverse ecosystems and regeneration processes.
2. 2That Forest Law No. 7575 published in La Gaceta No. 72 of April 16, 1996, establishes as an essential function of the State, to ensure the conservation, utilization, protection, administration and promotion of the country's forest resources, in accordance with the principle of rational use of renewable natural resources.
3. 3That the National Forest Financing Fund called FONAFIFO, created in the cited Law No. 7575, has as a primary obligation to establish various promotion mechanisms for small and medium forest producers, among them the Payment of Environmental Services generated by forests and forest plantations in their various modalities, as provided by article three, subsection k of the Forest Law, its Regulations and Executive Decrees No. 31633 MINAE, published in La Gaceta 29 of February 11, 2004, No. 31081-MINAE published in La Gaceta 61 of March 27, 2003.
4. 4That as FONAFIFO is an entity attached to MINAE, it must take into consideration in its programs aspects that contribute to improving the socioeconomic conditions of areas with the lowest socioeconomic indices.

By virtue of the foregoing, it is necessary to have a technical-administrative document that regulates and provides the procedures and mechanisms to carry out these important processes. Therefore:

The Board of Directors of the National Forest Financing Fund issues the following:

PROCEDURES MANUAL FOR THE PAYMENT OF ENVIRONMENTAL SERVICES 1.-Objective. To establish the procedures to be applied in the Payment of Environmental Services (PSA) generated by the country's forests and forest plantations, through the promotion of activities of reforestation, protection of forest cover (cobertura boscosa), recovery of cover through natural regeneration and planting of forest trees in agroforestry systems (SAF), paid with resources from the National Budget and from any other donor or investor that does not establish conditions different from those established in this Manual.

2.-Project prioritization criteria. The priority areas for the Payment of Environmental Services (PSA), in the modalities of forest protection, reforestation, recovery of cover through natural regeneration and planting of forest trees in SAF, shall be those established by the Executive Decree to be issued by the Executive Branch, which shall be applied for the selection of projects to be considered in the PSA program. Only when the national demand for priority areas has been satisfied, will projects be accepted in other areas that FONAFIFO will duly announce.

For properties located on the boundary of priority areas, those having at least 30% within said areas shall be considered for the purposes of the PSA Program.

PSA pre-applications shall be governed by the following prioritization criteria considered in the following order of priority:

2.1. REFORESTATION PROJECTS 2.1.1. Sites that present a high productive potential for the development of forest plantations, with the exception of land use capacity classes VII and VIII (of the official methodology established in the corresponding Executive Decree).

2.1.2. For reforestation projects with species contained in the logging ban decrees and threatened or endangered species (Decreto Nº 25663-MINAE and Decreto Nº 25700-MINAE), the entire country is established as a priority. For reforestation projects established in protection areas according to article No. 33 of Forest Law No. 7575, the entire country shall be considered a priority.

2.1.3. Reforestation projects through natural regeneration in pastures and paddocks, which may only be carried out in areas defined as Kyoto lands, that were deforested before December 31, 1989.

2.1.4. Natural regeneration projects with productive potential on sites with at least one year of abandonment and free of grazing.

2.2. FOREST PROTECTION PROJECTS 2.2.1. Sites located in biological corridors officially recognized by SINAC, which are conserved as the first priority for entry into the PSA Program.

2.2.2 Protection projects on properties that comply with the provisions of the preceding point, where environmental services payment contracts have been signed in previous years, provided they meet the other requirements established in the manual and their validity period concludes in the same year in which the new pre-application is submitted. The validity of the new contracts will begin on the day following the expiration date of the previous contract (Thus amended the previous point by the National Forest Financing Fund and published in La Gaceta No. 78 of April 23, 2008).

2.2.3. Forest areas whose main function is the protection of water resources, considered of interest for rural aqueducts, Aqueduct and Sewerage projects, and public service companies, which must be supported by a certification issued by the administrator of the respective aqueduct.

2.2.4. Privately owned properties located within protected wilderness areas and that have not yet been purchased or expropriated by the State.

2.2.5. Sites with forest located in cantons with a Social Development Index (IDS) of less than 40% according to the determination made by MIDEPLAN.

2.3. PROJECTS FOR THE ESTABLISHMENT OF FOREST TREES IN SAF 2.3.1. Priority will be given to projects processed by organizations that have a current agreement with FONAFIFO.

2.3.3. Areas in specific agreements with FONAFIFO.

3.-Minimum and maximum areas and quantities. The minimum and maximum areas to be considered annually for PSA through the different modalities shall be as detailed below:

3.1. The minimum area for the Payment for Environmental Services to be carried out under the Reforestation modality is one hectare and a maximum of three hundred hectares per year, per farm or group of farms adjacent to each other or nearby within a radius of five kilometers, per natural or legal person and per Conservation Area (Área de Conservación).

3.2. For reforestation projects presented by organizations in a joint project, the maximum area per producer per year shall be up to fifty hectares.

3.3. For reforestation projects whose beneficiaries opt for advance payment, they must indicate this at the time of submitting the pre-application. Contracts with advance payments of the first disbursement will only be authorized when they are processed through organizations or when they involve projects of small and medium forest producers of less than 50 hectares per producer. For such purposes, a guarantee must be provided to the satisfaction of FONAFIFO, which will be evaluated and approved by the Internal Committee of FONAFIFO.

3.4. For the Payment of Environmental Services under the forest protection modality, the minimum area is two hectares and maximum three hundred hectares per year, per farm or group of farms adjacent to each other or nearby within a radius of five kilometers, per natural or legal person per Conservation Area (Área de Conservación).

3.5. For natural regeneration projects with productive potential, the minimum area considered on sites undergoing recovery is 2 hectares.

3.6. The maximum area per Indigenous Reserve for PSA under the Forest Protection modality is 1,000 hectares per year.

(Thus amended the preceding subsection through publication made in La Gaceta No. 48 of March 7, 2008) 3.7. For the modality of planting forest trees in SAF, the minimum quantity shall be three hundred fifty (350) trees and a maximum of three thousand five hundred trees (3,500) per beneficiary.

3.8. In projects for planting forest trees in SAF presented as joint projects, self-management cooperatives, and in Indigenous Reserves, the maximum quantity shall be three hundred thirty-six thousand trees (336,000) per year, provided that each beneficiary does not exceed the range established in point 3.7.

3.9. Within the following arrangements, the range of trees per hectare and/or kilometer of SAF to be established is:

3.9.1. Timber trees in perennial crops between 40 and 250 trees per hectare.

3.9.2. Multiple-use trees in perennial crops between 40 and 277 trees per hectare.

3.9.3. Timber trees in rows between 333 and 500 trees per km.

3.9.4. Windbreaks between 666 and 1000 trees per km.

3.9.5. Block plantations of less than one hectare, the equivalent of (625 and 1,111 trees/ha). A maximum of three blocks of less than one hectare per beneficiary is considered.

3.9.6. Taungya systems and improved fallows, solely and exclusively in Indigenous Territories.

3.10. Species used in SAF are detailed in ANNEX 13 (ANEXO 13).

Given that the minimum number of trees per SAF contract is 350 trees (point 3.7 of this Manual), the necessary combinations among the arrangements must be established to reach the minimum allowed, according to the area of each farm.

4.-Beneficiaries. All natural or legal persons, owners, lessees, usufructuaries of properties registered in the National Registry who wish to enjoy the Payment of Environmental Services in the various modalities shall be considered beneficiaries of the PSA Program. For forest protection projects, possessors who comply with the provisions of Executive Decree No. 31633-MINAE shall also be considered.

Interested applicants may submit pre-applications in the following manner:

4.1. Individually: For forest protection, recovery of cover through natural regeneration, reforestation, and establishment of forest trees in SAF.

4.2. Joint projects developed by organizations for forest protection, reforestation, recovery of cover through natural regeneration, and the establishment of forest trees in SAF.

4.3. In joint projects, the beneficiary agrees that the PSA and SAF resources be deposited into the bank account of the organization, which is stipulated in the respective contract.

4.4. All individual PSA beneficiaries must provide FONAFIFO with their bank account number at Banco Nacional de Costa Rica, to receive payments from the PSA Program.

4.5. Indigenous Communities that sign PSA contracts must provide FONAFIFO with their bank account number at Banco Nacional de Costa Rica, to receive payments from the PSA Program.

5.-Organizations. The organizations must be duly registered in the respective registry, have legal personality, group or represent small or medium producers, and collaborate with the beneficiary and with FONAFIFO in the processing, execution, and supervision of the PSA project and must meet the following requirements:

5.1. Be organizations governed by the Associations Law No. 218 of August 8, 1939, Law No. 7932 of November 19, 1999, corresponding to the Reform of Law No. 4521 on the Establishment of Cantonal Agricultural Centers attached to the Ministerio de Agricultura y Ganadería, Cooperative Associations Law No. 6756 of May 5, 1982, Law on Community Development No. 3859 of April 7, 1996, and be legally constituted, with current legal status, or Foundations that have forestry or natural resources activity in their programs.

5.2. Organizations duly qualified by FONAFIFO and that have signed a cooperation agreement with it, according to the provisions of Annex 14 (Anexo 14), may channel and collaborate in the PSA program in all modalities, provided they comply with the provisions set forth below.

5.2.1. Sign a cooperation agreement with FONAFIFO, upon the approval of PSA pre-applications and incorporate it into the respective files (ANNEX 14) for which it must meet the following requirements:

• a)Be legally constituted, according to the provisions of article 5 of the 2005 PSA Manual.
• b)Provide FONAFIFO with a legible and current photocopy of the legal identification card and the identity card of the legal representative(s).
• c)Provide a certification of legal status issued no more than three months prior.
• d)Submit a written request to FONAFIFO signed by the legal representative of the Organization.

5.2.2. Maintain a bank account at Banco Nacional de Costa Rica, to exclusively manage the resources that FONAFIFO transfers to it for PSA.

5.2.3. Pre-qualify the associates who will enter the PSA Program, according to the requirements of this Procedures Manual, to verify the ownership of the property and the existence or not of legal limitations on the farms to be submitted for PSA or verifying that the requirements of farms in possession comply with the provisions of Decreto Nº 31633-MINAE, published in La Gaceta No. 29 of February 11, 2004.

5.2.4. Commit to delivering the resources to the PSA beneficiaries, within a maximum of 15 calendar days after the resources are disbursed by the fiduciary entity of FONAFIFO.

5.2.5. Collaborate with FONAFIFO in the supervision tasks of the PSA projects of its associates.

5.2.6. Sign forestry management (regencia) contracts for the projects of its associates.

5.2.7. Inform its associates in writing and prior to the signing of the contract, the amount of the fees for the services they will provide in the PSA projects, which must not exceed 18% of the total contract amount.

5.2.8. Formalize private individual contracts with the PSA beneficiary, establishing the amount of professional fees for the services provided, the periodicity of the technical assistance, among others.

5.2.9. Submit to FONAFIFO, in the months of January and July of each year, a copy of the deposits, transfers, or checks issued to each beneficiary.

5.3. In these projects, the organization will be responsible for processing, it will collaborate with FONAFIFO in the supervision of the PSA projects, and its particular obligations are:

5.3.1. Maintain an individualized file for each beneficiary.

5.3.2. Contract the forestry regents (Regentes forestales) responsible for the execution of the project.

5.3.3. Supervise compliance with the contract obligations.

5.3.4. Collect and retain the agreed amount from the producers.

5.3.5. Immediately notify FONAFIFO in case of non-compliance by any of the beneficiaries.

5.4. Have no pending obligations regarding forestry projects, financing programs, incentives, or credit granted by MINAE or any of its attached bodies. Only those organizations that have settled their obligations or have made a payment arrangement may execute new projects.

6.-The forestry regent (regente forestal).

6.1. The professional accredited as a Forestry Regent must comply with the provisions of the Forest Law, its Regulations, and its amendments. In special cases for Indigenous Reserves, the Regional Manager of the respective Conservation Area may certify the area that will benefit from PSA, in accordance with the procedures established in this Manual, provided that the regulations established by the Colegio de Ingenieros Agrónomos are complied with and no professional fees are charged.

6.2. In the case of SAF projects, the Forestry Regent must conduct at least two visits in the first year and one visit per year in the following two years.

6.3. The Regent must deliver ordered documents for the respective files and their copies for the received stamp at the respective Regional Offices.

6.4. It is the obligation of the Forestry Regents to accompany FONAFIFO personnel or persons authorized by it, on field visits conducted to the PSA projects. For such purposes, FONAFIFO will notify the Forestry Regent at least eight business days prior to the scheduled visit. The farm owners, their legal representatives, or their administrators may also participate in the field visits.

6.5. Inform the beneficiary in writing of the progress and status of the respective PSA Projects.

6.6. The Forestry Regent shall be responsible for providing technical assistance for the projects and verifying compliance with technical recommendations and obligations by their clients.

6.7. Submit to FONAFIFO the technical documentation required for the processing and follow-up of the PSA projects, in a timely and truthful manner, complying with the requirements established by this Manual.

7.-Procedures for processing pre-applications for PSA. Any procedure related to PSA projects shall be carried out at the Regional Offices of FONAFIFO, which are the following:

. Limón (A.C. Amistad Caribe).

. Pococí (A.C. Tortuguero).

. Sarapiquí, (A.C. Cordillera Volcánica Central).

. San Carlos (A.C. Huetar Norte).

. Palmar Norte (A.C. Osa).

. Nicoya (A.C. Tempisque).

. Cañas (A.C. Guanacaste and A.C. Arenal Tilarán).

. San José Oriental and Occidental (A.C. Cordillera Volcánica Central, A.C. Pacífico Central and A.C. Amistad Pacífico).

A map shall be maintained at each of FONAFIFO's Regional Offices to locate whether the farms submitting pre-applications for the PSA program are within the priority areas.

The reception period for pre-applications for entry into the Payment of Environmental Services program for the year 2007 will begin with the publication of this Procedures Manual and concludes forty-five business days thereafter.

For subsequent years, the reception period shall be forty-five business days and will begin on the first business day of February of each year.

The final approval of applications for each year will be subject to the publication of the Executive Decree establishing the priority areas, the number of hectares per modality, and the budget allocated to FONAFIFO for the implementation of the PSA program.

The Regional Offices may open an extraordinary period for receiving pre-applications in the required PSA modality, when the number of pre-applications admitted is less than the allocated area.

7.1. Among the requirements for entering the PSA, the applicant must submit in writing to the corresponding Regional Office of FONAFIFO, a pre-application signed by him/her (Annexes 1 and 2 / Anexos 1 y 2). Attaching a copy for the received stamp, on which the Regional Office staff will indicate the assigned pre-application number.

The pre-application contains the following information:

7.1.1. Name of the owner, co-owners, and/or corporation and their details (complete marital status, occupation, exact address, identity card number), telephone number, fax, and a legible full-page photocopy of the current identity card and/or current legal identification card on both sides.

7.1.2. Name and details of the legal representative (complete marital status, occupation, exact address, telephone number, fax, identity card number, and representative capacity) and a legible full-page photocopy of the current card on both sides.

7.1.3. The claim of the pre-application including the area to be submitted and the modality desired for each property, indicating if it is a property in possession or registration citations of the property before the Public Registry. It must also indicate the following socioeconomic information: a) date of birth, b) education level, c) number of children, and d) nationality. If the procedure includes legal entities, the full name of the entity and the legal identification number must be indicated.

7.1.4. Legible full-page photocopy on both sides of the cadastral map (plano catastrado), with location on the 1:50,000 cartographic sheet.

7.1.5. Indicate a place to receive notifications; if it is the domicile or office, it must be located within the administrative perimeter of the respective Regional Office.

