Therefore, IT IS AGREED To approve the following Regulation:

REGULATION FOR THE REGULATION AND CONTROL OF THE USE OF PREFERENTIAL-PRICE FUEL, DESTINED FOR THE NATIONAL TOURIST FISHING FLEET

General Provisions

A- ARESEP: Public Services Regulatory Authority.

B- Competent Authorities: ICT, ARESEP, MINAE, TAX POLICE, RECOPE, National Coast Guard Service, Public Force Delegates, Port Captaincies of the General Directorate of Maritime Transport of the Ministry of Public Works and Transport, Fuel Control and Administration Section (SCAC), Directorates, Regional and Subregional Offices of INCOPESCA C- Beneficiary: Individual or legal entity with a valid tourist fishing license, who requests preferential-price fuel personally or through a special power of attorney (poder especial), as established in this Regulation.

D- Catch: Quantity of fish caught, exclusively for sport, recreation, tourism, or hobby purposes, so its commercialization shall not be permitted under any circumstances.

E- Fuel: Refers to the fuel (gasoline, regular and diesel) used by vessels with a tourist fishing license.

F- Reconciliation: Matching balances of fuel liters authorized at a preferential price by INCOPESCA through purchase orders, with those liters sold and invoiced by RECOPE in the same period.

G- Contracts: Documents containing the different clauses expressing the conditions to which the beneficiaries, the Fishing Organizations, and INCOPESCA are bound with regard to the fuel recommended at a preferential price.

H- Fishing Days: Period of time dedicated to the fishing day, which covers from the departure from its port of operation to its return, given as an average of 9 hours per day.

I- Tourist Fishing Vessels: national vessels owned by individuals or legal entities, to provide for-profit services to those users who wish to engage in tourist fishing.

J- Conversion Factor: Corresponds to the value required to convert the horsepower (Hp) to kilowatts (Kw) of the propulsion engines of the vessels. Said conversion factor is equal to 0.7453.

K- National Tourist Fishing Fleet: Set of national vessels with a valid fishing license, used for the tourist fishing established in the Fisheries and Aquaculture Law Nº 8436.

L- Travel Hours: Hours of absence elapsed from the departure of the vessel to the end of the fishing trip.

M- INCOPESCA: Costa Rican Institute of Fisheries and Aquaculture.

N- Fishing Organizations: bodies formed by fishers and related activities, such as associations, cooperatives, and unions, with valid legal status and duly accredited before INCOPESCA.

O- Tourist Fishing Organizations: bodies formed exclusively by individuals or legal entities, administrators or owners of vessels with a valid tourist fishing license, including their crew.

P- Tourist Fishing: Fishing activity carried out by national or foreign individuals, for the purpose of catching, with personal fishing tackle appropriate for the purpose, aquatic fishery resources in continental or jurisdictional waters or in the Exclusive Economic Zone, for commercial purposes and exclusively tourist purposes, carried out on a permanent basis.

Q- Port: Place of departure or arrival of fishing vessels.

R- Home Port of Operation: Port chosen by the permit holder to regularly provision their vessel.

S- RECOPE: Costa Rican Petroleum Refinery S. A.

T- Fuel Control and Administration Section (SCAC): INCOPESCA unit responsible for the Administration, Supervision, and Control of the efficient use of the fuel recommended at a preferential price.

U- Special Power of Attorney: Individuals or legal entities duly authorized by the beneficiary, appointed through a duly registered notarial document.

Article Nº 45 of Law Nº 7384, of March 16, 1994, and Article Nº 123 of Law Nº 8436 of April 25, 2005, RECOPE shall sell fuel (gasoline, regular and diesel) to the national fishing fleet, except for the sport fishing activity, at a price competitive with the international price.

On the Powers, Obligations, and Responsibilities of the Fuel Control and Administration

For such purposes, said offices must comply with the guidelines that, in matters within its competence, the SCAC Head Office in Puntarenas dictates.

• a)Authorize the sale of fuel at a price competitive with the international price according to Law Nº 8436 and Law Nº 7384, for the National Tourist Fishing Fleet in accordance with current legislation.
• b)Reduce or suspend benefits individually or generally, in compliance with agreements issued by the Board of Directors of INCOPESCA on this matter or any other established legal provision or the regulations derived from the Contracts signed for these purposes.
• c)Maintain physical manual files for each beneficiary vessel, with the following information:

- Individual special power of attorney (poder especial) of the beneficiary through which they authorize a third party, to carry out the fuel procedure on their behalf.

- All documents or requirements established in Article 5 of this Regulation.

• d)Carry out quarterly reconciliations between the Purchase Orders issued by INCOPESCA and the Purchase Orders made effective at the RECOPE distribution facilities nationwide, through a Commission comprised of the Head of the SCAC in Puntarenas, an official from the Information Technology Unit, and an official from the Accounting Section of INCOPESCA.
• e)Carry out reconciliations between the number of liters authorized by INCOPESCA and those effectively delivered to the permit holders through organizations, service stations, and other duly authorized storage and distribution centers.
• f)Receive and resolve, in the first instance, complaints regarding the correct application of this Regulation and other provisions established for the rational enjoyment of the benefits created by Law.
• g)For the purpose of verifying the normative provisions of this Regulation issued to guarantee the correct and efficient use of fuel, the officials of the SCAC or the persons it designates, by reason of their investiture, shall be empowered to carry out, at places and times they deem appropriate, the inspections and studies necessary on all those subjects who enjoy the benefit of preferential-price fuel.

The fuel transporters may be supervised by the Tax Police of the Ministry of Finance, according to the agreement that said Ministry signs with INCOPESCA.

• h)Any others conferred by the Board of Directors of INCOPESCA through express agreement.

On the Submission of Applications and Requirements

• a)Fuel application form with one copy duly signed by the beneficiary or duly authorized special agent, as established in this regulation (Anexo 1).
• b)A copy or photocopy of the Customer Service Sales Invoice.

These invoices must comply with the regulations established by the Ministry of Finance for these purposes.

• c)A copy or photocopy of the Fishing Trip(s) Report(s) in accordance with the stipulations established by INCOPESCA for these purposes (Anexo 2).
• d)A copy or photocopy of the Fuel Purchase Invoice(s) (Cash or Credit), from the previous fishing trip(s), issued as appropriate by RECOPE, a Service Station, duly authorized Storage and Distribution Centers, or by a Fishing Organization with its own or leased tanks for storing preferential-price fuel, which must bear the canceled stamp and the stamp of the Fishing Organization whose Code was used to make effective the Preferential-Price Fuel Purchase Order issued by INCOPESCA. Said invoice must include the detail of the cost for the price to RECOPE, haulage, storage, pumping or profit margin, and the fee charged by the Fishing Organization.
• e)A copy or photocopy of the previous Preferential-Price Fuel Purchase Order with the RECOPE stamp as sufficient proof that it was made effective.
• f)A copy or photocopy of the Expenditure Control Slip at the Service Station, duly authorized Storage and Distribution Centers, Fishing Organizations with their own or leased tanks, and/or in the vessel's own tanks, signed by the beneficiary or duly authorized person for each withdrawal (Anexo 3).
• g)Catch Data Registration Form per fishing trip, in accordance with the stipulations of INCOPESCA (Anexo 4).

• j)Individual or legal entity beneficiaries must be up to date in their obligations with the CCSS and demonstrate this by means of a suitable document issued by the CCSS, on a one-time basis.

In those cases where the application for preferential-price fuel is rejected, whether due to non-compliance with any of the established documents or requirements, because the information is incomplete, illegible, with erasures or smudges that cast doubt on its veracity, or because another document had to be requested, it shall be returned to the interested party. The beneficiary must be prevented, for a single time and in writing, that they are granted up to 10 business days in accordance with Law Nº 8220, to complete or correct what is necessary.

Once the previous period has elapsed without action by the administered party, the application shall lapse by operation of law.

