THE FIRST VICE PRESIDENT, EXERCISING THE PRESIDENCY OF THE REPUBLIC, AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Using the powers conferred upon them by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration, and Law No. 6289 of December 4, 1978, Seed Law (Ley de Semillas).
1st—That it is an unavoidable duty of the State to safeguard the health of the population, preventing or suppressing those acts or omissions by private parties that entail a risk to human health as a legal interest of supreme importance for the social and economic development of the country.
2nd—That the National Seed Office (Oficina Nacional de Semillas), an Institution attached to the Ministry of Agriculture and Livestock, is responsible for the promotion, protection, improvement, control, and use of superior-quality seeds, for which it shall establish the necessary standards and mechanisms for their circulation and trade.
3rd—That the National Seed Office (Oficina Nacional de Semillas) must register all imports and exports of seeds and establish controls for their commercialization, observing the criteria of protecting the health and life of people and animals, the preservation of plants, and the prevention of practices that may induce error.
4th—That all seed reproduced in the country, regardless of its place of origin, can be affected by external pathogenic and physical factors, which directly affect and deprive the farmer and consumer of the legitimate right to acquire products capable of satisfying their expectations of profitable production and consumption.
5th—That any regulation of economic activities in the internal market for national and imported products requires the minimum necessary to protect human, plant, or animal health, the environment, and compliance with minimum quality standards.
6th—That both the seed that is commercialized and that which is introduced for other purposes is exposed to contamination risks, and therefore the necessary controls must be exercised. Therefore:
