in the entirety of the text - Complete Text of Norm 31146 Creates the Registry of Importers of Plants and Plant Products Complete Text of record: E22B6 No. 31146-MAG THE FIRST VICE PRESIDENT No. 31146-MAG (This decree was repealed by Article 26 of Decreto Ejecutivo N° 36999 of January 25, 2012, "Creates the Registry of Importers of Plant Products, and the establishment of controls for transport units and warehouses as a measure of traceability for imported agricultural products") THE FIRST VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by Articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, Articles 25, 27.1, 28.2.b, of Ley Nº 6227 of May 2, 1978, General Law of Public Administration, Ley Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Ley Nº 7664 of April 8, 1997, Law of Phytosanitary Protection.

1That with the increasing commercial exchange, due to the opening of markets among countries, geographical barriers have been eliminated, increasing the possibilities of dissemination of organisms capable of causing damage to agriculture, such as insects, nematodes, fungi, viruses and other pests.

2º—According to the provisions of the Law of Phytosanitary Protection, it is an essential function of the State Phytosanitary Service (Servicio Fitosanitario del Estado) to prevent and avoid the entry of new pests and diseases, establishing the phytosanitary requirements and necessary controls on imports of plants or plant products.

3That the State Phytosanitary Service (Servicio Fitosanitario del Estado) has instrumental legal personality and broad powers to fulfill the objectives, purposes, and competencies established by its enabling law.
4That for traceability purposes, the State Phytosanitary Service (Servicio Fitosanitario del Estado) requires a registry of importers of plant products, as well as of the storage and distribution centers for these products in the national market.
5That the phytosanitary measures established by the State Phytosanitary Service (Servicio Fitosanitario del Estado) pursuant to the application of the law are of public interest and mandatory application.
6That it is necessary to modernize and adapt the regulations governing the importation of plant products to the current needs of Costa Rican society, international trade, and the commitments the country has undertaken in the area of food safety. Therefore,

They decree:

CREATION OF THE REGISTRY OF IMPORTERS OF PLANTS AND PLANT PRODUCTS

Considering:

(Note from Sinalevi: Through Article 48 of the Regulation of the Organizational Structure of the State Phytosanitary Service (Servicio Fitosanitario del Estado), approved by Decreto Ejecutivo N° 36801 of September 20, 2011, it is established that the functions assigned to the Department of Plant Quarantine or Technical Management of Plant Quarantine (Gerencia Técnica de Cuarentena Vegetal) shall be assumed by the Department of Phytosanitary Control)

a)Submit an application for registration in the registry of importers to the Technical Management of Plant Quarantine (Gerencia Técnica de Cuarentena Vegetal)(*) of the State Phytosanitary Service (Servicio Fitosanitario del Estado), including the following information:

2- Exact location where the facilities for storing the imported plant products are located.

3- Indicate the type or types and qualities of products to be imported.

b)The applicant must also provide the following documents:

1- Certified copy of the identity card or legal identification, as applicable depending on whether it is a natural or legal person.

2- Certified copy of the operating permit, issued by the Ministry of Health, for the premises or storage warehouses for the imported products.

3- Certification issued by the Caja Costarricense de Seguro Social indicating that the applicant is not in default in the payment of obligations to the Caja for employer/employee contributions.

4- Certification issued by the Tax Administration of being up to date in the payment of all types of national taxes.

Said facilities must comply with the requirements established in the technical guide held by the State Phytosanitary Service (Servicio Fitosanitario del Estado) for this purpose.

For these purposes, it shall assign a number and code identifying the importer, which shall be indicated on the import applications made in the future.

Once that period has elapsed and at the request of the interested party, a new inspection shall be carried out to verify compliance with the measures ordered by the State Phytosanitary Service (Servicio Fitosanitario del Estado), proceeding in accordance with the provisions of Article 4 of this decree if compliance has been achieved; otherwise, the application shall be archived.

The cost of the enrollment service in the registry of importers for the year 2009 shall be ¢ 46,575.00, which must be paid at the beginning of the period. Likewise, this amount shall be automatically updated based on the value of the consumer price index for the previous year, effective as of February 1 of each year.

1Que con el creciente intercambio comercial, por la apertura de mercados entre los países, se han eliminado las barreras geográficas incrementándose las posibilidades de diseminación de organismos capaces de causar daños a la agricultura, tales como insectos, nemátodos, hongos, virus y otras plagas.

2º—Conforme a lo dispuesto en la Ley de Protección Fitosanitaria, es función esencial del Servicio Fitosanitario del Estado prevenir y evitar el ingreso de nuevas plagas y enfermedades, estableciendo los requisitos fitosanitarios y los controles necesarios a las importaciones de vegetales o productos de origen vegetal.

