Complete Text record: 78E9C No. 32066 No. 32066 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers conferred upon them by Articles 46, 50, 140 subsections 3) and 18, and 146 of the Political Constitution, Articles 46 and 47 of the Organic Law of the Environment No. 7554 of October 4, 1995, and Article 62 of the Biodiversity Law No. 7788 of April 30, 1998.
Considering:
7416 of June 30, 1994, in its Article 15 affirms that in recognition of the sovereign rights of States over their natural resources, the authority to regulate access to genetic resources rests with governments and is subject to national legislation, and that each party shall endeavor to create conditions to facilitate access for environmentally sound uses.
7788 of April 30, 1998, provides that the biochemical and genetic properties of wild and domesticated elements of biodiversity are in the public domain, and that the State shall authorize the exploration, research, bioprospecting (bioprospección), use, and exploitation (aprovechamiento) of the elements of biodiversity that constitute public domain goods, as well as the utilization of all genetic and biochemical resources, through the general rules on access.
7788 of April 30, 1998, creates the National Commission for the Management of Biodiversity (CONAGEBIO).
It shall act as a mandatory consulting body in the procedures for requesting the protection of intellectual rights over biodiversity.
The provisions agreed upon on this matter shall constitute the general rules for access to genetic and biochemical elements and for the protection of intellectual rights over biodiversity, to which the administration and interested private parties must submit.”
7788 of April 30, 1998, various international agreements, namely the Convention on Biological Diversity, Law No. 7416 of June 30, 1994, the Bonn Guidelines on Access to Genetic Resources and Fair and Equitable Sharing of the Benefits Arising out of their Utilization of the aforementioned Convention on Biological Diversity, and Convention 169 concerning Indigenous and Tribal Peoples, Law No. 7316 of November 3, 1992.

DECREE
31514 so that it shall instead read: “For the genetic and biochemical elements and resources of biodiversity maintained under ex situ conditions.
As of the publication of this regulation and within a term of one year, CONAGEBIO, with the support of specialized technical persons and groups, shall establish the procedure for access to the genetic and biochemical elements and resources of biodiversity maintained under ex situ conditions in accordance with Article 69 of the Biodiversity Law. As long as this regulation does not exist, access permits for bioprospecting or economic exploitation (aprovechamiento económico) shall not be granted for material found under these conditions.”

Texto Completo acta: 78E9C Nº 32066 Nº 32066 EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AMBIENTE Y ENERGIA En el uso de las facultades que les confiere los artículos 46, 50, 140 incisos 3) y 18 y 146 de la Constitución Política, los artículos 46 y 47 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995 y el artículo 62 de la Ley de Biodiversidad N° 7788 del 30 de abril de 1998.
Considerando:
Actuará como órgano de consulta obligatoria en los procedimientos de solicitud de protección de los derechos intelectuales sobre la biodiversidad.
Las disposiciones que sobre la materia acuerde constituirán las normas generales para el acceso a los elementos genéticos y bioquímicos y para la protección de los derechos intelectuales sobre la biodiversidad a las que deberán someterse la administración y los particulares interesados”.
Por tanto:
DECRETAN
A partir de la publicación de esta norma y en el término de un año, la CONAGEBIO con apoyo de personas y grupos técnicos especializados fijará el procedimiento para el acceso a los elementos y recursos genéticos y bioquímicos de la biodiversidad mantenidos en condiciones ex situ de acuerdo con el artículo 69 de la Ley de Biodiversidad. Mientras no exista esta normativa no se otorgarán permisos de acceso para bioprospección o de aprovechamiento económico para material que se encuentre en estas condiciones”.