7.1.6. In the case of a forest protection project on unregistered farms, the applicant must attach to the application the documentation established in Executive Decree No. 31633-MINAE. The documentation provided must contain the corresponding fiscal stamps.

7.1.7. Express indication of whether it is a reforestation project with advance payment.

7.1.8 Upon receiving a pre-application, the respective Regional Office shall proceed with the digitization and location of the map in its Information System. If it is determined that it overlaps with one or several farms from other pre-applications or on farms with current Payment of Environmental Services contracts, the person in charge of the Regional Office will notify the interested parties so they may proceed to clarify and/or correct the inconsistencies within a period not exceeding 15 business days. If upon expiration of the granted period the inconsistencies persist, the pre-application will be rejected and the file will be archived.

In all cases, the information provided by the applicant must be orderly and legible. Once the pre-application is received, FONAFIFO will assign a consecutive number, and will have a period of 10 business days to notify whether or not the entry into the PSA Program will continue according to the prioritization criteria and allocated budget.

7.2. For pre-applications not approved for legal reasons, the applicant will have a period of up to 30 days to correct and complete the requirements. Once this period has expired without completing the requirements, the file will be archived and the Regional Offices will not accept the submission of missing requirements, except in justified situations, where the applicant submits in writing a reconsideration of their situation before the expiration of the period.

7.3. If the pre-application is approved by the assigned notary, the applicant will have a period of up to 15 business days, to provide the following requirements to the Regional Offices of FONAFIFO:

7.3.1. Map certified by Catastro Nacional or Notary Public.

7.3.2. Technical Study (Estudio Técnico) to be issued by the Forestry Regent in which the effective area to be contracted according to the corresponding modality and the technical requirements thereof, according to Annexes 3, 5, and 7 (Anexos 3, 5 y 7).

a. For reforestation, the Technical Study must be submitted with the location of the area to be submitted, with GPS points, according to the guide in Annex 3 (Anexo 3). Once the plantation is established, the applicant must submit a certification complementing the information according to the guide in Annex 4 (Anexo 4).

b. For forest protection, it must be certified that the protected forest complies with the definition established in Forest Law No. 7575. The guide for developing Technical Studies including the effective area to be compensated and the technical aspects, is established in ANNEX 5 (ANEXO 5) of this Manual.

c. For natural regeneration, a description of the successional state of the resource must be included. The guide for developing Technical Studies including the effective area to be compensated and the technical aspects, is established in Annex 5 of this Manual.

d. For SAF, the Technical Study must be submitted with the arrangement to be used, the number of trees, the species to be planted, and GPS points, according to the guide in ANNEX 7 (ANEXO 7). Once the SAF is established, the applicant must submit the certification complementing the required information, according to the guide in Annex 8 (Anexo 8).

7.3.3. Forestry management (regencia forestal) contract duly registered with the Colegio de Ingenieros Agrónomos, which shall include the totality of the PSA area or SAF trees. One contract must be registered for each PSA project or for each modality. In the case of projects processed through an Organization, the list of beneficiaries duly accepted and sealed by the Colegio de Ingenieros Agrónomos must be attached, which must contain the details of each beneficiary, Real Property Folio number or cadastral map of the farm(s), and a breakdown of the PSA area or SAF trees included in the cited contract.

For all modalities, the location of the PSA area or the area of the SAF arrangements must be provided with the three GPS points, in accordance with the corresponding guides.

7.3.4 The Technical Study must be submitted in original at the corresponding Regional Office of FONAFIFO. In case corrections are required, a maximum period of up to 10 business days after notification will be granted. For projects submitted by organizations, it will be one Technical Study for each beneficiary, individually.

7.3.5 In the case of unregistered farms, the Technical Study shall be requested once the period for hearing oppositions has elapsed, after the corresponding edict (edicto) has been published and all previously requested requirements have been completed. For the approval of the project, a report from the FONAFIFO official is required, according to the provisions of Annex 12 (Anexo 12) of this Manual.

7.4. Once the requirements are submitted to the Regional Office of FONAFIFO, the person in charge will assess them; if they are met, he/she will prepare the respective resolution (Annexes 9 and 10 / Anexos 9 y 10). This resolution must contain:

a. Consecutive official letter number.

b. Name of the beneficiary.

c. Geographic location of the property.

d. Farm number in the case of registered properties or cadastral map number in the case of unregistered properties.

e. Modality.

f. Area or number of trees subject to payment.

The Regional Office will notify the resolution and will request in writing from the beneficiary, the client account number at Banco Nacional de Costa Rica for the deposit of the respective payments. Subsequently, it will proceed to notify the beneficiary via written note that the contract is ready, granting a period of up to 30 business days to appear and sign it. The file will be sent to the Central Offices of FONAFIFO for its final review, signature of the Minister of Environment or their representative, and of the president of FONAFIFO or their representative, and for its protocolization (protocolización).

8.-Legal requirements. The properties submitted to the Program must:

8.1. Be duly registered in the National Registry, except for the exceptions noted for forest protection projects in accordance with Executive Decree No. 31633-MINAE and those that comply with the requirements established in the Regulations to the Forest Law.

8.2. In compliance with the directives issued by the National Registry, the maps of the properties submitted for the Payment of Environmental Services in any of its modalities must meet the following requirements.

8.2.1 Be registered in the Database of Catastro Nacional.

8.2.2 Be related—both in the Database of Catastro Nacional and in that of the Registro de la Propiedad—to the property to be submitted.

8.2.3 The location and area of the property indicated both on the map and in the Database of the Catastro Nacional, must coincide with what is indicated in the Database of the Registro de la Propiedad.

8.3. In the case of unregistered farms, the map must be in the name of the person claiming to be the possessor of the property.

8.4. Have no annotations, immobilizations, lawsuits of any kind, preventive or executed seizures.

Excepted from this prohibition are those farms that, even if they have judicial annotations, these do not refer to litigation over the ownership of the property, and may enjoy Payment for Environmental Services under the forest conservation modality; through the year-arrears procedure.

In the event of having limitations from the IDA, BANHVI, or other similar entity, you must have written authorization from said entity to sign the contract and to establish limitations. Except in those cases where they are authorized by an inter-institutional cooperation agreement.

8.6. Protection and reforestation projects may be executed on leased farms, provided that the lease is registered in the National Registry for the duration of the project execution. Provided they do not exceed three hundred hectares, per farm or group of farms adjacent to each other or nearby within a five-kilometer radius, per natural or legal person, per Conservation Area (Área de Conservación).

In all cases, the property owner must sign the payment for environmental services contract jointly with the lessee.

8.7. In the event that there are co-owners, usufructuaries (usufructuarios), bare owners (nudos propietarios), or other similar arrangements, the co-owners, usufructuaries, bare owners, or others may, in a public deed, expressly authorize one of them to sign the contract in their own name or on behalf of the grantor and the authorization to record the encumbrance (afectación) of the property in the National Registry. This must be indicated in the PSA pre-application so that it can be assessed by FONAFIFO's external notary.

8.8. Properties on which mortgage certificates (cédulas hipotecarias) exist will not be accepted, unless these are endorsed as a performance guarantee to FONAFIFO, or other guarantee mechanisms satisfactory to FONAFIFO are used.

8.9. Properties on which constituted mortgages (hipotecas) exist will not be accepted, unless in a public deed, the mortgage creditor authorizes the execution of the project, the encumbrance of the property before the Registry, and states that in the event of a foreclosure sale (remate), the property will be awarded with the corresponding encumbrances and limitations.

When the mortgage creditor is a Bank of the National Banking System, a letter signed by the competent official of the entity will suffice. Notwithstanding the foregoing, PSA projects in the forest protection modality will be accepted when the creditor bank has signed agreements with FONAFIFO to respect the encumbrances and projects, or when dealing with mortgaged farms where the beneficiary states their desire for payment to be made in arrears (por año vencido), according to the terms established in the clause included in the respective contract.

8.10. For the establishment of plantations within protected wild areas affected by the Environmental Management Plan (Plan de Ordenamiento Ambiental), they must conform to the regulations stipulated therein. When dealing with reforestation projects with fast-growing species, the technical suitability of the proposal must be expressly endorsed in the evaluation report prepared by the FONAFIFO Regional Office.

8.11. Not have outstanding obligations with previous PSA projects, financing programs, incentives, or credits granted by FONAFIFO.

8.12. Only Reforestation and agroforestry systems (SAF) projects whose planting was established a maximum of twelve months before the formalization of the contract will be accepted for inclusion in the Payment for Environmental Services.

9.-Outstanding Obligations. The verification of obligations from previous contracts of the beneficiaries will be carried out as follows:

9.1. FONAFIFO will verify, according to the records it has, the obligations of the beneficiaries or organizations regarding credits, forest bond certificates (certificados de abono forestal), PSA contracts. It will verify the obligations established in this manual and will also proceed to verify the acreage capacity (cabida) of the property and the validity of previous contracts.

9.2. The FONAFIFO Regional Offices will verify outstanding obligations regarding Environmental Services and must record the result of this consultation in the file.

9.3. If the existence of outstanding obligations is determined, the heads of the FONAFIFO Regional Offices, in coordination with the Central Offices, will initiate the administrative processes aimed at recovering the resources.

9.4. FONAFIFO will maintain a registry of beneficiaries or organizations that have breached the contract or obligations with the PSA, to verify whether or not the processing of new contracts or payment requests is appropriate.

10.-Issuance and Delivery of Payment for Environmental Service 10.1. In the case of forest protection, once the contract is signed by all parties and the encumbrance is registered before the Property Registry or the contract is notarized (protocolizado) for farms in possession (fincas en posesión), FONAFIFO will process the Payment Order and forward it to the BNCR. The payment for contracts with payment in arrears (por año vencido) and for contracts signed on farms in possession will be processed twelve months after their effective date. (see point 8.9).

10.2. For subsequent payments, the Forest Regent (Regente Forestal) will deliver to the respective FONAFIFO Regional Office an annual certification at 12, 24, 36, and 48 months from the contract's effective date, or 24, 36, 48, and 60 months for contracts signed on farms in possession according to the guide in Annex 6. The responsible official of the FONAFIFO Regional Office will assess the certification and proceed to assign a consecutive number to continue with the process. FONAFIFO will process the Payment Order and forward it to the BNCR.

10.3. For reforestation projects, once the contract is signed by all parties, the encumbrance is registered, and the Forest Regent's certification is submitted according to the guide in Annex 4, FONAFIFO will process the Payment Order and forward it to the BNCR.

10.4. For subsequent payments in the reforestation modality, the Forest Regent will deliver to the respective FONAFIFO regional office an annual certification at 12, 24, 36, 48, 60, 72, 84, 96, 108, and 120 months after the average planting date, according to the guide in Annex 4. The responsible official of the FONAFIFO Regional Office will assess the certification and proceed to assign a consecutive number to continue with the process. FONAFIFO will process the Payment Order and forward it to the BNCR.

10.5. In reforestation contracts with advance payment, subsequent payments will also be made according to the planting date, provided that the respective annual certification is delivered.

10.6. For natural regeneration contracts, the first payment will be made once the contract is signed by all parties and the encumbrance is registered before the Registry. FONAFIFO will process the Payment Order and forward it to the National Treasury.

For subsequent payments in the reforestation modality, the regent will deliver to the respective FONAFIFO Regional Office an annual certification at 12, 24, 36, and 48 months after the average planting date, according to the guide in Annex 11. FONAFIFO will process the Payment Order and forward it to the National Treasury.

(Thus reformed the previous subsection through publication in La Gaceta No. 48 of March 7, 2008) 10.8. For projects establishing forest trees in SAF, the first payment will be made once the contract is signed by all parties and the Forest Regent's certification is submitted according to the guide in ANNEX 8. FONAFIFO will process the Payment Order and forward it to the BNCR.

10.9. For subsequent payments, the Forest Regent will deliver an annual certification at 12 and 24 months from the average establishment date of the SAF, according to the guide in Annex 8; the amount to be paid will depend on the number of surviving trees reported. The responsible official of the FONAFIFO Regional Office will assess the certification and proceed to assign a consecutive number to continue with the process. FONAFIFO will process the Payment Order and forward it to the BNCR.

10.10. Upon receipt of the Regent's certification, FONAFIFO will have a period of 30 calendar days to issue the payment order, which will be done provided that it meets the requirements established in the Forest Law (Ley Forestal), its Regulations, the Procedures Manual, the encumbrance of the property is duly registered in the Public Registry, and the beneficiary is up to date on their obligations with the Costa Rican Social Security Fund (Caja Costarricense del Seguro).

10.11. Powers of attorney granted to third parties by legal representatives (apoderados) to sign contracts and/or process or withdraw PSA payments will not be accepted.

11.-Follow-up and Monitoring Provisions 11.1. For the follow-up and evaluation of the projects of the Environmental Services Program, FONAFIFO may rely on the services of an external entity to audit and evaluate the status and compliance with obligations by the entities involved in the PSA, namely beneficiaries, FONAFIFO Regional and Central Offices, organizations, SINAC, Regents, etc. This evaluation must be carried out at least every two years. FONAFIFO will define the technical guidelines for it. Those involved must contribute to this process, as well as implement the recommendations arising from the audit.

11.2. Annually, FONAFIFO will send SINAC the list of approved projects, so they can be taken into consideration when carrying out other procedures or implementing the monitoring strategy that this institution will carry out, no later than one month after the end of the project processing period.

11.3. For the monitoring of projects, FONAFIFO may contract external services for this purpose, as well as to keep the National Inventory of Environmental Services and other forest products updated. Those involved must contribute to this process as well as implement the recommendations derived from it.

11.4. The Technical Personnel of FONAFIFO, the official from the legal department (fiscalía) of the College of Agronomists (Colegio de Ingenieros Agrónomos) who regulate the professionals involved in these processes, and the officials of SINAC, may visit the compensated area at any time to corroborate its condition and the information recorded in the certifications.

11.5. The FONAFIFO Offices must maintain the files duly foliated, ordered chronologically, and with an updated index of the contents.

11.6. FONAFIFO will maintain a database of PSA projects in the Geographic Information System (GIS) and in the Integrated Project Administration System (SIAP).

11.7. FONAFIFO will use, in its control visits, the Indicator forms designed for the protection, reforestation, and SAF modalities. These will be annexed to the respective files and will have the corresponding follow-up.

12.-Obligations of the Beneficiaries. The obligations of the PSA beneficiaries in the various modalities are as follows:

12.1. Comply with the stipulations of the contract and recommendations of the Forest Regent or FONAFIFO personnel in any of its modalities.

12.2. Prevent and control forest fires.

12.3. Keep the vertices delimiting the area subject to PSA easily identifiable in the field.

12.4. Prevent and control illegal hunting and the illegal extraction of other forest products.

12.5. Not carry out agricultural and/or livestock activities, except in SAF according to what is recorded in the respective Certified Technical Study.

12.6. Not carry out logging and extraction of timber products, in protection projects.

12.7. Not carry out activities that alter the natural behavior of the area under forest protection.

12.8. Inform FONAFIFO of any alteration or contingency that causes changes in the compensated area.

12.9. Allow free access to the personnel of SINAC in charge of control, FONAFIFO, and others designated by them, to the site of the compensated area, facilitating their work.

12.10. Allow SINAC to carry out research and environmental education activities in the compensated area.

12.11. Comply with the obligations established in the Forest Law, its regulations, and other applicable provisions.

12.12. Abide by any technically justified recommendation issued by SINAC and those emanating from FONAFIFO; likewise, must collaborate in the visits that FONAFIFO or its representatives eventually make to the PSA projects.

12.13. In the event of a sale of the area subject to PSA, partially or totally, the beneficiary must notify the FONAFIFO Regional Office of the transaction to be carried out within a maximum period of thirty days.

