COSTA RICAN INSTITUTE OF PACIFIC PORTS That the Board of Directors of this Institution, through Agreement No. 2 taken in Session No. 3296 held on June 9 of the current year, agreed to approve the Regulations for the Operation of the Quepos Port Pier, which shall read as follows:

OPERATING REGULATIONS FOR THE QUEPOS PORT PIER

General Provisions

CHAPTER I

22161-MOPT in La Gaceta No. 95 of Wednesday, May 19, 1993. Furthermore, as established by Law of the Republic No. 1721 of December 1953, amended by Law No. 4964 of March 1972, which clarifies that the Costa Rican Institute of Pacific Ports (INCOP) is responsible for the functions of Port Authority of the Pacific Coast of Costa Rica.

a)I.N.C.O.P.: Costa Rican Institute of Pacific Ports.
b)Facilities: Any port infrastructure work intended to provide any service and facility to vessels and cargo.
c)Vessel: Any craft intended for maritime navigation used for the transport of cargo and/or passengers, cabotage, or tourism.
d)G.R.T.: Gross Registered Tonnage of the vessel, it is the total capacity of the ship expressed in tons of 100 cubic feet.
e)Pier: Part of the infrastructure of the Port, intended for the stay of the vessel in order to facilitate its loading and unloading operations.
f)Client: Any natural or legal person who requests and pays for a service and complies with the rules established by INCOP.
g)Supplies: Each of the factors that intervene in the production of goods or services.
h)ISPS Code: Code for the protection of ships and port facilities.

The administration of the Quepos Port Terminal will take the necessary measures to meet the security requirements at the pier, allowing it to implement the ISPS Code. The conditions that are determined shall form an integral part of this Regulation.

These must be removed once the operation is completed at the client's expense.

Non-compliance shall result in the corresponding disciplinary and legal sanction.

On the Description of Services

CHAPTER II

a)Berthing (Estadía): Corresponds to the occupation of the pier made by the vessel while it is berthed.

Billing unit: Meter of length overall-day or fraction.

Description of services:

1)Sport fishing vessels.
2)Artisanal fishing vessels.
3)Yachts and pleasure vessels.
b)Wharfage (Muellaje): Consists of the use of the pier facilities by cargo in transit from or to the vessel. Billing unit: Metric ton or fraction.
c)Entry of vehicles to the pier facilities (toll): Every vehicle entering the pier facilities must pay for their use.

Billing unit: Movement.

d)Boarding and disembarkation of passengers: Passengers disembarking from or boarding pleasure and tourist vessels must pay for the use of the facilities.

Billing unit: Per person.

e)Anchoring of vessels in the protected zone: Billing unit: G.R.T.
f)Any other service offered mainly to larger vessels shall be governed by the General Regulations for Port Services of INCOP and its tariff provisions.

Any service provided in the future at this terminal, and that is duly approved by ARESEP, shall form an integral part of this Regulation.

On the Entry and Stay of Persons and Vehicles at the Facilities of the Quepos Port Pier

CHAPTER III

a)Duly identified officials or employees of INCOP.
b)Vessel employees or persons who for work reasons must remain within the facilities, provided they are duly identified with their pass.

a)Transi along the routes designated for that purpose.
b)Respect the indicated speed limit.
c)Park in the areas designated for that purpose.
d)Turn off the engine while loading or unloading is taking place.
e)Not carry out repairs, and in the event of breakdowns, they must be removed from the pier facilities immediately.

a)All vehicles owned by INCOP or under its administration.
b)Private vehicles authorized by the Executive Presidency, General Management of INCOP, or the Pier Administration.
c)Every vehicle that has paid its toll.

There are two types of passes: a) Temporary b) For visitors.

Furthermore, the passes shall indicate their validity.

Crew members shall carry a temporary pass within the Pier facilities, and the Administration shall keep the corresponding control.

The visitor passes shall bear a registration number.

On the Supply of Provisions

CHAPTER VI

Such request must clearly indicate the identification of the service requested, using a submission format which shall contain, among other things, the name of the applicant, identity card; description of the services requested, and data of the vessel.

The request shall be signed by the client or their representative, previously accredited as such before the Administration of the Quepos Port Pier, for which the latter shall keep a signature record of the persons authorized by the user to assume the responsibilities entailed by the provision of the service.

The person in charge of making the bank deposit shall report to the Accounting Department of the Institution on every business day the income report (daily movement report).

The deposit amount must be paid in cash or certified checks, provided that the General Management of INCOP authorizes the Pier Administration to receive checks drawn on Banks of the National System, as long as these are habitual clients.

A settlement shall be made based on the deposit previously made.

In the event that the balance of the settlement is a credit, the amount shall be credited for application to future services.

Final Provisions

CHAPTER VII

As regards clients of the pier facilities who breach the provisions established herein, they shall receive the following sanctions:

a)A written warning, if not a repeat offender, this being for minor cases.
b)Suspension of the provision of the service or of the entry pass to the pier facilities for 15 days the first time.
c)Total cancellation of the provision of services or of the pass or entry permit to the pier facilities.

Shall become effective upon its publication in the Official Gazette La Gaceta.

INSTITUTO COSTARRICENSE DE PUERTOS DEL PACÍFICO Que la Junta Directiva de esta Institución mediante Acuerdo Nº 2 tomado en la sesión Nº 3296 celebrada el día 9 de junio del año en curso, acordó aprobar el Reglamento para la Operación para el Muelle de Puerto Quepos, que se leerá como sigue:

REGLAMENTO DE OPERACIÓN PARA EL MUELLE DE PUERTO QUEPOS

CAPÍTULO I

Disposiciones generales

Además, conforme lo establece la Ley de la República Nº 1721 de diciembre de 1953, reformada por Ley Nº 4964 de marzo de 1972, en la cual nos aclara que es competencia del Instituto Costarricense de Puertos del Pacífico (INCOP) las funciones de Autoridad Portuaria del Litoral Pacífico de Costa Rica.

a)I.N.C.O.P.: Instituto Costarricense de Puertos del Pacífico.
b)Instalaciones: Toda obra de infraestructura del puerto destinada a brindar cualquier atención y facilidad a los buques y a la carga.
c)Buque: Cualquier embarcación destinada a la navegación marítima que se utiliza para el transporte de carga y/o pasajeros, de cabotaje o turismo.
d)T.R.B.: Tonelada de Registro Bruto del buque, es la capacidad total del barco expresada en toneladas de 100 pies cúbicos.
e)Muelle: Parte de la infraestructura del Puerto, destinada para la estadía del buque a efecto de facilitar sus operaciones de carga y descarga.
f)Cliente: Toda persona natural o jurídica que solicita y pague por un servicio y acatando las normas establecidas por el INCOP.
g)Insumos: Cada uno de los factores que intervienen en la producción de bienes o servicios.
h)Código PBIP: Código para la protección de buques e instalaciones portuarias.

La administración de la Terminal de Puerto Quepos tomará las previsiones necesarias para contar con los requerimientos de seguridad en el muelle, que le permitan implementar el código PBIP. Las condiciones que se determinen formarán parte integral de este Reglamento.

Estos deben ser retirados una vez concluida la operación por cuenta del cliente.

El incumplimiento acarreará la sanción disciplinaria y legal correspondiente.

De la descripción de los servicios

CAPÍTULO II

a)Estadía: Corresponde a la ocupación que hace la nave del muelle mientras se encuentra atracada.

Unidad de tarificación: Metro eslora-día o fracción.

Descripción de servicios:

1)Embarcaciones de pesca deportiva.
2)Embarcaciones de pesca artesanal.
3)Yates y embarcaciones de placer.
b)Muellaje: Consiste en la utilización que hace la carga de las instalaciones del muelle en tránsito de o hacia la nave. Unidad de tarificación: Tonelada métrica o fracción.
c)Ingreso de vehículos a las instalaciones del muelle (peaje): Todo vehículo que ingrese a las instalaciones del muelle deberá pagar por el uso de las mismas.

Unidad de tarificación: Movimiento.

d)Embarque y desembarque de pasajeros: Los pasajeros que desembarquen o aborden embarcaciones de placer y turísticas deberán pagar por el uso de las instalaciones.

Unidad de tarificación: Por persona.

e)Fondeo de embarcaciones en zona protegida: Unidad de tarificación: T.R.B.
f)Cualquier otro servicio ofrecido principalmente a embarcaciones mayores, se regirá por el Reglamento General de Servicios Portuarios de INCOP y sus disposiciones tarifarías.

Todo servicio que se brinde a futuro en esta terminal, y que sea debidamente aprobado por la ARESEP, formará parte integral de este Reglamento.

Del ingreso y permanencia de personas y vehículos a las instalaciones del Muelle de Puerto Quepos

CAPÍTULO III

a)Funcionarios o empleados del INCOP debidamente identificados.
b)Empleados de las naves o personas que por razón de trabajo deban permanecer dentro de las instalaciones siempre y cuando estén debidamente identificados con su pase.

a)Transitar por las vías señaladas para tal fin.
b)Respetar el límite de velocidad que se indique.
c)Estacionarse en los lugares indicados para tal efecto.
d)Detener el motor mientras se realiza la carga o descarga.
e)No efectuar reparaciones y en caso de averías deberán ser retirados de las instalaciones del muelle de inmediato.

a)Todos los vehículos propiedad del INCOP o bajo su administración.
b)Vehículos particulares autorizados por la Presidencia Ejecutiva, Gerencia General del INCOP o la Administración del muelle.
c)Todo vehículo que haya pagado su peaje.

Existen dos pases: a) Temporales b) Para visitantes.

Además los pases indicarán su vigencia.

Los tripulantes portarán pase temporal dentro de las Instalaciones del muelle y la Administración llevará el control correspondiente.

Los pases de visitantes llevarán un número de registro.

De la facturación y el cobro de los servicios

CAPÍTULO VI

Dicha solicitud deberá indicar claramente, la identificación del servicio que solicita, bajo un formato de presentación el cual contendrá entre otras cosas nombre del solicitante, cédula de identidad; descripción de los servicios a solicitar y datos de la embarcación.

La solicitud será firmada por el cliente o su representante, previamente acreditado como tal ante la Administración del Muelle de Quepos, para lo cual ésta llevará un registro de firmas de las personas facultadas por el usuario para contraer las responsabilidades que implica la prestación del servicio.

El encargado de efectuar el depósito del banco reportará todos los días hábiles al Departamento de Contabilidad de la Institución el informe de ingresos (informe diario de movimiento).

El importe del depósito debe ser pagado en dinero efectivo o cheques certificados siempre y cuando la Gerencia General del INCOP autorice a la Administración del muelle a la recepción de cheques contra Bancos del Sistema Nacional, siempre que se trate de clientes habituales.

Se efectuará una liquidación sobre la base del depósito previamente efectuada.

En caso de que el saldo de la liquidación sea acreedor, su importe le será acreditado para aplicarse a próximos servicios.

CAPÍTULO VII

Disposiciones finales

En lo que corresponde a los clientes de las instalaciones del muelle que incumplan las disposiciones aquí establecidas recibirán las siguientes sanciones:

a)Con una advertencia escrita, si no es reincidente, ésta en casos menores.
b)Con la suspensión de la prestación del servicio o del pase de ingreso a las instalaciones del muelle por 15 días la primera vez.
c)Con la anulación total de la prestación de los servicios o del pase o permiso de entrada a las instalaciones del muelle.

Rige a partir de su publicación en el Diario Oficial La Gaceta.

Operation Regulations for the Puerto Quepos DockReglamento de Operación para el Muelle de Puerto Quepos

Artículo 1 — —This set of articles establishes the general precepts under which clients, officials, workers, and employees of both INCOP and private parties shall be subject, in accordance with the General Regulations for Port Services of INCOP in its Articles 1 and 2 and Executive Decree No.

Artículo 2 — —For the purposes of this set of rules, the following concepts are defined:

Artículo 3 — —This Regulation shall function as an Appendix to the General Regulations for Port Services of INCOP, according to its Article 2.

Artículo 4 — —The operating hours of the services provided at the Pier shall be defined by the Administration according to convenience and needs, provided that the internal rules that INCOP has established are respected.

Artículo 5 — —The Administration of the Quepos Port Pier may reserve the right not to provide or to suspend services to those clients who are not current in their obligations or who breach the provisions of this Regulation.

Artículo 6 — —Any damage to the facilities and equipment owned by INCOP or under its administration, caused by third parties, shall be compensated by the responsible party at the actual cost of the damage.

Artículo 7 — —Clients or private parties will not be allowed to leave garbage or waste within the Pier facilities.

Artículo 8 — —Any claim related to the provision of services or their collection must be addressed to the Services Comptroller's Office or to the General Management.

Artículo 9 — —INCOP workers shall be prohibited from purchasing products on ships.

Artículo 10 — —The security guards (surveillance service) of INCOP stationed at the pier shall follow the rules and roles established by the Administration of the Quepos Port Pier.

Artículo 11 — —No vessel may use the berthing fender without the proper authorization from the Pier Administration.

Artículo 12 — —The Administration of the Quepos Pier reserves the right to designate the order of berthing of vessels or to limit their stay at the pier, when this is required for reasons of operational order.

Artículo 13 — —No vessel shall be berthed, unberthed, or moved from its berth without the authorization of the Administration of the Quepos Port Pier.

Artículo 14 — —Vessels shall be attended to following the order of arrival, provided that the pier facilities or the clients and officials stationed there are not exposed to danger.

Artículo 15 — —Any vessel that is not going to work immediately after its arrival at the pier shall lose its berthing right, as well as those that, being anchored and whose turn for berthing is due, do not carry it out.

Artículo 16 — —Any vessel that endangers or damages the pier facilities shall not be berthed.

Artículo 17 — —The captain or the person responsible for each vessel shall ensure that their craft is ready to unberth or change location, when, in the opinion of the Pier Administration, it is necessary to do so.

Artículo 18 — —Once operations are completed, every vessel must leave the berth immediately.

Artículo 20 — —In the event of a fire or some other accident posing imminent danger onboard, the vessel must be unberthed immediately.

Artículo 21 — —The Pier Administration may order the suspension of work and the unberthing of a vessel when it considers that the manner and conditions of work are detrimental to the operations at the Quepos Port Pier, the service to other vessels, or in any way damage the pier facilities.

Artículo 22 — —The boarding or disembarkation of passengers from pleasure and tourist vessels shall be at the own risk of those in charge of said activity.

Artículo 23 — —Every service provided at the facilities of the Quepos Port Pier shall be subject to the regulations and tariff provisions.

Artículo 24 — —The tariff structure shall comprise the following services:

Artículo 25 — —The control of entry, exit, and stay of persons and vehicles within the pier facilities shall be governed by the provisions of this set of articles, and in the case of circumstances not covered, the legal and regulatory provisions that INCOP has established shall also govern.

Artículo 26 — —Entry and stay within the pier facilities shall only be permitted to the following persons:

Artículo 27 — —Drivers of vehicles within the pier facilities must:

Artículo 28 — —Every driver, client, and any other person must refrain from reckless or dangerous acts within the Pier facilities that could cause accidents or endanger the health of persons.

Artículo 29 — —The entry of vehicles is prohibited except in the following cases:

Artículo 30 — —The entry of persons shall be done through the main entrance where the guardhouse and inspection point are located; at this location, they shall identify themselves to the surveillance unit.

Artículo 31 — —All persons who enter, with the exception of the Institution's officials or employees stationed at the Quepos Pier, must record the reasons for their visits to the pier and sign the logbook indicating the time of entry and subsequently the time of exit.

Artículo 32 — —Every person involved in the activities within the pier must provide themselves with a pass in order to enter the facilities thereof.

Artículo 33 — —Temporary passes shall be granted to occasional workers and to the employees of users who must constantly perform work within the pier facilities.

Artículo 34 — —Persons entering as visitors shall receive a visitor's pass at the Administrative Offices, in addition to complying with the provisions of Article 31.

Artículo 35 — —All passes, with the exception of those for visitors, must bear a recent photograph of the holder.

Artículo 36 — —Every person upon entering the pier facilities must display the pass (badge) in a visible place, and must also respect and observe the provisions contained in this chapter.

Artículo 37 — —When a person has lost their badge, they must inform the Pier Administration, which shall process the issuance of a new badge upon prior payment of a sum equal to twice the original cost.

Artículo 38 — —The Administration of the Quepos Port Pier shall keep the control and record of the passes granted.

Artículo 39 — —The pass granted to a person does not authorize the entry of their private vehicle, which shall be under another regulation.

Artículo 40 — —The Administration of the Quepos Port Pier may deny entry permission to persons who do not comply with the provisions of this chapter.

Artículo 42 — —The Administration of the Quepos Port Pier shall define the schedules and mode of operation for the sale of supplies, provided it does not interfere with the rules of this Regulation or those of the Institution.

Artículo 43 — —All machinery used in the pier facilities shall be under the strict supervision of the Administration.

Artículo 45 — —It is prohibited for any worker to use open shirts and other objects such as chains, bracelets, or any type of personal item and clothing that could be caught by moving machinery (cranes, forklifts, etc.) or snagged by load handling equipment.

Artículo 46 — —The service of any machine for load handling shall be regulated by a tariff structure which establishes the item to be charged.

Artículo 47 — —Every client, regardless of their type, who needs the services provided at the pier or in any way uses the facilities or amenities given, must request them in writing and in advance, according to the criteria of the Pier Administration.

Artículo 48 — —The interested party, upon submitting the service request, shall do so to the Pier Administration, which must authorize, channel, and expedite the corresponding procedures.

Artículo 49 — —In addition to the service request, the user must deposit the estimated value of the services required.

Artículo 51 — —The value of the deposit shall be communicated to the Billing Section of the Accounting Department upon receipt of the request.

Artículo 52 — —Once the service has been provided, the respective charges shall be presented on an invoice for this purpose.

Artículo 53 — —In the event that the charge for the services provided exceeds the deposit, the client must immediately pay the corresponding difference; failing to do so, the Pier Administration may suspend or cancel services in the future.

Artículo 54 — —In case of doubt regarding the interpretation of this Regulation, it shall be the responsibility of the Board of Directors of INCOP to correctly interpret the provisions contained herein.

Artículo 55 — —For any vessel that does not comply with the provisions stipulated in this Regulation, the Pier Administration shall deny the permit to berth at said pier.

Artículo 56 — —The provisions set forth must be strictly complied with by all INCOP workers and private parties who make use of the pier facilities or who, for reasons of visit or work, transi or remain within them.

Artículo 57 — —INCOP workers who do not comply with the rules of this set of articles shall be sanctioned as provided by the Autonomous Service Regulations of the Institution and the respective legislation.

Artículo 58 — —Any service or regulation that is not covered by this set of articles shall be covered by the General Regulations for Port Services of INCOP.

Artículo 2 — Para lo que atañe a este conjunto de normas se definen los siguientes conceptos:

Artículo 3 — Este Reglamento funcionará como Apéndice del Reglamento General de Servicios Portuarios de INCOP, según su Artículo 2.

Artículo 4 — El horario de funcionamiento de los servicios prestados en el Muelle será definido por la Administración según la conveniencia y necesidades, siempre y cuando se respeten las normas internas que el INCOP ha establecido.

Artículo 5 — La Administración del Muelle de Puerto Quepos podrá reservarse el derecho de no prestar o suspender los servicios a aquellos clientes que no se encuentren a derecho en sus obligaciones o que incumplan las disposiciones de este Reglamento.

Artículo 6 — Todo daño a las instalaciones y equipos propiedad de INCOP o bajo su administración, causados por terceros, será indemnizado por el responsable en el costo real del daño.

Artículo 7 — No se permitirá a los clientes o particulares dejar basuras o desperdicios dentro de las instalaciones del Muelle.

Artículo 8 — Todo reclamo que se relacione con la prestación de servicios o su cobro, debe dirigirse a la Contraloría de Servicios o a la Gerencia General.

Artículo 9 — A los trabajadores del INCOP les será prohibida la compra de productos en las naves.

Artículo 10 — Los guardas (servicio de vigilancia) de INCOP destacados en el muelle, seguirán las normas y roles establecidos por la Administración del Muelle de Puerto Quepos.

Artículo 11 — No podrá ninguna nave utilizar la pantalla de atraque sin la debida autorización de la Administración del muelle.

Artículo 12 — La Administración del Muelle de Quepos se reserva el derecho de designar el orden de atraque de las naves o limitar su permanencia en el muelle, cuando esto se requiera por razón de orden operativo.

Artículo 13 — Ninguna nave será atracada, desatracada o cambiada de atracadero sin la autorización de la Administración del Muelle de Puerto Quepos.

Artículo 14 — Las naves serán atendidas siguiendo el orden de arribo, siempre y cuando no se expongan las instalaciones del muelle o a los clientes y funcionarios destacados en él.

Artículo 15 — Perderá el derecho de atraque toda nave que no vaya a trabajar inmediatamente después de su arribo al muelle, así como las que estando fondeadas y les corresponda el atraque, no lo efectúen.

Artículo 16 — Toda nave que ponga en peligro o dañe las instalaciones del muelle no será atracada.

Artículo 17 — El capitán o el responsable de cada nave cuidará que su embarcación se encuentre lista para desatracar o cambiar de sitio, cuando a juicio de la Administración del muelle sea necesario hacerlo.

Artículo 18 — Terminadas las operaciones, toda nave deberá abandonar el puesto de atraque de inmediato.

Artículo 20 — En caso de incendio o algún otro accidente de peligro inminente abordo, la nave debe ser desatracada inmediatamente.

Artículo 22 — El embarque o desembarque de pasajeros de embarcaciones de placer y turísticas, se hará por cuenta y riesgo de los encargados de dicha actividad.

Artículo 23 — Todo servicio que se brinde en las instalaciones del Muelle de Puerto Quepos estará sujeto a las regulaciones y las disposiciones tarifarías.

Artículo 24 — La estructura tarifaría comprenderá los siguientes servicios:

Artículo 26 — Únicamente se permitirá el ingreso y permanencia dentro de las instalaciones del muelle a las siguientes personas:

Artículo 27 — Los conductores de vehículos dentro de las instalaciones del muelle deben:

Artículo 28 — Todo conductor, cliente y cualquier otra persona debe abstenerse de actos imprudentes o peligrosos dentro de las instalaciones del Muelle que puedan originar accidentes o exponer la salud de las personas.

Artículo 29 — Es prohibido el ingreso de vehículos salvo los siguientes casos:
