in the entirety of the text - Complete Text of Norm 29447 Reestablishes the China Kicha Indigenous Reserve and redefines its boundaries Complete Text record: 9F5D7 N° 29447-G N° 29447-G THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE AND PUBLIC SECURITY In accordance with the provisions of Article 140 of the Political Constitution, subsections 3) and 18), and based on Law 5251 of July 11, 1973, and its amendments, Indigenous Law No. 6172 of November 29, 1977, and Law 7316, ILO Convention 169. And,
Considering:
34 of La Gaceta No. 3 of January 5, 1957, was repealed by Executive Decree No. 13570 - G of April 30, 1982, omitting fundamental legal aspects of indigenous legislation, such as the Indigenous Law itself and ILO Convention 107 of 1957, thereby harming the rights of the indigenous community.
It being understood that the community itself has conducted the communal consultation, as established by ILO Convention 169, Article 6, subsection a.
169 of the ILO, and established Indigenous Law 6172, its Regulations, and concordant decrees, must safeguard the rights and interests of the petitioning indigenous population. Therefore, They decree:
Repunta 3443 I, Coronado 3443 II, Buenos Aires 3543 IV, and General 3543 III.
The Indigenous Reserve of China Kicha shall have as its boundaries the following coordinates:
Starting from the confluence of the Pejibaye and General rivers at the point with coordinates N344 960 E 521 250. The boundary of the reserve continues upstream along the Río General, to the point with coordinates N 348 800 E 520 090, the place where the Quebrada Pita flows into the Río General. From there, it continues upstream along the Quebrada Pita, to a point where it intersects a road that crosses it, at coordinates N 348 850 E 519 250. From this point, the boundary follows the road southward, passing through the following coordinate points:

6172, taking into account Article 14 of Convention No. 169 of the ILO.
The Federated College of Architects and Engineers and the College of Topographical Engineers are obligated to comply with the provisions of this article, which is inscribed within the framework of Article 14, subsection 3 of Convention No. 169, so as not to obstruct the cadastral registration process for the aforementioned plan and for the plans of the indigenous reserves that remain to be registered or modified, based on the coordinates defined in the decrees that delimit them.

Ya realizó los estudios técnicos en China Kicha, recomendando el reestablecimiento de la reserva de China Kicha, con una nueva delimitación, sobre la cual existe pleno acuerdo de la comunidad indígena de ese lugar.
Debe salvaguardar los derechos e intereses de la población indígena solicitante. Por tanto,
Decretan:
La Reserva Indígena de China Kicha, tendrá por límites, las siguientes coordenadas:
Partiendo de la unión de los ríos Pejibaye y General en el punto de coordenadas N344 960 E 521 250. El lindero de la reserva, sigue aguas arriba por el Río General, hasta el punto de coordenadas N 348 800 E 520 090, lugar donde confluye la Quebrada Pita sobre el Río General. De ahí, se continúa aguas arriba por la Quebrada Pita, hasta un punto donde ésta interseca un camino que la atraviesa, en coordenadas N 348 850 E 519 250. A partir de este punto, el límite sigue por el camino en sentido Sur, pasando por los puntos de coordenadas siguientes:

De ahí, al punto de coordenadas N 346 725 e 516 440(*). Punto en donde confluye, una pequeña quebrada (dibujada en el mapa por curvas de nivel) con la Quebrada Bonita. De este punto, se sigue aguas abajo por la Quebrada Bonita, hasta su desembocadura sobre el Río Pejibaye, en el punto de coordenadas N 344 780 E 518 650. De este último punto, se continúa por el Río Pejibaye aguas abajo, hasta la unión de éste con el Río General, en el punto de coordenadas N 344 960 E 521 250. Punto inicial de la presente descripción.

La Comisión Nacional de Asuntos Indígenas, CONAI, queda facultada para indemnizar, terrenos colindantes con la reserva, e incluirlos dentro de ésta, para su parcelación a la comunidad indígena. Una vez que se hayan indemnizado conforme a las disposiciones de la Ley Indígena N° 6172, los terrenos ubicados dentro de los límites definidos en el artículo N° 2 del presente Decreto. Tomando en cuenta el artículo N° 14 del convenio N° 169 de la OIT.
Omitiendo el trabajo del levantamiento topográfico en el terreno, quedando obligado el Colegio Federado de Arquitectos e Ingenieros y el Colegio de Ingenieros Topógrafos a cumplir con lo dispuesto en este artículo, el cual se inscribe dentro del marco del artículo 14, inciso 3 del Convenio N° 169. En razón de no obstaculizar, el tramite de catastro del citado plano y de los planos de las reservas indígenas que faltasen por catastrar o modificar, a partir de las coordenadas que se definen en los decretos que las delimitan.