12.14. Assign to FONAFIFO the rights for Environmental Services for a period equal to the duration of the signed contract.

12.15. Have a Regent during the disbursement period.

12.16. Adequately identify the area subject to Payment for Environmental Services, with at least one sign per 50 hectares. For projects presented jointly with areas of less than 50 hectares per beneficiary, at least one sign per property is required, and in cases of SAF, one per property. The signs must contain information about the beneficiary's name, modality, contract number, and submitted PSA area or SAF trees.

12.17. In the modality of forest trees in SAF, the trees must be protected from browsing (ramoneo) by animals.

13.-Refunds (Devoluciones). Refunds made by the administered parties (administrados) for reasons such as: breach of contract, voluntary withdrawals when applicable, or others, will be made through a deposit into FONAFIFO's bank account number 100-01-000-216750-0 in the name of the Trust 544-1 Payment for Environmental Services BNCR. The beneficiary must send a copy of the deposit to FONAFIFO, attaching a note indicating: beneficiary's name, contract number, PSA area corresponding to the deposit amount, and reason for the refund. This amount must include the corresponding interest, when applicable, which will be calculated based on the basic passive rate fixed by the Central Bank on the date of the pronouncement by FONAFIFO's Legal Area; therefore, the beneficiary must, prior to the deposit, inquire at FONAFIFO's Administrative Area about the amount to be deposited.

14.-Final Provisions 14.1. Projects between the years 1997 and 2006 will be governed by the respective Executive Decrees and Manuals. The follow-up of contracts signed between the years 1997 and 2002 will correspond to the National System of Conservation Areas (SINAC).

14.2. FONAFIFO and SINAC, jointly or individually, may suspend the application of the Payment for Environmental Services for the projects and initiate the corresponding administrative and legal actions for the recovery of the resources already applied, when it is proven that there was a breach of the signed contract, the Forest Law, and other current regulatory provisions. Likewise, it will initiate the pertinent administrative procedure to determine whether or not to cancel the forest contract, establishing the responsibilities of the case.

14.3. In the event of a sale of the area subject to PSA, partially or totally, the beneficiary must notify the FONAFIFO Regional Office of the transaction to be carried out within a maximum period of thirty days. Subsequently, the new beneficiary must request the modification of the contract by providing the corresponding legal documentation accrediting them as the owner, within a maximum period of thirty days after the transaction. Failure to comply with this provision obliges FONAFIFO to suspend payment and open the administrative procedure to terminate the contract and recover the disbursed resources when applicable.

14.4. The protection areas established in article 33 of the Forest Law No. 7575, which are within the area subject to PSA, will be included within the total area that will receive compensation. For reforestation areas in protection areas, the owner may recover them through the establishment of native species, which will receive the corresponding PSA on the understanding that they cannot be cut in the future. Or failing that, natural restoration can be considered and is considered as an effective payment area.

14.5. The treatment of lands in Indigenous Reserves (Reservas Indígenas) must be the same as that given to other beneficiaries; however, those particular aspects that arise as an Indigenous Reserve must be considered. Without exception, in all cases, the procedures for the application of the PSA must be signed by the president of the Indigenous Development Association (Asociación de Desarrollo Indígena), with the prior agreement of the General Assembly of Associates. In the event that the Indigenous Reserve does not have the respective cadastral map, the project may be processed using the boundary description (derrotero) detailed in the decree creating the Reserve, in which case the Regent must locate the area to be submitted under a PSA contract.

14.6. The certifications issued by the Forest Regent required for the different procedures must have been issued on a recent date, not exceeding one month prior to the time of submission to the FONAFIFO Regional Office.

14.7. The pre-applications that were not processed in the previous year due to budgetary limitations will be placed in a temporary archive. They will be considered in the following year only if the interested party so states in writing to the respective Regional Office. Only pre-applications delivered within the period established in this Manual will be processed.

14.8. The National Forest Financing Fund, by means of a resolution, may establish the temporary or permanent suspension of the payment for environmental services when there are conflicts of interest between possessors or owners, or when, due to project auditing or supervision processes, elements are found that cast doubt on the project area, the owner or possessor of the property, or other important elements. Likewise, it may proceed with the cancellation of contracts when it considers that the existence of these conflicts or processes jeopardizes the proper use of the economic resources allocated for such purposes.

14.9. Given that the Payment for Environmental Services Program is voluntary in nature, early withdrawal from it is possible for beneficiaries. For this purpose, the corresponding settlement (finiquito) must be signed, and the beneficiary must refund the resources received, plus the corresponding interest calculated at the basic passive rate. Exempt from this refund are those cases of forest protection projects where there is a Regent's certification that the forest was effectively protected in the immediately preceding years.

14.10. Beneficiaries of Payment for Environmental Services contracts may avail themselves of the benefits established in Articles 29 and 36 of the Forest Law No. 7575, for which they must comply with the requirements established in the Regulation to the Forest Law (Reglamento a la Ley Forestal).

14.11. If the beneficiary does not appear to sign the contract or withdraws from the PSA process during the property encumbrance process, they must pay, through Bank Deposit, the total cost of the "Forest Law Encumbrance (Afectación Ley Forestal)" if it has already been carried out. FONAFIFO, for its part, will take administrative, legal, and economic actions when appropriate against those who withdraw, given the costs incurred during the incorporation process into the PSA Program.

14.12. In the modalities of forest protection, reforestation, and natural regeneration, the first payment cannot be made effective until the encumbrance is duly registered in the Property Registry or the Testimony of deed is available for unregistered farms. The respective contract will establish a percentage of 1% of the total contract value as expenses for file studies and Public Registry, issuance of certifications, preparation and notarization (protocolización) of the respective contract, and registration before the Public Registry. For unregistered farms, the notary must prepare a testimony of the contract to be incorporated into the Registry that FONAFIFO will maintain for this purpose.

15.-Encumbrances and Releases (afectaciones y desafectaciones). The costs for the encumbrance will be 1% of the total contract value for protection, natural regeneration, and reforestation, an amount that will be deducted from the beneficiary once in the first payment and will be deposited directly to the respective notary.

This cost will also be charged to the beneficiaries who decide to terminate the contract during the period in which the respective encumbrance is being registered before the Public Registry.

I certify the content of the following Technical Study:

1. Name of beneficiaries, ID numbers, Folio Real registration number(s), map number(s), total area(s) of the registration(s), current use, administrative location, and exact address of the farm(s), adjacent property owners found in the field.

2. Indicate the modality and the Pre-application number previously assigned by the respective Regional Office.

3. Indicate if the area is located in a protected wild area, stating its name.

4. The common and scientific name of the species to be planted must be included, and clearly indicate the species by area and for each Folio Real registration.

5. The Forest Regent must certify that they carried out an evaluation of the physical-environmental, ecological, and silvicultural factors to recommend the species, planting sites, and their management, and that these were communicated in writing to the beneficiary.

6. The Forest Regent must certify the origin of the improved vegetative material when it exists, or failing that, the origin of the material selected for the plantation.

7. The surfaces occupied by other land uses (existing infrastructure, protection zones, etc.) must be located and quantified, provided these are within the blocks or areas to be planted.

8. In reforestation projects with other methods, in addition to effective area, planting date, and survival percentage, the phenotypical conditions of the best individuals must be included. In the case of the species Gmelina arborea, certify adequate genetic material in the original plantation, certified harvests above the national average (more than 100 m3 in the harvest), certification that at least 200 trees from the first harvest were Class 1.

9. For natural regeneration projects with productive potential, it must be certified that at least 1240 saplings (brinzales) of commercial species per hectare are found and/or 720 commercial poles (latizales) per hectare, depending on the age at which the natural regeneration process began, as indicated in Annex 20. Remnant primary forest trees and palms, nor stumps with multiple resprouts, will not be quantified in these types of vegetation. The density of remnant trees must not exceed 5 individuals per hectare. In addition, a description of the management activities must be made.

10. The property plan must be georeferenced with at least three points located by GPS with the WGS 84 datum and in decimal-degree format (GG.dddd). At least two of these points must be vertices of the plan. All GPS points must be at a distance of no less than 50 meters from each other. (The locations of the points must be indicated on the sketch). The GPS point information must be included.

11. Likewise, each Technical Study must contain the sketch of the area to be submitted to PSA in relation to the total area of the property, indicating the boundary (derrotero) and the corresponding vertex numbering; in addition, the starting point (point 1) of the area to be submitted must be tied to a point with known coordinates, the system used, and its accuracy. The sketch of the effective PSA area, as well as the sketch of the entire plan, must be delivered printed and digitally in ArcView Shape file format, in Lambert North or South coordinate systems, Ocotepeque projection, or in geographic coordinate systems, WGS 84 datum, and in decimal degree format (GG.dddd).

Likewise, each technical study must contain the sketch of the area to be submitted to PSA in relation to the total area of the property, indicating the boundary (derrotero) and the corresponding vertex numbering; in addition, the starting point (point 1) of the area to be submitted must be tied from a point with known coordinates, the system used, and its accuracy. The sketch of the effective PSA area, as well as the sketch of the entire plan, must be delivered printed and digitally.

The digital file must comply with:

1. The file must be in ArcView Shape file format, type (polygon); other formats will not be accepted.

2. The shape file must be named with the application number assigned by the regional office (example, SJOI000108).

3. A single shape must be presented, which includes in the attribute table the quantification of the area, use (PSA area, rest of the farm), and the cadastral plan number, as applicable.

4. The file must be presented georeferenced in the system: CRTM05 coordinates (made official by Decreto 33797 MJ-MOPT published in La Gaceta 108 of Wednesday, June 6, 2007) or in geographic coordinate system, WGS 84, and in decimal degree format (GG.dddd).

5. It must be delivered on a compact disc (cd).

The scales to use for areas under thirty hectares must be 1:5,000 to 1:10,000. For larger areas, they may be used at professional convenience.

(Thus amended the previous point by the Fondo Nacional de Financiamiento Forestal and published in La Gaceta N° 78 of April 23, 2008).

12. The scales to use for areas over thirty hectares must be 1:5,000 to 1:10,000. For smaller areas, they may be used at professional convenience.

13. Furthermore, the Study must be prepared based on the legal area of the land, that is, the 'agricultural surface' (superficie agraria), defining this as the area of a portion of land determined by the horizontal projection of its perimeter.

14. Express statement of the existence of other valid PSA contracts on the same farm, indicating the area, location, and area size (cabida) of the contracts.

15. On properties where lease contracts exist, it must be certified that the PSA areas are excluded from the leased areas, in the event that it is the property owner who requests entry into the PSA. Otherwise, certify that the leases effectively correspond to PSA areas requested by the lessees.

16. Only Technical Studies referring to plans whose cartographic location displacement does not exceed 500 meters, with respect to what is indicated on the plan and the actual location of the farm, will be accepted. In cases exceeding 500 meters, a certification issued by a licensed surveyor (topógrafo colegiado) indicating the correct location of the plan must be attached.

17. Technical Studies must be prepared on security paper, contain the name, professional registration number (número de colegiado) and signature of the responsible professional, the date of preparation, and the respective stamps (timbres).

Note: Installation of preventive signs. The sign must contain the following information: name of the beneficiary, modality, PSA area submitted, and forestry contract number.

4. For forest protection projects, protection areas shall not be detailed, as these form part of the area subject to PSA. It will only be necessary to quantify and deduct from the effective area the areas occupied by primary roads and log collection yards (patios de acopio), and indicate the location of areas subject to previous valid PSA contracts. In the case of water bodies (embalses or lagunas without vegetation) exceeding one hectare, these must be considered and excluded from the area to be compensated.

5. On sites undergoing natural regeneration, the status of the existing vegetation on the site and the estimated age of abandonment must be certified.

6. The property plan must be georeferenced with at least three points located by GPS with the WGS 84 datum and in decimal-degree format (GG.dddd). At least two of these points must be vertices of the plan. All GPS points must be at a distance of no less than 50 meters from each other. Likewise, each Technical Study must contain the sketch of the area to be submitted to PSA in relation to the total area of the property, indicating the boundary (derrotero) and the corresponding vertex numbering; in addition, the starting point (point 1) of the area to be submitted must be tied to a point with known coordinates, the system used, and its accuracy. The sketch of the effective PSA area, as well as the sketch of the entire plan, must be delivered printed and digitally in ArcView Shape file format, in Lambert North or South coordinate systems, Ocotepeque projection, or in geographic coordinate systems, WGS 84 datum, and in decimal degree format (GG.dddd).

Likewise, each technical study must contain the sketch of the area to be submitted to PSA in relation to the total area of the property, indicating the boundary (derrotero) and the corresponding vertex numbering; in addition, the starting point (point 1) of the area to be submitted must be tied from a point with known coordinates, the system used, and its accuracy. The sketch of the effective PSA area, as well as the sketch of the entire plan, must be delivered printed and digitally.

The digital file must comply with:

1. The file must be in ArcView Shape file format, type (polygon); other formats will not be accepted.

2. The shape file must be named with the application number assigned by the regional office (example, SJOI000108).

3. A single shape must be presented, which includes in the attribute table the quantification of the area, use (PSA area, rest of the farm), and the cadastral plan number, as applicable.

4. The file must be presented georeferenced in the system: CRTM05 coordinates (made official by Decreto 33797 MJ-MOPT published in La Gaceta 108 of Wednesday, June 6, 2007) or in geographic coordinate system, WGS 84, and in decimal degree format (GG.dddd).

5. It must be delivered on a compact disc (cd).

The scales to use for areas under thirty hectares must be 1:5,000 to 1:10,000. For larger areas, they may be used at professional convenience.

Only Certified Technical Studies referring to plans whose cartographic location displacement does not exceed 500 meters, with respect to what is indicated on the plan and the actual location of the farm, will be accepted. In cases exceeding 500 meters, a certification issued by a licensed surveyor indicating the correct location of the plan must be attached.

4. The common and scientific name of the species to be planted must be included, and the number of trees per species and per each real property folio of the contract must be clearly indicated.

5. The Forestry Regent must certify that they carried out an evaluation of the physical-environmental, ecological, and silvicultural factors to recommend the species, planting sites, and their management, and that these were communicated in writing to the beneficiary.

6. The Forestry Regent must certify the origin of the vegetative material to be planted in the project.

7. The property plan must be georeferenced with at least three points located by GPS with the WGS 84 datum and in decimal-degree format (GG.dddd). FIFTH: Any total or partial sale, cession or disposal of the property subject to this contract must be previously communicated to the National Forest Financing Fund. The sale obligates the new owner or purchaser under the same terms, unless he/she wishes to return the proportional amount paid by FONAFIFO. In which case, the corresponding settlement (finiquito) will proceed.

SIXTH: FONAFIFO is expressly authorized to commercialize the ceded rights in any manner and to any natural or legal person, national or international.

.The SAF arrangements should not exceed twelve months prior to the signing of the contract, this to guarantee a replanting in the event that the mortality percentage exceeds 10%.

.The arrangements in perennial crops correspond to coffee, cacao, plantain, citrus, peach palm (palmito), oil palm and pastures.

.The Regent must certify that the area to be submitted under PSA-SAF is sufficient for the number of trees and recommended arrangement.

In all cases, the species used must adapt to the specific conditions of the site and the SAF, as well as receive adequate silvicultural management and protection from livestock when required. Other forest species may be used, provided they adapt to the site according to their biological and ecological conditions.