However, in those cases where they must disembark at a port different from their base of operation, the procedure may be carried out at the nearest INCOPESCA office to that location, in which case the officials of this Institution shall follow the guidelines established for these purposes.

On the Authorization and Allocation of Preferential-Price Fuel

The issuance date of the fuel invoice must be on or after the same date on which the Preferential-Price Fuel Purchase Order for the fishing trip(s) being liquidated was issued by INCOPESCA, unless the beneficiary had a fuel credit balance in their favor, which allowed them to start a fishing trip without the fuel consumed on the previous trip(s) having been authorized.

Only the fuel expenditure for one propulsion engine shall be recognized, even when the vessels use two engines, previously registered with INCOPESCA, applying the corresponding calculation for only one of the engines. However, when for reasons of a technical nature, such as the vessel's own design and others duly demonstrated to INCOPESCA, the vessel requires the use of two stationary propulsion engines, the fuel expenditure for a maximum of two stationary propulsion engines may be recognized upon prior express authorization from the Head of the Fuel Control and Administration Section or the Regional Directors or Heads, in which case the recognition may not exceed 250 Hp for gasoline and 1450 Hp for diesel.

Regardless of the quantity that said model yields, the liters that INCOPESCA will finally authorize shall be those that the beneficiary acquired in accordance with the Fuel Invoice(s) that were presented with the application.

If, in accordance with the presented Fuel Invoice(s), the quantity the beneficiary acquired is greater than that resulting from the application of the corresponding model, the SCAC may only authorize the maximum quantity indicated by that model.

If for some reason the beneficiary acquired additional fuel at the price established by ARESEP for the final consumer at service stations, the SCAC may authorize it provided the beneficiary provides the respective invoice and the application of the model permits it. Otherwise, it may not authorize it, or it may authorize it up to the maximum quantity indicated by said model.

On the Preferential-Price Fuel Purchase Orders

• a)Purchase Order Number.
• b)File Number.
• c)Name of the Vessel.
• d)Fishing License and Registration Number.
• e)Name of the Permit Holder.
• f)Type of Fuel.
• g)Quantity in Numbers of the authorized fuel liters.
• h)Quantity in Words of the authorized fuel liters.
• i)Name and Signature of the official who prepares the Purchase Order.
• j)Signature of the official who approves the Purchase Order.

k. Signature of the official who delivers the Purchase Order.

• l)Signature, date, and Identity or Residence Card Number of the person receiving the Purchase Order.
• m)Stamp of the Fuel Control and Administration Section (SCAC).
• n)Date of Issuance and Expiration Date of the Purchase Order.

Once its validity period has expired without it having been made effective, it shall lapse by operation of law.

However, in exceptional cases, upon a maximum period of 10 business days counted from the expiration date, the Head of the SCAC may issue a new Fuel Purchase Order for an equal period.

On the Powers, Obligations, and Responsibilities of the Beneficiaries

It shall be essential for obtaining preferential-price fuel that the respective Organization, company, or permit holder "direct clients" have the RECOPE Code for fuel acquisition.

Each beneficiary may process the preferential-price fuel procedure through the Fishing Organizations duly accredited before INCOPESCA, for which this Institution and the respective Organization shall sign a Contract regulating said procedure and which shall have a maximum validity of four years.

For the foregoing purposes, the Fishing Organization must, prior to signing the Contract, comply with the following requirements:

• a)Provide a certified photocopy of the Articles of Incorporation.
• b)Provide a Certification of Legal Status, issued no more than one month prior.
• c)Provide a certified photocopy of the valid identity or Residence card of the Legal Representative.

After signing the agreement entered into with INCOPESCA, they must provide a photocopy of the Contract entered into with RECOPE.

Said procedure must be submitted to INCOPESCA within the first twenty business days from the date of arrival from the last fishing trip(s) to the home port of operation. Otherwise, it shall lapse by operation of law.

At the beneficiary's procedure, the SCAC shall record the submission of the application and shall be empowered to issue the Preferential-Price Fuel Purchase Order when the interested party so requests again in writing.

In this case, the SCAC shall be empowered to issue a Preferential-Price Fuel Purchase Order, as a result of two fuel applications.

The SCAC shall record said situation and shall proceed to issue it once the interested party so requests.

If this is not done, the order for no reason may be issued again or revalidated, and it shall lapse by operation of law.

If this is not done, INCOPESCA shall not issue a new order in favor of said beneficiary, unless their procedure is carried out as if it were the first time, in which case they will have had to have acquired the fuel at the price established by ARESEP for the final consumer in the service stations.

Por tanto, SE ACUERDA Aprobar el siguiente Reglamento:

REGLAMENTO PARA LA REGULACIÓN Y CONTROL DEL USO DEL COMBUSTIBLE A PRECIO PREFERENCIAL, DESTINADO A LA FLOTA PESQUERA TURÍSTICA NACIONAL

A- ARESEP: Autoridad Reguladora de los Servicios Públicos.

B- Autoridades Competentes: ICT, ARESEP, MINAE, POLICIA FISCAL, RECOPE, Servicio Nacional de Guardacostas, Delegados de la Fuerza Pública, Capitanías de Puerto de la Dirección General de Transporte Marítimo del Ministerio de Obras Públicas y Transporte, Sección de Control y Administración de Combustible (SCAC), Direcciones, Oficinas Regionales y Subregionales del INCOPESCA C- Beneficiario: Persona física o jurídica con licencia de pesca turística vigente, que solicite en forma personal o a través de poder especial combustible a precio preferencial, según lo establece el presente Reglamento.

D- Captura: Cantidad de peces capturados, exclusivamente con propósitos de deporte, recreo, turismo o pasatiempo, por lo que bajo ninguna circunstancia se permitirá su comercialización.

E- Combustible: Refiérase al combustible (gasolina, regular y diesel) que utilizan las embarcaciones con licencia de pesca turística.

F- Conciliación: Igualar saldos de los litros de combustible autorizados a precio preferencial por el INCOPESCA mediante órdenes de compra, con aquellos litros vendidos y facturados por RECOPE en un mismo período.

G- Contratos: Documentos en los cuales constan las diferentes cláusulas en donde se expresan las condiciones a las que los beneficiarios, las Organizaciones Pesqueras y el INCOPESCA quedan obligados con relación al combustible que se recomienda a precio preferencial.

H- Días de Pesca: Período de tiempo destinado a la jornada de pesca, el cual comprende desde la salida de su puerto de operación hasta su regreso, dado en un promedio de 9 horas diarias.

I- Embarcaciones de Pesca Turística: embarcaciones nacionales propiedad de personas físicas o jurídicas, para proveer servicios con fines de lucro, a aquellos usuarios que deseen dedicarse a la pesca turística.

J- Factor de conversión: Corresponde al valor requerido para convertir los caballos de fuerza (Hp) a kilovatios (Kw) de los motores propulsores de las embarcaciones. Dicho factor de conversión es igual a 0.7453.

K- Flota Pesquera Turística: Conjunto de embarcaciones nacionales con licencia de pesca vigente, utilizadas para la pesca turística establecida en la Ley de Pesca y Acuicultura Nº 8436.

L- Horas de viaje: horas de ausencia transcurridas desde la partida de la embarcación hasta el final del viaje de pesca.

M- INCOPESCA: Instituto Costarricense de Pesca y Acuicultura.

N- Organizaciones Pesqueras: órganos conformados por pescadores y actividades afines, tales como asociaciones, cooperativas y sindicatos, con personería jurídica vigente y debidamente acreditadas ante el INCOPESCA.

O- Organizaciones Pesqueras Turísticas: órganos conformados exclusivamente por personas físicas o jurídicas, administradores o propietarios de embarcaciones con licencia de pesca turística vigente, incluyendo su tripulación.

