Throughout the full text - Complete Text of Norm 32750 Reform of the Budget Assigned to the Environmental Services Program for 2005 Complete Text of Record: 9529E Nº 32750 Nº 32750 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by article 140, subsections 3) and 18) and article 146 of the Political Constitution, articles 3, 46, 47, subsection d) of the Forest Law (Ley Forestal) and its amendments, Nº 7575, published in La Gaceta Nº 72 of April 16, 1996, article 5 of the Law of Tax Simplification and Efficiency, Nº 8114, published in La Gaceta Nº 131 of July 9, 2001, the Law of Approval of the Loan Contract signed between the International Bank for Reconstruction and Development (World Bank) and the Government of the Republic of Costa Rica, Nº 8058, published in La Gaceta Nº 13 of January 10, 2001.

1That the experience generated over the last 10 years in the Payment for Environmental Services (Pago por Servicios Ambientales) program, executed by the Ministry of Environment and Energy, in the modality of forest protection, shows us the need to extend the term of validity of the contracts, in order to achieve a greater impact on forest protection actions and with it the favorable effects that derive for society.
2That during the term of the Payment for Environmental Services (Pago de Servicios Ambientales) program, the market values of these services provided by forest plantations and forests have been revealed, which makes necessary an adjustment of the amounts that the State recognizes to small and medium forest producers, for the environmental services produced.
3That these measures will be another means to motivate small and medium forest producers to increase the rate of reforestation and thus contribute to solving the problem of undersupply of plantation timber, a fact that will partially reduce illegal logging in forests and protected areas.
4That the National Forest Development Plan proposes, as one of its main goals, the establishment of 95,000 hectares of forest plantations, the recovery of 283,961 hectares in the modality of forest protection, and at least 24,000 hectares of agroforestry systems contained in the 2004-2013 Action Plan.
5That it is essential that the amounts paid for Payment for Environmental Services in the different modalities adequately reflect the value of the environmental services and that the periods of assignment of rights and commitment of the landowners are adequate to guarantee the provision thereof.
6That it is necessary to apply indexing or adjustment mechanisms to the subsequent payments of the contracts signed by the owners, so that they receive fair compensation, guaranteeing, in turn, the sustainability of the environmental services provided by their forests and plantations.
7That article 3 of Executive Decree (Decreto Ejecutivo) Nº 25721-MINAE, Regulations for the Forest Law and its amendments, published in La Gaceta Nº 16 of January 23, 1997, established that the State Forest Administration shall be the responsibility of the Ministry of Environment and Energy, and shall perform its functions through the National System of Conservation Areas (SINAC) and the National Forest Financing Fund (FONAFIFO). Regarding the promotion of the forestry sector and specifically regarding Payment for Environmental Services in any of its modalities, both institutions may carry out joint actions in order to fulfill the objectives emanating from forest legislation. Therefore,

Considering:

DECREE:

"Article 2º-The maximum amount to be paid per hectare and per tree, as the case may be and as established in subsections d), e), f), g), and h) of article 1 of this Decree, shall be:

a)Sixty-four dollars ($64) per hectare per year for the payment of environmental services for forest protection, disbursed over a period of five years, extendable for another period of five years.
b)Eight hundred sixteen dollars ($816) per hectare for the payment of environmental services for reforestation, disbursed over a term of ten years.
c)One dollar and thirty cents ($1.30) per tree, for the payment of environmental services in reforestation integrated into agroforestry systems, disbursed over a term of three years.

The amount established in subsection a) of this article shall apply starting in the year 2006, for contracts signed in the year 2005. Said amount shall be updated as of the second disbursement.

The amounts established in subsections b) and c) above shall apply to Environmental Services contracts approved as of the year 2005.

The amounts pending disbursement from previous years shall be governed as established in the respective executive decrees for each year.

The disbursements referred to in this article shall be made in colones at the exchange rate in effect on the date of payment authorization." "Article 7º-The payment of environmental services shall be made on a deferred basis according to the following conditions:

a)Reforestation projects with areas less than or equal to fifty hectares may receive advance payment. For these projects, the first disbursement of 46% shall be made once the contract with the State is formalized. The amount to be disbursed must be guaranteed as established in the 2005 Procedures Manual (Manual de Procedimientos). In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. Payments shall be made as of the average planting date.
b)Reforestation projects that do not receive advance payment shall receive the first payment of 46% once the contract is formalized and after complying with the requirements established in the 2005 Procedures Manual. In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. Payments shall be made as of the average planting date.
c)For forest protection projects, the first disbursement shall be made once the contract with the State is signed and after complying with the requirements established in the 2005 Procedure Manual. Disbursements for subsequent years may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
d)For the payment of environmental services for projects in which agroforestry systems are developed, the first disbursement shall be made once the respective contract is signed and the guarantee established in the 2005 Procedures Manual is received by FONAFIFO, or the establishment of the trees and their average planting date is certified by the forest regent (regente forestal). This first disbursement shall be 65% of the established amount. For the second year, it shall be 20%, and 15% for the third year, and they may be requested at twelve and twenty-four months after the date of establishment of the trees certified by the forest regent."