COOPERATION AGREEMENT NATIONAL FOREST FINANCING FUND AND THE ORGANIZATIONS We, Mr. Jorge Mario Rodríguez Zúñiga, of legal age, married once, agronomist, ID one - five hundred forty-five seven hundred seven, resident of Sabanillas de Montes de Oca, in his capacity as Executive Director of the National Forest Financing Fund, with powers of general attorney duly authorized for this act as recorded in the Legal Entities Registry of the Public Registry, under the registration citations: five hundred thirty-four - one thousand eight hundred seventy- nine - one - two, Legal ID three- zero zero seven - two zero four seven two four, hereinafter referred to as FONAFIFO and (Name of the legal representative, qualities, ID, name of the Organization, legal ID), as recorded by the Department of Social Organizations of the Ministry of Labor and Social Security, and in accordance with Agreement No. of the Board of Directors dated , hereinafter referred to as THE ORGANIZATION, based on the forest law, its regulations, the Manual of administrative procedures, as well as the good performance of the organization in similar tasks in the past, agree to enter into this cooperation agreement which shall be governed by the following clauses:

FIRST: The organization undertakes to provide technical advice and follow-up to the beneficiary producers of PSA projects, in the modalities of Forest Protection and Reforestation, Agroforestry Systems and Natural Regeneration.

SECOND: The obligations of the Organization are:

a- Provide regency services and technical advice in the execution of the PSA projects.

b- Sign individual contracts with the beneficiaries of the PSA Program, regulating the particular relationships with the beneficiaries. These contracts shall establish the amounts of fees for the services provided, the frequency of technical assistance, among others.

c- Manage the collection and subsequent delivery to each beneficiary, of the resources that correspond to them, for which it must channel said resources into a current account exclusively for administering the resources that FONAFIFO transfers for PSA.

d- Undertake to transfer the resources to the PSA beneficiaries, within a maximum of 15 calendar days after they are transferred by FONAFIFO, provided no irregular situation has existed.

e- Collaborate with FONAFIFO in the supervision tasks of the PSA projects under its charge and technical supervision, during the term of this agreement. The Organization must immediately communicate any irregular situation arising from the PSA Contracts.

THIRD: For its participation, the organization shall charge the beneficiary an amount that may not exceed 18% of each disbursement.

FOURTH: FONAFIFO undertakes to pay the beneficiaries through the intermediation of the organization, for having so stipulated by them in the PSA contracts. However, when by mutual agreement it is established, or the organization disappears, or a serious fault in its obligations is proven, through an administrative procedure, FONAFIFO may partially or totally suspend the payments to the organization and disburse directly to the beneficiary. The organization waives in advance any claim derived from the application of this clause.

FIFTH: This Agreement has a duration period of five years, from its signature.

SIXTH: Any conflict arising in the execution or application of this agreement shall be resolved under the principles of good faith and mutual cooperation, but always considering the viability and execution of the PSA projects signed with the beneficiaries.

SEVENTH: The organization shall not be responsible for the execution or non-compliance of the projects, unless knowing of irregularities it did not report them in a timely manner.

EIGHTH: For tax purposes, this agreement is of inestimable value.

en la totalidad del texto - Texto Completo Norma 2 Manual de Procedimientos para el pago de Servicios Ambientales Texto Completo acta: A6E4D FONDO NACIONAL DE FINANCIAMIENTO FORESTAL (Nota de Sinalevi: El Fondo Nacional de Financiamiento Forestal, aprobó un nuevo Manual de Procedimientos para el Pago de Servicios Ambientales, en sesión N° 01 del 28 de enero de 2009) FONDO NACIONAL DE FINANCIAMIENTO FORESTAL Según acuerdo noveno celebrado en la sesión ordinaria número dos del día catorce del mes de febrero del dos mil siete.

1. 1Que según dispone la Constitución Política, en su Artículo 50 y numerosos Convenios y Tratados suscritos y aprobados por Costa Rica, es deber del Estado garantizar un medio ambiente ecológicamente equilibrado, creando mecanismos internos para asegurar el uso y disfrute de los recursos naturales vitales, para el ser humano, recursos contenidos en los diversos ecosistemas y procesos de regeneración.
2. 2Que la Ley Forestal Nº 7575 publicada en La Gaceta Nº 72 del 16 de abril de 1996, establece como una función esencial del Estado, velar por la conservación, aprovechamiento, protección, administración y fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables.
3. 3Que el Fondo Nacional de Financiamiento Forestal denominado FONAFIFO, creado en la citada Ley Nº 7575, tiene como obligación primordial establecer diversos mecanismos de fomento a pequeños y medianos productores forestales, entre ellos el Pago de Servicios Ambientales que generan los bosques y las plantaciones forestales en sus diversas modalidades, según dispone el artículo tres inciso k de la Ley Forestal, su Reglamento y los Decretos Ejecutivos Nº 31633 MINAE, publicado en La Gaceta 29 del 11 Febrero del 2004, Nº 31081-MINAE publicado en La Gaceta 61 del 27 de marzo del 2003.
4. 4Que siendo el FONAFIFO, un ente adscrito al MINAE, el mismo debe tener en consideración en sus programas aspectos que coadyuven a mejorar las condiciones socioeconómicas de las áreas con índices socioeconómicos más bajos.

En virtud de lo anterior, se hace necesario contar con un documento técnico - administrativo que regule y disponga los procedimientos y mecanismos para llevar a cabo estos importantes procesos. Por tanto:

La Junta Directiva del Fondo Nacional de Financiamiento Forestal, emite el siguiente:

MANUAL DE PROCEDIMIENTOS PARA EL PAGO DE SERVICIOS AMBIENTALES 1.-Objetivo. Establecer los procedimientos que se aplicarán en el Pago de los Servicios Ambientales (PSA) generados por los bosques y plantaciones forestales del país, mediante el fomento de las actividades de reforestación, protección de la cobertura boscosa, recuperación de cobertura mediante regeneración natural y plantación de árboles forestales en sistemas agroforestales (SAF), pagados con recursos provenientes del Presupuesto Nacional y de cualquier otro donante o inversionista que no establezca condiciones diferentes, a las establecidas en este Manual.

2.-Criterios de priorización de proyectos. Las áreas prioritarias para el Pago de Servicios Ambientales (PSA), en las modalidades de protección de bosque, reforestación, recuperación de cobertura mediante regeneración natural y plantación de árboles forestales en SAF, serán las establecidas mediante el Decreto Ejecutivo que emitirá el Poder Ejecutivo, los cuales serán aplicados para la selección de los proyectos que se considerarán en el programa de PSA. Solamente, cuando la demanda nacional de las áreas prioritarias ha sido satisfecha, se aceptarán proyectos en otras áreas que oportunamente el FONAFIFO dará a conocer.

Para inmuebles que se encuentren sobre el límite de las áreas prioritarias se considerarán para efectos del Programa de PSA aquellas que al menos tengan un 30% dentro de dichas áreas.

Las presolicitudes de PSA se regirán por los siguientes criterios de priorización considerado en el siguiente orden de prioridad:

2.1. PROYECTOS DE REFORESTACIÓN 2.1.1. Los sitios que presenten un alto potencial productivo para el desarrollo de plantaciones forestales a excepción de las clases de capacidad de uso VII y VIII (de la metodología oficial establecida en el Decreto Ejecutivo correspondiente).

2.1.2. Para los proyectos de reforestación con especies contenidas en los decretos de vedas y especies amenazadas o en peligro de extinción (Decreto Nº 25663-MINAE y Decreto Nº 25700-MINAE), se establece como prioritario todo el país. Para proyectos de reforestación establecidas en las áreas de protección según el artículo Nº 33 de la Ley Forestal N° 7575, se considerará como prioritario todo el país.

2.1.3. Proyectos de reforestación mediante regeneración natural en pastos y potreros, que se podrán realizar solo en áreas definidas como tierras Kyoto, que hayan sido deforestadas antes del 31 de diciembre de 1989.

2.1.4. Proyectos de regeneración natural con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo.

2.2. PROYECTOS DE PROTECCIÓN DE BOSQUES 2.2.1. Los sitios ubicados en corredores biológicos reconocidos oficialmente por el SINAC, los cuales se conservan como primera prioridad para ingreso al Programa PSA.

2.2.2 Proyectos de protección sobre inmuebles que cumplan con lo establecido en el punto anterior, donde se hayan suscrito contratos de pago de servicios ambientales en años anteriores, siempre que cumplan con los demás requisitos establecidos en el manual y concluya su período de vigencia en el mismo año en que se presente la nueva presolicitud. La vigencia de los nuevos contratos iniciará al día siguiente de la fecha de vencimiento del contrato anterior (Así reformado el punto anterior por el Fondo Nacional de Financiamiento Forestal y publicado en La Gaceta N°78 del 23 de abril de 2008).

2.2.3. Áreas de bosque que tengan como función principal la protección del recurso hídrico, consideradas de interés para acueductos rurales, proyectos de Acueductos y Alcantarillado y las empresas de servicios públicos, los cuales deben estar respaldados mediante una certificación emitida por el administrador del acueducto respectivo.

2.2.4. Inmuebles de propiedad privada ubicados dentro de las áreas silvestres protegidas y que aún no han sido compradas o expropiadas por el Estado.

2.2.5. Los sitios con bosque ubicados en los cantones con IDS menor a 40% según la determinación realizada por MIDEPLAN.

2.3. PROYECTOS DE ESTABLECIMIENTO DE ÁRBOLES FORESTALES EN SAF 2.3.1. Se dará prioridad a proyectos tramitados por organizaciones que tengan convenio vigente con el FONAFIFO.

2.3.3. Áreas en convenios específicos con FONAFIFO.

3.-De las áreas y cantidades mínimas y máximas. Las áreas mínimas y máximas a considerar anualmente para el PSA a través de las diferentes modalidades, serán las que se detallan a continuación:

3.1. El área mínima para el Pago por Servicios Ambientales que se vaya a ejecutar en la modalidad de Reforestación, es de una hectárea y máximo de trescientas hectáreas por año, por finca o conjunto de fincas colindantes entre sí o cercanas en un radio de cinco kilómetros, por persona física o jurídica y por Área de Conservación.

3.2. Para proyectos de reforestación presentados por organizaciones en un proyecto conjunto, el área máxima por productor por año, será de hasta cincuenta hectáreas.

3.3. Para proyectos de reforestación cuyos beneficiarios opten por el pago por adelantado, deben de indicarlo al momento de presentar la presolicitud. Solamente se autorizará contratos con pagos por adelantado del primer desembolso, cuando éstos se tramiten a través de las organizaciones o cuando se trate de proyectos de pequeños y medianos productores forestales de menos de 50 hectárea por productor(a). Para tales efectos, deberá otorgarse una garantía a satisfacción del FONAFIFO, la cual será valorada y aprobada por el Comité Interno de FONAFIFO.

3.4. Para el Pago de los Servicios Ambientales en la modalidad de protección de bosque, el área mínima es dos hectáreas y máxima trescientas hectáreas por año, por finca o conjunto de fincas colindantes entre sí o cercanas en un radio de cinco kilómetros, por persona física o jurídica por Área de Conservación.

3.5. Para proyectos de regeneración natural con potencial productivo el área mínima considerada en sitios en vías de recuperación es de 2 hectáreas.

3.6. El área máxima por Reserva Indígena para el PSA en la modalidad de Protección de Bosque es de 1.000 hectáreas por año.

(Así reformado el inciso anterior mediante publicación efectuada en La Gaceta N° 48 del 7 de marzo de 2008) 3.7. Para la modalidad de plantación de árboles forestales en SAF, la cantidad mínima será de trescientos cincuenta (350) árboles y máxima de tres mil quinientos árboles (3.500) por beneficiario (a).

3.8. En proyectos de plantación de árboles forestales en SAF presentados en proyectos conjuntos, cooperativas de autogestión y en Reservas Indígenas, la cantidad máxima será de trescientos treinta y seis mil árboles (336.000) por año, siempre que cada beneficiario no sobrepase el rango establecido en el punto 3.7.

3.9. Dentro de los siguientes arreglos, el rango de árboles por hectárea y/o kilómetro de SAF por establecer es de:

3.9.1. Árboles maderables en cultivos perennes entre 40 y 250 árboles por hectárea.

3.9.2. Árboles de uso múltiple en cultivos perennes entre 40 y 277 árboles por hectárea.

3.9.3. Árboles maderables en hilera entre 333 y 500 árboles por km.

3.9.4. Cortinas rompevientos entre 666 y 1000 árboles por km.

3.9.5. Plantaciones en bloque de menos de una hectárea, el equivalente entre (625 y 1.111 árboles/ha). Se considera como máximo tres bloques de menos de una hectárea por beneficiario(a).

3.9.6. Sistemas Taungya y barbechos mejorados, única y exclusivamente en Territorios Indígenas.

3.10. Especies que se utilizan en SAF, se detallan en el ANEXO 13.

Dado que el mínimo de árboles por contrato de SAF es de 350 árboles (punto 3.7 de este Manual), deberán de establecerse las combinaciones necesarias, entre los arreglos para alcanzar el mínimo permitido, de acuerdo al área de cada finca.

4.-De los beneficiarios (as). Se considerarán beneficiarios (as) del Programa PSA, todas aquellas personas físicas o jurídicas, propietarios (as), arrendatarios, usufructuarios de inmuebles inscritos en el Registro Nacional que deseen gozar del Pago de los Servicios Ambientales en las diversas modalidades. Para proyectos de protección de bosque también se considerará a los poseedores (as) que cumplan con lo establecido en el Decreto Ejecutivo Nº 31633-MINAE.

Los (las) solicitantes interesados podrán presentar presolicitudes de la siguiente manera:

4.1. En forma individual: Para la protección de bosques, recuperación de cobertura mediante regeneración natural, reforestación y establecimiento de árboles forestales en SAF.

4.2. Proyectos conjuntos elaborados por organizaciones para la protección de bosques, reforestación, recuperación de cobertura mediante regeneración natural y el establecimiento de árboles forestales en SAF.

4.3. En proyectos conjuntos el beneficiario(a) estará de acuerdo en que los recursos PSA y SAF sean depositados en la cuenta bancaria de la organización, lo cual se estipula en el contrato respectivo.

4.4. Todos los beneficiarios (as) individuales de PSA, deberán indicarle al FONAFIFO su número de cuenta bancaria en el Banco Nacional de Costa Rica, para recibir los pagos del Programa de PSA.

4.5. Las Comunidades Indígenas que suscriban contratos de PSA deberán indicarle al FONAFIFO su número de cuenta bancaria en el Banco Nacional de Costa Rica, para recibir los pagos del Programa de PSA.

5.-De las organizaciones. Las organizaciones deberán estar debidamente inscritas en el registro respectivo, contar con personalidad jurídica, agrupar o representar a pequeños o medianos productores y colaborar con el beneficiario(a) y con el FONAFIFO en el trámite, ejecución y supervisión del proyecto PSA y deben cumplir con los siguientes requisitos:

5.1. Ser organizaciones regidas por la Ley de Asociaciones Nº 218 del 8 de agosto de 1939, Ley Nº 7932 del 19 de noviembre de 1999 correspondiente a la Reforma a la Ley Nº 4521 de Establecimiento de Centros Agrícolas Cantonales adscritos al Ministerio de Agricultura y Ganadería, Ley de Asociaciones Cooperativas Nº 6756 del 5 de mayo de 1982, Ley sobre Desarrollo de la Comunidad Nº 3859 del 7 de abril de 1996 y estar legalmente constituidas, con personería jurídica vigente o Fundaciones que tengan en sus programas la actividad forestal o de recursos naturales.

5.2. Las organizaciones debidamente calificadas por FONAFIFO y que hayan suscrito un convenio de cooperación con éste según lo establecido en el Anexo 14, podrán canalizar y colaborar en el programa de PSA en todas las modalidades, siempre y cuando cumplan con lo establecido a continuación.

5.2.1. Firmar un convenio de cooperación con el FONAFIFO, a partir de la aprobación de presolicitudes PSA e incorporarlo a los siguientes requisitos:

• a)Encontrarse legalmente constituida, según lo establecido en el artículo 5 del Manual PSA 2005.
• b)Entregar en FONAFIFO una fotocopia legible y vigente de la cédula jurídica y de la cédula de identidad del representante(s) legal (es).
• c)Entregar una certificación de personería jurídica con no menos de tres meses de emitida.
• d)Presentar una solicitud por escrito ante FONAFIFO firmada por el representante legal de la Organización.

5.2.2. Mantener una cuenta bancaria en el Banco Nacional de Costa Rica, para administrar de forma exclusiva los recursos que FONAFIFO le transfiera por PSA.

5.2.3. Precalificar a los asociados (as) que van a ingresar al Programa de PSA, según los requisitos de este Manual de Procedimientos para verificar la propiedad del inmueble y la existencia o no de limitaciones legales sobre las fincas a someter al PSA o verificando que los requisitos de fincas en posesión cumplan con lo establecido en el Decreto Nº 31633-MINAE, publicado en la Gaceta Nº 29 del once de febrero del dos mil cuatro 5.2.4. Comprometerse a entregar los recursos a los beneficiarios (as) de PSA, como máximo dentro de los 15 días naturales posteriores, al que se giren los recursos por parte ente fiduciario del FONAFIFO.

5.2.5. Colaborar con el FONAFIFO en las labores de supervisión de los proyectos de PSA de sus asociados (as).

5.2.6. Suscribir contratos de regencia para los proyectos de sus asociados (as).

5.2.7. Comunicar por escrito y previo a la firma del contrato a sus asociados, el monto de las tarifas por los servicios que van a brindar en los proyectos de PSA, los cuales no deben superar el 18% del monto total del contrato.

5.2.8. Formalizar contratos individuales privados con el beneficiario(a) de PSA, en los que se establezcan el monto por honorarios por los servicios brindados, la periodicidad de la asistencia técnica, entre otras.

5.2.9. Presentar al FONAFIFO, en los meses de enero y julio de cada año, copia de los depósitos, transferencias o cheques emitidos a cada beneficiario(a).

5.3. En estos proyectos la organización será la encargada del trámite, colaborará con FONAFIFO en la supervisión de los proyectos de PSA y sus obligaciones particulares son:

5.3.1. Llevar un expediente individualizado de cada beneficiario (a).

5.3.2. Contratar los Regentes forestales responsables de la ejecución del proyecto.

5.3.3. Supervisar el cumplimiento de las obligaciones del contrato.

5.3.4. Cobrar y retener el monto convenido a los productores.

5.3.5. Notificar en forma inmediata a FONAFIFO, en caso de incumplimiento de alguno de los beneficiarios (as).

5.4. No tener obligaciones pendientes con proyectos forestales, programas de financiamiento, incentivos o crédito otorgados por MINAE o alguno de sus órganos adscritos. Solo podrán ejecutar nuevos proyectos aquellas organizaciones que hayan cancelado sus obligaciones o hayan realizado un arreglo de pago.

6.-Del regente forestal.

6.1. El profesional acreditado como Regente Forestal deberá cumplir con lo establecido en la Ley Forestal, su Reglamento y sus modificaciones. En casos especiales para Reservas Indígenas, el Gerente Regional del Área de Conservación respectiva podrá certificar el área que gozará del PSA, de acuerdo a los procedimientos establecidos en este Manual, siempre y cuando se cumpla con la normativa establecida por el Colegio de Ingenieros Agrónomos y no se cobren honorarios.

6.2. En el caso de los proyectos de SAF el Regente Forestal como mínimo deberá realizar dos visitas en el primer año y en los dos años posteriores una visita por año.

6.3. El Regente debe entregar documentos ordenados para los expedientes respectivos y sus copias para sello de recibido en las respectivas Oficinas Regionales.

6.4. Es obligación de los Regentes Forestales acompañar al personal de FONAFIFO o a personas que éste autorice, a las visitas de campo que se realicen a los proyectos PSA. Para tales efectos, FONAFIFO notificará al Regente Forestal con al menos ocho días hábiles anteriores a la visita programada. En las visitas de campo también pueden participar los y las propietarios de la finca, sus representantes legales o sus administradores.

6.5. Informar por escrito al beneficiario del avance y estado de los Proyectos PSA respectivos.

6.6. Será responsabilidad de Regente Forestal brindar la asistencia técnica de los proyectos y verificar el cumplimiento de recomendaciones técnicas y las obligaciones de parte de sus regentados.

6.7. Presentar al FONAFIFO la documentación técnica requerida para el trámite y seguimiento de los proyectos de PSA, de manera oportuna, veraz, cumpliendo con los requerimientos establecidos por este Manual.

7.-Procedimientos para el trámite de presolicitudes para PSA. Cualquier trámite, que se refiera a los proyectos de PSA, será realizado en las Oficinas Regionales del FONAFIFO, las cuales son las siguientes:

. Limón (A.C. Amistad Caribe).

. Pococí (A.C. Tortuguero).

. Sarapiquí, (A.C. Cordillera Volcánica Central).

. San Carlos (A.C. Huetar Norte).

. Palmar Norte (A.C. Osa).

. Nicoya (A.C. Tempisque).

. Cañas (A.C. Guanacaste y A.C. Arenal Tilarán).

. San José Oriental y Occidental (A.C. Cordillera Volcánica Central, A.C. Pacífico Central y A.C. Amistad Pacífico).

En cada una de las Oficinas Regionales del FONAFIFO se mantendrá un mapa para ubicar si las fincas que apliquen presolicitudes para el programa de PSA están dentro de las áreas prioritarias.

El período de recepción de presolicitudes de ingreso al programa de Pago de Servicios Ambientales para el año 2007 se iniciará con la publicación del presente Manual de Procedimientos y concluye a los cuarenta y cinco días hábiles posteriores.

Para los años siguientes, el período de recepción será de cuarenta y cinco días hábiles y se iniciará el primer día hábil del mes de febrero de cada año.

La aprobación definitiva de las solicitudes para cada año, estará sujeta a la publicación del Decreto Ejecutivo que establece las áreas prioritarias, la cantidad de hectáreas por modalidad y el presupuesto asignado a FONAFIFO para la implementación del programa de PSA.

Las Oficinas Regionales podrán abrir un período extraordinario de recepción de presolicitudes en la modalidad PSA que se requiera, cuando la cantidad de presolicitudes admitida sea inferior al área asignada.

7.1. Dentro de los requisitos para ingresar al PSA, el solicitante debe presentar por escrito y ante la Oficina Regional del FONAFIFO correspondiente, una presolicitud firmada por él mismo (Anexos 1 y 2). Adjuntando copia para sello de recibido, en la cual el personal de la Oficina Regional le indicará el número de presolicitud asignado.

La presolicitud contiene la siguiente información:

7.1.1. Nombre del propietario(a), copropietarios (as) y/o sociedad anónima y sus calidades (estado civil completo, ocupación, domicilio exacto, número de cédula de identidad) número de teléfono, fax y fotocopia visible en hoja completa de la cédula de identidad vigente y/o jurídica vigente por ambos lados.

7.1.2. Nombre y calidades del representante legal (estado civil completo, ocupación, domicilio exacto, número de teléfono, fax, número de cédula de identidad y condición de representación) y fotocopia visible en hoja completa de la cédula vigente por ambos lados.

7.1.3. La pretensión de la presolicitud que incluya el área a someter y la modalidad que se desea por cada inmueble, indicando si se trata de un inmueble en posesión o citas de inscripción del inmueble ante Registro Público. Además debe de indicar la siguiente información socioeconómica: a) fecha de nacimiento, b) escolaridad, c) número de hijos y d) nacionalidad. En caso de que el trámite incluya personas jurídicas deberá indicarse el nombre completo de la misma y el número de cédula jurídica.

7.1.4. Fotocopia visible en hoja completa por ambos lados del plano catastrado, con ubicación en la hoja cartográfica 1:50.000.

7.1.5. Indicar lugar para recibir las notificaciones, si se tratara de su domicilio u oficina deberá ubicarse dentro del perímetro administrativo de la Oficina Regional respectiva.

7.1.6. Cuando se trate de un proyecto de protección de bosque en fincas no inscritas, el solicitante deberá adjuntar a la solicitud la documentación establecida en el Decreto Ejecutivo Nº 31633-MINAE. La documentación aportada deberá contener las especies fiscales correspondientes.

7.1.7. Indicación expresa de si se trata de un proyecto de reforestación mediante pago por adelantado.

7.1.8 Recibida una presolicitud, la Oficina Regional respectiva procederá a la digitalización y ubicación del plano en su Sistema de Información. Si se determina que la misma traslapa con una o varias fincas de otras presolicitudes o sobre fincas que existan contratos de Pago de Servicios Ambientales vigentes, el encargado de la Oficina Regional lo notificará a los interesados para que procedan a aclarar y/o corregir las inconsistencias en un plazo no mayor a 15 días hábiles. Si vencido el plazo otorgado las mismas persisten, se rechazará la presolicitud y se procederá al archivo del expediente.

En todos los casos, la información aportada por el solicitante debe estar ordenada y legible. Una vez recibida la presolicitud, el FONAFIFO asignará un número consecutivo, y tendrá un plazo de 10 días hábiles para notificar la continuación o no de ingreso al Programa PSA según los criterios de priorización y presupuesto asignado.

7.2. Las presolicitudes no aprobadas por aspectos legales, el solicitante tendrá un plazo de hasta 30 días para corregir y completar los requisitos. Cumplido éste plazo sin que se completen los requisitos, se procederá a su archivo y las Oficinas Regionales no aceptarán la presentación de requisitos faltantes, salvo en situaciones justificadas, en donde el solicitante presente por escrito una reconsideración de su situación antes del vencimiento del plazo.

7.3. Si la presolicitud es aprobada por el notario asignado, el solicitante tendrá un plazo de hasta 15 días hábiles, para aportar a las Oficinas Regionales del FONAFIFO los siguientes requisitos:

7.3.1. Plano certificado por Catastro Nacional o Notario Público.

7.3.2. Estudio Técnico que deberá emitir el Regente Forestal en el cual se establezca el área efectiva a contratar según la modalidad que corresponda y los requerimientos técnicos de las mismas, según los Anexos 3, 5 y 7.

a. Para reforestación deberá presentar el Estudio Técnico con la ubicación del área a someter, con los puntos GPS, de acuerdo a la guía del Anexo 3. Una vez establecida la plantación deberá presentar una certificación complementando la información de acuerdo a la guía del Anexo 4.

b. Para protección de bosque deberá certificarse que el bosque protegido cumpla con la definición establecida en la Ley Forestal Nº 7575. La guía para la elaboración de los Estudios Técnicos donde se incluye el área efectiva a compensar y los aspectos técnicos, se establece en el ANEXO 5 de este Manual.

c. Para regeneración natural deberá incluir una descripción del estado sucesional del recurso, La guía para la elaboración de los Estudios Técnicos donde se incluye el área efectiva a compensar y los aspectos técnicos, se establece en el Anexo 5 de éste Manual.

d. Para SAF deberá presentar el Estudio Técnico con el arreglo a utilizar, el número de árboles, las especies a plantar y los puntos GPS, de acuerdo a la guía del ANEXO 7. Una vez establecido el SAF, deberá presentar la certificación complementando la información requerida, de acuerdo a la guía del Anexo 8.

7.3.3. Contrato de regencia forestal debidamente inscrito en el Colegio de Ingenieros Agrónomos, en el cual se incluirá la totalidad de área PSA o árboles SAF. Deberá inscribirse un contrato por cada proyecto PSA o por cada modalidad.

Cuando se trate de proyectos tramitados a través de una Organización se deberá adjuntar el listado de beneficiarios debidamente aceptado y sellado por el Colegio de Ingenieros Agrónomos, el cual deberá contener calidades de cada beneficiario(a), matrícula de Folio Real o plano catastrado de la o las fincas y un desglose del área PSA o árboles SAF incluidos en el citado contrato.

Para todas las modalidades, deberá entregar la ubicación del área de PSA o el área de los arreglos de SAF con los tres puntos GPS, de acuerdo con las guías correspondientes.

7.3.4 El Estudio Técnico deberá ser presentado en original en la Oficina Regional del FONAFIFO correspondiente. En caso de requerir correcciones, se concederá un plazo máximo de hasta 10 días hábiles después de la notificación. Para proyectos presentados por organizaciones será un Estudio Técnico por cada beneficiario(a) en forma individual.

7.3.5 Cuando se trate de fincas sin inscribir, el Estudio Técnico se solicitará una vez transcurrido el plazo para oír oposiciones, luego de publicado el correspondiente edicto y completados todos los requisitos solicitados previamente.

Para la aprobación del proyecto se deberá contar con el informe por parte del funcionario (a) de FONAFIFO, según lo establecido en el Anexo 12 de este Manual.

7.4. Presentados los requisitos a la Oficina Regional de FONAFIFO, el Encargado(a) valorará los mismos, en caso de que se cumplan, elaborará la resolución respectiva (Anexos 9 y 10 ). Esta resolución deberá contener:

a. Consecutivo de número de oficio.

b. Nombre del beneficiario(a).

c. Ubicación geográfica del inmueble.

d. Número de finca en caso de inmuebles inscritos o número de plano catastrado en casos de inmuebles no inscritos.

e. Modalidad.

f. Área o número de árboles sujetos a pago.

La Oficina Regional notificará la resolución y solicitará por escrito al beneficiario(a) o beneficiarios (as), el número de cuenta cliente en el Banco Nacional de Costa Rica para el depósito de los pagos respectivos. Posteriormente, procederá a comunicar al beneficiario(a) mediante nota escrita, que el contrato está listo, otorgándole un plazo de hasta 30 días hábiles, para presentarse a firmarlo. El final, firma del Ministro de Ambiente o su representante y del presidente del FONAFIFO o su representante y para su protocolización.

8.-Requerimentos legales. Los inmuebles que se sometan al Programa, deberán:

8.1. Estar debidamente inscritas en el Registro Nacional, salvo las excepciones señaladas para proyectos de protección de bosques de acuerdo al Decreto Ejecutivo Nº 31633-MINAE y que cumplan con los requerimientos establecidos en el Reglamento a la ley Forestal.

8.2. En acatamiento de las directrices emitidas por el Registro Nacional, los planos de los inmuebles que se sometan al Pago de Servicios Ambientales en cualquiera de sus modalidades, debe cumplir con los siguientes requisitos.

8.2.1 Encontrarse inscrito en la Base de Datos de Catastro Nacional.

8.2.2 Estar relacionado -tanto en la Base de Datos del Catastro Nacional, como en la del Registro de la Propiedad- al inmueble que se desea someter.

8.2.3 La ubicación y área del inmueble indicada tanto en el plano como en la Base de Datos del Catastrado Nacional, debe coincidir con lo que se indica en la Base de Datos del Registro de la Propiedad.

8.3. Cuando se trate de fincas sin inscribir, el plano deberá estar a nombre de quien se dice poseedor del inmueble.

8.4. No tener anotaciones, inmovilizaciones, demandas de cualquier tipo, embargos preventivos o practicados.

Se exceptúa de esta prohibición aquellas fincas que aun cuando tengan anotaciones judiciales, estas no se refieran a litigio sobre la titularidad del inmueble pudiendo gozar de Pago por Servicios Ambientales modalidad conservación de bosque; mediante el procedimiento de año vencido.

En caso de tener limitaciones del IDA, BANHVI u otra similar, deberá contar con la autorización escrita de dicha entidad para suscribir el contrato y para establecer limitaciones. Salvo aquellos casos en que se encuentren autorizados por un convenio de cooperación interinstitucional.

8.6. Podrán ejecutarse proyectos de protección y reforestación en fincas arrendadas, siempre y cuando el arrendamiento esté inscrito en el Registro Nacional por el plazo de ejecución del proyecto. Siempre que no sobrepasen las trescientas hectáreas, por finca o conjunto de fincas colindantes entre sí o cercanas en un radio de cinco kilómetros, por persona física o jurídica, por Área de Conservación.

En todos los casos, el propietario del inmueble deberá suscribir el contrato de pago de servicios ambientales conjuntamente con el arrendante.

8.7. En caso de que existan copropietarios, usufructuarios, nudos propietarios u otros esquemas similares, podrán los copropietarios, usufructuarios, nudos propietarios u otros en escritura pública autorizar expresamente a uno de ellos la firma del contrato a nombre propio o en representación del poderdante y la autorización para realizar la afectación del inmueble en el Registro Nacional. Esto debe indicarse en la presolicitud PSA para que sea valorado por el notario externo de FONAFIFO.

8.8. No se admitirán inmuebles sobre los que existen cédulas hipotecarias, salvo que éstas sean endosadas como garantía de cumplimiento al FONAFIFO, o se utilicen otros mecanismos de garantía a satisfacción de FONAFIFO.

8.9. No se admitirán inmuebles sobre los que existan constituidas hipotecas, salvo que en escritura pública, el acreedor hipotecario autorice la ejecución del proyecto, la afectación del inmueble ante el Registro y manifieste que en caso de remate, el inmueble se adjudique con las afectaciones y limitaciones correspondientes.

Cuando el acreedor hipotecario sea un Banco del Sistema Bancario Nacional, bastará con un oficio firmado por el funcionario competente de la entidad. No obstante lo anterior, se aceptarán proyectos PSA en la modalidad de protección de bosque, cuando el banco acreedor haya suscrito convenios con FONAFIFO para respetar las afectaciones y los proyectos, o cuando se trate de fincas con hipotecas donde el beneficiario, manifieste su deseo de que el pago se realice por año vencido, según los términos que establece la cláusula incluida en el contrato respectivo.

8.10. Para el establecimiento de plantaciones dentro de las áreas silvestres protegidas afectadas por el Plan de Ordenamiento Ambiental, deberán ajustarse a las regulaciones estipuladas en el mismo. Cuando se trate de proyectos de reforestación con especies de rápido crecimiento, la conveniencia técnica de la propuesta deberá ser expresamente avalada en el informe de evaluación que haga la Oficina Regional del FONAFIFO.

8.11. No tener obligaciones pendientes con proyectos de PSA anteriores, programas de financiamiento, incentivos o créditos otorgados por el FONAFIFO.

8.12. Únicamente se aceptará incluir para el Pago de Servicios Ambientales, proyectos de Reforestación y SAF cuya plantación haya sido establecida como máximo doce meses antes de la formalización del contrato.

9.-Obligaciones pendientes. La verificación de obligaciones por contratos anteriores de los beneficiarios (as) se realizará de la siguiente forma:

9.1. El FONAFIFO verificará de acuerdo a los registros con que cuenta, las obligaciones de los beneficiarios (as) u organizaciones con respecto a créditos, certificados de abono forestal, contratos de PSA. Se verificará las obligaciones que se establecen en este manual y también procederá a verificar la cabida del inmueble y la vigencia de contratos anteriores.

9.2. Las Oficinas Regionales del FONAFIFO verificarán las obligaciones pendientes en cuanto a los Servicios Ambientales y deberán dejar constancia en el expediente del resultado de esta consulta.

9.3. Si se determina la existencia de obligaciones pendientes, los responsables de las Oficinas Regionales de FONAFIFO en coordinación con las Oficinas Centrales, iniciarán los procesos administrativos tendientes a la recuperación de los recursos.

9.4. FONAFIFO mantendrá un registro de beneficiarios (as) u organizaciones que han incumplido con el contrato u obligaciones con el PSA, para verificar si procede o no el trámite de contratos nuevos o solicitudes de pago.

10.-Emisión y entrega del pago por servicio ambiental 10.1. Tratándose de protección de bosque, una vez firmado el contrato por todas las partes, inscrita la afectación ante el Registro de la Propiedad o protocolizado el contrato en caso de fincas en posesión, el FONAFIFO tramitará la Orden Pago y la remitirá al BNCR. El pago de los contratos por año vencido y de los contratos suscritos sobre fincas en posesión, se tramitarán doce meses después de su vigencia. (ver punto 8.9).

10.2. Para pagos posteriores, el Regente Forestal entregará a la Oficina Regional respectiva de FONAFIFO una certificación anual a los 12, 24, 36 y 48 meses de la fecha de vigencia de contrato, o 24, 36, 48 y 60 meses cuando se trate de contratos suscritos sobre fincas en posesión según la guía del Anexo 6, el funcionario (a) responsable de la Oficina Regional de FONAFIFO, valorará la certificación y procederá a asignar un número de consecutivo, para continuar con el trámite. El FONAFIFO tramitará la Orden Pago y la remitirá al BNCR.

10.3. Para los proyectos de reforestación una vez firmado el contrato por todas las partes, inscrita la afectación y presentada la certificación del Regente Forestal según la guía del Anexo 4, el FONAFIFO tramitará la Orden Pago y la remitirá al BNCR.

10.4. Para pagos posteriores en la modalidad de reforestación el Regente Forestal entregará a la oficina regional respectiva de FONAFIFO una certificación anual a los 12, 24, 36, 48, 60, 72, 84, 96, 108 y 120 meses posteriores a la fecha promedio de plantación, según la guía del Anexo 4, el funcionario (a) responsable de la Oficina Regional de FONAFIFO, valorará la certificación y procederá a asignar un número de consecutivo, para continuar con el trámite.

El FONAFIFO tramitará la Orden Pago y la remitirá al BNCR.

10.5. En contratos de reforestación con pago por adelantado, también se realizarán los pagos posteriores según la fecha de plantación, siempre y cuando se haga entrega de la certificación anual respectiva.

10.6 Para los contratos de regeneración natural el primer pago se realizará una vez firmado el contrato por todas las partes y se encuentre inscrita la afectación ante el Registro. El FONAFIFO tramitara la Orden Pago y la remitirá a la Tesorería Nacional.

(Así reformado el inciso anterio mediante publicación efectuada en La Gaceta N° 48 del 7 de marzo de 2008) 10.7 Para pagos posteriores en la modalidad de reforestación, el regente entregará a la Oficina Regional respectiva de FONAFIFO una certificación anual a los 12, 24, 36 y 48 meses posteriores a la fecha promedio de plantación, según la guía del anexo 11. El FONAFIFO tramitará la Orden Pago y la remitirá a la Tesorería Nacional.

(Así reformado el inciso anterior mediante publicación efectuada en La Gaceta N° 48 del 7 de marzo de 2008) 10.8. Para los proyectos de establecimiento de árboles forestales en SAF el primer pago se realizará una vez firmado el contrato por todas las partes y presentada la certificación del Regente Forestal según la guía del ANEXO 8 , el FONAFIFO tramitará la Orden Pago y la remitirá al BNCR.

10.9. Para pagos posteriores el Regente Forestal entregará una certificación anual a los 12 y 24 meses de la fecha promedio de establecimiento del SAF, según la guía del 8, el monto a pagar dependerá de la cantidad de árboles sobrevivientes reportados. El funcionario (a) responsable de la Oficina Regional de FONAFIFO, valorará la certificación y procederá a asignar un número de consecutivo, para continuar con el trámite. El FONAFIFO tramitará la Orden Pago y la remitirá al BNCR.

10.10. Recibida la certificación del Regente, FONAFIFO tendrá un plazo de 30 días naturales para la emisión de la orden pago, lo cual se hará siempre y cuando ésta cumpla con los requisitos establecidos en la Ley Forestal, sus Reglamentos, el Manual de Procedimientos, la afectación del inmueble se encuentre debidamente inscrita en el Registro Público y el beneficiario(a) se encuentra al día en sus obligaciones con la Caja Costarricense del Seguro.

10.11. No se aceptarán poderes otorgados a terceros por apoderados para firmar contratos y/o tramitar o retirar PSA.

11.-Disposiciones de seguimiento y monitoreo 11.1. Para el seguimiento y evaluación de los proyectos del Programa de Servicios Ambientales, el FONAFIFO podrá contar con los servicios de un ente externo que permita auditar y evaluar el estado y cumplimiento de las obligaciones, por parte de los entes involucrados en el PSA, a saber beneficiarios (as), Oficinas Regionales y Centrales del FONAFIFO, organizaciones, SINAC, Regentes, etc. Esta evaluación deberá realizarse al menos cada dos años. El FONAFIFO definirá los lineamientos técnicos de la misma. Los involucrados deberán contribuir en este proceso, así como implementar las recomendaciones que se deriven de la auditoría.

11.2. Anualmente, el FONAFIFO remitirá al SINAC el listado de los proyectos aprobados, para que los tome en consideración al momento de realizar otros trámites o en la implementación de la estrategia de monitoreo que llevará a cabo esta institución, a más tardar un mes después de finalizado el período de tramitación de proyectos.

11.3. Para el monitoreo de los proyectos, el FONAFIFO podrá contratar los servicios externos para este fin, así como para mantener actualizado el Inventario Nacional de Servicios Ambientales y otros productos del bosque. Los involucrados deberán contribuir en este proceso así como implementar las recomendaciones derivadas del mismo.

11.4. El personal Técnico de FONAFIFO y el funcionario (a) de la fiscalía del Colegio de Ingenieros Agrónomos, que regulen a los profesionales involucrados en estos procesos y los funcionarios (as) del SINAC, podrán visitar en cualquier momento el área compensada para corroborar el estado de la misma y la información consignada en las certificaciones.

11.5. Las Oficinas del FONAFIFO deberán mantener los expedientes debidamente foliados, ordenados cronológicamente y con índice actualizado del contenido.

11.6. FONAFIFO llevará una base de datos de los proyectos de PSA en el Sistema de Información Geográfica (SIG) y en el Sistema Integrado de Administración de Proyectos (SIAP).

11.7. El FONAFIFO utilizará en sus visitas de control los formularios de Indicadores diseñados para las modalidades de protección, reforestación y SAF. Los mismos serán anexados a los expedientes respectivos y tendrán el seguimiento correspondiente.

12.-De las obligaciones de los beneficiarios (as). Son obligaciones de los beneficiarios (as) de PSA en las diversas modalidades las siguientes:

12.1. Cumplir con las estipulaciones del contrato, recomendaciones del Regente Forestal o el personal de FONAFIFO en cualquiera de sus modalidades.

12.2. Prevenir y controlar los incendios forestales.

12.3. Mantener fácilmente identificados en el campo los vértices que delimitan el área sujeta a PSA.

12.4. Prevenir y controlar la cacería ilegal y la extracción ilegal de otros productos del bosque.

12.5. No desarrollar actividades agrícolas y/o ganaderas, excepto en los SAF según lo consignado en el Estudio Técnico Certificado respectivo.

12.6. No efectuar acciones de corta y extracción de productos maderables, en los proyectos de protección.

12.7. No realizar actividades que alteren el comportamiento natural del área bajo protección de bosque.

12.8. Comunicar al FONAFIFO cualquier alteración o contingencia que ocasione cambios en el área compensada.

12.9. Permitir el libre acceso del personal del SINAC encargado del control, FONAFIFO, y otros que estos designen, al lugar del área compensada, facilitando su labor.

12.10. Permitir al SINAC realizar labores de investigación y educación ambiental en el área compensada.

12.11. Cumplir con las obligaciones establecidas en la Ley Forestal, sus reglamentos y otras disposiciones aplicables.

12.12. Acatar cualquier recomendación, técnicamente justificada emitida por el SINAC y las emanadas por FONAFIFO, igualmente deberá colaborar en las visitas que FONAFIFO o sus representantes eventualmente realicen a los proyectos PSA.

12.13. En caso de venta del área sujeta a PSA, en forma parcial o total el beneficiario(a) deberá comunicar en un plazo máximo de treinta días a la Oficina Regional de FONAFIFO, la transacción a realizar.

12.14. Ceder al FONAFIFO los derechos por los Servicios Ambientales por un período igual a la vigencia del contrato suscrito.

12.15. Contar con un Regente durante el período de desembolsos.

12.16. Identificar adecuadamente el área sujeta a Pago por Servicios Ambientales, con un rótulo por cada 50 hectáreas como mínimo. Para proyectos presentados en forma conjunta con áreas inferiores a 50 hectáreas por beneficiario(a) se requiere al menos un rótulo por inmueble y en casos de SAF uno por inmueble. Los rótulos deben contener información sobre el nombre del beneficiario, modalidad, número de contrato y área PSA sometida o árboles SAF.

12.17. En la modalidad de árboles forestales en SAF se debe proteger los árboles del ramoneo de los animales.

13.-Devoluciones. Las devoluciones que al efecto realicen los administrados (as) por conceptos como: incumplimiento de contrato, retiros voluntarios cuando procedan, u otros, serán realizados mediante depósito a la cuenta bancaria de FONAFIFO, número 100-01-000-216750-0 a nombre del Fideicomiso 544-1 Pago de Servicios Ambientales BNCR. El beneficiario(a) deberá remitir copia del depósito a FONAFIFO, adjuntado una nota que indique: nombre del beneficiario, número de contrato, área PSA que corresponde al monto del depósito y concepto por devolución. Este monto debe incluir los intereses correspondientes, cuando corresponda, los cuales se calcularán con base en la tasa básica pasiva fijada por el Banco Central a la fecha del pronunciamiento del Área Legal de FONAFIFO, por lo cual, el beneficiario(a) deberá previo al depósito, realizar la consulta del monto a depositar al Área Administrativa de FONAFIFO.

14.-Disposiciones finales 14.1. Los proyectos comprendidos entre los años 1997 y 2006, se regirán por los Decretos Ejecutivos y Manuales respectivos. El seguimiento de los contratos suscritos entre los años 1997 y 2002, corresponderá al Sistema Nacional de Áreas de Conservación (SINAC).

14.2. El FONAFIFO y el SINAC conjunta o individualmente, podrán suspender la aplicación del Pago por Servicios Ambientales, de los proyectos e iniciar las gestiones administrativas y legales correspondientes, para la recuperación de los recursos ya aplicados, cuando se compruebe que hubo incumplimiento del contrato sucrito, de la Ley Forestal, y las demás disposiciones reglamentarias vigentes. Asimismo, iniciará el procedimiento administrativo pertinente a fin de determinar si se cancela o no el contrato forestal, estableciendo las responsabilidades del caso.

14.3. En caso de venta del área sujeta a PSA, en forma parcial o total, el beneficiario(a) deberá comunicar en un plazo máximo de treinta días a la Oficina Regional de FONAFIFO, la transacción a realizar. Posteriormente, el nuevo beneficiario(a) deberá solicitar la modificación del contrato aportando la documentación legal correspondiente, que lo acredita como dueño(a), en un plazo máximo de treinta días posteriores a la transacción. El incumplimiento de esta disposición obliga al FONAFIFO a suspender el pago y abrir el procedimiento administrativo para dar por finalizado el contrato y recobrar los recursos girados cuando corresponda.

14.4. Las áreas de protección establecidas en el artículo 33 de la Ley Forestal Nº 7575, que se encuentren dentro del área sujeta al PSA, estarán comprendidas dentro del área total que recibirá la compensación. Para las áreas de reforestación en áreas de protección, el propietario(a) podrá recuperar las mismas mediante el establecimiento de especies nativas, las cuales recibirán el PSA correspondiente en el entendido que no podrán ser cortadas en el futuro. O en su defecto, se puede considerar la restauración natural y se considera como área efectiva de pago.

