Likewise, to ensure the production of raw material that reduces pressure on the natural forest, protecting biodiversity and ensuring the provision of environmental services established in the Ley Forestal.

a). One hundred thousand hectares of forest dedicated to protection, on lands located within the areas of the Mesoamerican Biological Corridor Project (Costa Rica Section).

b). A 100% increase in the participation of indigenous communities in the PPSA.

c). A 30% increase in the participation of female landowners in the PPSA.

7575 and its amendments, the Executive Branch shall establish by decree the priority areas in which environmental services are to be paid, the number of hectares available, and the amount per hectare.

Therefore,

Furthermore, the World Bank, through the Ecomercados Project, will allocate up to five thousand two hundred eighty-one million nine hundred thirty thousand seven hundred sixty-four exact colones (¢5,281,930,764). For its part, Trust 544-1 "Payment for Environmental Services" will contribute the sum of one thousand seven hundred twenty-eight million one hundred thirteen thousand one hundred eighty-two exact colones (¢1,728,113,182), which includes the sum of nine hundred forty-eight million six hundred seventy-three thousand seven hundred ninety-eight colones (¢948,673,798) from the Financial Cooperation Agreement for the Huetar Norte Forest Project.

These amounts will be distributed in the following manner:

a). One hundred million four hundred ninety-two thousand exact colones (¢100,492,000) corresponding to 7% to cover the execution costs of the PPSA, in accordance with the provisions of Article 64 of Executive Decree No. 25721-MINAE, Regulation to the Ley Forestal No. 7575, reformed by Executive Decree No. 31081-MINAE,

b). Seventy-five million six hundred thousand exact colones (¢75,600,000) to comply with subsection b) of Section 3.02 of Law No. 8058.

c). Six thousand four hundred eighty-three million one hundred sixty-five thousand six hundred ninety-six exact colones (¢6,483,165,696) for the payment of pending commitments from payment for environmental services contracts formalized in the years 1997 to 2004.

d). Seven hundred twenty-seven million six hundred fifty thousand exact colones (¢727,650,000) for the payment of environmental services under the reforestation modality on 5,400 hectares located in priority areas, for the purpose of establishing plantations for the production of raw material for industrial purposes.

e). Eighty million eight hundred fifty thousand exact colones (¢80,850,000) for the payment of environmental services under the reforestation modality on 600 hectares with native species, contained in the decrees on logging bans and threatened or endangered species (Decree No. 25663-MINAE and Decree No. 25700-MINAE), or recovery of areas through natural regeneration.

f). One thousand eighty-seven million eight hundred thousand exact colones (¢1,087,800,000), for the payment of environmental services under the forest protection modality on 51,800 hectares located in priority areas.

g). Forty-six million two hundred thousand exact colones (¢46,200,000), for environmental services under the forest protection modality on 2,200 hectares located in areas that protect water sources in general and especially those destined for human consumption.

h). One hundred nineteen million four hundred eighty-six thousand two hundred fifty exact colones (¢119,486,250) for the payment of environmental services under the reforestation integrated into agroforestry systems modality on 475,000 trees.

FONAFIFO may vary the distribution established in the preceding subsections in accordance with the supply of lands that intend to enter the modalities, provided that the total amount of resources authorized in this article is not exceeded.

The contracts that FONAFIFO issues for this purpose shall establish the conditions, terms, form of payment, and other requirements to comply with what is stipulated in this article.

In the event of having a greater allocation of resources as established in Article 5 of Law No. 8114 "Law on Tax Simplification and Efficiency," and other financial resources from projects under negotiation or from other income received by FONAFIFO for the payment of environmental services, they shall be distributed proportionally for the same modalities established in this decree.

• a)Sixty-four dollars ($64) per hectare per year for the payment of environmental services for forest protection, disbursed over a period of five years, renewable for another period of five years.
• b)Eight hundred sixteen dollars ($816) per hectare for the payment of environmental services for reforestation, disbursed over a term of ten years.
• c)One dollar and thirty cents ($1.30) per tree, for the payment of environmental services in reforestation integrated into agroforestry systems, disbursed over a term of three years.

