Decreto 29449 — Reform of the Guaymí Indigenous Reserve of Coto Brus

in the entirety of the text - Complete Text of Norm 29449 Reform of the Guaymí de Coto Brus Indigenous Reserve Complete Text of record: 9F5E4 N° 29449-G N° 29449 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE, AND PUBLIC SECURITY Pursuant to subsections 3) and 18) of article 140 of the Political Constitution and laws Nº 5251 of July 11, 1973 and its amendments, the Indigenous Law Nº 6172 of November 29, 1977 and Law 7316 of October 12, 1992, Convention 169 ILO.

1That the current boundaries of the Guaymí de Coto Brus indigenous reserve, established by Executive Decree Nº 12232-G, La Gaceta Nº 25 of February 5, 1981 with corrections given by Decree Nº 12751-G- La Gaceta, 130 of July 10, 1981, present detailing imperfections in the Fila Cruces, which, according to article 6 of this decree provides it with a special status of "Protective Forest", as a flora and fauna reserve zone, as well as for the protection of hydrographic basins, which are elemental in the supply of potable water for the populations of Limoncito, Brusmalís, Alto Unión, Paraíso, La Guaria, Km 19 and Río Claro. Leaving out the southern sector of said ridge.
2That due to the ecological richness and hydrographic source that the southern sector of Fila Cruces presents, it must be included within the demarcation of the reserve in order to provide the protective forest status to said southern sector, just as article 6 of the aforementioned decree indicates.
3That in the zone of Paraíso, there exist lands traditionally considered of indigenous occupation, which must be included within the indigenous reserve,. Guaymí de Coto Brus, in order to comply with the mandate of article Nº 14 of Law Nº 7316, Convention 169, ILO, of October 12, 1992.
4That it is necessary to define a delimitation in accordance with reality, to avoid land conflicts for the indigenous and non-indigenous population of the place.
5That it is a fundamental requirement, to safeguard the natural wealth of the Guaymí de Coto Brus indigenous reserve, for the Guaymí indigenous population that inhabits it. Therefore,

The Guaymí de Coto Brus Indigenous Reserve, is located by the points, whose coordinates are: starting from the Anguciana vertex N 307, 230, E 556 662 (Cerro of 1707 meters).

From this point it continues along a trail drawn on the map, passing through the following coordinate points:

Starting from this point, the boundary of the reserve leaves the trail to continue with a southeast course, toward the coordinate point N 310 700 E 560 200. From there it follows the same course toward the coordinate point N 310 450 E 560 550. From this point it continues with a due east course to coordinates N 310 450 E 561 275, a point that intersects a road drawn on the map. From there it follows with a southeast course along a straight line to coordinate point N 310 125 E 561 500. From this point the limit deviates taking a Northeast course to coordinate point N 310 550 E 562 500. Confluence point between the stream named, quebrada Caballo (Modori) on the ground ( without a name on the map) and the Río Limón. From this point, the boundary of the reserve continues upstream along the Río Limón, to coordinate point N 3l0 150, E 564 150. Starting from this point, it follows the following coordinates.

From this point, it follows upstream along the Quebrada Brusmalis, to coordinate point N 310 300 E 565 950. Starting from this point it follows with the following coordinates.

From this point, it follows the left branch upstream, to coordinate point N 305 250 E 569 450. From there it continues with a due East course, to coordinate N 305 250 E 570 150, a point that intersects a stream drawn by contour lines that flows into the Río Salto.

From this point, a due South course is taken to coordinate point N 304 750 E 570 150. Point that intersects the Fila Cruces. Starting from this point the limit continues passing through the following coordinate points.

Point that is located at the spring (naciente) of a stream drawn on the map by contour lines, which constitutes one of the principal springs (nacientes) of Río Lagarto. From this point, it follows downstream along this spring (naciente), to coordinates N 302 325 E 566 295, confluence point with another spring (naciente) of the Río Lagarto. Starting from there, it follows along the Río Lagarto downstream, to coordinates N 301 925 E 566 025. From there a straight line to coordinate point N 301 700 E 565 550. Starting from this point, it continues through the following coordinates:

From there, it continues along a straight line with a Northwest course, to coordinate N. 305 475 E 554 450. Point that intersects over the Río Esquinas. From here, the boundary of the reserve continues along this river upstream, following its principal spring (naciente), to coordinate point N 307 350 E 555 100. | Starting from there, it follows a straight line to the coordinate point, N 307 405 E 555 350, and from this point, it follows to coordinate point N 307 230, E 556 662, Anguciana vertex, point of origin of the present description.