P- Pesca Turística: Actividad pesquera que realizan personas físicas nacionales o extranjeras, con el fin de capturar, con un aparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas continentales, jurisdiccionales o en la Zona Económica Exclusiva, con fines comerciales y propósitos exclusivamente turísticos, llevados a cabo en forma permanente.

Q- Puerto: lugar de partida o arribo de las embarcaciones pesqueras.

R- Puerto base de operación: Puerto elegido por el permisionario para avituallar regularmente su embarcación.

S- RECOPE: Refinadora Costarricense de Petróleo S. A.

T- Sección de Control y Administración de Combustible (SCAC): Dependencia del INCOPESCA encargada de la Administración, Fiscalización y Control del uso eficiente del combustible recomendado a precio preferencial.

U- Poder Especial: personas físicas o jurídicas debidamente autorizadas por el beneficiario, nombrados mediante documento notarial debidamente inscrito.

De las atribuciones, obligaciones y responsabilidades de la Sección de Control y Administración de Combustible (SCAC)

• a)Autorizar la venta de combustible a precio competitivo con el precio internacional según Ley Nº 8436 y Ley Nº 7384, para la Flota Pesquera Turística Nacional de conformidad con la legislación vigente.
• b)Disminuir, suspender los beneficios en forma particular o general, en cumplimiento de acuerdos emanados por la Junta Directiva del INCOPESCA en esta materia o cualquier otra disposición legal establecida o las regulaciones derivadas de los Contratos suscritos para estos efectos.
• c)Llevar expedientes físicos manuales por cada embarcación beneficiaria, con la siguiente información:

- Poder especial individual del beneficiario mediante el que autoriza a una tercera persona, para que en su representación le realice el trámite de combustible.

- Todos los documentos o requisitos establecidos en el Artículo 5 del presente Reglamento.

• d)Efectuar trimestralmente conciliaciones entre las Órdenes de Compra emitidas por el INCOPESCA y las Órdenes de Compra hechas efectivas en los planteles de distribución de RECOPE a nivel nacional, a través de una Comisión conformada por la Jefatura de la SCAC en Puntarenas, un funcionario de la Unidad de Informática y un funcionario de la Sección de Contabilidad del INCOPESCA.
• e)Efectuar conciliaciones entre la cantidad de litros autorizados por INCOPESCA y los efectivamente entregados a los permisionarios a través de organizaciones, estaciones de servicio y otros centros de almacenamiento y distribución debidamente autorizados.
• f)Recibir y resolver en primera instancia, los reclamos sobre la correcta aplicación de este Reglamento y demás disposiciones que se establezcan para el racional disfrute de los beneficios creados por Ley.
• g)A efecto de verificar las disposiciones normativas del presente Reglamento emitido para garantizar el uso correcto y eficiente del combustible, los funcionarios de la SCAC o las personas que ésta designe y en razón de su investidura, estarán facultados para efectuar en los lugares y tiempo que consideren procedentes, las inspecciones y los estudios necesarios a todos aquellos sujetos que disfrutan del beneficio del combustible a precio preferencial.

Los transportistas de combustible podrán ser supervisados por la Policía Fiscal del Ministerio de Hacienda, de acuerdo al convenio que suscriba dicho Ministerio con el INCOPESCA.

• h)Cualesquiera otras que le confiera la Junta Directiva del INCOPESCA mediante acuerdo expreso.

De la presentación de solicitudes y requisitos

• a)Formulario de solicitud de combustible con una copia debidamente firmada por el beneficiario o apoderado especial debidamente autorizadas, según lo establecido en el presente reglamento (Anexo 1).
• b)Una copia o fotocopia de la Factura de Venta de Servicio al Cliente.

Estas facturas deberán cumplir con las regulaciones establecidas por el Ministerio de Hacienda para estos efectos.

