Nature of the functions of the Department of Institutional Management:
This department is responsible for providing direct and personalized communication to all citizens (administrados) or users of the services provided by SETENA, through an effective system that uses automated and personalized mechanisms. It must supervise and control that a timely and quality response is given, according to the requirements and needs of the various users and/or citizens (administrados) of the system. Likewise, it is responsible for exercising control and follow-up of the works, activities, or projects subject to environmental impact study (Estudio de Impacto Ambiental), and is therefore obliged to verify compliance with the environmental commitments (compromisos ambientales) undertaken by the project proponent (proyectista) or proponent.
The functions of the Department of Institutional Management are the following:
1. Provide users and citizens (administrados) with timely information on services, procedures, forms, and processes according to the type of procedure and nature of the activity, work, or project.
2. Register, record, and coordinate all activities, works, or projects presented before SETENA according to the environmental impact assessment (Evaluación de Impacto Ambiental) mechanism established in the respective regulation.
3. Receive environmental complaints (denuncias ambientales) and forward them to the Department of Project Administration or to the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) or other instances, as appropriate.
4. Guarantee the provision of a transparent, efficient, and effective service, through standardized instruments that ensure service quality, as well as the necessary mechanisms for assertive and active participation of civil society, according to the terms defined by law and regulation.
5. Coordinate and organize everything concerning the organization and execution of public hearings (audiencias públicas) that the Plenary Commission orders to be held for a particular activity, work, or project.
6. Administer the library and the Environmental Information System of SETENA.
7. Request the competent accreditation body to keep an updated registry of accredited external environmental consultants (consultores ambientales), and verify that it periodically sends SETENA a list of the physical or legal persons that comprise it.
8. Establish a registry of environmental responsible parties (responsables ambientales).
9. Verify the payment of fees for services and for the technical and legal instruments issued in the environmental impact assessment (Evaluación de Impacto Ambiental) process, to fulfill the purposes of the Organic Law of the Environment, such as: licenses, registries, manuals, guides, forms, documents, certifications, records, publications, courses.
10. Define mechanisms to evaluate the management of the Department of Institutional Management, as well as the needs, expectations, and requirements of users or citizens (administrados).
11. Provide interested users, non-governmental organizations, public institutions, and civil society, through suitable means at its disposal, such as: electronic means, telephone, fax, or in person, in writing, with information on the activities, works, or projects presented for their environmental viability (viabilidad ambiental), their progress status, as well as the final administrative resolutions (resoluciones administrativas).
12. Supply in printed or electronic form all guides and instruments required by executive decree (decreto ejecutivo) to submit an activity, work, or project to the environmental impact assessment (Evaluación de Impacto Ambiental) process, after charging the cost of the corresponding service.
13. Implement the File Administration (Administración de Expedientes) system, together with what the Plenary Commission orders in this regard for the activities, works, or projects subject to the environmental impact assessment (Evaluación de Impacto Ambiental), and within the scope of its competence, respond to the proponent or project proposer (proyectista) regarding the environmental impact assessment (Evaluación de Impacto Ambiental) in process.
14. Ensure that the proponent or project proponent (proyectista) is provided, efficiently and single window (ventanilla única), with the appropriate technological platform and the necessary instruments, so that on-site decisions are made to resolve the case, as well as sufficient advice for proper administration of their file.
15. Ensure that prior classification of the activities, works, or projects is carried out, and that the deadlines provided for in the regulation are met.
16. Promptly forward to the Department of Project Administration all activities, works, or projects that require an environmental impact study (Estudio de Impacto Ambiental).
17. Render the reports required of it in matters within its competence.
18. Carry out field inspections to evaluate the information presented in the process.
19. Carry out environmental control (control), follow-up (seguimiento), and audit (auditoría ambiental) of all activities, works, or projects subject to an environmental impact study (Estudio de Impacto Ambiental), in accordance with the prioritization and distribution systems established by the Plenary Commission.
20. Verify that the execution of the activity, work, or project is in accordance with the environmental commitments (compromisos ambientales) undertaken by the proponent, project proponent (proyectista), or developer (desarrollador) and as indicated in the information provided to the file.
21. Train the public officials designated as environmental authorities to SETENA in fulfilling the functions entrusted, especially in the environmental control (control) and follow-up (seguimiento) of the activities, works, or projects subject to an environmental impact study (Estudio de Impacto Ambiental).
22. Any others necessary for the effective and efficient fulfillment of its functions.