The amount established in subsection a) of this article shall apply starting in the year 2006, for contracts signed in the year 2005. Said amount will be updated from the second disbursement.

The amounts established in subsections b) and c) above shall apply to Environmental Services contracts approved starting in the year 2005.

The amounts pending disbursement from previous years shall be governed by the provisions of the respective executive decrees for each year.

The disbursements referred to in this article shall be made in colones at the exchange rate in effect on the date of authorization of payment.

This goal shall be subject to the budgetary allocation for the PPSA.

A. Reforestation projects. The following areas with the following criteria are established as priority areas for the execution of reforestation projects:

a). Priority shall be given to sites that present high productive potential for the development of forest plantations (land-use capability classes III, IV, V, and VI of the official methodology established in the Manual for the Determination of Land-Use Capability of Costa Rica, Executive Decree No. 23214-MAG-MIRENEM).

b). Sites where there is high potential for plantation blocks, giving special priority to projects that use improved genetic material.

c). Furthermore, these areas must be located in the Tortuguero Conservation Areas, in the zone of influence of the Huetar Norte Forest Project (Huetar Norte Conservation Area and Sarapiquí Subregion of the Cordillera Volcánica Central Conservation Area), Tempisque, Central Pacific, Osa, and the Central Subregion of the La Amistad Pacífico Conservation Area (an area considered to have sufficient industrial, social, and technological development for reforestation).

d). Areas where reforestation projects financed through incentives were executed and that have complied with the approved management plans may be included.

e). For reforestation projects with native species, established as a priority and contained in the decrees on logging bans and threatened or endangered species (Decree No. 25663-MINAE and Decree No. 25700-MINAE), the entire country is established as a priority.

f). Areas located in cantons with a Social Development Index (Índice de Desarrollo Social, IDS) of less than 40%, according to the determination made by MIDEPLAN in 2001.

B. Forest protection projects. The following areas with the following criteria are established as priority areas for the execution of forest protection projects:

a). For the processing of protection projects, priority shall be given to those located in biological corridors officially recognized up to the year 2003 by SINAC, especially those prioritized for the Ecomercados Project.

b). For the processing of protection projects, in the zone of influence of the Huetar Norte Forest Project.

c). Protection projects that comply with the provisions of points a and b, and that have expired contracts from previous years.

d). Forest areas that function to protect water resources.

e). Private areas within protected wild areas, whatever their management category.

f). Areas located in cantons with a Social Development Index (IDS) of less than 40%, according to the determination made by MIDEPLAN in 2001.

C. Agroforestry systems projects. Priority shall be given to projects processed by organizations that meet the requirements established in the 2005 Procedures Manual.

In each of the Subregional Offices of SINAC and Regional Offices of FONAFIFO, a map shall be maintained with the priority areas for locating the farms that apply to the PPSA.

• a)Reforestation projects with areas less than or equal to fifty hectares may receive advance payment. For these projects, the first disbursement of 46% shall be made once the contract with the State is formalized. The amount to be disbursed must be guaranteed as established in the 2005 Procedures Manual. In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. Payments shall be made based on the average planting date.
• b)Reforestation projects that do not receive advance payment shall receive the first payment of 46% once the contract is formalized and upon meeting the requirements established in the 2005 Procedures Manual. In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. Payments shall be made based on the average planting date.
• c)For forest protection projects, the first disbursement shall be made once the contract with the State is signed and upon meeting the requirements established in the 2005 Procedure Manual. Disbursements for subsequent years may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
• d)For the payment of environmental services for projects in which agroforestry systems are developed, the first disbursement shall be made once the respective contract is signed and the guarantee established in the 2005 Procedures Manual is received by FONAFIFO, or the establishment of the trees and their average planting date is certified by the forest manager (regente forestal). This first disbursement shall be for 65% of the established amount. For the second year, it shall be 20%, and 15% for the third year, and may be requested at twelve and twenty-four months after the date of establishment of the trees certified by the forest manager (regente forestal).