14.5. El tratamiento de los terrenos en las Reservas Indígenas deberá ser igual al que se le da al resto de los beneficiarios, no obstante se deben considerar aquellos aspectos particulares, que como Reserva Indígena se presentan. Sin excepción, en todos los casos, los trámites para la aplicación del PSA deberán ser suscritos por el presidente de la Asociación de Desarrollo Indígena, previo acuerdo de Asamblea General de Asociados En caso que la Reserva Indígena no cuente con el respectivo plano catastrado se podrá dar trámite al proyecto utilizando el derrotero que se detalla en el decreto de creación de la Reserva, en cuyo caso el Regente deberá ubicar el área a someter bajo contrato de PSA.

14.6. Las certificaciones emitidas por el Regente Forestal que se requieran para los diferentes trámites deberán haber sido emitidas en fecha reciente no superior a un mes al momento de la presentación a la Oficina Regional del FONAFIFO.

14.7. Las presolicitudes que por limitaciones presupuestarias no fueron tramitadas en el año anterior, serán depositadas en un archivo temporal. Las mismas serán consideradas en el año siguiente, solamente si el interesado así lo manifiesta por escrito a la Oficina Regional respectiva. Sólo se tramitarán presolicitudes entregadas dentro del período establecido en el presente Manual.

14.8. El Fondo Nacional de Financiamiento Forestal, mediante resolución, podrá establecer la suspensión temporal o definitiva del pago por servicios ambientales, cuando existan conflictos de intereses entre poseedores o propietarios, o cuando por razón de procesos de fiscalización o supervisión de proyectos, se encuentren elementos que duden a cerca del área del proyecto, del propietario o poseedor del inmueble u otros elementos de importancia. Igualmente, podrá proceder con la cancelación de los contratos cuando considere que la existencia de esos conflictos o procesos, ponen en riesgo el buen uso de los recursos económicos destinados para tales fines.

14.9. En razón de que el Programa de Pago de Servicios Ambientales es de naturaleza voluntaria, se posibilita el retiro anticipado del mismo a los beneficiarios. Para tales efectos, deberá suscribirse el finiquito correspondiente, y el beneficiario deberá hacer la devolución de los recursos recibidos, más los intereses correspondientes calculados a la tasa básica pasiva. Se exceptúan de esta devolución, aquellos casos de proyectos de protección de bosque donde conste una certificación del Regente de que efectivamente se dio la protección del bosque en los años inmediatos anteriores.

14.10. Los beneficiarios de contratos de Pago de Servicios Ambientales, podrán acogerse a los beneficios establecidos en los Artículos 29 y 36 de la Ley Forestal Nº 7575, para lo cual deberán cumplir con los requisitos establecidos en el Reglamento a la Ley Forestal.

14.11. Si el beneficiario (a) no se presenta a firmar el contrato o se retira del trámite de PSA durante el proceso de afectación de la finca, deberá cancelar mediante Depósito Bancario el monto total del costo de la "Afectación Ley Forestal" si es que ésta ya se hubiese realizado, FONAFIFO por su parte tomará acciones administrativas, legales y económicas cuando corresponda, contra quienes se retiren, ello dado los costos en que se incurrió durante el proceso de incorporación al Programa de PSA.

14.12. En las modalidades de protección de bosque, reforestación y regeneración natural, no se podrá hacer efectivo el primer pago, hasta que la afectación no se encuentre debidamente inscrita en el Registro de la Propiedad o se cuente con el Testimonio de escritura cuando se trate de fincas sin inscribir. El contrato respectivo establecerá un porcentaje del 1% del valor total del contrato, como gastos por concepto de estudios de protocolización del contrato respectivo e inscripción ante el Registro Público. Para fincas sin inscribir el notario deberá elaborar un testimonio del contrato para incorporarlo en el Registro que FONAFIFO llevará para tal fin.

15.-De las afectaciones y desafectaciones. Los costos por afectación, serán del 1% del valor total del contrato para protección regeneración natural y reforestación, monto que será deducido al beneficiario por única vez en el primer pago y será depositado directamente al notario respectivo.

Las afectaciones vencidas, o producto de retiros voluntarios, podrán ser realizados por cualquier notario que el beneficiario(a) decida. Para ello, deberá el notario correspondiente presentar un borrador de la escritura para su aprobación y coordinar la firma de la misma ante el Área de Asesoría Legal de FONAFIFO. En caso que así lo decida el beneficiario(a), podrá utilizar cualquiera de los notarios del FONAFIFO, para ello se pondrá a disposición una lista. En todos los casos, el beneficiario(a) cubre los costos por estos trámites.

También, se cobrará este costo a los beneficiarios (as) que decidan finiquitar el contrato, durante el plazo en que se esté inscribiendo la afectación respectiva ante el Registro Público.

2. Indicar la modalidad y el número de Presolicitud asignado de previo por la Oficina Regional respectiva.

3. Indicar si el área se encuentra en un área silvestre protegida, señalando el nombre de la misma.

4. Se debe incluir el nombre común y científico de las especies a plantar e indicar claramente la especie por área y por cada folio real.

5. El Regente Forestal debe certificar que realizó una evaluación de los factores físico- ambientales, ecológicos y silviculturales para recomendar la (s) especie (s), sitios a plantar y el manejo de la (s) misma (s) y que estas fueron comunicadas por escrito al beneficiario (a).

6. El Regente Forestal debe certificar el origen del material vegetativo mejorado cuando exista o en su defecto el origen del material seleccionado para la plantación.

7. Se deberá localizar y cuantificar las superficies ocupadas por otros usos de la tierra (infraestructura existente, zonas de protección, etc.), siempre y cuando estos se encuentren dentro de los bloques o áreas a plantar.

8. En proyectos de reforestación con otros métodos debe incluirse además de área efectiva, fecha de plantación y porcentaje de sobrevivencia, condiciones fenotípicas de los mejores individuos, en el caso de la especie Gmelina arborea, se certifique material genético adecuado en la plantación original, cosechas certificadas superiores al promedio nacional (más de 100 m3 en la cosecha), certificación que al menos 200 árboles de la primera cosecha fue de clase 1.

9. Para proyectos de regeneración natural con potencial productivo se debe certificar que al menos se encuentren 1240 brinzales de especies comerciales por hectárea o/y 720 latizales comerciales por hectáreas, dependiendo de la edad de iniciado el proceso de regeneración natural, según lo indicado en el Anexo 20. No se cuantificarán en estos tipos de vegetación, los árboles y palmas remanentes de bosque primario ni tocones con rebrotes múltiples La densidad de árboles remanentes no debe sobrepasar los 5 individuos por hectárea. Además de hacer una descripción de las labores de manejo.

10. El plano de la propiedad debe estar georeferenciado con al menos tres puntos ubicados mediante GPS con el datum WGS 84 y en formato grados-decimales (GG.dddd). Dos de estos puntos como mínimo deben ser vértices del plano. Todos los puntos GPS, deben de estar a una distancia no menor a 50 metros entre ellos. (deben indicarse en el croquis, las ubicaciones de los puntos). La información, de los puntos GPS debe estar incluida.

11. Asimismo, cada Estudio Técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área a someter de un punto con coordenadas conocidas, sistema empleado y exactitud del mismo. El croquis del área efectiva PSA, así como el croquis de la totalidad del plano debe entregarse impreso y en digital en formato de Shape files de ArcView, en sistemas de coordenadas Lambert Norte ó Sur, proyección Ocotepeque ó bien en sistemas de coordenadas geográficas, datum WGS 84 y en formato grados decimales (GG. dddd).

Asimismo, cada estudio técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área a someter de 11 punto con coordenadas conocidas, sistema empleado y exactitud del mismo. El croquis del área efectiva PSA, así como el croquis de la totalidad del piano debe entregarse impreso y en digital.

El digital debe de cumplir con:

1. El archivo debe ser en formato Shape files de ArcView, tipt (polígono), no se admitirán otros formatos.

2. El archivo shape debe venir nombrado con el número de solici18 asignado por la oficina regional (ejemplo, SJOI000108).

3. Se debe presentar un solo shape, que incluya en la t.1bla. atributos la cuantificación del área, uso (área PSA, resto de la finca) y el número de plano catastrado cuando sea el caso.

4. El archivo debe presentarse georeferenciado en el sistema.: coordenadas CRTM05 (oficializado mediante el Decreto 33797 MJ-MOPT publicado en La Gaceta 108 del miércoles 6 de junio del 2007) o bien en sistema de coordenadas geográficas. WGS 84 y en formato grados decimales (GG. dddd).

5. Debe ser entregado en un disco compacto (cd).

Las escalas a utilizar para áreas menores a treinta hectáreas de ser 1:5.000 al: 10.000. Para el caso de áreas mayores pueden utilizarse a conveniencia profesional.

(Así reformado el punto anterior por el Fondo Nacional de Financiamiento Forestal y publicado en La Gaceta N° 78 del 23 de abril de 2008).

12. Las escalas a utilizar para áreas superiores a treinta hectáreas deben de ser 1:5.000 a 1:10.000. Para el caso de áreas menores pueden utilizarse a conveniencia profesional.

13. Además, el Estudio deberá elaborarse con base al área legal del terreno, es decir la 'superficie agraria', definiéndose ésta como el área de una porción de terreno determinada por la proyección horizontal de su perímetro.

14. Manifestación expresa de la existencia de otros contratos de PSA vigentes sobre la misma finca, indicando el área, ubicación y cabida de los contratos.

15. En inmuebles sobre los que existan contratos de arrendamientos, debe certificarse que las áreas PSA están excluidas de las áreas en arriendo, esto en caso de que sea el propietario del inmueble que solicita el ingreso al PSA. Caso contrario, certificar que los arriendos corresponden efectivamente a áreas PSA solicitados por los arrendatarios.

16. Solo se admitirán Estudios Técnicos que se refieran a planos cuyos desplazamientos en la ubicación cartográfica no superen los 500 metros, con respecto a lo indicado en el plano y la ubicación real de la finca. En los casos que supere los 500 metros se deberá adjuntar una certificación emitida por un topógrafo colegiado que indique la ubicación correcta del plano.

17. Los Estudios Técnicos deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

Nota: Instalación de letreros preventivos, El rótulo debe de contener la siguiente información: nombre del beneficiario(a), modalidad, área PSA sometida y número de contrato forestal.

INSTRUCTIVO PARA ELABORAR LAS CERTIFICACIONES DE SEGUIMIENTO PARA LOS PROYECTOS PSA DE REFORESTACIÓN El Regente Forestal debe certificar el estado de la plantación utilizando el siguiente instrumento, al momento de establecer la plantación y para tramitar los pagos correspondientes a los 12, 36, 60, 84 y 120 meses de la fecha promedio de plantación:

7. A excepción del año de establecimiento de la plantación, en las certificaciones posteriores se deben de presentar los datos de diámetro a la altura de pecho (dap) de los árboles de las parcelas y su respectivo coeficiente de variación.

8. Para el trámite de los pagos a los 24, 48, 72, 96 y 108 meses de la fecha promedio de establecimiento de la plantación, el Regente Forestal solamente deberá certificar las labores silviculturales realizadas, el estado fitosanitario de la plantación, las labores de control de incendios, rotulación, fecha promedio de plantación y cualquier anomalía detectada. En estas certificaciones agregar los aspectos indicados en los puntos 1 y 2 de este anexo.

9. En todos los casos, las Certificaciones deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

4. Para proyectos de protección de bosque, no se deberán detallar las áreas de protección, debido a que estas forman parte del área sujeta al PSA. Únicamente, será necesario cuantificar y deducir del área efectiva las áreas ocupadas por caminos primarios y patios de acopio e indicar la ubicación de áreas sujetas a contratos PSA anteriores vigentes. En el caso de espejos de agua (embalses o lagunas sin vegetación) que sobrepasen una hectárea, los mismos deberán considerarse y excluirse del área a compensar.

5. En sitios en vías de regeneración natural, debe certificarse el estado de la vegetación existente en el sitio y edad estimada de abandono.

6. El plano de la propiedad debe estar georeferenciado con al menos tres puntos ubicados mediante GPS con el datum WGS 84 y en formato grados-decimales (GG.dddd). Dos de estos puntos como mínimo deben ser vértices del plano. Todos los puntos GPS, deben de estar a una distancia no menor a 50 metros entre ellos. (deben indicarse en el croquis, las ubicaciones de los puntos). La información, de los puntos GPS debe estar incluida.

7. Asimismo, cada Estudio Técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área a someter de un punto con coordenadas conocidas, sistema empleado y exactitud del mismo. El croquis del área efectiva PSA, así como el croquis de la totalidad del plano debe entregarse impreso y en digital en formato de Shape files de ArcView, en sistemas de coordenadas Lambert Norte ó Sur, proyección Ocotepeque ó bien en sistemas de coordenadas geográficas, datum WGS 84 y en formato grados decimales (GG. dddd).

Asimismo, cada estudio técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área a someter de 11 punto con coordenadas conocidas, sistema empleado y exactitud del mismo. El croquis del área efectiva PSA, así como el croquis de la totalidad del piano debe entregarse impreso y en digital.

El digital debe de cumplir con:

1. El archivo debe ser en formato Shape files de ArcView, tipt (polígono), no se admitirán otros formatos.

2. El archivo shape debe venir nombrado con el número de solici18 asignado por la oficina regional (ejemplo, SJOI000108).

3. Se debe presentar un solo shape, que incluya en la t.1bla. atributos la cuantificación del área, uso (área PSA, resto de la finca) y el número de plano catastrado cuando sea el caso.

4. El archivo debe presentarse georeferenciado en el sistema.: coordenadas CRTM05 (oficializado mediante el Decreto 33797 MJ-MOPT publicado en La Gaceta 108 del miércoles 6 de junio del 2007) o bien en sistema de coordenadas geográficas. WGS 84 y en formato grados decimales (GG. dddd).

5. Debe ser entregado en un disco compacto (cd).

Las escalas a utilizar para áreas menores a treinta hectáreas de ser 1:5.000 al: 10.000. Para el caso de áreas mayores pueden utilizarse a conveniencia profesional.

(Así reformado el punto anterior por el Fondo Nacional de Financiamiento Forestal y publicado en La Gaceta N° 78 del 23 de abril de 2008).

8. Las escalas a utilizar para áreas superiores a treinta hectáreas deben de ser 1:5.000 a 1:10.000. Para el caso de áreas menores pueden utilizarse a conveniencia profesional.

9. Además, el Estudio deberá elaborarse con base al área legal del terreno, es decir la 'superficie agraria', definiéndose ésta como el área de una porción de terreno determinada por la proyección horizontal de su perímetro.

10. Manifestación expresa de la existencia de otros contratos de PSA vigentes indicando el área, ubicación y certificando la cabida de los contratos.

11. En caso de fincas en posesión o contratos por año vencido, el Regente debe certificar que el bosque fue protegido en los últimos doce meses.

12. En inmuebles con arrendamientos debe certificarse que las áreas PSA están excluidas de las áreas en arriendo, esto en caso de que sea el propietario del inmueble que solicita el ingreso al PSA. Caso contrario, certificar que los arriendos corresponden efectivamente a áreas PSA solicitados por los arrendatarios.

13. Solo se admitirán Estudios Técnicos Certificados que se refieran a planos cuyos desplazamientos en la ubicación cartográfica no superen los 500 metros, con respecto a lo indicado en el plano y la ubicación real de la finca. En los casos que supere los 500 metros se deberá adjuntar una certificación emitida por un topógrafo colegiado que indique la ubicación correcta del plano.

14. En todos los casos, los Estudios Técnicos Certificados deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

Nota: Instalación de letreros preventivos, el rótulo debe de contener la siguiente información: nombre del beneficiario(a), modalidad, área PSA sometida y número de contrato forestal.