• c)Una copia o fotocopia del (los) Informe(s) del Viaje(s) de Pesca de conformidad con las estipulaciones establecidas por el INCOPESCA para estos efectos (Anexo 2).
• d)Una copia o fotocopia de la(s) Factura(s) de Compra del Combustible (de Contado o al Crédito), del (los) viaje(s) de pesca anterior (es), emitid(s) según corresponda por RECOPE, Estación de Servicio, Centros de Almacenamiento y Distribución debidamente autorizados o por una Organización Pesquera con tanques propios o arrendados para almacenamiento de combustible a precio preferencial, la cual deberá llevar el sello de cancelado y el sello de la Organización Pesquera cuyo Código fue utilizado para hacer efectiva la Orden de Compra de Combustible a Precio Preferencial emitida por el INCOPESCA. Dicha factura deberá incluir el detalle del costo por precio ante RECOPE, acarreo, almacenamiento, bombeo o margen de utilidad y el canon cobrado por la Organización Pesquera.
• e)Una copia o fotocopia de la Orden de Compra de Combustible a Precio Preferencial anterior con el sello de RECOPE como prueba fehaciente de que la misma se hizo efectiva.
• f)Una copia o fotocopia de la Boleta de Control de Gasto en la Estación de Servicio, Centros de Almacenamiento y Distribución debidamente autorizados, Organizaciones Pesqueras con tanques propios o arrendados y/o en los tanques de la propia embarcación, firmada por el beneficiario o persona debidamente autorizada en cada retiro (Anexo 3).
• g)Formulario de Registro de Datos de Capturas por viaje de pesca, de acuerdo con las estipulaciones del INCOPESCA (Anexo 4).

• j)Los beneficiarios físicos o jurídicos deberán estar al día en sus obligaciones con la CCSS y demostrarlo mediante documento idóneo expedido por la CCSS, por una única vez.

En aquellos casos en que la solicitud de combustible a precio preferencial sea rechazada, ya sea por incumplimiento de alguno de los documentos o requisitos establecidos, porque la información está incompleta, ilegible, con tachaduras o borrones que hagan dudar de su veracidad o que se le haya tenido que pedir otro documento, la misma será devuelta al (la) interesado(a), debiéndose de prevenir al beneficiario por una única vez y por escrito, que se le conceden hasta 10 días hábiles de conformidad con la Ley Nº 8220, para que complete o corrija lo que corresponda.

Transcurrido el plazo anterior sin gestión por parte del administrado la solicitud caducará de pleno derecho.

De la autorización y asignación del combustible a precio preferencial

La fecha de emisión de la factura de combustible deberá ser posterior o bien, con la misma fecha en fue emitida en el INCOPESCA, la Orden de Compra de Combustible a Precio Preferencial del (los) viaje(s) de pesca que se está(n) liquidando, a excepción de que el beneficiario hubiese tenido un saldo de combustible a su favor, que le haya permitido iniciar un viaje de pesca sin que se le haya autorizado el combustible consumido en el (los) viaje(s) anterior (es).

Solamente se reconocerá el gasto de combustible para un motor impulsor, aún cuando las embarcaciones utilicen dos motores, previamente registrados ante el INCOPESCA, aplicando el cálculo correspondiente para uno sólo de los motores, sin embargo, cuando por razones de naturaleza técnica tales como, diseño propio de la embarcación y otras debidamente demostradas ante el INCOPESCA, la misma requiera la utilización de dos motores impulsores estacionarios, se podrá reconocer previa autorización expresa por parte del Jefe de la Sección de Control y Administración de Combustible o los Directores o Jefes Regionales, el gasto de combustible para un máximo de dos motores impulsores estacionarios, en cuyo caso el reconocimiento no podrá exceder de 250 Hp tratándose de gasolina y 1450 Hp tratándose de diesel.

Modelos para asignar el combustible (gasolina, regular y diesel) a las embarcaciones pertenecientes a la Flota Pesquera Turística Nacional

h = número total de horas de faena de pesca (sólo se reconocerá un máximo de 9 horas por día).

Si de conformidad con la(s) Factura(s) de Combustible presentada (s), la cantidad que adquirió el beneficiario fuese mayor a la que resulte de la aplicación del modelo correspondiente, la SCAC solo podrá autorizar la cantidad máxima que indique ese modelo.