• a)In reforestation projects that incorporate several forest species with different harvest cycles, the effectiveness period shall be that of the species with the longest harvest cycle, provided it does not exceed fifteen years, in which case this shall be the length of the effectiveness period.
• b)For forest protection projects, the effectiveness period shall be five years, renewable for an equal period.
• c)For projects involving agroforestry systems, the term shall be five years. In these, no encumbrance (afectación) of the property shall be made.

For the extension of the forest protection Environmental Services contract to proceed, the beneficiary must meet the following requirements:

• a)Written request for extension during the last year of the contract's effectiveness, addressed to FONAFIFO.
• b)Maintain ownership of the property subject to the contract, as per the requirements of FONAFIFO's Administrative Procedures Manual.
• c)Certification of Forest Management of the forest's state, issued by the competent professional.

Once the requirements are met, the National Forestry Financing Fund shall proceed to approve the extension, provided there is budgetary content to finance these projects.

Servicios Ambientales (PPSA).

Así mismo asegurar la producción de materia prima que disminuya la presión sobre el bosque natural, protegiendo la biodiversidad y asegurando la provisión de los servicios ambientales establecidos en la Ley Forestal.

a). Cien mil hectáreas de bosque dedicados a la protección, en terrenos ubicados dentro de las áreas del Proyecto Corredor Biológico Mesoamericano (Sección Costa Rica).

b). Aumento de 100% en la participación de comunidades indígenas en el PPSA.

c). Aumento de un 30% en la participación de mujeres propietarias en el PPSA.

10.-Que en la selección de proyectos en la modalidad de protección de bosques, las Oficinas Regionales del FONAFIFO, deben dar prioridad a las presolicitudes de áreas ubicadas dentro del Proyecto Corredor Biológico Mesoamericano (Sección Costa Rica), con el fin de contribuir a su fortalecimiento y consolidación.

11.-Que según el artículo 38 y 62 del Reglamento a la Ley Forestal Nº 7575 y sus modificaciones, el Poder Ejecutivo establecerá mediante decreto, las áreas prioritarias en las que se debe pagar servicios ambientales, la cantidad de hectáreas disponibles y el monto por hectárea.

12.-Que FONAFIFO como órgano adscrito al MINAE procurará mejorar el índice de desarrollo social especialmente en las áreas rurales. Por lo tanto,

Estos montos se distribuirán de la siguiente manera:

a). Cien millones cuatrocientos noventa y dos mil colones exactos (¢100.492.000) correspondiente al 7% para cubrir los gastos de ejecución del PPSA, de conformidad con lo establecido en el artículo 64 del Decreto Ejecutivo Nº 25721-MINAE, Reglamento a la Ley Forestal Nº 7575, reformado por el Decreto Ejecutivo Nº 31081- MINAE, artículo 12.

b). Setenta y cinco millones seiscientos mil colones exactos (¢75.600.000) para dar cumplimiento al inciso b), de la Sección 3.02 de la Ley Nº 8058.

c). Seis mil cuatrocientos ochenta y tres millones ciento sesenta y cinco mil seiscientos noventa y seis colones exactos (¢6.483.165.696) para el pago de compromisos pendientes de contratos de pago de servicios ambientales formalizados en los años 1997 al 2004.

d). Setecientos veintisiete millones seiscientos cincuenta mil colones exactos (¢727.650.000) para el pago de servicios ambientales en la modalidad de reforestación sobre 5.400 hectáreas ubicadas en las áreas prioritarias, con el fin de establecer plantaciones para la producción de materia prima con fines industriales.

e). Ochenta millones ochocientos cincuenta mil colones exactos (¢80.850.000) para el pago de servicios ambientales en la modalidad de reforestación sobre 600 hectáreas con especies nativas, contenidas en los decretos de vedas y especies amenazadas o en peligro de extinción (Decreto Nº 25663 MINAE y Decreto Nº 25700 MINAE), o recuperación de áreas mediante regeneración natural.

f). Mil ochenta y siete millones ochocientos mil colones exactos (¢1.087.800.000), para el pago de servicios ambientales en la modalidad de protección de bosques sobre 51.800 hectáreas ubicadas en las áreas prioritarias.

g). Cuarenta y seis millones doscientos mil colones exactos (¢46.200.000), para servicios ambientales en la modalidad de protección de bosque sobre 2.200 hectáreas situadas en áreas que protegen fuentes de agua en general y en especial aquellas destinadas al consumo humano.

h). Ciento diecinueve millones cuatrocientos ochenta y seis mil doscientos cincuenta colones exactos (¢119.486.250) para el pago de servicios ambientales en la modalidad de reforestación integrada a sistemas agroforestales sobre 475.000 árboles.

FONAFIFO podrá variar la distribución establecida en los incisos anteriores de acuerdo con la oferta de tierras que pretendan ingresar a las modalidades, siempre y cuando no sobrepasen el monto total de los recursos autorizados en este artículo.

Los contratos que al efecto emita el FONAFIFO, establecerán las condiciones, plazos, forma de pago y otros requisitos para cumplir con lo estipulado en este artículo.

En caso de disponer con una mayor asignación de recursos según lo establece el artículo 5 de la Ley Nº 8114 "Ley de Simplificación y Eficiencia Tributaria", y otros recursos financieros provenientes de proyectos en negociación o por otros ingresos que capte el FONAFIFO, para el pago de servicios ambientales, se distribuirán en forma proporcional para las mismas modalidades establecidas en este decreto.

• a)Sesenta y cuatro dólares ($64) por hectárea por año para el pago de servicios ambientales por protección de bosque, desembolsados en un período de cinco años prorrogable por otro período de cinco años.
• b)Ochocientos dieciséis dólares ($816) por hectárea para el pago de servicios ambientales por reforestación, desembolsados en un plazo de diez años.
• c)Un dólar treinta centavos ($1,30) por árbol, para el pago de servicios ambientales en reforestación integrados a sistemas agroforestales, desembolsados en un plazo de tres años.

El monto establecido en el inciso a) de este artículo, se aplicará a partir del año 2006, para los contratos firmados el año 2005. Dicho monto será actualizado a partir del segundo desembolso.

Los montos establecidos en los incisos b) y c) anteriores, se aplicarán a los contratos de Servicios Ambientales aprobados a partir del año 2005.

Los montos pendientes de desembolsar de años anteriores, se regirán según lo establecido en los decretos ejecutivos respectivos para cada año.

Los desembolsos a que hace referencia este artículo se realizarán en colones al tipo de cambio vigente a la fecha de autorización del pago.

A. Proyectos de reforestación. Se establecen como prioritarias para la ejecución de proyectos de reforestación las áreas con los siguientes criterios:

a). Se dará prioridad a los sitios que presenten un alto potencial productivo para el desarrollo de plantaciones forestales (clases de capacidad de uso III, IV, V y VI de la metodología oficial establecida en el Manual para la determinación de la capacidad de uso de las tierras de Costa Rica, Decreto Ejecutivo Nº 23214- MAG-MIRENEM).

b). Sitios donde haya un alto potencial de bloques de plantación, dando especial prioridad a los proyectos que utilicen material genético mejorado.

c). Además estas áreas deben ubicarse en las Áreas de Conservación Tortuguero, en la zona de influencia del Proyecto Forestal Huetar Norte (Área de Conservación Huetar Norte y Subregión Sarapiquí del Área de Conservación Cordillera Volcánica Central), Tempisque, Pacífico Central, Osa y la Subregión Central del Área de Conservación Amistad Pacífico (Área considerada con suficiente desarrollo industrial, social y tecnológico para la reforestación).

d). Se podrán incluir áreas en donde se ejecutaron proyectos de reforestación financiados por medio de incentivos y que hayan cumplido con los planes de manejo aprobados.

e). Para los proyectos de reforestación con especies nativas, establecidos como prioritarios y contenidos en los decretos de vedas y especies amenazadas o en peligro de extinción, (Decreto Nº 25663-MINAE y Decreto Nº 25700-MINAE), se establece como prioritario todo el país.

f). Áreas ubicadas en los cantones con Índice de Desarrollo Social (IDS) menor al 40% según la determinación realizada por MIDEPLAN en el 2001.

