Decreto 33030 — Amendment to MINAE Autonomous Service Regulation on Human Resources

1That since 1994 the different dependencies of the Executive Branch initiated a restructuring process aimed at improving the efficiency of the State, a process in which the Ministry of Environment and Energy has been involved.
2That by means of Executive Decree Nº 18557-MIRENEM published on November 18, 1988, the Autonomous Work Regulations of the Ministry of Natural Resources, Energy and Mines were enacted.
3That the Decree cited in the preceding considering clause was repealed by Executive Decree Nº 28409-MINAE published on February 17, 2000, and through the same, the new Autonomous Service Regulations of the Ministry of Environment and Energy were decreed.
4That in accordance with the Biodiversity Law Nº 7788 of May 27, 1998, in its article 22, the National System of Conservation Areas (SINAC), called the SYSTEM, shall have its own legal personality; it shall be a decentralized and participatory institutional management and coordination system within the administrative structure of the System.
5That with the enactment of the Organic Law of the Environment Nº 7554 of October 4, 1995, the Ministry of Environment and Energy assumed new functions, for which it requires the modernization of the legal provisions governing labor relations with its officials, in order to adequately fulfill them.
6That to achieve the effectiveness and efficiency of Human Resource Management, it is advisable to review the Autonomous Service Regulations of the institution.
7That the present modification was authorized by the Legal Advisory Office of the Civil Service General Directorate, pursuant to article 13 subsection i) of the Civil Service Statute, through official communication AJ-099-2006 dated March 13, 2006. Therefore,

THEY DECREE:

Considering:

"Article 4º-There shall be a Department of Human Resources within the Organization of the Ministry, to duly attend to all matters concerning personnel.

This Department shall have the collaboration of Auxiliary Offices, which shall report to each General Directorate. Likewise, the National System of Conservation Areas (SINAC) shall independently have a Human Resources office, which shall report administratively to the Senior Director and technically to the Civil Service General Directorate, in accordance with article 8 of the Regulations to the Civil Service Statute; and this office shall have the support and cooperation of auxiliary offices in the different Conservation Areas nationwide; which shall report technically to the Human Resources Office of SINAC and administratively to the Directorate of the Conservation Area.

The Department of Human Resources and its auxiliary offices, the Human Resources Office of SINAC and its respective auxiliary offices shall have the functions assigned to them by these Regulations and other applicable regulations.

The content of these Regulations and other regulations related to the matter, where it involves the Department of Human Resources, must be understood intrinsically to refer to the Human Resources Office of SINAC for the same purposes."

67, 69 and 70 of Executive Decree number 28409-MINAE, which shall hereafter read as follows:

"Article 67.-The Department of Human Resources of the Ministry and the Human Resources Office of SINAC shall be responsible for the creation and custody of the personnel file of each official according to their respective dependency, and for keeping up to date the archives of pertinent documents, as well as for guaranteeing their confidentiality." "Article 69.-The Department of Human Resources and the Human Resources Office of SINAC, as appropriate for the official under their competence, shall prepare a prontuario (summary record) for each employee, in order to have a practical summary of all the information derived from the service relationship on matters such as: date of entry, attendance, performance evaluation, disciplinary aspects, qualifications and suitability of the official, vacations, and other key information." "Article 70.-It is the duty of the administrative units of both the Ministry and the National System of Conservation Areas and their dependencies to send a copy to the personnel file of the officials, of those actions that, within their scope of competence, may generate legal-administrative acts.

The information and continuity in the prontuario, as well as in the personnel file, is of a confidential nature and only the officials of the Ministry and the National System of Conservation Areas, as appropriate, who require it for duties inherent to their position, the employee, and their authorized representative shall have access to it."

"Article 113:

b)For officials with a non-statutory relationship, with regard to the instruction of dismissal, it shall be carried out by the Legal Unit of the Department of Human Resources of the Ministry and, for officials of SINAC, by the corresponding Human Resources Office; with the knowledge and approval of the Vice Minister or Senior Director respectively, following the same procedure indicated in the preceding articles."

1Que desde 1994 las diferentes dependencias del Poder Ejecutivo, iniciaron un proceso de reestructuración dirigido a mejorar la eficiencia del Estado, proceso en el que ha estado involucrado el Ministerio del Ambiente y Energía.
2Que mediante Decreto Ejecutivo Nº 18557-MIRENEM publicado el 18 de noviembre de 1988, se promulga el Reglamento Autónomo de Trabajo del Ministerio de Recursos Naturales Energía y Minas.
3Que el Decreto citado en el considerando anterior fue derogado por Decreto Ejecutivo Nº 28409-MINAE publicado el 17 de febrero del 2000 y a través del mismo se decretó el nuevo Reglamento Autónomo de Servicio del Ministerio del Ambiente y Energía.
4Que de conformidad con la Ley de Biodiversidad Nº 7788 del 27 de mayo de 1998 en su artículo 22, el Sistema Nacional de Áreas de Conservación (SINAC), denominado SISTEMA, tendrá personería jurídica propia, será un sistema de gestión y coordinación institucional desconcentrado y participativo a la estructura administrativa del Sistema.
5Que con la promulgación de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995, el Ministerio del Ambiente y Energía asumió nuevas funciones, por lo que requiere de la modernización de las disposiciones jurídicas que rigen las relaciones laborales con sus funcionarios (as), a efecto de cumplir adecuadamente con ellos.
6Que para lograr la eficacia y eficiencia de la Gestión de Recursos Humanos, conviene revisar el Reglamento Autónomo de Servicios de la institución.
7Que la presente modificación fue autorizada por la Asesoría Jurídica de la Dirección General de Servicio Civil, según lo establece el artículo 13 inciso i) del Estatuto de Servicio Civil, mediante oficio AJ-099-2006 de fecha 13 de marzo del 2006. Por tanto,

Considerando:

DECRETAN:

"Artículo 4º-Existirá un Departamento de Recursos Humanos dentro de la Organización del Ministerio, para atender debidamente todos los asuntos referentes al personal.

Éste Departamento contará con la colaboración de Oficinas Auxiliares, que dependerán de cada Dirección General. Asimismo, el Sistema Nacional de Áreas de Conservación (SINAC) contará en forma independiente con una oficina de Recursos Humanos, la cual dependerá administrativamente del Director Superior y técnicamente de la Dirección General de Servicio Civil, de conformidad con el artículo 8 del Reglamento al Estatuto del Servicio Civil; y ésta contará con el apoyo y cooperación de oficinas auxiliares en las diferentes Áreas de Conservación a nivel nacional; las cuales dependerán técnicamente de la Oficina de Recursos Humanos del SINAC y administrativamente de la Dirección del Área de Conservación.

El Departamento de Recursos Humanos y sus oficinas auxiliares, la Oficina de Recursos Humanos del SINAC y sus respectivas oficinas auxiliares tendrán las funciones que les asigne este Reglamento y la demás normativa sobre la materia.

El contenido de éste Reglamento y demás normativa relacionada con la materia, donde implique al Departamento de Recursos Humanos, debe entenderse intrínsecamente a la Oficina de Recursos Humanos del SINAC para los mismos efectos."

67, 69 y 70 del Decreto Ejecutivo número 28409-MINAE, el que en lo sucesivo se leerá de la siguiente manera:

"Artículo 67.-El Departamento de Recursos Humanos del Ministerio y la Oficina de Recursos Humanos del SINAC, serán responsables de la elaboración y custodia del dependencia, y de mantener al día los archivos de los documentos pertinentes, así como de garantizar su confidencialidad." "Artículo 69.-El Departamento de Recursos Humanos y la Oficina de Recursos Humanos del SINAC, según sea el funcionario de su competencia, confeccionará un prontuario de cada servidor (a), a efecto de disponer de un resumen práctico de toda la información derivada de la relación de servicios en asuntos tales como: fecha de ingreso, asistencia, evaluación del desempeño, aspectos disciplinarios, calidades e idoneidad del funcionario (a), vacaciones, y demás información clave." "Artículo 70.-Es deber de las unidades administrativas tanto del Ministerio como del Sistema Nacional de Áreas de Conservación y sus dependencias enviar copia al de su ámbito de competencia, puedan generar actos jurídicos-administrativos.

La información y continuidad en el prontuario, así como en el expediente personal, es de carácter confidencial y solo tendrán acceso a ella los funcionarios (as) del Ministerio y del Sistema Nacional de Áreas de Conservación según corresponda, y que lo requieran para labores propias del cargo, el servidor (a) y su representante autorizado (a)."

"Artículo 113:

b)Para funcionarios (as) con una relación no estatutaria, en lo referente a la instrucción de despido, lo realizará la Unidad legal del Departamento de Recursos Humanos del Ministerio y para los funcionarios (as) del SINAC, la Oficina de Recursos Humanos correspondiente; con el conocimiento y la aprobación del Viceministro o Director Superior (a) respectivamente, siguiendo el mismo procedimiento señalado en los artículos anteriores."

Amendment to MINAE Autonomous Service Regulation on Human ResourcesReforma al Reglamento Autónomo de Servicios del MINAE sobre Recursos Humanos

Artículo 1 — Amend as appropriate Chapter II, on the Department of Human Resources (Departamento de Recursos Humanos), article 4º of Executive Decree number 28409-MINAE, which shall hereafter read as follows:

Artículo 2 — Amend as appropriate Chapter XVII, on the Personnel File (Expediente Personal), articles Nos.

Artículo 3 — Amend as appropriate Chapter XXII, on the Disciplinary Regime and the Application Procedure, article 113 subsection b) of Executive Decree number 28409-MINAE, which shall hereafter read as follows:

Artículo 4 — It shall take effect from its publication.

Artículo 1 — Modifíquese en lo conducente el Capítulo II, del Departamento de Recursos Humanos, artículo 4º del Decreto Ejecutivo número 28409-MINAE, el que en lo sucesivo se leerá de la siguiente manera:

Artículo 2 — Modifíquese en lo conducente el Capítulo XVII, del Expediente personal, artículos Nos.

Artículo 3 — Modifíquese en lo conducente el Capítulo XXII, del Régimen Disciplinario y del Procedimiento de Aplicación, artículo 113 inciso b) del Decreto Ejecutivo número 28409-MINAE, el que en lo sucesivo se leerá de la siguiente manera:

Artículo 4 — Rige a partir de su publicación.