*(NOTE FROM SINALEVI: By means of the present article, article 1° of executive decree N° 12232 of January 26, 1981 is modified, nonetheless, by reason of the amended matter and the information supplied by the Ministry of Governance and Police, the amendment corresponds to article 2°).

The Guaymí de Coto Brus Indigenous Reserve, is composed of the following localities:

1- Brusmalís: From Río Chico to Quebrada Pita including Villa Palacios (Kebidini).

2- Kigari (or Pita): Quebrada Pita to Caño Bravo.

3- La Unión, between the three principal branches of the Caño Bravo river, drawn on the cartographic sheet Piedras Blancas 3542 II scale l:50,000 I:G:N:

4- La Casona 5- Modori (Quebrada Caballo) to the north of this stream 6- Anguciana 7- Cerro Paraguas or Quebrada Pita

Together, they shall have the category of neighborhood of the Cantón of Coto Brus and shall be denominated: Barrio Guaymí de Coto Brus.

1Que los límites actuales de la reserva indígena Guaymí de Coto Brus, establecido por Decreto Ejecutivo Nº 12232-G, La Gaceta Nº 25 de fecha 5 de febrero de 1981 con correcciones dadas por el Decreto Nº 12751-G- La Gaceta, 130 de fecha 10 de julio de 1981, presenta imperfecciones de detalle en la Fila Cruces, la cual, según artículo 6 de este decreto le brinda un estatuto especial de "Bosque Protector", como zona de reserva de flora y fauna, así como para la protección de cuencas hidrográficas, que son elementales en el abastecimiento de agua potable para las poblaciones de Limoncito, Brusmalís, Alto Unión, Paraíso, La Guaria, Km 19 y Río Claro. Dejándose por fuera el sector sur de dicha fila.
2Que por la riqueza ecológica y fuente hidrográfica que presenta el sector sur de Fila Cruces, debe ser incluida dentro de la demarcación de la reserva a fin de brindarle el estatuto de bosque protector a dicho sector sur, tal y como lo indica el artículo 6 del decreto antes citada.
3Que en la zona de Paraíso, existen terrenos considerados tradicionalmente de ocupación indígena, que se deben incluir dentro de la reserva indígena,. Guaymí de Coto Brus, a fin de cumplir con el mandato del artículo Nº 14 de la Ley Nº 7316, Convenio 169, OIT, de fecha 12 de octubre de 1992.
4Que es necesario definir una delimitación conforme a la realidad, para evitar conflictos por tierra a la población indígena y no indígena del lugar.
5Que es requisito fundamental, salvaguardar la riqueza natural de la reserva indígena Guaymí de Coto Brus, para la población indígena Guaymí que la habita. Por tanto,

Decretan:

La Reserva Indígena Guaymí de Coto Brus, se localiza por los puntos, cuyas coordenadas son: partiendo del vértice Anguciana N 307, 230, E 556 662 (Cerro de 1707 metros).

De este punto se continúa por una trocha dibujada en el mapa, pasando por los puntos de coordenadas siguientes:

A partir de este punto, el lindero de la reserva sale de la trocha para continuar con rumbo sur este, hacia el punto de coordenadas N 310 700 E 560 200. De ahí se sigue el mismo rumbo hacia el punto de coordenadas N 310 450 E 560 550. De este punto se continúa con rumbo este franco a las coordenadas N 310 450 E 561 275 punto que interseca un camino dibujado en el mapa. De ahí se sigue con rumbo sur este por una recta al punto de coordenadas N 310 125 E 561 500. De este punto el límite se desvía tomando rumbo Noreste al punto de coordenadas N 310 550 E 562 500. Punto de confluencia entre la quebrada denominada, quebrada Caballo (Modori) en el terreno ( sin nombre en el mapa) y el Río Limón. De este punto, el lindero de la reserva, continúa aguas arriba por el río Limón, hasta el punto de coordenadas N 3l0 150, E 564 150. A partir de este punto se sigue por las siguientes coordenadas.

De este punto, se sigue aguas arriba por la quebrada Brusmalis, hasta el punto de coordenadas N 310 300 E 565 950. A partir de este punto se sigue con las siguientes coordenadas.