Si por alguna razón el beneficiario adquirió combustible adicional al precio establecido por la ARESEP para el consumidor final en las estaciones de servicio, la SCAC podrá autorizarlo siempre y cuando el beneficiario aporte la respectiva factura y la aplicación del modelo lo permita, caso contrario no lo podrá autorizar o bien, podrá autorizarlo hasta la cantidad máxima que indique dicho modelo.

De las órdenes de compra de combustible a precio preferencial

• a)Número de Orden de Compra.
• b)Número de Expediente.
• c)Nombre de la Embarcación.
• d)Número de Licencia de Pesca y de Matrícula.
• e)Nombre del Permisionario.
• f)Tipo de Combustible.
• g)Cantidad en Número de los litros de combustible autorizados.
• h)Cantidad en Letras de los litros de combustible autorizados.
• i)Nombre y Firma del funcionario que confecciona la Orden de Compra.
• j)Firma del funcionario que aprueba la Orden de Compra.

k. Firma del funcionario que entrega la Orden de Compra.

• l)Firma, fecha y número de Cédula de Identidad o de Residencia de la persona que recibe la Orden de Compra.
• m)Sello de la Sección de Control y Administración de Combustible (SCAC).
• n)Fecha de Emisión y Fecha de Vencimiento de la Orden de Compra.

Sin embargo, en casos excepcionales ante solicitud expresa del interesado en donde conste justificación razonable, en un plazo máximo de 10 días hábiles contados a partir de la fecha de vencimiento, el Jefe de la SCAC podrá emitir una nueva Orden de Compra de combustible por un plazo igual.

De las atribuciones, obligaciones y responsabilidades de los beneficiarios

Será esencial para poder obtener combustible a precio preferencial que la respectiva Organización, empresa o permisionario "clientes directos", cuenten con el Código de RECOPE para la adquisición de combustible.

Cada beneficiario podrá realizar el trámite de combustible a precio preferencial a través de las Organizaciones Pesqueras debidamente acreditadas ante el INCOPESCA, para lo cual esta Institución y la respectiva Organización, firmarán un Contrato que regule dicha gestión y que tendrá una vigencia máxima de cuatro años.

Para los efectos anteriores, la Organización Pesquera deberá cumplir previo a la firma del Contrato con los siguientes requisitos:

• a)Aportar fotocopia certificada del Acta Constitutiva.
• b)Aportar Certificación de Personería Jurídica, con un máximo de un mes de haber sido expedida.
• c)Aportar una fotocopia certificada de la cédula de identidad o de Residencia vigente, del Representante Legal.

Posterior a la firma del convenio suscrito con el INCOPESCA, deberán aportar fotocopia del Contrato suscrito con RECOPE.

Dicha gestión deberá ser presentada ante el INCOPESCA dentro de los primeros veinte días hábiles a partir de la fecha de arribo del (los) último(s) viaje(s) de pesca al puerto base de operación, caso contrario la misma caducará de pleno derecho.

A gestión del beneficiario la SCAC hará constar la presentación de la solicitud y estará facultada a emitir la Orden de Compra de Combustible a Precio Preferencial, cuando el interesado lo solicite nuevamente por escrito.

En este caso la SCAC estará facultada para emitir una Orden de Compra de Combustible a Precio Preferencial, como resultado de dos solicitudes de combustible.

La SCAC hará constar dicha situación y procederá a emitirla una vez que el (la) interesado así lo solicite.

De no procederse de esta manera la orden por ningún motivo podrá ser emitida nuevamente ni revalidada y caducará de pleno derecho.

De no procederse de esta manera el INCOPESCA no emitirá una nueva orden a favor de dicho beneficiario, salvo que su gestión se realice como si fuese la primera vez y en cuyo caso tendrá que haber adquirido el combustible al precio establecido por la ARESEP para el consumidor final en las estaciones de servicio.