INSTRUCTIVO PARA ELABORAR LAS CERTIFICACIONES DE SEGUIMIENTO PARA LOS PROYECTOS PSA DE PROTECCIÓN DE BOSQUE Y PROYECTOS DE REGENERACION NATURAL Para el trámite de los pagos a los 12, 24, 36 y 48 meses de firma del contrato, el Regente Forestal debe presentar la certificación considerando los siguientes aspectos:

El suscrito ____________, Nº colegiado ______, En mi calidad de Regente Forestal, con póliza de fidelidad Nº ______, amparado a la Ley Forestal, su reglamentación, sus modificaciones y la normativa vigente. Certifico el estado del bosque o de la regeneración natural de acuerdo a los siguientes criterios.

1. Indicar el nombre del propietario, folio real y área efectiva de PSA.

2. Agregar el número de contrato PSA y el número de cuota respectiva.

3. Indicar las acciones realizadas para evitar la cacería, tala e incendios forestales, rotulación e informar de cualquier anomalía detectada.

4. Para los pagos posteriores, el Regente Forestal debe certificar el estado del bosque o del estado de la regeneración natural existente.

5. En caso de fincas en posesión o contratos por año vencido, el Regente debe certificar que el bosque fue protegido en los últimos doce meses.

6. En todos los casos, las Certificaciones deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

INSTRUCTIVO PARA ELABORAR LOS ESTUDIOS TÉCNICOS PARA LOS PROYECTOS PSA EN SISTEMAS AGROFORESTALES (SAF) El suscrito ____________, Nº colegiado ______, En mi calidad de Regente Forestal, con póliza de fidelidad Nº ______, amparado a la Ley Forestal, su reglamentación, sus modificaciones y la normativa vigente.

Certifico el contenido del siguiente Estudio Técnico:

1. Nombre de beneficiarios (as), números de cédula, folio (s) real (es), número(s) de plano, área (s) total (es) de folio (s), uso actual, ubicación administrativa, la dirección exacta de la (s) finca (s) y los colindantes encontrados en el campo.

2. Indicar si el área se encuentra en un área silvestre protegida, señalando el nombre de la misma.

3. Indicar la modalidad y el número de Presolicitud asignado de previo por la Oficina Regional respectiva.

4. Se debe incluir el nombre común y científico de las especies a plantar e indicar claramente la cantidad de árboles por especie y por cada folio real del contrato.

5. El Regente Forestal debe certificar que realizó una evaluación de los factores físico- ambientales, ecológicos y silviculturales para recomendar la (s) especie (s), sitios a plantar y el manejo de la (s) misma (s) y que las mismas fueron comunicadas por escrito al beneficiario (a).

6. El Regente Forestal debe certificar el origen del material vegetativo a plantar en el proyecto.

7. El plano de la propiedad debe estar georeferenciado con al menos tres puntos ubicados mediante GPS con el datum WGS 84 y en formato grados-decimales (GG.dddd). Dos de estos puntos como mínimo deben ser vértices del plano. Todos los puntos GPS, deben de estar a una distancia no menor a 50 metros entre ellos. (deben indicarse en el croquis, las ubicaciones de los puntos). La información, de los puntos GPS debe estar incluida.

8. Asimismo, cada Estudio Técnico debe contener el croquis del área de los arreglos a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área del arreglo a someter de un punto con coordenadas conocidas, sistema empleado y exactitud del mismo. El croquis del área efectiva PSA de l arreglo, así como el croquis de la totalidad del plano debe entregarse impreso y en digital en formato de Shape files de ArcView, en sistemas de coordenadas Lambert Norte ó Sur, proyección Ocotepeque ó bien en sistemas de coordenadas geográficas, datum WGS 84 y en formato grados decimales (GG.dddd).

Asimismo, cada estudio técnico debe contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, además debe amarrarse el punto de inicio (punto 1) del área a someter de 11 punto con coordenadas conocidas, sistema empleado y exactitud del mismo. INSTRUCTIVO PARA ELABORAR LAS CERTIFICACIONES DE SEGUIMIENTO PARA LOS PROYECTOS PSA EN SISTEMAS AGROFORESTALES Para el trámite del primer pago una vez establecido el SAF y para los pagos a los 24 y 36 meses de la fecha promedio de establecimiento el Regente Forestal debe presentar la certificación indicando:

2. Agregar el número de contrato PSA y el número de cuota respectiva.

3. Indicar el total de árboles sobrevivientes, por especie, tipo de arreglo, estado fitosanitario, rotulación, mes y fecha promedio del establecimiento del SAF.

4. Las Certificaciones deben ser elaborados en papel de seguridad, contener el nombre, número de colegiado y firma del profesional responsable, la fecha de elaboración y con los timbres respectivos.

SEGUNDA: "EL BENEFICIARIO ", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual a la vigencia de este contrato los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de ___________ (protección, reforestación, regeneración) . Como contraprestación por la _________________, y la cesión señalada, el FONAFIFO pagará la suma de _____ dólares por hectárea por año, distribuidas según Decreto Ejecutivo N° 32750- MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental. El primer desembolso se girará una vez que el Regente Forestal presente a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el contrato de regencia debidamente inscrito, en los años subsiguientes el Regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense del Seguro Social.

TERCERA: Como afectación voluntaria a la propiedad "El Beneficiario" acepta mantener durante cinco años a partir de su vigencia, afectada dicha propiedad con las limitaciones y obligaciones establecidas en este contrato, para lo cual autoriza al FONAFIFO la protocolización de lo conducente de este contrato, a fin de que se inscriba en el Registro Público como una limitación de la propiedad, así como deducir el 1% del monto total del contrato, para tales efectos.

CUARTA: "EL BENEFICIARIO" se compromete a: a) Proteger el bosque, la cobertura vegetal o los procesos de regeneración, del área comprendida en este contrato, y por ende no cortar árboles, o cualquier tipo de vegetación. b) Contar con un Regente Forestal, debidamente colegiado, responsable de la ejecución técnica durante la vigencia del contrato, c) Prevenir y controlar los incendios forestales. d) Prevenir y evitar la cacería ilegal y la extracción ilegal de otros productos del bosque, e) No desarrollar actividades agrícolas y/o ganaderas, f) No efectuar acciones de corta y extracción de productos maderables, g) No realizar ninguna actividad que altere el comportamiento natural del área a proteger, h) Comunicar al MINAE, cualquier alteración o contingencia que ocasione cambios en el área protegida, i) Permitir el libre acceso del personal de MINAE, FONAFIFO, encargado de control, al lugar del área sujeta al PSA facilitando su labor, j) Ceder al Fondo Nacional de Financiamiento Forestal los servicios ambientales, generados por su bosque. k-) Acatar cualquier recomendación técnica emitida por el MINAE o el Regente, en forma escrita.

QUINTA: Cualquier venta total, parcial, cesión o enajenación del inmueble objeto de este contrato, deberá ser comunicado de previo al Fondo Nacional de Financiamiento Forestal. La venta obliga en iguales términos al nuevo dueño o adquirente, salvo que éste desee devolver el monto proporcional pagado por FONAFIFO. En cuyo caso procederá el finiquito correspondiente.

SEXTA: FONAFIFO queda expresamente facultado a comercializar de cualquier forma y a cualquier persona física, jurídica, nacional o internacional los derechos cedidos.

SÉTIMA: El incumplimiento por parte de "EL BENEFICIARIO" de cualquiera de sus obligaciones establecidas en este contrato, en la Ley Forestal, en su Reglamento, dará por finalizado el presente contrato en forma automática y autoriza al FONAFIFO a suspender total o parcialmente los pagos pendientes y a solicitar el reintegro de los pagos otorgados, sus intereses y en general los daños y perjuicios ocasionados, renunciando expresamente en este supuesto a su domicilio. Las partes podrán dar por finalizado el presente contrato de mutuo acuerdo, para ello el FONAFIFO reconocerá como servicios prestados los años de protección pagados al beneficiario.

ARREGLOS Y LISTA DE ESPECIES FORESTALES ACEPTADAS PARA EL ESTABLECIMIENTO DE ÁRBOLES FORESTALES EN SAF El número máximo de árboles por hectárea y/o kilómetro para SAF por establecer, será como se describe:

.Árboles maderables en cultivos perennes entre 40 y 250 árboles/ha, de las especies: laurel (Cordia alliodora), cedro (Cedrela spp), caoba (Swietenia macrophylla), eucalipto (Eucalyptus spp.), jaúl (Alnus acuminata), amarillón (Terminalia amazonia), Ronron (Astronium graveolens), Pilón (Hyeronima alchornoides), Melina (Gmelina arborea), Gallinazo (Schizolobium parahyba), Espavel (Anacardium excelsum), Guayacán (Tabebuia guajava), Indio desnudo (Bursera simarouba), Pochote (Bombacopsis quinata), cebo (Vochysia guatemalensis o hondurensis) y botarrama (Vochysia ferruginea).

.Árboles de uso múltiple en cultivos perennes entre 40 y 277 árboles por hectárea, de las especies: poró (Erythrina spp.), guaba (Inga spp.), madero negro (Gliricidia sepium), Leucaena (Leucaena leucocephala).

.Árboles maderables en hilera entre 333 y 500 árboles por km. De las especies: las mismas que se recomiendan para plantaciones en bloque.

.Árboles de Uso Múltiple en hilera entre 333 y 500 árboles por km.

Solo para Sistemas Silvopastoriles.

.Cortinas rompevientos entre 666 y 1.000 árboles por km. Especies: Estrato alto: eucalipto (Eucalyptus spp.), casuarina (Casuarina spp.), ciprés (Cupressus lusitanica), papa (Panopsis suaveolens), Pino (Pinnus spp).

.Estrato medio: manzana de agua (Eugenia malaccensis), cirrí (Tapiria brenesii), cirrí colorado (Mosquitoxylon jamaicense), guachipelín (Diphysa robinioides), limoncillo (Randia armata), cucaracho (Billia colombiana), níspero (Prunus annularis), murta (Ardisia compresa), manzana rosa (Eugenia jambos), colpachí (Croton niveus).

.Estrato bajo: manzana rosa (E. jambos), colpachí (C. niveus), uruca (Trichilia glabra), tubú (Montanoa dumicola), trueno (Ligustrum lucidum).

.Plantaciones en bloque de menos de una hectárea, el equivalente entre (625 y 1.111 árboles por hectárea). Como máximo tres bloques por beneficiario(a) por año, con especies maderables.

.Los arreglos SAF no deben superar los doce meses anteriores a la firma del contrato, esto para garantizar una resiembra en el caso de que el porcentaje de mortalidad sea superior al 10%.

.Los arreglos en cultivos perennes corresponden a café, cacao, plátano, cítricos, palmito, palma aceitera y pastos.

.El Regente debe certificar que el área a someter en PSA-SAF es suficiente para el número de árboles y arreglo recomendado.

En todos los casos, las especies utilizadas deberán adaptarse a las condiciones específicas del sitio y del SAF, así como recibir un manejo silvicultural adecuado y protección del ganado cuando así lo requieran. Se pueden utilizar otras especies forestales, siempre y cuando se adapten al sitio según sus condiciones biológicas y ecológicas.

CONVENIO DE COOPERACION FONDO NACIONAL DE FINANCIAMIENTO FORESTAL Y LAS ORGANIZACIONES Nosotros, el señor Jorge Mario Rodríguez Zúñiga, mayor, casado una vez, ingeniero agrónomo, cédula uno - quinientos cuarenta y cinco setecientos siete, vecino de Sabanillas de Montes de Oca, en su condición de Director Ejecutivo del Fondo Nacional de Financiamiento Forestal, con facultades de apoderado general debidamente facultado para este acto según consta en el Registro de Personas Jurídicas del Registro Público, bajo las citas de inscripción: quinientos treinta y cuatro - mil ochocientos setenta y nueve - uno - dos, cédula Jurídica tres- cero cero siete - dos cero cuatro siete dos cuatro, en adelante denominado FONAFIFO y (Nombre del representante legal, calidades, cédula, nombre de la Organización, cédula jurídica), según consta, por el Departamento de Organizaciones Sociales del Ministerio de Trabajo y Seguridad Social, y de conformidad con el Acuerdo No del Consejo de Administración de fecha del en adelante denominada LA ORGANIZACIÓN, con fundamento en la ley forestal, su reglamento y el Manual de procedimientos administrativos, así como el buen desempeño en la organización en labores similares en el pasado, acordamos celebrar el presente convenio de cooperación el cual se regirá por las siguientes cláusulas:

PRIMERA: La organización se compromete a brindar asesoría técnica y seguimiento a los productores beneficiarios (as) de proyectos de PSA, en la modalidad de Protección de Bosque y Reforestación, Sistemas Agroforestales y Regeneración Natural.

SEGUNDA: Son obligaciones de la Organización:

a- Brindar los servicios de regencia y de asesoría técnica en la ejecución de los proyectos PSA.

b- Suscribir contratos individuales con los beneficiarios (as) del Programa de PSA, en donde se regulen las relaciones particulares con los beneficiarios (as). En estos contratos se establecerán los montos por los honorarios por los servicios brindados, la periodicidad de la asistencia técnica, entre otras.

c- Gestionar el cobro y su posterior entrega a cada beneficiario(a), de los recursos que le corresponden, para ello deberá canalizar dichos recursos en una cuenta corriente exclusiva para administrar los recursos que FONAFIFO le transfiera por PSA.

d- Comprometerse a girar los recursos a los beneficiarios (as) de PSA, como máximo 15 días naturales después de que se giren por parte de FONAFIFO, esto si no ha existido ninguna situación irregular.

e- Colaborar con el FONAFIFO en las labores de supervisión de los proyectos de PSA a su cargo y supervisión técnica, durante la vigencia de este convenio. La Organización deberá comunicar en forma inmediata cualquier situación irregular derivada de los Contratos PSA.

TERCERA: La organización por su participación, cobrará al beneficiario un monto que no podrá ser superior al 18% de cada desembolso.

CUARTA: El FONAFIFO se compromete a pagar a los beneficiarios (as) a través de la inmediación de la organización, por haberlo así estipulado estos en los contratos de PSA. No obstante, cuando por mutuo acuerdo se establezca o la organización desaparezca o se compruebe falta grave en sus obligaciones, mediante un procedimiento administrativo, el FONAFIFO podrá suspender parcial o totalmente los pagos a la organización y girar en forma directa al beneficiario(a). La organización, renuncia de antemano a cualquier reclamo derivada por la aplicación de esta cláusula.

QUINTA: Este Convenio tiene un plazo de duración de cinco años, a partir del su firma.

SEXTA: Cualquier conflicto presentado en la ejecución o aplicación de este convenio será resuelta bajo los principios de buena fe y cooperación mutua, pero teniendo en cuenta siempre la viabilidad y ejecución de los proyectos de PSA, suscrito con los beneficiarios (as).

SÉTIMA: La organización no será responsable de la ejecución o incumplimiento de los proyectos, salvo que conociendo de irregularidades no las manifestare oportunamente.

OCTAVA: Para efectos fiscales este convenio es de carácter inestimable.

LISTA DE ESPECIES FORESTALES ACEPTADAS EN SITIOS EN VÍAS DE RECUPERACIÓN

Así como regeneración natural de palmas silvestres, y especies incluidas en los Decretos de vedas y especies amenazas en vías de extinción Nº 25663-MINAE y Nº 25700-MINAE u otras especies forestales que el Regente Forestal recomiende técnicamente.

La definición de los tipos de vegetación para evaluar sitios en vías de recuperación de bosque, se indica a continuación:

.Brinzal comercial, plántula de especie forestal con altura mayor a 30 cm, pero con altura menor a 1.5 metro hasta el brote.