3Que el Servicio Fitosanitario del Estado, cuenta con personería jurídica instrumental y amplias facultades para cumplir con los objetivos, fines y competencias que establece su ley de creación.
4Que para efectos de trazabilidad, el Servicio Fitosanitario del Estado requiere contar con un registro de los importadores de productos de origen vegetal, así como de los centros de almacenamiento y distribución, en el mercado nacional, de esos productos.
5Que las medidas fitosanitarias que en virtud de la aplicación de la ley, establezca el Servicio Fitosanitario del Estado, son de interés público y de aplicación obligatoria.
6Que es necesario modernizar y adecuar la normativa que regula la importación de productos vegetales a las necesidades actuales de la sociedad costarricense, el comercio internacional y a los compromisos que ha adquirido el país en materia de inocuidad de alimentos. Por tanto,

CREACIÓN DEL REGISTRO DE IMPORTADORES DE VEGETALES Y PRODUCTOS DE ORIGEN VEGETAL

Considerando:

Decretan:

a)Presentar una solicitud de inscripción en el registro de importadores, ante la Gerencia Técnica de Cuarentena Vegetal(*) del Servicio Fitosanitario del Estado, que incluya la siguiente información:

(Nota de Sinalevi: Mediante el artículo 48 del Reglamento de la Estructura Organizativa del Servicio Fitosanitario del Estado, aprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se establece que las funciones asignadas al Departamento de Cuarentena Vegetal o Gerencia Técnica de Cuarentena Vegetal, las asumirá el Departamento de Control Fitosanitario) 1- Nombre y calidades del importador; cuando se trate de personas jurídicas aportar la certificación de personería que acredite la condición legal y facultades del solicitante.

2- Lugar exacto donde se ubican las instalaciones donde se almacenarán los productos vegetales importados.

3- Indicar el tipo o tipos y calidades de productos a importar.

b)El solicitante, además, deberá aportar los siguientes documentos:

1- Copia certificada de la cédula de identidad o jurídica, según se trate de una persona física o jurídica.

2- Copia certificada del permiso de funcionamiento, extendido por el Ministerio de Salud, de los locales o bodegas de almacenamiento de los productos importados.

3- Certificación expedida por la Caja Costarricense de Seguro Social que indique que no se encuentra en mora en el pago de sus obligaciones con la Caja por concepto de cuotas obrero patronales.

4- Certificación extendida por la Administración Tributaria de estar al día, en el pago de todo tipo de impuestos nacionales.

Dichas instalaciones deberán cumplir con los requisitos que se establecen en la guía técnica, que al efecto tiene el Servicio Fitosanitario del Estado.

Para tales efectos asignará un número y código, que identifique al importador, el cual será indicado en las solicitudes de importación que a futuro realice.

Transcurrido ese plazo y a solicitud del interesado, se realizará una nueva inspección para verificar el cumplimiento de las medidas ordenadas por el Servicio Fitosanitario del Estado, procediendo de conformidad con lo dispuesto en el artículo 4º de este decreto en caso de que se haya cumplido, caso contrario se archivará la solicitud.

El costo del servicio de inscripción en el registro de importadores, para el año 2009 será de ¢ 46 575,00 que deberán ser cancelados al inicio del período. Asimismo, este monto se actualizará en forma automática con base en el valor del índice de precios al consumidor del año anterior y que rige a partir del 1° de febrero de cada año.

Artículo 2 — —For registration in the registry of importers, the following requirements must be met:

Artículo 6 — —The State Phytosanitary Service (Servicio Fitosanitario del Estado) may cancel the importer's registration in the registry if any of the rules established in this decree are breached.

Artículo 7 — —If the storage facilities do not meet the technical conditions, a period of up to sixty days shall be granted to make the necessary corrections.

Artículo 8 — —The importers' registration and enrollment services shall be paid annually by the interested party.

Artículo 9 — —The State Phytosanitary Service (Servicio Fitosanitario del Estado) shall determine the laboratory analyses to be performed on imported products prior to their marketing.

Artículo 10 — —Shall take effect upon its publication.

Artículo 2 — Para la inscripción en el registro de importadores deberá cumplir con los siguientes requisitos:

Artículo 5 — En caso que el solicitante no cumpla con los requisitos establecidos o no aporte los documentos indicados en este Decreto, se prevendrá al solicitante, para que en un plazo máximo de diez días hábiles aclare o complete la misma, caso contrario se archivará la solicitud.

Artículo 6 — El Servicio Fitosanitario del Estado podrá cancelar la inscripción del importador en el registro en caso de que incumpla cualquiera de las normas establecidas en el presente decreto.

Artículo 7 — En caso de que las instalaciones de almacenamiento no reúnan las condiciones técnicas, se otorgará un plazo de hasta sesenta días para realizar las correcciones necesarias.

Artículo 8 — Los servicios de inscripción y registro de importadores serán cancelados anualmente por el interesado.

Artículo 9 — El Servicio Fitosanitario del Estado determinará los análisis de laboratorio que deben realizarse a los productos importados de previo a su comercialización.

Artículo 10 — Rige a partir de su publicación.
