The application for authorization shall be submitted to the Directorate of Geology and Mines (DGM) by the duly identified Mayor (Alcalde), Intendant (Intendente), or Minister, in original and 3 copies, and shall be accompanied by the documentation detailed below:
- a)Geographic and administrative location of the site where the extraction will take place. Copy of the IGN Cartographic Sheet, scale 1:50000, as well as a sketch (croquis) or recent photograph of the requested site. Indicating in detail the works to be carried out where the material will be used.
- b)materials, which must be solely for public works, for which purpose a sworn statement (declaración jurada) issued by the respective legal counsel of the Local Governments and Ministries processing the respective permit must be submitted. The requested volume of material may not exceed 20,000 m3.
- c)Basic description of the environmental surroundings where the extraction project will be located, which shall have the character of a sworn statement (declaración jurada). The mining project may not be developed on sites where trees must be felled, unless the corresponding permits are previously obtained in accordance with the law. The description of the environmental surroundings must be signed by the Mayor (Alcalde), Intendant (Intendente), or Minister, as the case may be, and by the environmental consulting geologist (geólogo consultor ambiental) or environmental consulting mining engineer (ingeniero de minas consultor ambiental), who will be the technical and environmental responsible party for the with experience in related areas, may be appointed. To declare the lack of professionals (inopia), there must be a certification from the Colegio de Geólogos de Costa Rica determining that a lack of professionals (inopia) exists.
- d)In the event that the area to be exploited is a quarry (cantera), a certification of property ownership of the real estate and authorization from the owner must be submitted. Furthermore, a certified copy of the cadastral plan (plano catastrado) of the property must be submitted, indicating whether it is intended to exploit it in its entirety or in part; in this latter case, the part of the property to be exploited must be indicated on the plan.
- e)If the concessionaire does not carry out the extraction works directly, it must indicate if they will be executed by means of a contractor or subcontractor. Before starting the work, the Local Government or Ministry must submit, for the file (expediente), the name of the contractor and a copy of the contract duly signed.
- f)Place for receiving notifications within the first judicial district of San José, or alternatively a fax number, in accordance with the provisions of the Ley de Notificaciones, Citaciones y otras Comunicaciones Judiciales.
The application must be submitted in complete form with all the documents indicated in this Regulation.