"Article 14.-The amounts established in this Decree shall apply to contracts whose effectiveness is as of the year 2005, with the exception of forest conservation projects, in which case the amount established in subsection a) of article 7 of Decree Nº 32226-MINAE shall be made as of the second disbursement in the year two thousand six.

a)In reforestation projects that incorporate several forest species with different harvest rotations, the effectiveness shall be that of the species with the longest harvest rotation, provided it does not exceed fifteen years, in which case this would be the effectiveness period.
b)For forest protection projects, the effectiveness shall be five years, extendable for an equal period.
c)For projects in which agroforestry systems are developed, the term shall be five years. In these, the encumbrance of the property (afectación del inmueble) shall not be carried out.

For the extension of the Environmental Services contract for forest protection to proceed, the beneficiary must fulfill the following requirements:

a)Written request for extension during the last year of the contract's effectiveness, addressed to FONAFIFO.
b)Maintain ownership of the property subject to the contract, according to the requirements of FONAFIFO's Administrative Procedures Manual.
c)Certification of forest regency (Regencia) of the state of the forest, issued by the competent professional.

Once the requirements are fulfilled, the National Forest Financing Fund shall proceed to approve the extension, provided there is budget content to finance these projects.

"Article 64º-FONAFIFO, from the resources it receives from any source for the payment for environmental services, may use a percentage that may not exceed seven percent of the annual amount granted, to cover the administrative expenses it incurs in the execution of the payment for environmental services program. Likewise, FONAFIFO shall finance, with 2% of that percentage, the execution of the Strategy for Monitoring Payment for Environmental Services (Estrategia de Seguimiento al Pago por Servicios Ambientales) prepared by the National System of Conservation Areas (SINAC).

FONAFIFO must submit the budget corresponding to the remaining 5% for prior approval by SINAC."

1Que la experiencia generada durante los últimos 10 años en el programa de Pago por Servicios Ambientales, ejecutado por el Ministerio de Ambiente y Energía, en la modalidad de protección de bosque, nos evidencia la necesidad de ampliar el periodo de vigencia de los contratos, a fin de lograr a efecto que se tenga un mayor impacto en las acciones de protección del bosque y con ello los efectos favorables que se derivan para la sociedad.
2Que en el periodo de vigencia del programa de Pago de Servicios Ambientales, se han ido revelando los valores de mercado de estos servicios que prestan las plantaciones forestales y los bosques, lo que hace necesario un reajuste de los montos que el Estado reconoce a los pequeños y medianos productores forestales, por los servicios ambientales producidos.
3Que estas medidas serán un medio más para motivar a los pequeños y medianos productores forestales para incrementar la tasa de reforestación y contribuir así a solucionar el problema de desabastecimiento de madera de plantación, hecho que disminuirá en parte la tala ilegal sobre los bosques y las áreas protegidas.
4Que el Plan Nacional de Desarrollo Forestal, propone como una de sus principales metas, el establecimiento de 95,000 hectáreas de plantaciones forestales, la recuperación de 283.961 hectáreas en la modalidad de protección de bosques y al menos 24.000 hectáreas de sistemas agroforestales contenidos en el Plan de Acción 2004-2013.
5Que se hace indispensable que los montos pagados por concepto de Pago de Servicios Ambientales en las distintas modalidades, reflejen adecuadamente el valor de los servicios ambientales y que los períodos de cesión de derechos y compromiso de los propietarios de tierras, sean adecuados para garantizar la prestación de los mismos.
6Que es necesario aplicar mecanismos de indexación o ajuste de los pagos posteriores de los contratos suscritos por los y las propietarios (as), de manera que estos reciban una justa compensación, garantizando a su vez, la sostenibilidad de los servicios ambientales por sus bosques y plantaciones.
7Que el artículo 3º del Decreto Ejecutivo Nº 25721-MINAE, Reglamento de la Ley Forestal y sus reformas, publicado en La Gaceta Nº 16 del 23 de enero de 1997, estableció que la Administración Forestal del Estado le competerá al Ministerio del Ambiente y Energía, y realizará sus funciones, por medio del Sistema Nacional de Áreas de Conservación (SINAC) y del Fondo Nacional de Financiamiento Forestal (FONAFIFO). En lo relativo al fomento del sector forestal y específicamente en cuanto al Pago por Servicios Ambientales en cualquiera de sus modalidades ambas instituciones podrán realizar acciones conjuntas con el fin de cumplir los objetivos emanados de la legislación forestal. Por tanto,

Considerando:

DECRETAN:

"Artículo 2º-El monto máximo a pagar por hectárea y por árboles según sea el caso y según lo establecido en los incisos d), e), f), g) y h) del artículo 1 de este Decreto, será de:

a)Sesenta y cuatro dólares ($64) por hectárea por año para el pago de servicios ambientales por protección de bosque, desembolsados en un período de cinco años prorrogable por otro período de cinco años.
b)Ochocientos dieciséis dólares ($816) por hectárea para el pago de servicios ambientales por reforestación, desembolsados en un plazo de diez años.
c)Un dólar treinta centavos ($1,30) por árbol, para el pago de servicios ambientales en reforestación integrados a sistemas agroforestales, desembolsados en un plazo de tres años.

El monto establecido en el inciso a) de este artículo, se aplicará a partir del año 2006, para los contratos firmados el año 2005. Dicho monto será actualizado a partir del segundo desembolso.

Los montos establecidos en los incisos b) y c) anteriores, se aplicarán a los contratos de Servicios Ambientales aprobados a partir del año 2005.

Los montos pendientes de desembolsar de años anteriores, se regirán según lo establecido en los decretos ejecutivos respectivos para cada año.

Los desembolsos a que hace referencia este artículo se realizarán en colones al tipo de cambio vigente a la fecha de autorización del pago." "Artículo 7º-El pago de servicios ambientales se hará diferido de acuerdo con las siguientes condiciones:

a)Los proyectos de reforestación con áreas menores o iguales a cincuenta hectáreas, podrán recibir el pago por adelantado. Para estos proyectos, el primer desembolso del 46% se hará una vez formalizado el contrato con el Estado. El monto a desembolsar deberá estar garantizado según se establezca en el Manual de Procedimientos del año 2005. En los restantes nueve años se pagará un porcentaje anual de 6% del monto total del contrato. Los pagos se realizarán a partir de la fecha promedio de plantación.
b)Los proyectos de reforestación que no reciben pago por adelantado, recibirán el primer pago del 46% una vez formalizado el contrato y cumpliendo con los requisitos establecidos en el Manual de Procedimientos del año 2005. En los restantes nueve años se pagará un porcentaje anual de 6% del monto total del contrato. Los pagos se realizarán a partir de la fecha promedio de plantación.
c)Para los proyectos de protección de bosque, el primer desembolso se hará una vez firmado el contrato con el Estado y cumpliendo con los requisitos establecidos en el Manual de Procedimiento del año 2005. Los desembolsos de los años siguientes podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
d)El pago de servicios ambientales para los proyectos en los que se desarrollen sistemas agroforestales, el primer desembolso se hará una vez firmado el respectivo contrato y sea recibida por FONAFIFO la garantía que se establezca en el Manual de Procedimientos del año 2005 o se certifique por parte del regente forestal el establecimiento de los árboles y su fecha promedio de plantación. Este primer desembolso será de un 65% del monto establecido. Para el segundo año será de un 20% y un 15% para el tercer año y podrán solicitarse a los doce y veinticuatro meses después de la fecha de establecimiento de los árboles certificada por el regente forestal."

"Artículo 14.-Los montos establecidos en este Decreto se aplicarán a los contratos cuya vigencia sea a partir del año 2005, con excepción de los proyectos de conservación de bosque, en cuyo caso el monto establecido en el inciso a) del artículo 7º del Decreto Nº 32226- MINAE, se realizará a partir del segundo desembolso en el año dos mil seis.

a)En proyectos de reforestación que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia será la de la especie que tenga el turno mayor de cosecha, siempre que ésta no exceda de quince años, en cuyo caso éste sería el lapso de tiempo de la vigencia.
b)Para proyectos de protección de bosque, la vigencia será de cinco años prorrogables por un período igual.
c)Para los proyectos en los que se desarrollan sistemas agroforestales, el plazo será de cinco años. En éstos no se realizará la afectación del inmueble.

Para que proceda la prórroga del contrato de Servicios Ambientales de protección de bosque, el beneficiario deberá cumplir los siguientes requisitos:

a)Solicitud de prórroga por escrito durante el último año de vigencia del contrato, dirigida al FONAFIFO.
b)Mantener la titularidad del inmueble objeto del contrato, según los requerimientos del Manual de Procedimientos Administrativos del FONAFIFO.
c)Certificación de Regencia del estado del bosque, emitida por el profesional competente.

Cumplidos los requisitos, el Fondo Nacional de Financiamiento Forestal, procederá a aprobar la prórroga, siempre y cuando exista el contenido presupuestario para financiar estos proyectos.

"Artículo 64º-FONAFIFO, de los recursos que perciba de cualquier fuente para el pago por servicios ambientales, podrá disponer de un porcentaje que no podrá ser mayor al siete por ciento del monto anual otorgado, para hacer frente a los gastos administrativos en que incurra en la ejecución del programa de pagos por servicios ambientales. Asimismo, el FONAFIFO financiará con un 2% de ese porcentaje, la ejecución de la Estrategia de Seguimiento al Pago por Servicios Ambientales elaborada por el Sistema Nacional de Áreas de Conservación (SINAC).

El FONAFIFO deberá someter a aprobación previa del SINAC, el presupuesto correspondiente al 5% restante."
