1That the Indigenous Reserve of Këköldi was confirmed by Indigenous Law 6172 of November 29, 1977, published in La Gaceta 240 of December 20, 1977 and delimited by Executive Decree 7267-G of August 9, 1977, published in Supplement 14 to La Gaceta 157 of August 20, 1977.
2That the boundaries of the Indigenous Reserve of Këköldi were modified by Article 2 of Executive Decree 25296-G, published in La Gaceta 134 of July 15, 1996.
3That in the modification of the boundaries of the Indigenous Reserve of Këköldi, defined by Article 2 of Decree 25296-G, published in La Gaceta 134 of July 15, 1996, an important area of protection and conservation of great natural wealth was not included, located in the northwestern sector of the reserve, between the springs (nacientes) of the Carbón "Uno" and Carbón "Dos" Rivers.
4That this area comprises a territory traditionally of indigenous occupation, which it is necessary to include within the indigenous reserve by provisions of Law No. 7316, Convention 169 I.L.O., Article 14.
5That this area holds a water wealth of great benefit, including for the communities of Bribrí, Home Creek, Patiño, Carbón Dos and Punta Caliente, which mandates its protection since it is the area that sustains the main source of that mineral for said populations.
6That said area geographically unites the indigenous population of Këköldi with the indigenous population Bribrí of Talamanca, which demonstrates it to be an area traditionally of indigenous occupation, and its inclusion also favors the social unity of a Bribrí indigenous population, which was spatially separated for many years.
7That under such considerations, it is necessary to modify the northwestern boundary of the Indigenous Reserve of Këköldi, in order to include that important area.
8That the National Commission on Indigenous Affairs (Comisión Nacional de Asuntos Indígenas, CONAI), has already conducted the studies on the area claimed by the indigenous community of Këköldi and that the cited community, under consultation according to Convention 169 of the I.L.O.,

THEY DECREE:

Considering:

The Bribrí Indigenous Reserve of Këköldi is located on the cartographic sheets of the Instituto Geográfico Nacional, scale 1:50,000, Amubri 3644 IV, Sixaola 3644 I and Cahuita 3645 III, and it is delimited by the points whose coordinates are the following:

Starting from the Summit of Cerro Pirripli, 220 m.a.s.l., south of Puerto Viejo, at coordinates N 399 825 E 600 825, it continues eastward along a spur of cerro Pirripli, passing through the points with coordinates:

N 399 725	E 601 405	(hill, 100 m.)
N 399 800	E 601 600

From this last point, it follows to the point with coordinates N 399 525 E 601 715. From there, a straight line following approximately a road southward, to the point with coordinates N 398 975 E 601 600, to continue to the point with coordinates N 398 700 E 601 450 (hillock, 80 meters). It continues through the following coordinate points:

N 398 225	E 602 075	(Río Caño Negro)

It continues up the Río Caño Negro upstream, to the confluence of its two main springs (nacientes), at coordinates N 396 750 E 602 225. From there, a straight line to the point with coordinates N 396 575 E 601 800.

The boundary line continues southwestward, along a spur, to the point with coordinates N 396 150 E 601 275 (hill, 112 m.).

From this point, it follows with straight lines through the following coordinate points:

From this point, it continues along the watershed divide between the Río Sand Box on one side and the Ríos Sixaola, Carbón and Quebrada Carbón on the other side, passing through the coordinate points:

The boundary follows through the coordinate points: N 399 075 E 588 480 (hill, 342 m.), N 399 125 E 587 750, N 399 250 E 587 520.

From this last point, a straight line to the point with coordinates N 398 650 E 586 790. From this point, the common boundary with the Bribrí Indigenous Reserve of Talamanca begins, continuing the boundary line through the coordinate points:

From there, it follows upstream along the río Carbón, to the point with coordinates N 399 725 E 585 590, to take a straight line heading northwest toward the fila Carbón, at the point with coordinates N 400 150 E 585 460. At this last point, the described common boundary ends, with the boundary of the Indigenous Reserve of Këköldi continuing with a straight line to the point with coordinates N 401 000 E 585 900. A point that intersects a spring (naciente) of the Río Carbón ("Dos"), drawn by contour lines on the map. It follows downstream along this spring, to its confluence with the main spring (naciente) of the Río Carbón ("Dos"), to the point with coordinates N 185 250 E 660 375. It continues upstream along the main spring (naciente) of the río Carbón ("Dos") to the point with coordinates N 183 850 E 561 720. From there, a straight line to the point with coordinates N 401 600 E 590 075. A point that intersects a tributary of the quebrada Carbón. It follows upstream along this tributary, to the point with coordinates N 400 975 E 590 075. From there, it continues passing through the following coordinate points:

From this point, it follows the watershed divide between the ríos Carbón ("Dos"), Río Sand Box and Río Patiño, with the following coordinates:

1Que la Reserva Indígena de Këköldi fue confirmada por la Ley Indígena 6172 del 29 de noviembre de 1977, publicada en La Gaceta 240 del 20 de diciembre de 1977 y delimitada por el Decreto Ejecutivo 7267-G del 9 de agosto de 1977, publicado en el Alcance 14 a La Gaceta 157 del 20 de agosto de 1977.
2Que los límites de la Reserva Indígena de Këköldi fueron modificados por el artículo 2 del Decreto Ejecutivo 25296-G, publicado en La Gaceta 134 de 15 de julio 1996.
3Que en la modificación de los límites de la Reserva Indígena de Këköldi, definidos por el artículo 2º del Decreto 25296-G, publicado en La Gaceta 134 de 15 de julio de 1996, no se incluyó un área importante de protección y conservación de gran riqueza natural, ubicada en el sector noroeste de la reserva, entre las nacientes de los Ríos Carbón "Uno" y Carbón "Dos".
4Que esa área comprende un territorio tradicionalmente de ocupación indígena, que es necesario incluirlo dentro de la reserva indígena por disposiciones de la Ley Nº 7316, Convenio 169 O.I.T., artículo 14.
5Que esa área guarda una riqueza hídrica de gran beneficio, inclusive para las comunidades de Bribrí, Home Creek, Patiño, Carbón Dos y Punta Caliente, que obliga a su protección ya que es el área que sostiene la fuente principal de ese mineral para dichas poblaciones.
6Que dicha área une geográficamente a la población indígena de Këköldi con la población indígena Bribrí de Talamanca, lo que demuestra ser un área tradicionalmente de ocupación indígena, y su inclusión favorece así mismo la unidad social de una población indígena Bribrí, que estuvo espacialmente separada por muchos años.
7Que bajo tales consideraciones, se hace necesario modificar el límite noroeste de la Reserva Indígena de Këköldi, a fin de incluir esa importante área.
8Que la Comisión Nacional de Asuntos Indígenas (CONAI), ya realizó los estudios sobre el área que reclama la comunidad indígena de Këköldi y que la comunidad citada, bajo consulta según Convenio 169 de la O.I.T., manifiesta su acuerdo con el estudio presentado por CONAI. Por tanto,

Considerando:

DECRETAN:

La Reserva Indígena Bribrí de Këköldi se localiza en las hojas cartográficas del Instituto Geográfico Nacional, escala 1:50.000, Amubri 3644 IV, Sixaola 3644 I y Cahuita 3645 III, y se delimita por los puntos cuyas coordenadas son las siguientes:

Partiendo de la Cima del Cerro Pirripli, 220m/snm, al sur de Puerto Viejo, en coordenadas N 399 825 E 600 825, se continúa hacia el este por una estribación del cerro Pirripli, pasando por los puntos de coordenadas:

N 399 725	E 601 405	(cerro, 100 m.)
N 399 800	E 601 600

De este último punto se sigue al punto de coordenadas N 399 525 E 601 715. De allí una recta siguiendo aproximadamente un camino hacia el sur, hasta el punto de coordenadas N 398 975 E 601 600, para continuar al punto de coordenadas N 398 700 E 601 450 (cerrito, 80 metros). Se continúa por los puntos de coordenadas siguientes:

N 398 620	E 601 425
N 398 225	E 602 075	(Río Caño Negro)

Se sigue por el río Caño Negro aguas arriba, hasta la confluencia de sus dos nacientes principales, en coordenadas N 396 750 E 602 225. De ahí, una recta al punto de coordenadas N 396 575 E 601 800.

El lindero continúa hacia el suroeste, por una estribación, hasta el punto de coordenadas N 396 150 E 601 275 (cerro, 112 m.).

De este punto, se sigue con líneas rectas por los puntos de coordenadas siguientes:

De este punto se continúa por la fila divisoria de aguas entre el Río Sand Box por una parte los Ríos Sixaola, Carbón y Quebrada Carbón; por otra parte, pasando por los puntos de coordenadas:

N 398 740	E 589 070	(Cerro, 320 m., aproximadamente)

El límite sigue por los puntos de coordenadas: N 399 075 E 588 480 (cerro, 342 m.), N 399 125 E 587 750, N 399 250 E 587 520.

De este último punto, una recta al punto de coordenadas N 398 650 E 586 790. A partir de este punto, se inicia el límite común con la Reserva Indígena Bribrí de Talamanca, continuando el lindero por los puntos de coordenadas:

De ahí se sigue aguas arriba por el río Carbón, hasta el punto de coordenadas N 399 725 E 585 590, para tomar una recta con rumbo noroeste hacia la fila Carbón, en el punto de coordenadas N 400 150 E 585 460. En este último punto, termina el límite común descrito, siguiendo el límite de la Reserva Indígena de Këköldi, con una recta al punto de coordenadas N 401 000 E 585 900. Punto que interseca una naciente del Río Carbón ("Dos"), dibujada por curvas de nivel en el mapa. Se sigue aguas abajo por esta naciente, hasta su confluencia con la naciente principal del Río Carbón ("Dos"), hasta el punto de coordenadas N 185 250 E 660 375. Continúa aguas arriba por la naciente principal del río Carbón ("Dos") hasta el punto de coordenadas N 183 850 E 561 720. De ahí una recta al punto de coordenadas N 401 600 E 590 075. Punto que interseca un afluente de la quebrada Carbón. Se sigue aguas arriba por este afluente, hasta el punto de coordenadas N 400 975 E 590 075. De ahí, se continúa pasando por los puntos de coordenadas siguientes:

De este punto, se sigue por la divisoria de aguas entre los ríos Carbón ("Dos"), Río Sand Box y Río Patiño, con las siguientes coordenadas:

(Nota de Sinalevi: Mediante resolución de la Sala Primera de la Corte Suprema de Justicia N° 004507-F-S1-2019 del 12 de diciembre de 2019, se anuló de este numeral, el canon 1 en cuanto reitera la exclusión mencionada en el artículo 2 del decreto ejecutivo N° 25296 del 24 de junio de 1996, que fuera anulado por la resolución antes mencionada, solo en cuanto a la nueva delimitación hecha que excluye parte de la finca 19.056-000, pero no en lo que favorece. Asimismo, dicha sentencia declara que el inmueble 19.056-000 forma parte de la Reserva Indígena de Këköldi, el cual deberá inscribirse de conformidad con la Ley Indígena y su Reglamento a nombre de la Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi)

Se indica que dicha anulación, solo en cuanto mantiene la vigencia del artículo 3 del decreto ejecutivo N° 25296 del 24 de junio de 1996)