B. Proyectos de protección de bosques. Se establecen como prioritarias para la ejecución de proyectos de protección de bosque las áreas con los siguientes criterios:

a). Para el trámite de proyectos de protección, se dará prioridad aquellos ubicados en corredores biológicos reconocidos oficialmente hasta el año 2003 por el SINAC, especialmente los prioritarios para el Proyecto Ecomercados.

b). Para el trámite de proyectos de protección, en la zona de influencia del Proyecto Forestal Huetar Norte.

c). Proyectos de protección que cumplan con lo establecido en los puntos a y b, y que tengan contratos vencidos de años anteriores.

d). Áreas de bosque que tengan como función la protección del recurso hídrico.

e). Áreas privadas dentro de las áreas silvestres protegidas cualquiera que sea su categoría de manejo.

f). Áreas ubicadas en los cantones con Índice de Desarrollo Social (IDS) menor al 40% según la determinación realizada por MIDEPLAN en el 2001.

C. Proyectos de sistemas agroforestales. Se dará prioridad a proyectos tramitados por organizaciones que cumplan con los requisitos establecidos en el Manual de Procedimientos del 2005.

En cada una de las Oficinas Subregionales del SINAC y Regionales del FONAFIFO, se mantendrá un mapa con las áreas prioritarias para ubicar las fincas que apliquen al PPSA.

• a)Los proyectos de reforestación con áreas menores o iguales a cincuenta hectáreas, podrán recibir el pago por adelantado. Para estos proyectos, el primer desembolso del 46% se hará una vez formalizado el contrato con el Estado. El monto a desembolsar deberá estar garantizado según se establezca en el Manual de Procedimientos del año 2005. En los restantes nueve años se pagará un porcentaje anual de 6% del monto total del contrato. Los pagos se realizarán a partir de la fecha promedio de plantación.
• b)Los proyectos de reforestación que no reciben pago por adelantado, recibirán el primer pago del 46% una vez formalizado el contrato y cumpliendo con los requisitos establecidos en el Manual de Procedimientos del año 2005. En los restantes nueve años se pagará un porcentaje anual de 6% del monto total del contrato. Los pagos se realizarán a partir de la fecha promedio de plantación.
• c)Para los proyectos de protección de bosque, el primer desembolso se hará una vez firmado el contrato con el Estado y cumpliendo con los requisitos establecidos en el Manual de Procedimiento del año 2005. Los desembolsos de los años siguientes podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
• d)El pago de servicios ambientales para los proyectos en los que se desarrollen sistemas agroforestales, el primer desembolso se hará una vez firmado el respectivo contrato y sea recibida por FONAFIFO la garantía que se establezca en el Manual de Procedimientos del año 2005 o se certifique por parte del regente forestal el establecimiento de los árboles y su fecha promedio de plantación. Este primer desembolso será de un 65% del monto establecido. Para el segundo año será de un 20% y un 15% para el tercer año y podrán solicitarse a los doce y veinticuatro meses después de la fecha de establecimiento de los árboles certificada por el regente forestal.

• a)En proyectos de reforestación que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia será la de la especie que tenga el turno mayor de cosecha, siempre que ésta no exceda de quince años, en cuyo caso éste sería el lapso de tiempo de la vigencia.
• b)Para proyectos de protección de bosque, la vigencia será de cinco años prorrogables por un período igual.
• c)Para los proyectos en los que se desarrollan sistemas agroforestales, el plazo será de cinco años. En éstos no se realizará la afectación del inmueble.

Para que proceda la prórroga del contrato de Servicios Ambientales de protección de bosque, el beneficiario deberá cumplir los siguientes requisitos:

• a)Solicitud de prórroga por escrito durante el último año de vigencia del contrato, dirigida al FONAFIFO.
• b)Mantener la titularidad del inmueble objeto del contrato, según los requerimientos del Manual de Procedimientos Administrativos del FONAFIFO.
• c)Certificación de Regencia del estado del bosque, emitida por el profesional competente.

Cumplidos los requisitos, el Fondo Nacional de Financiamiento Forestal, procederá a aprobar la prórroga, siempre y cuando exista el contenido presupuestario para financiar estos proyectos.
