La norma establece condiciones materiales para las embarcaciones importadas: se prohíbe la importación de embarcaciones de madera, solo se permiten las construidas de otros materiales con una eslora igual o mayor a 65 pies, y la eslora máxima permitida será de hasta 30 metros. Además, se respeta el aumento máximo de eslora del 50% respecto a la embarcación sustituida, según lo fijado en el Acuerdo AJDIP 308-97. Queda sin efecto la eslora máxima anterior de 24 metros. Se mantienen vigentes las limitaciones de tamaño por zona y tipo de embarcación. Los interesados deben solicitar autorización formal al INCOPESCA y declarar bajo juramento el destino de la embarcación sustituida, bajo apercibimiento de sanciones. Este acuerdo fue derogado posteriormente por el Acuerdo 318 del 28 de julio de 2006.

1That in accordance with the provisions of Law No. 7384 of March 16, 1994, published in the Official Gazette La Gaceta No. 62 of March 29 of the same year, it is the competence of the Costa Rican Institute of Fisheries and Aquaculture to regulate the exploitation of fishery resources, as well as to regulate the relevant aspects regarding the granting of fishing permits and licenses, characteristics of vessels, catches, and other pertinent aspects regarding the exercise of fishing activity.
2That over time, various regulations and agreements have been established, in which the size of vessels for carrying out various fisheries has been determined and regulated regarding the possibility of their replacement, based on their size and engine power.
3That it is important for the purposes of the development and promotion of fishing activity to establish regulations and provisions that adequately allow the growth and reconversion of the national fishing fleet, respecting the existing regulatory provisions on the matter.
4That Law No. 4582 of May 4, 1970, which declares the promotion and development of the fishing industry, establishes regulations regarding the importation of vessels, which remains in force.

THEY AGREE:

Therefore,

- Fishing vessels built of wood may not be imported, regardless of their size.

- Vessels built of any other material may only be imported if they measure equal to or greater than 65 feet in length (eslora).

- Imported vessels for the purpose of replacing commercial fishing vessels may have a maximum measurement of thirty meters in length (eslora) (. feet).

- For purposes of importation and replacement of vessels, the maximum increase in length (eslora) permitted per vessel must be respected, according to the provisions of agreement AJDIP 308-97 of November 26, 1997 and its amendments, defined as fifty percent more than the length (eslora) of the vessel to be replaced. The maximum permitted length (eslora) that was previously set at 24 meters is hereby rendered without effect.

- The limitations or regulations regarding the size of vessels that exist for specific zones and type of vessels remain in force as they were issued.

Likewise, permit holders must make express statements under oath, regarding the destination to be given to the vessel to be replaced, proof of which may be required by the Institute and verified in due course, under penalty of application of the respective sanctions in case of non-compliance.

1Que de conformidad con lo dispuesto en la Ley Nº 7384 del 16 de marzo de 1994, publicado en el Diario Oficial La Gaceta Nº 62 del 29 de marzo del mismo año, es competencia del Instituto Costarricense de la Pesca y Acuicultura, normar el aprovechamiento de los recursos pesqueros, así como regular los aspectos pertinentes en cuanto al otorgamiento de permiso y licencia de pesca, características de las embarcaciones, capturas y demás aspectos pertinentes en cuanto al ejercicio de la actividad pesquera.
2Que en el transcurso del tiempo, se han establecido diversas regulaciones y acuerdos, en los cuales se ha determinado el tamaño de las embarcaciones para la realización de las diversas pesquerías y normado en cuanto a la posibilidad de sustitución de las mismas, por el tamaño de éstas y la potencia de los motores.
3Que es importante a los efectos del desarrollo y fomento de la actividad pesquera, establecer regulaciones y disposiciones que permitan en forma adecuada, el crecimiento y reconversión de la flota pesquera nacional, respetando las disposiciones normativas existentes en la materia.
4Que la Ley Nº 4582 de 4 de mayo de 1970, que declara el fomento y desarrollo de la industria pesquera, establece regulaciones en cuanto a la importación de embarcaciones, la cual se encuentra vigente.

ACUERDAN:

Considerando:

Por tanto,

- No se podrán importar embarcaciones de pesca construidas de madera, de cualquier tamaño que sean.

- Solo se podrán importar embarcaciones construidas de cualquier otro material, si las mismas tienen una medida igual o mayor a 65 pies de eslora - Las embarcaciones importadas para efecto de sustitución de las embarcaciones de pesca comercial, podrán tener una medida máxima de treinta metros de eslora (. pies).

- Para efectos de importación y sustitución de embarcaciones, deberá respetarse el aumento máximo de eslora permitido por embarcación, según lo dispuesto en el acuerdo AJDIP 308-97 de 26 de noviembre de 1997 y sus reformas, definido en un cincuenta por ciento más de la eslora de la embarcación a sustituir. Queda sin efecto la eslora máxima permitida que se encontraba fijada en 24 metros.

- Las limitaciones o regulaciones en cuanto al tamaño de las embarcaciones que existieren por zonas específicas y tipo de embarcaciones, se mantienen vigentes según se hubieren emitido.

De igual manera deberán los permisionarios realizar manifestaciones prueba podrá serle requerida por el Instituto y verificada en su oportunidad, bajo pena de aplicación en caso de incumplimiento de las sanciones respectivas.