De este punto, se sigue por el brazo izquierdo aguas arriba, hasta el punto de coordenadas N 305 250 E 569 450. De ahí se continúa con rumbo Este franco, a la coordenada N 305 250 E 570 150, punto que interseca una quebrada dibujada por curvas de nivel que confluye al Río Salto.

De este punto se toma rumbo Sur franco hasta el punto de coordenadas N 304 750 E 570 150. Punto que interseca la Fila Cruces. A partir de este punto el límite sigue pasando por los puntos de coordenadas siguientes.

Punto que se localiza en la naciente de una quebrada dibujada en el mapa por curvas de nivel, la cual constituye una de las nacientes principales de Río Lagarto. De este punto, se sigue aguas abajo por esta naciente, hasta las coordenadas N 302 325 E 566 295 punto de confluencia con otra naciente del río Lagarto. A partir de ahí, se sigue por el Río Lagarto aguas abajo, hasta las coordenadas N 301 925 E 566 025. De ahí una recta al punto de coordenadas N 301 700 E 565 550. A partir de este punto se continúa por las coordenadas siguientes:

Se continúa aguas arriba por este brazo, hasta el punto de coordenada N 304 800 E 555 550. De ahí continúa por una recta rumbo Noroeste, hasta la coordenada N. 305 475 E 554 450. Punto que interseca sobre el río Esquinas. De aquí, el límite de la reserva continúa por este río aguas arriba, siguiendo su naciente principal, hasta el punto de coordenadas N 307 350 E 555 100. | A partir de ahí se sigue por una recta hasta el punto de coordenada, N 307 405 E 555 350, y de este punto, se sigue hasta el punto de coordenadas N 307 230, E 556 662, vértice Anguciana, punto de origen de la presente descripción.

*(NOTA DE SINALEVI: Mediante el presente artículo, se modifica el artículo 1° del decreto ejecutivo N° 12232 del 26 de enero de 1981, no obstante, en razón de la materia reformada y la información suministrada por el Ministerio de Gobernación y Policía, la reforma corresponde al artículo 2°).

La Reserva Indígena Guaymí de Coto Brus, se compone de las siguientes localidades:

1- Brusmalís: De Río Chico a Quebrada Pita incluyendo Villa Palacios (Kebidini).

2- Kigari (o Pita): Quebrada Pita a Caño Bravo.

3- La Unión, entre los tres brazos principales del río Caño Bravo, dibujados en la hoja cartográfica Piedras Blancas 3542 II escala l:50,000 I:G:N:

4- La Casona 5- Modori (Quebrada Caballo) al norte de esta quebrada 6- Anguciana 7- Cerro Paraguas o quebrada Pita

En conjunto tendrán, una categoría de barrio del Cantón de Coto Brus y se denominará: Barrio Guaymí de Coto Brus.

Artículo 3 — That the limits established in article 2 of the present decree, are the current and definitive limits of the Guaymí de Coto Brus Indigenous Reserve.

Artículo 4 — For purposes of the Political Administrative Division and the Civil Registry.

Artículo 6 — Articles 7 and 8 of decree N° 12232-G of 1-26-81 La Gaceta Nº 25, of February 5, 1981, remain in force.

Artículo 7 — Article 5° of Decree N° 12232-G, of La Gaceta N° 25 of February 5, 1981, is modified, so that from now on it reads as follows: The sectors of La Casona, Brusmalís, Limoncito, Cerro Paraguas, Villa Palacios.

Artículo 8 — Takes effect upon its publication.

Artículo 3 — Que los límites establecidos en el artículo 2 del presente decreto, son los límites vigentes y definitivos de la Reserva Indígena Guaymí de Coto Brus.

Artículo 4 — Para efectos de la División Política Administrativa y el Registro Civil.

Artículo 6 — Los Artículos 7 y 8 del decreto N° 12232-G de fecha 26-1-81 La Gaceta Nº 25, de fecha 5 de febrero de 1981, quedan vigentes.

Artículo 7 — Modifíquese el Artículo 5° del Decreto N° 12232-G, de La Gaceta N° 25 de fecha 5 de febrero de 1981, para que de hora en adelante se lea así: Los sectores de La Casona, Brusmalís, Limoncito, Cerro Paraguas, Villa Palacios.

Artículo 8 — Rige a partir de su publicación.
