No. 31592-MINAE-TUR THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF TOURISM In exercise of the powers granted in Articles 140, subsections 3) and 18) and 146, of the Political Constitution and Articles 25, 28 subsection 2. b) of Law No. 6227 of May 2, 1978, General Law of Public Administration, and based on Article 5, subsection e) of Law No. 1917 of July 30, 1955, Organic Law of the Costa Rican Tourism Board.
1.-That it is necessary to conserve the biodiversity of protected wilderness areas for the well-being of human beings and all living beings.
2.-That the protection of biological diversity concerns us all, and especially the State and the different sectors of civil society.
3.-That the Ministry of Environment and Energy is responsible for the protection of protected wilderness areas, and to allow national and foreign tourists to appreciate the biodiversity of these wilderness areas, it is necessary to have adequate infrastructure and services.
4.-That the law assigns to the Costa Rican Tourism Board the function of protecting the natural beauties of the country, and in fulfillment of this attribution, emphasis has been placed on policies for the protection of natural resources and sustainable development of tourism activity.
5.-That the Fundación de Parques Nacionales is a private, non-profit organization, established by the Procuraduría General de la República in June 1979 with the purpose of "promoting the establishment, protection, and general development of the country's national parks and equivalent reserves," which has been providing its collaboration throughout all these years, particularly regarding the implementation and consolidation of the National System of Conservation Areas.
6.-That the Cámara Nacional de Turismo (CANATUR) is an organization that groups, plans, and coordinates private business actions in everything related to the tourism sector and the corresponding subsectors it represents, having an interest in the protection of natural resources.
7.-That one of the fundamental elements for the strengthening of protected wilderness areas as well as for the sustainable development of tourism activity, consists of effective cooperation between the public and private sectors.
8.-That the growth of the Tourism Sector has experienced a significant pace, where it is reported that last year 1,113,359 tourists entered our country, which produced 1078.0 million dollars in foreign exchange earnings. This contribution meant it became the most important sector within the national economy.
9.-That of the tourists who entered by air (approximately eight hundred thousand visitors), it is estimated that at least sixty percent (60%) visited conservation areas. Likewise, 45.8% of these visitors engaged in flora and fauna observation, 43% in walks along trails, 34.1% in bird watching, and 44.4% visited the volcanoes.
10.-That it is necessary to carry out a joint effort by the public and private sectors to adopt measures that, without affecting the flow of tourists, guarantee the conservation, protection, control, and appropriate management of protected wilderness areas, a resource that constitutes one of the country's main tourist attractions. Therefore:
